Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;
Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;
Pursuant to the Radio Frequency Law dated November 23, 2009; the Law Amending and Supplementing Certain Provisions of the Radio Frequency Law dated November 9, 2022;
Pursuant to the Law on Information Technology dated June 29, 2006;

The Minister of Information and Communications issues this Circular stipulating the List of products and goods that may cause safety risks under the management responsibility of the Ministry of Information and Communications.
Article 1. Scope of Regulation
1. This Circular stipulates the List of products and goods that may cause safety risks under the management responsibility of the Ministry of Information and Communications (hereinafter referred to as the List of products and goods group 2); principles for managing products and goods group 2; provisions on certain cases where products and goods are exempted from conformity certification and declaration; provisions on certain cases where the effectiveness is suspended or not mandatorily applied partially or entirely of certain technical standards.
2. This Circular only applies to products and goods with HS codes and product descriptions specified in the List of products and goods group 2.
Article 2. Applicability
This Circular applies to:
1. Organizations and individuals engaged in the production and business of products and goods listed in the List of products and goods group 2 in Vietnam.
2. Organizations and individuals engaged in activities related to the quality management of products and goods listed in the List of products and goods group 2 in Vietnam.
Article 3. List of Products and Goods Group 2
The List of products and goods group 2 and management measures are stipulated as follows:
1. The List of information technology and telecommunications products and goods that must be certified and declared as conforming is specified in Appendix I attached hereto.
2. The List of information technology and telecommunications products and goods that must be declared as conforming is specified in Appendix II attached hereto.
Article 4. Principles for Managing Products and Goods Group 2
1. The quality management of products and goods listed in the List of products and goods group 2 shall be carried out in accordance with the regulations of the Ministry of Information and Communications on conformity certification, declaration, and quality inspection for information technology and telecommunications products and goods and corresponding technical standards.
2. Products and goods listed in the List of products and goods group 2 that integrate other products and goods listed in the List of products and goods group 2 must fully certify and declare conformity according to the corresponding technical standards applicable to those products and goods and the integrated products and goods.
3. Products and goods listed in the List of products and goods group 2 subject to two or more technical standards must certify and declare conformity in accordance with the provisions of those technical standards.
4. In cases where technical standards promulgated before the effective date of this Circular have different provisions than this Circular, the provisions of this Circular shall apply.
5. From the effective date of this Circular, if new technical standards are issued to replace the technical standards specified in the List of products and goods group 2; or if new technical standards are issued to supplement the application to products and goods specified in the List of products and goods group 2, then the provisions of the Circular issuing the new technical standards shall apply.
Article 5. Provisions on certain cases where products, goods in Group 2 are exempted from conformity certification and declaration of conformity
1. Products, goods listed in Item 1 and Item 2 of Appendix II issued together with this Circular that integrate short-range radio equipment under Item 2 of Appendix I or Item 4 of Appendix II issued together with this Circular and do not integrate other radio transmitting/receiving equipment shall be exempted from conformity certification and declaration of conformity if they simultaneously meet the following requirements:
a) Imported for direct use by the importing organization or individual;
b) Imported in a maximum of three (3) products or goods of each type in a consignment;
c) The products, goods have operating frequency bands and technical parameters that comply with the technical conditions and operational regulations stipulated in Circular No. 08/2021/TT-BTTTT dated October 14, 2021 of the Minister of Information and Communications regarding the List of Radio Equipment Exempted from Frequency Usage Licenses, Technical Conditions, and Operational Regulations attached thereto.
2. Products, goods listed in Item 1 and Item 2 of Appendix II issued together with this Circular shall be exempted from conformity certification and declaration of conformity for QCVN 101:2020/BTTTT, QCVN 132:2022/BTTTT, parts of technical standards therein requiring destructive testing if they simultaneously meet the following requirements:
a) Imported in a maximum of three (3) products or goods of each type in a consignment;
b) The importing organization or individual has a written commitment that the products, goods comply with part or all of the technical standards requiring destructive testing and fully assume responsibility for the safety of imported products, goods.
3. The exemption from conformity certification and declaration of conformity for products, goods prescribed in Clause 1 and Clause 2 of this Article shall be implemented in accordance with Point c Clause 2 Article 16 of Circular No. 30/2011/TT-BTTTT dated October 31, 2011, which has been amended and supplemented by Circular No. 15/2018/TT-BTTTT dated November 15, 2018 and Circular No. 10/2020/TT-BTTTT dated May 7, 2020 of the Minister of Information and Communications.
