Regulations on the management of scientific and technological tasks of the Ministry of Culture, Sports and Tourism

Based on the Law on Science and Technology No. 21/2000/QH10 dated June 9, 2000;

Pursuant to Decree No. 81/2002/NĐ-CP dated October 17, 2002 of the Government detailing the implementation of certain provisions of the Law on Science and Technology;

Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Considering the proposal of the Director of the Department of Science, Technology and Environment;

The Minister of Culture, Sports and Tourism issues this Circular to regulate the management of scientific and technological tasks of the Ministry of Culture, Sports and Tourism.

Section 1

GENERAL PROVISIONS

Article 1. Scope and Applicability

1. SCOPE OF REGULATION.

a) This Circular regulates the management of scientific and technological tasks using the state budget for science and technology of the Ministry of Culture, Sports and Tourism, including ministry-level and grassroots-level scientific and technological tasks;

b) For ministry-level and grassroots-level scientific and technological tasks not using the state budget for science and technology of the Ministry of Culture, Sports and Tourism, relevant provisions of this Circular may be applied for management purposes.

2. This Circular applies to agencies and units under the Ministry of Culture, Sports and Tourism and related organizations and individuals.

Article 2. Interpretation of Terms

1. Ministry-level scientific and technological tasks (hereinafter referred to as scientific and technological tasks) are scientific and technological issues within the fields of culture, family, physical education, sports, and tourism that need to be resolved, determined, and implemented according to the State's regulations on scientific and technological management and the provisions of this Circular.

Scientific and technological tasks are organized and implemented in the form of ministry-level scientific and technological topics (hereinafter referred to as topics), ministry-level scientific and technological projects (hereinafter referred to as projects), and ministry-level scientific and technological programs (hereinafter referred to as programs).

2. Topic mainly focuses on researching a specific subject in the fields of culture, family, physical education, sports, and tourism, including scientific research topics and technology development topics, social and humanistic science topics. Topics can be independent or part of a project or program.

3. Project mainly involves conducting scientific research activities, developing and applying technology, testing solutions, methods, and models of management in the fields of culture, family, physical education, sports, and tourism. Projects include a group of scientific and technological tasks aimed at developing and applying technology, experimental production projects. Projects can be independent or part of a program.

4. the Program includes a group of topics, projects, gathered with a specific purpose to achieve long-term general goals of scientific and technological development or practical applications with high effectiveness in the fields of culture, family, physical education, sports, and tourism.

5. Determining scientific and technological tasks is the process of organizing and implementing the examination, selection, and formation of scientific and technological research ideas based on research directions and guidance from the Ministry of Culture, Sports and Tourism.

6. Selecting is the process of organizing and implementing selecting organizations and individuals with the best capabilities and experience to lead the implementation of scientific and technological tasks based on the application forms submitted by organizations and individuals participating in the selection process according to the requirements and criteria stipulated in this Circular.

7. Selection is the process of organizing and implementing the selection of organizations and individuals with sufficient capabilities and experience to lead the implementation of scientific and technological tasks upon request from the Ministry of Culture, Sports and Tourism based on the application forms prepared by the assigned organizations and individuals according to the requirements and criteria stipulated in this Circular.

8. Review is the process of examining and checking to evaluate the content and budget of scientific and technological tasks before deciding to implement them.

9. Results of the implementation of scientific and technological tasks encompass all scientific products created through research activities, including the following forms:

a) Official scientific products include: Summary reports of research results, abstract reports, recommendations of scientific and technological tasks to the agencies using research results and state management agencies on science and technology; other specific scientific and technological products registered in the approved task description and signed research and technology development contracts.

b) Intermediate scientific products serve as the basis and material for creating official scientific products, including: Proceedings of scientific seminars, branch reports, specialized reports, reports analyzing survey and investigation results, publications released during the implementation of scientific and technological tasks.

10. Specialized scientific topic is a scientific issue that needs to be addressed during the research process to determine and prove scientific arguments using scientific evidence, including theoretical evidence (theoretical foundation) and practical evidence (survey, investigation, experimental results conducted by the author or cited from other authors' works). Specialized scientific topics are divided into two types as follows:

a) Type 1: Theoretical research topic involving collecting and processing existing information and scientifically proven arguments extracted from previous literature, books, and scientific works, laboratory research and experiments, leading to necessary evidence to prove scientific arguments.

b) Type 2: Theoretical research topic combined with experimental implementation, in addition to activities like type 1 above, also includes field surveys, interviews, studies, trials, and experiments to contrast, compare, analyze, and evaluate to prove scientific arguments.

11. Recommendations of scientific and technological tasks are one of the official scientific products and must be included in scientific and technological tasks. The content of the recommendations should address issues and matters related to the research results of scientific and technological tasks for the Ministry of Culture, Sports and Tourism and competent agencies and units under the Ministry to consider and utilize the research results in practice.

12. Grassroots-level scientific and technological tasks (hereinafter referred to as grassroots-level tasks) are scientific and technological issues within the fields of culture, family, physical education, sports, and tourism implemented in the form of topics, projects, scientific information activities... approved by heads of agencies and units for implementation to resolve urgent tasks and development objectives of the unit.

