CIRCULAR
GUIDELINES FOR IMPLEMENTING THE ADJUSTMENT OF MONTHLY ALLOWANCE FROM JANUARY 1, 2022 FOR RETIRED RURAL, URBAN WARD, AND MARKET TOWN OFFICIALS IN ACCORDANCE WITH DECISION NO. 130-CP OF THE COUNCIL OF MINISTERS ON JUNE 20, 1975 AND DECISION NO. 111-HĐBT OF THE COUNCIL OF MINISTERIAL HEADS ON OCTOBER 13, 1981
Pursuant to Decree No. 34/2017/NĐ-CP dated April 3, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Clause 2, Article 4 of Decree No. 108/2021/NĐ-CP dated December 7, 2021 of the Government adjusting pensions, social insurance allowances, and monthly allowances;
At the proposal of the Director of the Salary Department;
The Minister of Home Affairs issues this Circular guiding the implementation of the adjustment of monthly allowances from January 1, 2022 for retired rural, urban ward, and market town officials in accordance with Decision No. 130-CP of the Council of Ministers on June 20, 1975 and Decision No. 111-HĐBT of the Council of Ministerial Heads on October 13, 1981.
Article 1. Scope of application
The subjects to which this Circular applies are retired rural, urban ward, and market town officials receiving monthly allowances in accordance with Decision No. 130-CP of the Council of Ministers on June 20, 1975 and Decision No. 111-HĐBT of the Council of Ministerial Heads on October 13, 1981 (hereinafter referred to as elderly retired village officials).
Article 2. Adjustment of Monthly Subsidies
From January 1, 2022, implement the adjustment of monthly allowances for elderly retired village officials in accordance with Article 2 of Decree No. 108/2021/NĐ-CP dated December 7, 2021 of the Government adjusting pensions, social insurance allowances, and monthly allowances as follows:
1. Increase the monthly allowance by 7.4% based on the monthly allowance received at the end of December 2021 according to the following calculation formula:

In which: The monthly allowance received at the end of December 2021 is the monthly allowance stipulated in Clause 2, Article 2 of Circular No. 09/2019/TT-BNV dated June 14, 2019 of the Minister of Home Affairs guiding the implementation of the adjustment of monthly allowances from July 1, 2019 for retired village officials in accordance with Decision No. 130-CP of the Council of Ministers on June 20, 1975 and Decision No. 111-HĐBT of the Council of Ministerial Heads on October 13, 1981.
2. For elderly retired village officials whose monthly allowance after adjustment in accordance with Clause 1 of this Article is lower than 2,500,000 VND/month, the allowance will be increased as follows:
a) Increase by 200,000 VND/person/month for those whose monthly allowance is below 2,300,000 VND/person/month;
b) Increase to 2,500,000 VND/person/month for those whose monthly allowance is from 2,300,000 VND/person/month to below 2,500,000 VND/person/month.
3. Based on the provisions of Clauses 1 and 2 of this Article, the monthly allowance received from January 1, 2022 (rounded off) for elderly retired village officials is as follows:
a) For former Secretaries of the Party Committee, Chairmen of the People's Committee of villages: 2,473,000 VND/month;
b) For former Deputy Secretaries, Deputy Chairmen, Standing Members of the Party Committee, Secretaries of the People's Committee, Secretaries of the People's Council, Village Militia Chiefs, Chiefs of Public Security Stations: 2,400,000 VND/month;
c) For other positions: 2,237,000 VND/month.
Article 3. Implementation Organization
1. Provincial People's Committees shall organize the payment of monthly allowances from January 1, 2022 in accordance with the guidelines set out in this Circular for the subjects under their management.
2. The funding for the adjustment of monthly allowances for elderly retired village officials shall be implemented in accordance with Clause 1, Article 3 of Decree No. 108/2021/NĐ-CP dated December 7, 2021 of the Government adjusting pensions, social insurance allowances, and monthly allowances.
Article 4. Effective date
1. This Circular takes effect from March 15, 2022.
2. The regulations stipulated in this Circular shall be implemented from January 1, 2022.
3. This Circular replaces Circular No. 09/2019/TT-BNV dated June 14, 2019 of the Minister of Home Affairs guiding the implementation of the adjustment of monthly allowances from July 1, 2019 for retired village officials in accordance with Decision No. 130-CP of the Council of Ministers on June 20, 1975 and Decision No. 111-HĐBT of the Council of Ministerial Heads on October 13, 1981. During the implementation process, if there are any difficulties, please report them to the Ministry of Home Affairs for study and resolution.
