CIRCULAR

Providing detailed regulations and guidance on implementation of certain provisions of the Chemical Law and Decree No. 26/2026/NĐ-CP of the Government detailing and guiding the implementation of certain provisions of the Chemical Law regarding management of chemical activities and hazardous chemicals in products and goods

 

Pursuant to The Chemical Law No. 69/2025/QH15;

Pursuant to Decree No. 26/2026/NĐ-CP of the Government detailing and guiding the implementation of certain provisions of the Chemical Law regarding management of chemical activities and hazardous chemicals in products and goods;

Pursuant to Decree No. 40/2025/NĐ-CP of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

At the proposal of the Director of the Chemical Administration Department;

The Minister of Industry and Trade promulgates this Circular providing detailed regulations and guidance on implementation of certain provisions of the Chemical Law and Decree No. 26/2026/NĐ-CP of the Government detailing and guiding the implementation of certain provisions of the Chemical Law regarding management of chemical activities and hazardous chemicals in products and goods.

 

Article 1. Scope of Regulation and Applicability

1. Scope of Regulation

This Circular provides detailed regulations and guidance on:

a) Classification of procedures for issuing, reissuing, amending Production Licenses, Business Licenses, Production and Business Licenses for specially controlled chemicals groups 1 and 2; issuing, reissuing, amending, and extending Export and Import Licenses for specially controlled chemicals groups 1 and 2;

b) Content and format of chemical safety certificates;

c) Establishment of production, import, use, and storage logs for banned chemicals under the management of the Ministry of Industry and Trade;

d) Formats, deadlines, methods, and timelines for establishing purchase and sale control certificates for specially controlled chemicals on the specialized chemical database;

đ) List of hazardous chemicals in products and goods that need to be disclosed within the scope of management of the Ministry of Industry and Trade;

e) Forms used in administrative procedures including: issuing, reissuing, amending Import Licenses for banned chemicals; issuing, reissuing, amending Production Licenses for banned chemicals; plans to control and prevent loss of banned chemicals; production, import, use, and storage logs for banned chemicals; issuing, reissuing, amending Production and Business Licenses for specially controlled chemicals; issuing, reissuing, amending, and extending Export and Import Licenses for specially controlled chemicals; plans to control and prevent loss of specially controlled chemicals; purchase and sale control certificate formats for specially controlled chemicals; issuing, reissuing, amending Certificates of Compliance for production and business of conditionally licensed chemicals; issuing, reissuing, amending Certificates of Compliance for operation of chemical storage services; registration of new chemicals; declaration and feedback of imported chemical declarations through the National Single Window Portal.

g) Registration and notification forms of enterprises registered on the specialized chemical database;

h) Information sharing templates for chemical management data on the specialized chemical database;

i) Principles of chemical classification;

k) Provisions on chemicals not allowed to be used in industries and sectors managed by the Ministry of Industry and Trade;

l) Digital transformation in state management of chemicals.

2. Applicability

This Circular applies to domestic agencies, organizations, individuals, and foreign organizations and individuals conducting activities related to chemicals within the territory of Vietnam.

Article 2. Definitions

1. Specially controlled chemicals group 1 includes chemicals group 1 specified in Appendix III of Decree No. 24/2026/NĐ-CP.

2. Specially controlled chemicals group 2 includes chemicals group 2 specified in Appendix III of Decree No. 24/2026/NĐ-CP.

Article 3. Classification of Administrative Procedures for Chemicals in the Management Scope of the Ministry of Industry and Trade

1. Provincial People's Committee where the organization or individual has its main office

a) Accepting applications, organizing reviews, issuing, reissuing, and amending Production Licenses, Business Licenses, Production and Business Licenses for specially controlled chemicals group 2 for organizations producing and trading in specially controlled chemicals group 2 and not producing or trading in specially controlled chemicals group 1;

b) Accepting applications, issuing, reissuing, amending, and extending Export and Import Licenses for specially controlled chemicals group 2 for organizations and individuals exporting and importing specially controlled chemicals group 2.