Article 3. Procedures for managing the implementation of scientific and technological tasks

1. Determining scientific and technological tasks.

2. Selecting and examining organizations and individuals to be in charge of implementation.

3. Reviewing scientific and technological tasks that have been selected and examined (hereinafter referred to as review).

4. Approving scientific and technological tasks for implementation.

5. Signing a scientific research and technology development contract (hereinafter referred to as Contract) to implement scientific and technological tasks.

6. Implementing the signed Contract.

7. Evaluating and accepting scientific and technological tasks at two levels (institutional level and Ministry level).

8. Transferring and applying research results in practice.

Article 4. Management of program implementation

1. The Minister of Culture, Sports and Tourism decides to establish the Program Steering Committee based on the proposal of the Department of Science, Technology and Environment Director. The Steering Committee has the task of advising the Minister of Culture, Sports and Tourism in organizing and managing the implementation of the program.

2. Responsibilities and authorities of the Program Steering Committee:

a) Being responsible to the Minister of Culture, Sports and Tourism for the implementation of the program's goals, contents, and approved product outcomes;

b) Leading and coordinating with relevant agencies to manage projects within the program according to this Circular; proposing adjustments and supplements to the annual program content;

c) Guiding the construction and approval of project descriptions within the program that have been approved by the Minister of Culture, Sports and Tourism in terms of content and budget; leading and coordinating with representatives from the Ministry of Culture, Sports and Tourism (Department of Science, Technology and Environment) to organize the signing of contracts to implement projects within the program;

d) Establishing and promulgating operational regulations of the Steering Committee during the program implementation process.

3. The Ministry of Culture, Sports and Tourism leads the organization of evaluation and acceptance of program implementation results according to Article 22 of this Circular.

Article 5. Management of institutional-level tasks

1. Agencies and units under the Ministry of Culture, Sports and Tourism base on development objectives, urgent task needs of their agencies and units, and guidelines for proposing and implementing institutional-level tasks in annual plan guidance documents; they collect and propose institutional-level tasks to be supported financially for implementation in the annual science and technology plan and submit them to the Ministry of Culture, Sports and Tourism.

2. The duration of institutional-level tasks supported financially shall not exceed 12 (twelve) months; when requesting support, these tasks must be approved by the scientific council of the agencies and units (if any); heads of agencies and units with institutional-level tasks supported financially bear responsibility for proposing, approving, managing, and evaluating acceptance; during implementation, the leading organizations and individuals must report regularly and promptly to the Ministry of Culture, Sports and Tourism upon request.

3. The Ministry of Culture, Sports and Tourism conducts regular and spot checks on institutional-level tasks supported financially; if violations are found during implementation, the financial support will be recovered.

4. Agencies and units apply the provisions of this Circular to examine, manage, and evaluate acceptance of institutional-level tasks.

Section 2

ORGANIZATION DETERMINING SCIENTIFIC AND TECHNOLOGICAL TASKS

Article 6. Proposing scientific and technological tasks

1. Basis for proposing scientific and technological tasks:

a) The development strategy of cultural, family, physical education, sports, and tourism fields of the Ministry of Culture, Sports and Tourism;

b) The orientation for the development of science and technology of the Government and the Ministry of Culture, Sports and Tourism;

c) Based on the objectives and research contents of the scientific and technological programs of the Ministry within the planning year and each period;

d) According to the research orders of the Ministry's leadership to address urgent issues of the Ministry through the implementation of scientific and technological tasks;

đ) Based on the need to resolve urgent issues at agencies and units to serve leadership, management, and operation activities at agencies and units;

e) Based on the ability to use the products of scientific and technological tasks in practice.

2. Proposing scientific and technological tasks:

a) Annually, based on the bases stipulated in Clause 1 of this Article, the Ministry of Culture, Sports and Tourism shall notify and guide the proposal of scientific and technological tasks.

b) Object proposing:

- Agencies, units, and individuals under the Ministry of Culture, Sports and Tourism;

- Scientific and technological organizations and individuals engaged in scientific and technological activities not under the Ministry of Culture, Sports and Tourism propose through subordinate agencies and units of the Ministry of Culture, Sports and Tourism.

- Information on the proposal of scientific and technological tasks is recorded according to the format of the Scientific and Technological Task Proposal Form (Annex 1a, Annex 1b).

c) The Department of Science, Technology, and Environment receives proposals and classifies scientific and technological tasks into groups of fields to include them in the preliminary list of scientific and technological tasks.

Article 7. Criteria for determining scientific and technological tasks

1. Criteria for determining topics:

a) Proposed based on the bases stipulated in Clause 1 of Article 6 of this Circular;

b) Scientific significance: New and innovative in science and technology;

c) Practical significance: Directly or contribute to solving urgent theoretical and practical issues; meet the development needs of the cultural, sports, tourism, and family sectors;

d) Feasibility: Consistent with the current scientific and technological capacity of the industry and the country regarding the level of scientific and technological personnel, equipment, facilities, and time for implementation; have the ability to mobilize domestic and foreign resources to meet the requirements of implementing the topic; have a user for the research results.

