JOINT CIRCULAR
Guidelines for implementing the adjustment of monthly allowances from May 1, 2009 for village cadres who have retired in accordance with Decision No. 130/CP dated June 20, 1975 of the Council of Ministers and Decision No. 111/HĐBT dated October 13, 1981 of the Council of Ministers.

Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Clause 2, Article 4 of Decree No. 34/2009/NĐ-CP dated April 6, 2009 of the Government adjusting pensions, social insurance allowances, and monthly allowances for village cadres who have retired (hereinafter referred to as Decree No. 34/2009/NĐ-CP);
After exchanging opinions with relevant ministries, the Ministry of Home Affairs and the Ministry of Finance provide guidelines for implementing the adjustment of monthly allowances from May 1, 2009 for village cadres who have retired in accordance with Decision No. 130/CP dated June 20, 1975 of the Council of Ministers and Decision No. 111/HĐBT dated October 13, 1981 of the Council of Ministers as follows:

Article 1. Applicability

The subjects to which this Circular applies are village, ward, and town cadres who have retired and are receiving monthly allowances in accordance with Decision No. 130/CP dated June 20, 1975 of the Council of Ministers and Decision No. 111/HĐBT dated October 13, 1981 of the Council of Ministers (hereinafter referred to as elderly village cadres who have retired).

Article 2. Adjustment of Monthly Allowances

From May 1, 2009, implement the adjustment of monthly allowances for elderly village cadres who have retired according to the provisions of Article 2 of Decree No. 34/2009/NĐ-CP (increasing the monthly allowance by 5% over the amount received in April 2009) as follows:

In which: The monthly allowance received at the time of April 2009 is the allowance prescribed in Clause 2, Section II of Circular Joint No. 03/2008/TTLT-BNV-BTC dated October 7, 2008 of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of the adjustment of monthly allowances from October 1, 2008 for village cadres who have retired in accordance with Decision No. 130/CP dated June 20, 1975 of the Council of Ministers and Decision No. 111/HĐBT dated October 13, 1981 of the Council of Ministers.

2. The monthly allowance received from May 1, 2009 for elderly village cadres who have retired (rounded off according to the calculation formula in Clause 1 of this Article) is as follows:

a. For cadres who were originally Secretaries of the Party Committee, Chairmen of the People's Committee of the commune: VND 820,000/month;

b. For cadres who were originally Deputy Secretaries, Deputy Chairmen, Permanent Members of the Party Committee, Secretaries of the People's Committee, Secretaries of the People's Council, Head of the Militia Company, Chief of Public Security Station: VND 790,000/month.

c. For other positions: VND 725,000/month.

Article 3. Implementation

1. Provincial People's Committees and municipal people's committees directly under the central government shall guide and implement the payment of monthly allowances from May 1, 2009 for the subjects within their jurisdiction according to the guidelines set forth in this Circular.

2. The source of funds for adjusting the monthly allowance for retired elderly village cadres shall be implemented according to the guidance of the Ministry of Finance.

3. Elderly village cadres who have retired, when moving to a new legal place of residence within the same district, must present a transfer certificate issued by the People's Committee of the commune; within the same province, a transfer certificate issued by the Department of Home Affairs of the district; outside the province, a transfer certificate issued by the Department of Home Affairs of the province; the transfer certificate must be accompanied by the file and decision on retirement (in case of loss, there must be a confirmation letter from the competent authority at the same level). The local authority where the cadre moves to will continue to pay the allowance to the transferred cadre. If the cadre has moved to a new legal place of residence before the effective date of Decree No. 34/2009/NĐ-CP, the current paying authority will continue to pay the allowance to the subject.

Article 4. Effectiveness

1. This Circular takes effect forty-five (45) days from the date of issuance.

2. The provisions set forth in this Circular shall take effect from May 1, 2009.

3. Abolish Circular Joint No. 03/2008/TTLT-BNV-BTC dated October 7, 2008 of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of the adjustment of monthly allowances from October 1, 2008 for village cadres who have retired in accordance with Decision No. 130/CP dated June 20, 1975 of the Council of Ministers and Decision No. 111/HĐBT dated October 13, 1981 of the Council of Ministers.

During the implementation process, if there are any difficulties, ministries, sectors, and localities should report to the Ministry of Home Affairs and the Ministry of Finance for research and resolution./.