2. Chemical Administration Department

a) Accepting applications, reviewing, and assessing actual conditions for issuing, reissuing, and amending Production Licenses for banned chemicals in the industrial sector; accepting and reviewing applications for issuing, reissuing, and amending Import Licenses for banned chemicals under the management of the Ministry of Industry and Trade;

b) Accepting applications, organizing reviews, issuing, reissuing, and amending Production Licenses, Business Licenses, Production and Business Licenses for specially controlled chemicals group 1, and organizations producing and trading simultaneously in groups 1 and 2;

c) Accepting applications, issuing, reissuing, amending, and extending Export and Import Licenses for specially controlled chemicals group 1;

d) Accepting applications, organizing reviews, issuing, reissuing, and amending Certificates of Compliance for operation of chemical storage services for facilities subject to Chemical Accident Prevention and Response Plans reviewed by the Ministry of Industry and Trade;

đ) Accepting applications, organizing reviews of new chemicals;

e) Receiving declarations of imported chemicals.

Article 4. Organization for reviewing and issuing Production Licenses, Business Licenses, and Production and Business Licenses for special control chemicals group 2

1. The provincial People's Committee where the organization has its main office shall implement the following procedures upon receiving the application dossier:

a) In case the organization only engages in production, business, and storage activities at the location where it has its main office and does not engage in such activities at other locations

The provincial People's Committee shall carry out the procedures for issuing the License according to the provisions of Clause 5, Article 13 of Decree No. 26/2026/NĐ-CP.

b) In case the organization engages in production, business, and storage activities at a location different from the location where it has its main office

Within three working days from the date of receiving a complete and valid dossier, the provincial People's Committee where the organization submits the dossier shall be responsible for sending a copy of the application dossier for obtaining a license for producing and trading special control chemicals group 2 to the provincial People's Committee where the organization has its production and trading facilities to seek their opinions.

Within ten working days from the date of receiving the copy of the dossier, the provincial People's Committee where the organization has its production and trading facilities shall be responsible for inspecting the actual conditions of the production and trading facilities within its jurisdiction and providing written comments on whether the conditions are met according to the regulations.

The provincial People's Committee where the organization submits the dossier shall be responsible for examining and reviewing the dossier and issuing a Certificate of Compliance to the organization within three working days from the date of receiving the written comments from the provincial People's Committee where the organization has its production and trading facilities confirming that the conditions have been met, while also sending the relevant units for coordinated management. If the permit is not issued, the competent authority must provide a written response stating the reasons.

2. In case the organization has already been granted a Production and Business License for special control chemicals group 2 by the provincial People's Committee and the license is still valid but the organization wishes to engage in production and business activities with special control chemicals group 1, the organization shall prepare one set of application dossier and submit it to the Chemicals Department. The Chemicals Department shall carry out the procedures for issuing the License according to the provisions of Clause 5, Article 13 of Decree No. 26/2026/NĐ-CP.

3. After issuing the permit, within seven working days, the competent authority issuing the permit shall update the License in the specialized database to coordinate monitoring and management.

Article 5. Content and format of chemical safety data sheets

1. The chemical safety data sheet includes the following basic contents:

a) Identification of the chemical and information about the supplier;

b) Identification of the hazardous characteristics of the chemical;

c) Information about the composition of substances;

d) First aid measures;

đ) Fire-fighting measures;

e) Preventive and emergency response measures;

g) Usage and storage requirements;

h) Exposure control/personal protective equipment requirements;

i) Physical and chemical properties of the chemical;

k) Stability and reactivity of the chemical;

l) Toxicity information;

m) Ecological information;

n) Disposal information;

o) Transportation information;

p) Legal information;

q) Other necessary information.

2. The format of the chemical safety data sheet is specified in Appendix I attached to this Circular.

Article 6. Forms used in chemical management

1. The forms used in the procedures for issuing, reissuing, and amending Import Permits for banned chemicals are specified in Appendix II attached to this Circular, including:

a) Form 02a: Request for issuing an Import Permit for banned chemicals;

b) Form 02b: Request for reissuing, amending an Import Permit for banned chemicals;

c) Form 02c: Format of the Import Permit for banned chemicals.