2. Criteria for determining projects and programs:

a) Proposed based on the bases stipulated in Clause 1 of Article 6 of this Circular;

b) The criteria stipulated in Clause 1 of this Article apply to topics within projects and programs.

3. Criteria for determining experimental production projects:

a) Technical requirements: Demonstrate the stability and reliability of the technology, economic and technical indicators, economic efficiency; have the ability to replace imported technology from abroad; ensure health and environmental safety standards; demonstrate novelty and advancement compared to existing technology in the cultural, sports, and tourism industries and in Vietnam; have an impact on improving the technological level of the industry when widely applied;

b) Market potential: Relevant socio-economic sectors under the management of the Ministry of Culture, Sports and Tourism have demand for project products; project products can compete in quality and price with similar products on the market, replace imported products; project products have export potential;

c) Economic and social benefits: Project products positively impact cultural, sports, and tourism development, create new professions, generate employment and income for the community;

d) Feasibility: Consistent with the scientific and technological capacity of the project's leading organizations and domestically regarding the level of scientific and technological personnel, equipment, facilities, and time for implementation; have the ability to mobilize resources from various sources to meet project requirements; have the ability to collaborate with production bases and other scientific and technological organizations to implement the project; have a market for product consumption (with plans for collaboration in consumption, transfer, or commercialization of project products).

Article 8. Advisory Board for Determining Scientific and Technological Tasks

1. The Minister of Culture, Sports and Tourism shall decide to establish Advisory Boards for Determining Scientific and Technological Tasks (hereinafter referred to as the Task Determination Board) based on the proposal of the Director of the Department of Science, Technology and Environment, according to each field group, to provide advice in determining scientific and technological tasks.

2. Composition of the Task Determination Board:

a) The Task Determination Board consists of from 07 (seven) to 11 (eleven) members including the Chairman, Vice-Chairman, and other members, comprising:

- At least half (one-half) of the members are representatives of agencies and units under the Ministry of Culture, Sports and Tourism related to research fields;

- Scientists inside or outside the Ministry of Culture, Sports and Tourism;

b) Members of the Task Determination Board are experts with credibility, objectivity, appropriate professional qualifications, and deep understanding in the assigned scientific and technological advisory fields.

c) The Secretary of the Task Determination Board is a specialist from the Department of Science, Technology and Environment.

3. Responsibilities of the Task Determination Board:

a) Analyze, evaluate, and make preliminary recommendations regarding the objectives, contents, and expected results of scientific and technological tasks;

b) Advise the Minister of Culture, Sports and Tourism to determine and select proposals to be implemented to effectively serve leadership, management, and development activities of the Ministry;

c) Implement the provisions stipulated in Clauses 4 and 5 of this Article.

4. Principles of Operation of the Task Determination Board:

a) Following democratic principles, members openly discuss the assigned advisory tasks while being responsible for their advisory opinions and not disclosing information about the Board's work;

b) A meeting of the Board must have at least 2/3 (two-thirds) of the members present (written opinions of absent members only have reference value);

c) The Chairman chairs meetings, and in the absence of the Chairman, the Vice-Chairman chairs the meeting;

5. Content of Meetings of the Task Determination Board:

a) Review and analyze each scientific and technological task according to the criteria specified in Article 7 of this Circular;

b) Discuss scientific and technological tasks that meet the required standards for research and resolution at the ministerial level, recommending approval for implementation and non-implementation for those not meeting the criteria specified in Article 7 of this Circular;

c) Board members assess scientific and technological tasks according to the prescribed form;

d) The Board elects a Counting Committee consisting of 03 (three) members, including 01 (one) Head. The counting results are recorded in a minutes document;

đ) Scientific and technological tasks recommended for implementation by the Board must be agreed upon by at least 2/3 (two-thirds) of the present Board members, and these members must ensure that they are not fewer than half (one-half) of the total number of Board members;

e) The Board exchanges, discusses, supplements, or modifies details related to the name, objectives, content, and expected products of each scientific and technological task recommended for implementation by the Board;

g) In cases where a final conclusion cannot be reached, the Board will report to the leadership of the Ministry for decision-making;

h) Meeting minutes of the Board are established along with the list of scientific and technological tasks approved by the Board.

Article 9. Approval of the List of Scientific and Technological Tasks

Based on the results of the Council's determination of scientific and technological tasks and on the proposal of the Director of the Department of Science, Technology and Environment, the Minister of Culture, Sports and Tourism decides to approve the List of scientific and technological tasks for selection or examination.

Section 3

SELECTION, EXAMINATION, REVIEW, APPROVAL OF ORGANIZATIONS AND INDIVIDUALS IN CHARGE OF IMPLEMENTING SCIENTIFIC AND TECHNOLOGICAL TASKS

Article 10. Announcement of Selection and Examination

1. The selection process is announced in writing and publicly through mass media by the Ministry of Culture, Sports and Tourism to allow organizations and individuals meeting the prescribed conditions to register to participate as the main implementers of scientific and technological tasks;

2. The examination process is announced in writing by the Ministry of Culture, Sports and Tourism to the organizations and individuals intended to directly implement the scientific and technological tasks.

