Amending and supplementing certain articles of Circular No. 29/2018/TT-BGTVT dated May 14, 2018, issued by the Minister of Transport on quality inspection, technical safety, and environmental protection for railway transportation vehicles, and Circular No. 18/2019/TT-BGTVT dated May 20, 2019, issued by the Minister of Transport guiding the implementation of Decree No. 139/2018/NĐ-CP dated October 8, 2018, of the Government on business operations of vehicle inspection services. Pursuant to the Road Traffic Law 2008 dated November 13, 2008;

The Minister of Transport issues this Circular amending and supplementing certain articles of Circular No. 29/2018/TT-BGTVT dated May 14, 2018, issued by the Minister of Transport on quality inspection, technical safety, and environmental protection for railway transportation vehicles, and Circular No. 18/2019/TT-BGTVT dated May 20, 2019, issued by the Minister of Transport guiding the implementation of Decree No. 139/2018/NĐ-CP dated October 8, 2018, of the Government on business operations of vehicle inspection services.
Article 1. Amending and supplementing certain articles of Circular No. 29/2018/TT-BGTVT dated May 14, 2018, issued by the Minister of Transport on quality inspection, technical safety, and environmental protection for railway transportation vehicles (hereinafter referred to as Circular No. 29/2018/TT-BGTVT), as follows:
"4. Special-purpose vehicles moving on railway tracks are vehicles used for transporting people, materials, and equipment for purposes such as rescue, accident response on railway tracks, inspection, construction, maintenance, and repair of railway infrastructure."
2. Appendix VI of Circular No. 29/2018/TT-BGTVT is amended and supplemented according to the provisions set out in the Appendix attached hereto.
Article 2. Supplementing Article 16a of Circular No. 18/2019/TT-BGTVT dated May 20, 2019, guiding the implementation of Decree No. 139/2018/NĐ-CP dated October 8, 2018, of the Government on business operations of vehicle inspection services, as follows:
"Article 16a. Responsibilities of the Department of Transport:
Cooperating with the Vietnam Vehicle Inspection Agency in the initial inspection and evaluation work of vehicle inspection units."
1. This Circular takes effect from March 1, 2022.
Article 3. Implementation Provisions
2. Abolishing Clause 11 of Article 1 of Circular No. 32/2020/TT-BGTVT dated December 14, 2020, issued by the Minister of Transport amending and supplementing certain articles of Circular No. 29/2018/TT-BGTVT dated May 14, 2018, on quality inspection, technical safety, and environmental protection for railway transportation vehicles and Circular No. 31/2018/TT-BGTVT dated May 15, 2018, on the implementation of system safety assessment for urban railways.
The Head of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of Agencies: Vietnam Vehicle Inspection Agency, Vietnam Railways Corporation, Directors of Provincial and Municipal Transport Departments under the Central Government, Director of the Lao Cai Transportation and Construction Department, Heads of agencies, units, and individuals concerned are responsible for implementing this Circular./.
Article 4. Organization of Implementation
The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of the Departments, the Directors of the Bureaus: Vietnam Inspection, Vietnam Railways, Directors of Provincial Department of Transport under centrally governed cities and provinces, Director of Lao Cai Department of Transport and Construction, Heads of agencies, units, and individuals related shall be responsible for implementing this Circular./.