2. The forms used in the procedures for issuing, reissuing, and amending Production Permits for banned chemicals are specified in Appendix III attached to this Circular, including:

a) Form 03a: Request for issuing a Production Permit for banned chemicals;

b) Form 03b: Request for reissuing, amending a Production Permit for banned chemicals;

c) Form 03c: Format of the Production Permit for banned chemicals.

3. The plan for controlling and preventing the loss of banned chemicals according to the specified form in Appendix IV attached to this Circular.

4. The record of production, import, use, and storage of banned chemicals according to the provisions in Appendix V attached to this Circular.

5. The forms related to the procedures for issuing, reissuing, and amending Production and Business Licenses for special control chemicals are specified in Appendix VI attached to this Circular, including:

a) Form 06a: Request for issuing a Production and Business License for special control chemicals;

b) Form 06b: Request for reissuing, amending a Production and Business License for special control chemicals;

c) Form 06c: Format of the Production and Business License for special control chemicals.

6. The forms related to issuing, reissuing, amending, and extending Export and Import Permits for special control chemicals are specified in Appendix VII attached to this Circular, including:

a) Form 07a: Request for issuing an Export and Import Permit for special control chemicals;

b) Form 07b: Request for reissuing, amending, and extending an Export and Import Permit for special control chemicals;

c) Form 07c: Format of the Export and Import Permit for special control chemicals.

7. The plan for controlling and preventing the loss of special control chemicals according to the specified form in Appendix VIII attached to this Circular.

8. The control purchase and sale form for special control chemicals according to the specified form in Appendix IX attached to this Circular.

9. The forms related to the procedures for issuing, reissuing, and amending Certificates of Compliance for conditional production and business of chemicals are specified in Appendix X attached to this Circular, including:

a) Form 10a: Request for issuing a Certificate of Compliance for conditional production and business of chemicals;

b) Form 10b: Request for reissuing, amending a Certificate of Compliance for conditional production and business of chemicals;

c) Form 10c: Format of the Certificate of Compliance for conditional production and business of chemicals.

10. The forms related to the procedures for issuing, reissuing, and amending Certificates of Compliance for operating services of chemical storage are specified in Appendix XI attached to this Circular, including:

a) Form 11a: Request for issuing a Certificate of Compliance for operating services of chemical storage;

b) Form 11b: Request for reissuing, amending a Certificate of Compliance for operating services of chemical storage;

c) Form 11c: Format of the Certificate of Compliance for operating services of chemical storage.

11. The forms for registering new chemicals are specified in Appendix XII attached to this Circular, including:

a) Form 12a: Registration request for new chemicals;

b) Form 12b: Summary report on the evaluation of new chemicals;

c) Form 12c: Confirmation of registration for new chemicals.

12. The form for declaring and responding to declarations of imported chemicals through the National Single Window Portal is specified in Appendix XIII attached to this Circular, including:

a) Form 13a: Declaration form for imported chemicals through the National Single Window Portal;

b) Form 13b: Response form for declarations of imported chemicals through the National Single Window Portal.

13. The form for registering and reporting enterprises registered in the specialized chemical database is specified in Appendix XIV attached to this Circular.

Article 7. Principles for Classifying Chemicals

Organizations and individuals producing or importing chemicals shall have the obligation to classify chemicals according to the guidelines set out in Appendix XV attached hereto or according to the principles of the Globally Harmonized System of Classification and Labelling of Chemicals (GHS) from version 2 in 2007 onwards.

Article 8. Control Purchase and Sale Forms for Special-Controlled Chemicals

1. From January 1, 2026, within ten days from the date of delivery, chemical trading organizations listed in the Special-Controlled Chemical List must establish control purchase and sale forms for special-controlled chemicals according to the model at Appendix IX issued together with this Circular through the identification system, traceability of special-controlled chemicals on the electronic identification and authentication platform managed by the Ministry of Public Security.