Article 11. Conditions for Participation in Selection and Examination

1. For organizations:

a) Organizations registering to be the main implementer of scientific and technological tasks: These are agencies and units under the Ministry of Culture, Sports and Tourism with functions suitable to the field of the registered scientific and technological task;

b) Organizations registering to be the main implementer whose scientific and technological task has exceeded the acceptance deadline by more than 12 (twelve) months from the time of selection and examination registration shall not be allowed to register to implement new scientific and technological tasks;

c) Each organization may only register as the main implementer or a key participant in one application for selection and examination for one scientific and technological task.

2. For individuals:

a) Registration to be the main implementer of scientific and technological tasks through organizations meeting the conditions stipulated in Clause 1 of this Article and satisfying the following criteria:

b) Having relevant expertise and actively operating in the same field of science as the scientific and technological task for at least 03 (three) years up to the submission date of the application;

c) Being the person in charge of organizing the preparation of the Description of the scientific and technological task;

d) Ensuring sufficient capacity, experience, and time to be the main implementer of the scientific and technological task;

đ) Not falling into any of the cases specified in Clause 3 of this Article.

3. Individuals shall not be eligible to participate in the selection and examination to be the main implementer of scientific and technological tasks in the following situations:

a) If, at the time of submitting the application, they are currently implementing 01 (one) Ministry-level scientific and technological task (including cases where the final evaluation report has been rated as "unsatisfactory" and not granted permission by the Ministry to extend the implementation period to complete the results) or the scientific and technological task has been suspended during implementation due to violations by the competent authority;

b) Individuals who have implemented a Ministry-level scientific and technological task but submitted the final evaluation report beyond the contract research deadline without approval from the Ministry of Culture, Sports and Tourism:

- Shall not be eligible to participate in selection and examination for 01 (one) year, starting from the actual date of submission of the final evaluation report, if it was submitted late by 06 (six) months to less than 24 (twenty-four) months;

- Shall not be eligible to participate in selection and examination for 02 (two) years, starting from the actual date of submission of the final evaluation report, if it was submitted late by 24 (twenty-four) months or more.

Article 12. Application for Participation in Selection and Examination

1. Content of the Application:

a) Application form for registration as the main implementer of scientific and technological tasks (Annex No. 2);

b) Description of the scientific and technological task:

- For social science and humanities research topics (Annex No. 3a);

- For scientific research and technology development topics (Annex No. 3b);

- For pilot production projects, the Ministry of Culture, Sports and Tourism will provide direct guidance to the implementing unit;

c) Summary of scientific and technological activities of the organization registering as the main implementer of scientific and technological tasks (Annex No. 4);

d) Scientific curriculum vitae of the individual registering as the main implementer of scientific and technological tasks and other participants (Annex No. 5).

2. The number of applications includes: 01 (one) original copy and 11 (eleven) copies. They can be sent in two forms: in written form and as data files (USB or CD-ROM). The application must be sealed and clearly marked on the outside:

a) Name of the scientific and technological task;

b) Name and address of the organization registering as the main implementer of the scientific and technological task;

c) Full name of the individual registering as the head implementer and list of participants in the scientific and technological task;

d) List of documents and texts included in the application.

3. Deadline for Submission of Applications for Selection and Examination.

a) Applications must be submitted within the deadline specified in the announcement of selection and examination; the receipt date of the application is considered the date stamped by the Hanoi Post Office (in case of mailing); the stamp of the Ministry's Office or the Department of Science, Technology and Environment's administrative office (in case of direct submission);

b) Before the submission deadline, organizations and individuals participating in the selection and examination may withdraw their submitted applications to submit new ones, and are permitted to supplement or modify their submitted applications for selection and examination. All supplements and modifications must be submitted within the prescribed timeframe and become part of the application.

Article 13. Opening the Application File for Selection and Examination

1. Within no more than 15 (fifteen) days from the deadline for submitting the Application File for Selection and Examination, the Department of Science, Technology and Environment shall take the lead in opening the Selection and Examination Application File.

2. The participants in the opening of the Selection and Examination Application File include:

a) A representative of the Ministry of Culture, Sports and Tourism (Ministry leader or Department leader of Science, Technology and Environment);

b) Representatives of relevant agencies and organizations and individuals who have registered to participate in the selection and examination and are invited to attend.

3. The opening of the Selection and Examination Application File shall be recorded in a Minutes.

Article 14. Advisory Board for Selection and Examination of Organizations and Individuals Responsible for Implementing Scientific and Technological Tasks

1. Within no more than 15 (ten) days after the opening of the Application File for Selection and Examination, the Minister of Culture, Sports and Tourism shall decide on the establishment of Advisory Boards for Selection and Examination of Organizations and Individuals Responsible for Implementing Scientific and Technological Tasks (hereinafter referred to as the Selection and Examination Advisory Board) based on the proposal of the Department Head of Science, Technology and Environment according to each field group; within 30 (thirty) days from the date of the decision establishing the Selection and Examination Advisory Boards, the Department of Science, Technology and Environment shall take the lead in organizing meetings of the Advisory Boards in accordance with the provisions of the following Clauses of this Article.

