CIRCULAR
Guidelines on the name of the People's Committee Office at the district and urban district level and the signboard of the People's Committee at the district, urban district, and commune levels where the pilot program of not establishing the People's Council is implemented.

Pursuant to Resolution No. 26/2008/QH12 dated November 15, 2008 of the National Assembly, Session XII, on implementing the pilot program of not establishing the People's Council at the district and urban district levels.
Pursuant to Resolution No. 724/2009/UBTVQH12 dated January 16, 2009 of the Standing Committee of the National Assembly on the list of districts, urban districts, and communes of provinces and centrally-run cities implementing the pilot program of not establishing the People's Council at the district and urban district levels.
Pursuant to Resolution No. 725/2009/UBTVQH12 dated January 16, 2009 of the Standing Committee of the National Assembly on adjusting the tasks and powers of the People's Councils and People's Committees of provinces and centrally-run cities and defining the tasks, powers, and organizational structure of the People's Committees at the district and urban district levels where the People's Councils are not established.
The Ministry of Home Affairs issues guidelines on the name of the People's Committee Office at the district and urban district levels and the signboard of the People's Committee at the district, urban district, and commune levels where the pilot program of not establishing the People's Council is implemented as follows:
Article 1. Scope and objects regulated
This Circular guides on the name of the People's Committee Office at the district and urban district levels and the signboard of the People's Committee at the district, urban district, and commune levels where the pilot program of not establishing the People's Council is implemented in the provinces of Lào Cai, Vĩnh Phúc, Nam Định, Quảng Trị, Phú Yên, Bà Rịa - Vũng Tàu, Kiên Giang, Ho Chi Minh City, Hai Phong City, and Da Nang City.
Article 2. Name of the People's Committee Office at the district and urban district levels implementing the pilot program of not establishing the People's Council
For districts and urban districts where the pilot program of not establishing the People's Council is implemented, since there is no longer a People's Council, the previous name "People's Council and People's Committee Office" shall now be uniformly called "People's Committee Office." The specific functions, tasks, and powers of this office shall be defined by the People's Committee at the district and urban district levels according to the guidance provided in Clause 1 of this Circular.
Article 3. Signboard of the People's Committee at the district, urban district, and commune levels implementing the pilot program of not establishing the People's Council
In places where the pilot program of not establishing the People's Council is implemented, since there is no longer a People's Council, there will no longer be a signboard for the People's Council office.
According to Clause 1, Section I of Circular No. 05/2008/TT-BNV dated August 7, 2008 of the Ministry of Home Affairs guiding on the signboard of administrative agencies, and Article 1 of the Administrative Agency Workplace Culture Regulation issued together with Decision No. 129/2007/QĐ-TTg dated August 2, 2007 of the Prime Minister, the scope and objects regulated by the signboard of administrative agencies include Ministries, ministerial-level agencies, agencies under the Government, and People's Committees at all levels. Therefore, for the People's Committees at the district, urban district, and commune levels where the pilot program of not establishing the People's Council is implemented, the signboard of the agency shall follow the guidance of Circular No. 05/2008/TT-BNV, only showing the name "People's Committee of the district, urban district, or commune."
Article 4. Effective date
1. This Circular takes effect from the date of issuance.
2. The Chairperson of the People's Committee of the province or centrally-run city where the pilot program is implemented shall be responsible for organizing the implementation of this Circular.
3. During the process of implementation, if any issues arise or difficulties occur, the People's Committee of the province or centrally-run city specified in Article 1 shall report to the Ministry of Home Affairs for research and resolution./.
