JOINT CIRCULAR

Guidelines for appointment and salary grading for career titles of sports professionals

Pursuant to the Civil Servant Law dated November 15, 2010;

Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, utilization, and management of civil servants;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for officials, civil servants, public employees, and armed forces; Decree No. 17/2013/NĐ-CP dated December 19, 2013 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for officials, civil servants, public employees, and armed forces;

Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

The Minister of Culture, Sports and Tourism and the Minister of Home Affairs issue this joint circular guiding the appointment and salary grading for career titles of sports professionals.

Article 1. Scope of Regulation and Applicability

1. This joint circular guides the appointment and salary grading for career titles of sports professionals as stipulated in Joint Circular No. 13/2014/TTLT-BVHTTDL-BNV dated October 17, 2014 of the Ministry of Culture, Sports and Tourism and the Ministry of Home Affairs on job code and criteria for career titles of sports professionals (hereinafter referred to as Joint Circular No. 13/2014/TTLT-BVHTTDL-BNV).

2. This joint circular applies to sports professionals working in state-owned sports institutions.

Article 2. Principles for Appointment and Classification of Salary Grades According to Position Titles for Civil Servants

1. The appointment to career titles of public employees as stipulated in Joint Circular No. 13/2014/TTLT-BVHTTDL-BNV must be based on the position, responsibilities, and professional qualifications currently held by the employee and according to Article 3 of this joint circular.

2. When appointing from the current public employee rank to the corresponding career title of sports professional, it shall not combine with increasing salary grade or advancing career title rank.

Article 3. Cases of Appointment to Position Titles

Public employees who have been appointed to the ranks of sports professionals as stipulated in Decision No. 12/2008/QĐ-BVHTTDL dated March 10, 2008 of the Minister of Culture, Sports and Tourism on professional standards for sports professionals (hereinafter referred to as Decision No. 12/2008/QĐ-BVHTTDL) are now appointed to career titles of sports professionals as stipulated in Joint Circular No. 13/2014/TTLT-BVHTTDL-BNV, as follows:

1. Appointment to the career title of senior coach (Class I), code V.10.01.01 for public employees currently holding the senior coach rank, code 18.179;

2. Appointment to the career title of head coach (Class II), code V.10.01.02 for public employees currently holding the head coach rank, code 18.180;

3. Appointment to the career title of coach (Class III), code V.10.01.03 for public employees currently holding the coach rank, code 18.181;

4. Appointment to the career title of instructor (Class IV), code V.10.01.04 for public employees currently holding the instructor rank, code 18.182.

Article 4. Salary Grading Method

1. Career titles of sports professionals as stipulated in Joint Circular No. 13/2014/TTLT-BVHTTDL-BNV apply the Professional and Technical Salary Scale for Officials and Public Employees in State-Owned Institutions (Scale 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for officials, civil servants, public employees, and armed forces (hereinafter referred to as Decree No. 204/2004/NĐ-CP) as follows:

a) The career title of senior coach (Class I) applies the salary coefficient of Class A3, Group 1 (A3.1) from coefficient 6.20 to coefficient 8.00;

b) The career title of head coach (Class II) applies the salary coefficient of Class A2, Group 1 (A2.1) from coefficient 4.40 to coefficient 6.78;

c) The occupational title of Coach (Class III) shall apply the salary coefficient of Class A1, ranging from salary coefficient 2.34 to 4.98.

d) The occupational title of Guide (Class IV) shall apply the salary coefficient of Class B, ranging from salary coefficient 1.86 to 4.06.

2. The salary grading for public employees appointed to career titles as stipulated in Clause 1 of this Article who have been graded to the ranks of sports professionals according to Decision No. 12/2008/QĐ-BVHTTDL and Decree No. 204/2004/NĐ-CP shall be implemented as follows:

a) In cases where public employees meet the conditions for appointment to career titles of sports professionals and have the same salary coefficient at the old rank, they will be assigned the same salary grade and percentage of seniority allowance exceeding the ceiling (if applicable) currently enjoyed at the old rank (including time for the next salary grade increase or seniority allowance exceeding the ceiling if applicable at the old rank) to the newly appointed career title;

Example: Mr. Nguyen Van A has been ranked as an instructor (code 18.182), Grade 4, coefficient 2.46 since February 1, 2013. Now meeting the conditions and being appointed by the competent authority to the career title of instructor (Class IV), code V.10.01.04, he will be assigned Grade 4, coefficient 2.46 of the instructor career title (Class IV) from the date of the decision; the time for the next salary grade increase will be calculated from February 1, 2013.

b) In cases where public employees meet the conditions for appointment to career titles of sports professionals and have a lower salary coefficient at the old rank, the salary grading for the new career title will be based on the years of service with mandatory social insurance contributions according to the national salary scale (excluding probationary period) to assign to the salary grade of the newly appointed career title as follows:

Starting from Grade 1 of the newly appointed career title, every three years (36 months) for the career title of coach (Class III) or every two years (24 months) for the career title of instructor (Class IV), one salary grade will be assigned to the newly appointed career title (if there are interrupted periods without enjoying social insurance benefits, they will be accumulated). If during the period of service there is a year when the assigned tasks are not completed or disciplinary action is taken, the time for the next salary grade increase will be extended according to the regular salary grade increase system of the newly appointed career title.