2. Principles of Selection and Examination:

a) The selection and examination shall be conducted through the Selection and Examination Advisory Board and carried out in accordance with the prescribed procedures, ensuring honesty, objectivity, accuracy, and fairness;

b) The evaluation of the Selection and Examination Application File shall be conducted by scoring each Application File participating in the selection and examination;

c) Each scientific and technological task put forward for selection and examination, when meeting the conditions stipulated, will only have one Application File proposed for successful selection.

3. Composition of the Selection and Examination Advisory Board:

a) The Selection and Examination Advisory Board shall consist of from 07 (seven) to 09 (nine) members, including the Chairman, Vice-Chairman, and other members comprising:

- One-third (one third) are representatives of state management agencies related to the application of research results of scientific and technological tasks;

- Two-thirds (two thirds) are reputable scientific and technological researchers with appropriate expertise and deep understanding of the field of science and technology that the Advisory Board is entrusted to advise on selection and examination. Researchers who have participated in priority determination boards may be invited to participate in selection and examination boards;

b) The Secretary of the Selection and Examination Advisory Board is a staff member of the Department of Science, Technology and Environment;

c) Individuals registering to be responsible for scientific and technological tasks and those participating in implementing scientific and technological tasks shall not participate in the Selection and Examination Advisory Board for such tasks (in exceptional cases, those participating in implementing scientific and technological tasks may participate in the Selection and Examination Advisory Board but shall not serve as Chairman or Vice-Chairman).

4. Working Principles:

a) Based on the principle of centralization and democracy; the meeting of the Advisory Board must have at least two-thirds (two-thirds) of the members of the Advisory Board present, including the Chairman or Vice-Chairman;

b) The Chairman of the Advisory Board shall preside over the Advisory Board's meetings. In the absence of the Chairman, the Vice-Chairman shall preside over the Advisory Board's meetings.

5. Responsibilities of Advisory Board Members:

a) To bear personal responsibility and not represent any organization when reviewing and evaluating the Selection and Examination Application File;

b) To comply with the provisions of this Circular, ensuring honest, objective, accurate, and fair evaluation;

c) To bear personal responsibility for their own evaluation results and collective responsibility for the Advisory Board's final conclusion;

d) To keep confidential all information related to the selection and examination process.

6. Content of the Advisory Board Meeting:

a) Members of the Advisory Board independently score according to the evaluation criteria and scale in the following Evaluation Forms: Evaluation Form for Social Science and Humanities Research Topics (Annex 6a); Evaluation Form for Science and Technology Development Research Topics (Annex 6b); b) The Advisory Board appoints three (three) members to join the ballot counting team (the secretary may also join the ballot counting team); the ballot counting results shall be recorded in a Minutes attached to the Meeting Minutes; c) For one Application File, if a member of the Advisory Board scores more than 20% (twenty percent) higher or lower than the average score of the Advisory Board members present, then that member's score will not be accepted. The evaluation result of this Application File will be based solely on the scores given by the remaining members of the Advisory Board;

d) The meeting results of the Advisory Board shall be recorded in a Minutes.

7. Determination of the Successful Selection Application File:

a) The successful Selection and Examination Application File must have an average total score of at least 70/100 (seventy out of one hundred) points;

b) In the case where two or more Application Files of one scientific and technological task achieve an average score of 70/100 (seventy out of one hundred) points, the Advisory Board shall rank the Application Files according to the following principles:

- If the Application Files have the same average total score, the Application File with a higher score from the Chairman of the Advisory Board (or the Vice-Chairman in the absence of the Chairman) will be prioritized;

- If the Application Files have the same average total score and the Chairman of the Advisory Board (or the Vice-Chairman in the absence of the Chairman) has the same score for these Application Files, the Advisory Board shall recommend the leadership of the Ministry to consider and decide.

- Average total scores in descending order;

- In cases where the total average scores of the Files are equal, the File with a higher score from the Chairman of the Council (or the Vice-Chairman's score in the absence of the Chairman of the Council) shall be prioritized for ranking;

- In cases where the total average scores of the Files are the same, and the scores from the Chairman of the Council (or the Vice-Chairman's score in the absence of the Chairman of the Council) for these Files are also equal, the Council will recommend that the Ministry Leadership consider and decide;

Article 15. Approval of the List of Selected Scientific and Technological Tasks

1. Based on the results of the Selection and Evaluation Committees' work and on the proposal of the Director of the Science, Technology and Environment Department, the Minister of Culture, Sports and Tourism shall decide to approve the List of Selected Scientific and Technological Tasks for evaluation.

2. For individuals who simultaneously apply to lead two or more Ministry-level scientific and technological tasks, if all application files for selection and evaluation are proposed to be selected, they may only choose to lead one scientific and technological task. The choice must be submitted in writing to the Ministry of Culture, Sports and Tourism for consideration and decision.