Article 6. Provisions on certain cases suspending the effectiveness, not mandatorily applying part or all of some technical standards
1. Certain cases where products, goods suspend the effectiveness, not mandatorily applying part or all of some technical standards until June 30, 2025 are specified in Appendix I and Appendix II issued together with this Circular.
2. From the date this Circular takes effect until June 30, 2025, it is encouraged to implement conformity certification and declaration of conformity for products, goods prescribed in Clause 1 of this Article with the entire corresponding technical standards.
3. As of July 1, 2025, products, goods prescribed in Clause 1 of this Article that have completed conformity certification and declaration of conformity during the period from July 15, 2023 to June 30, 2025 must complete supplementary conformity certification and declaration of conformity in accordance with the corresponding technical standards or conduct new conformity certification and declaration of conformity according to the corresponding technical standards if they continue production or import.
Article 7. Effective Date
1. This Circular takes effect from May 15, 2024.
2. Circular No. 04/2023/TT-BTTTT dated May 31, 2023 of the Minister of Information and Communications specifying the List of Products, Goods Capable of Causing Safety Hazards Under the Management Responsibility of the Ministry of Information and Communications and Circular No. 10/2023/TT-BTTTT dated September 5, 2023 of the Minister of Information and Communications suspending the application of provisions mandatorily applying part or all of some technical standards in Circular No. 04/2023/TT-BTTTT dated May 31, 2023 of the Minister of Information and Communications shall cease to be effective from the date this Circular takes effect.
Article 8. Transitional Provisions
1. Certificates of Conformity and Notifications of Acceptance of Declarations of Conformity issued to products, goods prescribed in Clause 1 of Article 6 of this Circular during the period from July 15, 2023 to before the date this Circular takes effect remain valid for use until the expiration date stated in the Certificate of Conformity and Notification of Acceptance of Declaration of Conformity.
2. Organizations and individuals producing or importing may choose to complete the declaration of conformity filing and registration for quality inspection of imported goods during the period from January 1, 2024 to before the date this Circular takes effect according to the technical standards stipulated in Circular No. 04/2023/TT-BTTTT dated May 31, 2023 and Circular No. 10/2023/TT-BTTTT dated September 5, 2023, or according to the technical standards stipulated in Clause 1 of Article 6 of this Circular.
Article 9. Implementation Organization
1. The Director of the Office, the Head of the Department of Science and Technology, the Heads of agencies and units under the Ministry of Information and Communications, and related organizations and individuals are responsible for implementing this Circular.
2. During the implementation of this Circular, organizations and individuals are responsible for promptly reflecting any issues encountered and implementing according to the guidance of the Ministry of Information and Communications (Department of Science and Technology).
3. In case there are difficulties in determining the HS code of imported goods that are products, goods capable of causing safety hazards within the scope of adjustment of this Circular, the Ministry of Information and Communications (Department of Science and Technology) will coordinate with the Ministry of Finance (General Customs Department) to provide guidance and handle uniformly.

(1) For this technical regulation, products and goods do not need to undergo conformity certification but only need to undergo declaration of conformity.
(2) When applying QCVN 47:2015/BTTTT, in addition to the requirements of QCVN 47:2015/BTTTT, products and goods must comply with Vietnam's radio frequency planning.
(3) This type of product and good does not apply to explosion-proof communication equipment.
(4) Short-range radio equipment in this section does not include radio receivers only; wideband data transmission equipment operating in the 2.4 GHz band with equivalent isotropic radiated power (EIRP) less than 60 mW; independent radio access equipment operating in the 5 GHz band with EIRP less than 60 mW. Conformity certification and declaration of conformity shall only be carried out when the equipment meets the band and technical conditions and is operated according to the provisions of Circular No. 08/2021/TT-BTTTT dated October 14, 2021 of the Minister of Information and Communications.
Wideband data transmission equipment, independent radio access equipment operating on one or more bands supporting the 6 GHz band (5.925 GHz to 7.125 GHz) (hereinafter referred to as Wi-Fi 6E, Wi-Fi 7) can only be certified and declared for conformity if the manufacturer of the Wi-Fi 6E, Wi-Fi 7 equipment has a written commitment to turn off the 6 GHz band and users cannot activate or use this band without the support of the manufacturer.