After transferring the salary grade to the occupational title position appointed according to this regulation, if the coefficient of the salary assigned at the occupational title position plus the seniority allowance exceeding the ceiling (if any) is lower than the coefficient of the salary already received at the old rank, then the difference coefficient shall be retained for equalization with the coefficient of the salary (including the seniority allowance exceeding the ceiling, if any) currently received at the old rank. This retained difference coefficient shall be enjoyed throughout the entire period during which the civil servant receives the salary at the new occupational title position. Subsequently, if the civil servant is promoted to a higher occupational title position, the retained difference coefficient shall be added to the current coefficient of the salary (including the seniority allowance exceeding the ceiling, if any) to determine the salary grade at the newly appointed occupational title position upon promotion, and the retention of the difference coefficient shall cease from the date the salary is received at the new occupational title position.

Example: Mr. Tran Van B was recruited as a civil servant at the Sports Center of Province H since January 1, 2008, and has been contributing to the mandatory social insurance until now. He was assigned to the rank of coach (code 18.181), level 3, with a coefficient of 3.00 since July 1, 2014, and has consistently fulfilled his tasks without disciplinary actions during his tenure. Now, based on the job position, meeting the conditions, and being appointed by the competent authority to the occupational title of instructor (Class IV), code V.10.01.04, the salary assignment will be carried out as follows:

Mr. Tran Van B's working period from January 1, 2008, excluding the probationary period of six months, and every two years advancing one level, he reached level 4 with a coefficient of 2.46 of the occupational title of instructor (Class IV) on July 1, 2014; the time enjoying the new level salary at the occupational title of instructor (Class IV) starts from the date of signing the decision; the time for the next regular salary increase is calculated from July 1, 2014; simultaneously, he enjoys the retained difference coefficient of 0.54 (3.00 - 2.46).

On July 1, 2016 (after two years), Mr. Tran Van B meets the conditions for a regular salary increase to level 5 with a coefficient of 2.66 of the occupational title of instructor (Class IV) and continues to enjoy the retained difference coefficient of 0.54 (total coefficient of the salary received is 3.20).

3. The promotion of civil servants in the field of Physical Education and Sports shall be implemented after being appointed to the occupational title of civil servant in the field of Physical Education and Sports as stipulated in Circular Joint Circular No. 13/2014/TTLT-BVHTTDL-BNV and implementing the salary assignment according to the guidance provided in Clause 1 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007, issued by the Ministry of Home Affairs regarding salary assignment when upgrading ranks, changing ranks, and changing types of civil servants.

Article 5. Transitional Provisions

Civil servants who have been appointed to the ranks of civil servants in the field of Physical Education and Sports as stipulated in Decision No. 12/2008/QĐ-BVHTTDL, now appointed to the occupational title of civil servant in the field of Physical Education and Sports as stipulated in Joint Circular No. 13/2014/TTLT-BVHTTDL-BNV and this Circular, the competent authority managing and using civil servants shall create conditions for civil servants to supplement the remaining criteria of the occupational title of civil servant in the field of Physical Education and Sports appointed.

Article 6. Implementation Organization

1. Ministries, agencies equivalent to ministries, agencies under the Government, People's Committees of provinces and centrally governed cities have the responsibility:

a) To direct units under their management to implement the transfer to occupational titles and salary assignment for civil servants in the field of Physical Education and Sports;

b) To approve plans for the transfer to occupational titles and salary assignment for civil servants in the field of Physical Education and Sports under their management from the current civil servant ranks to the occupational titles of civil servants in the field of Physical Education and Sports as stipulated in Joint Circular No. 13/2014/TTLT-BVHTTDL-BNV and this Joint Circular; to resolve issues within their jurisdiction during the process of transferring to occupational titles;

c) To decide on the transfer to occupational titles and salary assignment for civil servants under their management to the occupational titles of civil servants in the field of Physical Education and Sports within their jurisdiction. For cases of transferring to the occupational title of Senior Coach (Class I), a written request must be submitted to the Ministry of Home Affairs for decision;

d) To report the results of the transfer to occupational titles of civil servants in the field of Physical Education and Sports in public service units under their management to the Ministry of Culture, Sports and Tourism and the Ministry of Home Affairs.

2. Heads of public service units directly managing and using civil servants have the responsibility:

a) To review job positions in their units, develop plans for transferring to occupational titles and salary assignment for civil servants in the field of Physical Education and Sports within their jurisdiction, submit them for examination and decision by the competent authority or decide according to the delegated authority;

b) To decide on the transfer to occupational titles and salary assignment for civil servants under their management to the occupational titles of civil servants in the field of Physical Education and Sports within their jurisdiction or according to the delegated authority after the plan for transferring to occupational titles has been approved by the competent authority.

Article 7. Effective Date

This Joint Circular takes effect from August 1, 2015.

Article 8. Responsibility for Implementation

1. The Minister, the Head of a ministry-level agency, the Head of an agency under the Government; the Chairman of the People's Committee of a province or centrally governed city shall be responsible for implementing this Joint Circular;

2. During implementation, if there are any difficulties, please reflect them to the Ministry of Home Affairs for consolidation and coordination with the Ministry of Culture, Sports and Tourism to examine and resolve./.