3. Announcing the results of selection and evaluation:

The results of selection and evaluation will be announced by the Ministry of Culture, Sports and Tourism to the organizations and individuals leading the implementation of scientific and technological tasks immediately after the decision to approve the List of Selected Scientific and Technological Tasks for evaluation to complete the Detailed Description of the scientific and technological task for evaluation. Article 16. Organization of Content and Budget Review of Selected Scientific and Technological Tasks

1. The Minister of Culture, Sports and Tourism shall decide to establish Review Teams based on the proposal of the Director of the Science, Technology and Environment Department according to the List of Selected Scientific and Technological Tasks for selection and evaluation.

2. The composition of the Review Teams includes representatives from the Ministry of Culture, Sports and Tourism, the Selection and Evaluation Committee for scientific and technological tasks, the Science, Technology and Environment Department, the Planning and Finance Department, and related organizations and individuals.

3. Responsibilities of the Review Teams:

a) Examine and check the amendments to the content in the Detailed Description of the scientific and technological task according to the opinions of the Selection and Evaluation Committee;

b) Examine and check the assessment of the budget for implementing the scientific and technological task applied according to current regulations;

c) The results of the Review Teams' work shall be recorded in a Minutes.

4. Representatives of the organizations and individuals leading the implementation of the scientific and technological task are invited to attend the review meeting.

5. Based on the results of the Review Teams' work and the proposal of the Director of the Science, Technology and Environment Department, the Minister of Culture, Sports and Tourism shall consider and decide to approve the scientific and technological task for implementation.

IMPLEMENTATION OF SCIENTIFIC AND TECHNOLOGICAL TASKS

Section 4

Article 17. Contract for Implementing Scientific and Technological Tasks

1. The scientific and technological task is implemented through

a Research and Development Contract (hereinafter referred to as the Contract) signed between the ordering party (Party A) which is the Ministry of Culture, Sports and Tourism and the contracted party (Party B) which is the leading organization (departments and units under the Ministry of Culture, Sports and Tourism with their own seals and bank accounts) and individuals selected to lead the implementation of the approved scientific and technological task for implementation in the planned year. In cases where the leading organization is departments and units under the Ministry without their own seals and bank accounts, the Office of the Ministry will also sign the Contract as the account holder. 2. Signing the Contract:

a) Within fifteen days from the date the Ministry of Culture, Sports and Tourism announces, the organizations and individuals leading the implementation of the scientific and technological task shall complete the Contract in accordance with the regulations and submit it to the Ministry of Culture, Sports and Tourism for signature and implementation;

b) The Director of the Science, Technology and Environment Department, acting on behalf of the Minister of Culture, Sports and Tourism, shall sign the Contract with the organizations and individuals leading the implementation of the scientific and technological task;

c) The contents of the Contract shall be agreed upon by the parties involved, based on the prescribed model

(Annex 7). (Appendix No. 7).

Article 18. Adjustment of Contract

1. Adjustment of work content and budget estimate:

a) Work items that the contractor can proactively adjust according to the requirements of the job:

- The budget estimate between allocated expenditure items within the total allocated budget estimate for the scientific and technological task as stipulated in Circular Joint No. 93/2006/TTLT/BTC-BKHCN dated October 4, 2006, issued by the Ministry of Finance and the Ministry of Science and Technology guiding the allocation system of funds for scientific and technological projects using state budget;

- Adjusting the name and research content of branches and sub-topics of the scientific and technological task.

b) Matters requiring the consent of the client:

- In cases where it is necessary to change the objectives and main contents of the scientific and technological task to suit actual circumstances, the contractor must submit a proposal in writing to the Ministry of Culture, Sports and Tourism for consideration and decision on adjustment;

- If changing the objectives, main contents, and implementation schedule of the scientific and technological task leads to changes in funding, the contractor must prepare an adjusted budget estimate for the Ministry of Culture, Sports and Tourism to consider and decide on adjustment;

- If the contractor wishes to propose changes to the budget estimates of non-allocated expenditure items of the scientific and technological task, they must submit a proposal in writing to the Ministry of Culture, Sports and Tourism for consideration and decision on adjustment.

2. Adjustment of the time for implementing the scientific and technological task:

a) Before the deadline specified in the Contract, if the organization or individual in charge has not completed the content of the scientific and technological task as stipulated in the signed Contract, they must report to the Ministry of Culture, Sports and Tourism for consideration and adjustment of the implementation time of the scientific and technological task, including the following documents:

- A request for extension of the implementation period of the scientific and technological task from the principal individual, specifying the specific reasons leading to delays in the implementation of the scientific and technological task; a report on the implementation status of the scientific and technological task at the time of requesting an extension (both documents must be confirmed by the organization in charge of implementing the scientific and technological task);

- A letter proposing an extension of the implementation period from the organization in charge of implementing the scientific and technological task;

b) In cases where the scientific and technological task is approved for extension, the extension period will be calculated from the end date of the Contract and will be specifically stipulated in the agreement document by the Ministry of Culture, Sports and Tourism.