Equipment incorporating the functions of Wi-Fi 6E, Wi-Fi 7 can only be certified and declared for conformity if the manufacturer of the equipment incorporating these functions has a written commitment to turn off the 6 GHz band and users cannot activate or use this band without the support of the manufacturer.
(5) Certification of compliance and declaration of conformity shall only be carried out when the equipment complies with the frequency bands and technical conditions specified in Circular No. 08/2021/TT-BTTTT dated October 14, 2021, issued by the Minister of Information and Communications regarding the List of Radio Equipment Exempted from Frequency Usage Licenses, Technical Conditions, and Operation.
(6) Organizations, enterprises producing, importing, distributing, and using base station equipment and mobile repeater equipment commit to complying with the legal regulations on management and usage of radio frequencies.
(7) For QCVN 117:2023/BTTTT: The requirements for the Total Radiated Power Sensitivity (TRS) at Clause 2.2.12 and the Total Radiated Power (TRP) at Clause 2.2.13 of the technical standard are not applied.
(8) For QCVN 101:2020/BTTTT: Only the safety characteristics requirements stipulated in Clause 2.6 of this technical standard must be declared for conformity.
(9) For QCVN 65:2021/BTTTT: Formula (1) of the technical standard is not applied in Clause 2.1.2 of QCVN 65:2021/BTTTT.
(10) For QCVN 128:2021/BTTTT: The requirements for 5G Base Station Performance at Clause 2.4 are not applied. Note: The implementation of conformity declaration for products and goods specified in Appendix II is carried out as follows for certain specific cases:
(2) When applying QCVN 47:2015/BTTTT, in addition to the requirements of QCVN 47:2015/BTTTT, products and goods must comply with Vietnam's radio frequency planning.
(3) This type of product and good does not apply to explosion-proof communication equipment.
(4) Short-range radio devices at this item do not include only receiving radio devices; wideband data transmission devices operating in the 2.4 GHz band with equivalent isotropic radiated power (EIRP) less than 60 mW; 5 GHz band radio access devices with equivalent isotropic radiated power (EIRP) less than 60 mW. Conformity declaration shall only be implemented when the device complies with the frequency band and technical conditions stipulated in Circular No. 08/2021/TT-BTTTT dated October 14, 2021 issued by the Minister of Information and Communications.
Broadband data transmission devices, independent radio access devices operating on one or more bands supporting the 6 GHz band (5.925 GHz to 7.125 GHz) (hereinafter referred to as Wi-Fi 6E, Wi-Fi 7) shall only be subject to conformity declaration if the manufacturer of the Wi-Fi 6E, Wi-Fi 7 device has committed to turning off the 6 GHz band and users cannot activate or use this band without the support of the manufacturer.
Devices incorporating functions of Wi-Fi 6E, Wi-Fi 7 shall only be subject to conformity declaration if the manufacturer of the device incorporating functions of Wi-Fi 6E, Wi-Fi 7 has committed to turning off the 6 GHz band and users cannot activate or use this band without the support of the manufacturer.
(5) Conformity declaration shall only be implemented when the device complies with the frequency band and technical conditions stipulated in Circular No. 08/2021/TT-BTTTT dated October 14, 2021 issued by the Minister of Information and Communications, which specifies the List of Radio Equipment Exempted from Frequency Usage Licenses, Technical Conditions, and Operation.
(8) For QCVN 101:2020/BTTTT: Only the safety characteristics requirements stipulated in Clause 2.6 of this technical standard must be declared for conformity.
(12) Results of testing/calibration from domestic or foreign laboratories that have not been designated or recognized, or results from manufacturers, shall not be used to assess compliance with this technical standard.
(13) For QCVN 132:2022/BTTTT: In cases where products or goods use voltage converters (adapters), if the converter is included, test QCVN 132:2022/BTTTT for the product or good with the converter; if the converter is not included, test QCVN 132:2022/BTTTT for the product or good without the converter.
(14) For QCVN 53:2017/BTTTT: requirements for antennas as stipulated in Clause 2.3 of the technical regulation are not applied.
(15) Requirements for electromagnetic compatibility as stipulated in this technical regulation are not applied.