2. The Chemical Administration Department shall be responsible for ensuring the infrastructure to receive the contents of control purchase and sale forms for special-controlled chemicals into the specialized chemical database from the day the identification and traceability system of special-controlled chemicals is officially announced.

Article 9. Chemicals Not Permitted for Use in Industry and Commerce

Chemicals not permitted for use in industry and commerce include prohibited chemicals as stipulated in the Investment Law except where authorized by competent authorities.

Article 10. Digital Transformation in State Management of Chemicals

1. The specialized chemical database includes the following data:

a) Data on chemicals, chemical activities, the chemical industry, dangerous chemicals in products and goods;

b) Data on the National Chemical List, foreign chemical lists recognized by competent state agencies of the Socialist Republic of Vietnam;

c) Data on administrative procedures in the field of chemicals;

d) Data provided annually by organizations and individuals;

e) Data on the contents of control purchase and sale forms for special-controlled chemicals.

2. Information sharing on the specialized database shall be carried out according to the information sharing template prescribed in Appendix XVI issued together with this Circular.

3. Information updates on the specialized chemical database of organizations and individuals engaged in chemical activities shall be carried out according to the template prescribed in Appendix XVII issued together with this Circular.

4. Information on the publication of types of special-controlled chemicals and their intended uses on the specialized chemical database shall be carried out according to the template prescribed in Appendix XVIII issued together with this Circular.

5. The Chemical Administration Department shall be responsible for building, operating, maintaining, updating, upgrading, and developing a comprehensive, modern specialized database that ensures information security, network security, and connectivity with the Ministry of Industry and Trade's service portal and other related specialized databases; establishing mechanisms for sharing and using information from the specialized chemical database; taking the lead in building functions for the publication of hazardous chemical content in products and goods; taking the lead in building functions for the publication of types of special-controlled chemicals and their intended uses on the specialized chemical database.

6. The E-commerce and Digital Economy Department shall take the lead and coordinate with the Chemical Administration Department to build functions for issuing, reissuing, amending, and revoking Certificates and Licenses for Conditional Production and Trading Certificates, Production and Trading Licenses, Export and Import Licenses for Special-Controlled Chemicals, and Service Storage Certificates through the Ministry of Industry and Trade's service portal and share and synchronize data with the specialized chemical database.

Article 11. Hazardous Chemicals in Products and Goods Without Technical Standards

1. The list of hazardous chemicals in products and goods that must publish information in the industrial sector is published in Appendix XIX issued together with this Circular.

2. The Chemical Administration Department shall receive comments on the list specified in Clause 1 of this Article, review and assess the necessity, and submit to the Minister of Industry and Trade for updating and supplementing the list of hazardous chemicals in products and goods that need to publish information under the management of the Ministry of Industry and Trade.

Article 12. Effective Date

1. This Circular takes effect from January 17, 2026.

2. Circular No. 32/2017/TT-BCT dated December 28, 2017, of the Minister of Industry and Trade detailing and guiding the implementation of certain provisions of the Chemical Law and Decree No. 113/2017/NĐ-CP dated October 9, 2017, of the Government detailing and guiding the implementation of certain provisions of the Chemical Law, and Circular No. 17/2022/TT-BCT dated October 27, 2022, of the Minister of Industry and Trade amending and supplementing certain provisions of Circular No. 32/2017/TT-BCT dated December 28, 2017, of the Minister of Industry and Trade detailing and guiding the implementation of certain provisions of the Chemical Law and Decree No. 113/2017/NĐ-CP dated October 9, 2018, of the Government detailing and guiding the implementation of certain provisions of the Chemical Law shall cease to be effective from the date this Circular takes effect.

3. Repeal Article 7 of Circular No. 38/2025/TT-BCT dated June 19, 2025, of the Minister of Industry and Trade amending and supplementing certain provisions on the classification of administrative procedures in fields under the management of the Ministry of Industry and Trade.

4. During the implementation process, if any issues arise, relevant agencies, organizations, and individuals should send their opinions to the Ministry of Industry and Trade (through the Chemical Administration Department) for timely consideration, amendment, supplementation, or guidance.