3. Decisions on adjustments and related documents are part of the Contract.

Section 5

EVALUATION AND ACCEPTANCE OF THE RESULTS OF IMPLEMENTING THE SCIENTIFIC AND TECHNOLOGICAL TASK

Article 19. Principles and methods of evaluation and acceptance of the scientific and technological task

1. Principles of evaluation and acceptance:

a) The evaluation and acceptance of the scientific and technological task must be conducted objectively, democratically, ensuring the rights and obligations of the organizations and individuals in charge of implementing the scientific and technological task and the Ministry of Culture, Sports and Tourism in accordance with current laws;

b) The evaluation and acceptance of the scientific and technological task must be based on the signed Contract, carried out strictly according to procedures, ensuring seriousness, honesty, objectivity, accuracy, and fairness;

c) The classification of results of the scientific and technological task must be based on a comprehensive assessment with concrete evidence against specific criteria, focusing on the quality of science and the effectiveness of the scientific and technological task in practice.

2. Methods of evaluation and acceptance of the scientific and technological task:

a) Conducted in two levels:

- Evaluation and acceptance at the basic level: This is a preparatory step for evaluation and acceptance at the ministerial level, conducted before the Contract's deadline, at the latest by the Contract's deadline, to examine the conditions for making a formal evaluation and acceptance at the ministerial level;

- Evaluation and acceptance at the ministerial level: This is the final evaluation and acceptance step, conducted after receiving the results of the basic-level evaluation and acceptance, to comprehensively assess the results of the scientific and technological task against the signed Contract.

b) The Evaluation and Acceptance Council conducts the evaluation and acceptance of the scientific and technological task through a public meeting of the Council, including written comments from Council members and voting on the evaluation and classification of the scientific and technological task.

Article 20. Organizing the Final Acceptance Evaluation at the Basic Level

1. Time for organizing the final acceptance evaluation at the basic level:

a) Before the end of the period specified in the Contract, the principal individual shall be responsible for completing the Basic Level Final Acceptance Evaluation File and submitting it to the organization implementing the project;

b) Within 15 (fifteen) days from the date of receipt of the Basic Level Evaluation File, the implementing organization must conduct inspection, review, and ensure that the scientific and technological task has all necessary files to proceed with the basic level evaluation as stipulated in Clause 2 of this Article; decide to establish the Basic Level Final Acceptance Evaluation Board (hereinafter referred to as the Basic Level Board);

c) The meeting of the Basic Level Board shall be organized no later than 15 (fifteen) days from the date of the Decision establishing the Board and at least 7 (seven) days after the members of the Basic Level Board have received the Final Acceptance Evaluation File.

2. The Basic Level Final Acceptance Evaluation File includes:

a) The Contract and related documents during the implementation of the scientific and technological task;

b) The Task Description File of the scientific and technological task;

c) All scientific products of the scientific and technological task;

d) Report on the results of testing or applying scientific and technological products of the scientific and technological task (if any), comments and evaluations from organizations and individuals regarding the use of these products;

đ) The request for basic level final acceptance evaluation submitted by the principal individual.

3. The Basic Level Board:

a) Number and composition of the Basic Level Board:

The Basic Level Board consists of 7 (seven) to 9 (nine) members who are scientists and managers with competence, credibility, expertise in the specialized field of the scientific and technological task, and not included in the list of participants in the implementation of the scientific and technological task, including at least half of the members of the Basic Level Board who are not part of the implementing organization;

b) Composition of the Basic Level Board includes:

Chairman of the Board, 2 (two) Review Members, 1 (one) Secretary Member, and other Members.

c) Responsibilities of the Basic Level Board Members:

- Studying the File, reviewing, and evaluating the results of the scientific and technological task in writing;

- Proposing issues to be supplemented or modified to improve the products of the scientific and technological task;

- Not disclosing, providing information, or using the results of the scientific and technological task without the consent of the implementing organization or individual;

- Being personally responsible for their evaluation and classification of the scientific and technological task.

d) In addition to the responsibilities of the Basic Level Board Members as stipulated in Point c, Clause 3 of this Article, the Chairman, Review Members, and Secretary Member also have the following responsibilities:

- The Chairman is responsible for checking the conditions as stipulated in Point b, Clause 4 of this Article to hold the Board meeting; chairing and controlling the Program of the Basic Level Board meeting;

- The Review Members are responsible for checking and reviewing the entire File of the scientific and technological task against the Contract; providing comprehensive comments and evaluations on the results of the scientific and technological task and recommending whether the task meets the conditions for national-level final acceptance evaluation;

- The Secretary Member is responsible for assisting the Chairman in verifying the legality and completeness of the File as stipulated in Clause 2 of this Article, completing the Minutes and other documents of the Basic Level Board meeting.

4. Meeting of the Basic Level Board:

a) The main participants in the meeting of the Basic Level Board include: Members of the Basic Level Board; representatives of the Science, Technology, and Environment Department (if any); organizations and individuals involved in the implementation of the scientific and technological task;

b) The meeting of the Basic Level Board will be held when the following conditions are met:

- The Basic Level Evaluation File is complete and valid;

- There are written comments from 2 (two) Review Members and other members of the Basic Level Board;

- At least 2/3 (two-thirds) of the members of the Basic Level Board are present at the meeting, including the Chairman and 2 (two) Review Members.

