CIRCULAR
REGULATIONS ON THE LIST OF PRODUCTS AND GOODS WITH POTENTIAL TO CAUSE SAFETY HAZARDS UNDER THE RESPONSIBILITY OF THE MINISTRY OF LABOR, INVALIDS AND SOCIAL AFFAIRS FOR STATE MANAGEMENT
Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;
Pursuant to Decree No.132/2008/NĐ-CP December 31, 2008, Government Decree detailing implementation of certain articles of the Law on Product Quality;
Pursuant to Decree No.74/2018/NĐ-CP May 15, 2018, Government Decree amending and supplementing certain articles of Government Decree No. 132/2008/NĐ-CP of December 31, 2008 detailing implementation of certain articles of the Law on Product Quality;
Pursuant to Decree No.154/2018/NĐ-CP November 9, 2018, Government Decree amending, supplementing, and abolishing certain provisions regarding conditions for investment and business under the state management responsibility of the Ministry of Science and Technology and certain provisions on specialized inspection;
Pursuant to Decree No.14/2017/NĐ-CP of February 17, 2017, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;
At the proposal of the Director of the Occupational Safety and Health Inspectorate;
The Minister of Labor, Invalids and Social Affairs issues this Circular to regulate the List of products and goods with potential to cause safety hazards under the responsibility of the Ministry of Labor, Invalids and Social Affairs for state management.
Article 1. Scope of Regulation
This Circular regulates the List of products and goods with potential to cause safety hazards under the responsibility of the Ministry of Labor, Invalids and Social Affairs (hereinafter referred to as product group 2), along with the commodity code (HS) and measures for state quality control of imported product group 2.
Article 2. Applicability
This Circular applies to:
1. Domestic and foreign organizations and individuals operating within the territory of Vietnam producing, importing, trading, and using products and goods in product group 2 under the responsibility of the Ministry of Labor, Invalids and Social Affairs for state management.
2. Organizations and individuals related to the management, evaluation, and certification of quality of products and goods in product group 2 under the responsibility of the Ministry of Labor, Invalids and Social Affairs for state management.
Article 3. List of products and goods in product group 2 under the responsibility of the Ministry of Labor, Invalids and Social Affairs for state management
This Circular annexes the List of products and goods in product group 2 under the responsibility of the Ministry of Labor, Invalids and Social Affairs for state management and the HS code of these products and goods.
Article 4. Measures for state quality control of imported product group 2
1. Products and goods that must undergo state quality control upon importation are specified in Section I of the List of products and goods in product group 2 under the responsibility of the Ministry of Labor, Invalids and Social Affairs issued by this Circular. State quality control of imported goods shall be carried out according to Clause 2b, Article 7 of Government Decree No. 132/2008/NĐ-CP dated December 31, 2008 detailing certain articles of the Law on Product Quality, as supplemented by Clause 3, Article 1 of Government Decree No. 74/2018/NĐ-CP amending and supplementing certain articles of Government Decree No. 132/2008/NĐ-CP dated December 31, 2008 detailing implementation of certain articles of the Law on Product Quality.
2. Products and goods that do not need to undergo state quality control upon importation are specified in Section II of the List of products and goods in product group 2 under the responsibility of the Ministry of Labor, Invalids and Social Affairs issued by this Circular.
Article 5. Effective Date
1. This Circular takes effect from July 18, 2021.
2. Circular No. 22/2018/TT-BLDTBXH dated December 6, 2018 of the Minister of Labor, Invalids and Social Affairs regulating the List of products and goods with potential to cause safety hazards under the responsibility of the Ministry of Labor, Invalids and Social Affairs ceases to be effective from the date this Circular takes effect.
3. National technical standards on occupational safety for products and goods listed in Section II of the List of products and goods in product group 2 under the responsibility of the Ministry of Labor, Invalids and Social Affairs issued by this Circular, if they require quality control upon importation, shall be implemented according to Clause 2, Article 4 of this Circular.
Article 6. Implementation Organization
1. In case the legal normative documents and standards cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new documents.
2. During implementation, if there are difficulties or obstacles, relevant agencies, organizations, and individuals should report to the Ministry of Labor, Invalids and Social Affairs for study and resolution./.
