Amending and supplementing certain Articles of Circular No. 04/2015/TT-NHNN dated March 31, 2015 issued by the Governor of the State Bank of Vietnam on credit cooperatives

The Governor of the State Bank of Vietnam issues this Circular to amend and supplement certain Articles of Circular No. 04/2015/TT-NHNN dated March 31, 2015 on credit cooperatives (hereinafter referred to as Circular No. 04/2015/TT-NHNN).

Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

Pursuant to the Law on Credit Organizations dated June 16, 2010;

Pursuant to the Law Amending and Supplementing Certain Articles of the Law on Credit Institutions dated November 20, 2017;

Pursuant to Decree No. 102/2022/NĐ-CP dated December 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;

At the proposal of the Director of Banking Inspection and Supervision;

Article 1. Amending and supplementing certain Articles of Circular No. 04/2015/TT-NHNN

1. Amending and supplementing Point b Clause 6 Article 11 as follows:

"b) Citizen Identification Card number or Identity Card number or Passport number for individual members; Citizen Identification Card number or Identity Card number or Passport number of the household representative for household members; Enterprise Registration Code or Establishment Decision number or other equivalent documents and Citizen Identification Card number or Identity Card number or Passport number of the capital contribution representative for corporate members;"

2. Amending and supplementing Clause 7 Article 11 as follows:

"7. Confirmation letter of place of work, copy of recruitment decision or employment contract issued by the recruiting agency or unit for members contributing capital who are civil servants, public officials, or employees."

3. Amending and supplementing Clause 9 Article 11 as follows:

"9. Copy of Business Registration Certificate or Establishment Decision or other equivalent documents (for corporate members)."

4. Supplementing Clause 1a Article 12 as follows:

"1a. The State Bank branch shall extract necessary information from the National Population Database when examining and assessing information on residence. In cases where necessary information cannot be extracted from the National Population Database, the State Bank branch has the right to request the preparatory board to provide a copy of one of the documents with the value of proving residence information according to the law on the extraction and use of residence information to handle administrative procedures and provide public services."

Article 2. Supplementing, replacing, and abolishing certain terms, phrases, points, clauses, and articles of Circular No. 04/2015/TT-NHNN

1. Replacing the phrase "business registration" at Clause 1 and Point b Clause 3 Article 15, Appendix No. 01, Appendix No. 07 with the phrase "cooperative registration."

2. Replacing the phrase "Business Registration Certificate number" at Appendix No. 06 with the phrase "Enterprise Registration Code or Establishment Decision number or other equivalent documents."

3. Replacing Appendix No. 02A, Appendix No. 02B, Appendix No. 03, Appendix No. 04, Appendix No. 05 with Appendix No. 01, Appendix No. 02, Appendix No. 03, Appendix No. 04, Appendix No. 05 promulgated along with this Circular.

4. Abolishing Point b Clause 5 and Clause 8 Article 11.

The Director of the Office, the Inspector General of Banking Supervision, Heads of Units under the State Bank of Vietnam, credit cooperatives, and related organizations and individuals are responsible for organizing the implementation of this Circular.

This Circular takes effect from December 25, 2025/.

1. This Circular takes effect from March 1, 2023.

Article 4. Implementation provisions

2. Credit cooperatives established and operating according to the License issued by the State Bank before the effective date of this Circular do not need to reapply for a License according to the provisions of this Circular.

3. Sharebooks already issued by credit cooperatives to members before the effective date of this Circular may continue to be used or renewed upon member's request.

4. This Circular abolishes Clause 1 Article 2 of Circular No. 06/2017/TT-NHNN dated July 5, 2017 issued by the Governor of the State Bank of Vietnam amending and supplementing certain Articles of Circular No. 03/2014/TT-NHNN dated January 23, 2014 issued by the Governor of the State Bank of Vietnam on the guarantee fund for the safety of the credit cooperative system and Circular No. 04/2015/TT-NHNN dated March 31, 2015 issued by the Governor of the State Bank of Vietnam on credit cooperatives.

This Circular abolishes Clause 1 of Article 2 of Circular No. 06/2017/TT-NHNN dated July 5, 2017, issued by the Governor of the State Bank of Vietnam amending and supplementing certain provisions of Circular No. 03/2014/TT-NHNN dated January 23, 2014, issued by the Governor of the State Bank of Vietnam regarding the fund for ensuring the safety of the people's credit cooperative system, and Circular No. 04/2015/TT-NHNN dated March 31, 2015, issued by the Governor of the State Bank of Vietnam regarding people's credit cooperatives.