5. Evaluation and Classification of the Scientific and Technological Task in the Meeting of the Basic Level Board:

a) The Basic Level Board bases its evaluation and classification of the scientific and technological task on the Contract, the Task Description, and the results of the task as presented in the comprehensive research result report and the presentation by the principal individual before the Basic Level Board, according to the model prescribed in Appendix 8 with two levels: "pass" or "fail". The evaluation and classification results of the scientific and technological task are recorded in the Minutes and form part of the File requesting national-level final acceptance evaluation. b) The scientific and technological task is classified as meeting the conditions for national-level final acceptance evaluation if it satisfies the following criteria:

- Ensuring the volume and quality of research, including: completing the workload and research objectives and contents specified in the Contract; reliable and scientifically valuable documentation and data; ensuring the quantity and quality of intermediate scientific products specified in the Contract; a comprehensive research result report with a reasonable structure, clearly presented, scientifically valuable, and suitable for the research objectives and contents;

- Submitting the Basic Level Evaluation File within the time limit specified in the signed Contract or the extension document issued by the Ministry of Culture, Sports and Tourism in cases where the scientific and technological task has been extended for the basic level final acceptance evaluation period;

- At least 3/4 (three-quarters) of the members present at the meeting vote and classify as meeting the conditions.

c) The scientific and technological task is classified as not meeting the conditions if it fails to meet any of the criteria specified in Point b of this Clause;

d) The results of the Basic Level Board meeting are recorded in the Minutes and form part of the File requesting national-level final acceptance evaluation.

d) The results of the meeting of the basic-level Council are recorded in the Minutes and form part of the File for requesting evaluation and acceptance at the Ministry level.

Article 21. Handling the Results of Acceptance Evaluation at the Basic Level

1. For scientific and technological tasks classified as "achieved":

After the scientific documents and files of the scientific and technological task have been supplemented, corrected, and perfected according to the requirements of the Basic Level Council, the organizing entity shall submit a written request to the Ministry of Culture, Sports and Tourism for consideration and decision on conducting acceptance evaluation at the Ministry level.

2. For scientific and technological tasks classified as "unachieved":

The Basic Level Council shall clearly state the reasons and propose that the scientific and technological task be continued to be perfected or halted in the following cases:

a) Scientific and technological tasks classified as "unachieved" due to insufficient quantity or quality of research, the principal individual must supplement, modify, and perfect the task's file according to the opinions of the Basic Level Council and reapply for basic-level evaluation within thirty days from the date of the Council's conclusion. If this deadline is not met, the principal organization or individual must submit a written request to the Ministry of Culture, Sports and Tourism for consideration and decision regarding extending the time to complete the task's product or halting the task.

b) Scientific and technological tasks classified as "unachieved" due to untruthful documents, plagiarized research results, or violation of laws during implementation, the organizing entity has the responsibility to review and submit a written request to the Ministry of Culture, Sports and Tourism to halt the task.

Article 22. Organization of Acceptance Evaluation at the Ministry Level

1. The application for acceptance evaluation at the Ministry level includes:

a) The basic-level evaluation file that has been supplemented, modified, and perfected according to the requirements of the Basic Level Council;

b) Original copies of the following documents: Decision establishing the Basic Level Council; Minutes of the Council's meeting; comments and evaluations of the scientific and technological task by members of the Basic Level Council; Evaluation forms and Minutes of the vote;

c) A written request for acceptance evaluation at the Ministry level from the organizing entity;

d) Quantity of files: 01 (one) set

2. Timeframe for acceptance evaluation at the Ministry level:

a) Within thirty days from the date of the Basic Level Council's conclusion, the principal organization or individual implementing the scientific and technological task must complete the basic-level acceptance evaluation file and submit it to the Ministry of Culture, Sports and Tourism;

b) In case the above deadline is not met, the principal organization or individual must submit a written request to the Ministry of Culture, Sports and Tourism for consideration and decision on extending the time to complete the file. If extended, the period cannot exceed sixty days from the date of the Basic Level Council's conclusion;

c) Within fifteen days from receiving the application for acceptance evaluation at the Ministry level, the Department of Science, Technology and Environment is responsible for reviewing the file and ensuring it meets the conditions for Ministry-level acceptance evaluation, and submitting to the Minister of Culture, Sports and Tourism to establish the Ministry-level Acceptance Evaluation Council (hereinafter referred to as the Ministry-level Acceptance Council);

d) Within thirty days from the date of the decision to establish the Ministry-level Acceptance Council, the Department of Science, Technology and Environment is responsible for preparing, organizing meetings, and appointing administrative secretaries to assist the Ministry-level Acceptance Council;

đ) At least seven days before the meeting, the principal organization or individual implementing the task must send the application for acceptance evaluation at the Ministry level, the decision to establish the Ministry-level Acceptance Council, and meeting invitations to the Council members.

3. Expert Team for Reviewing Scientific and Technological Products:

a) The Minister of Culture, Sports and Tourism decides to establish an expert team for reviewing scientific and technological products based on the proposal of the Department Head of Science, Technology and Environment to review scientific and technological products with measurable technical parameters (including computer software) resulting from scientific and technological tasks.

b) Number and composition: The expert team consists of three to five members, including Council members or experts outside the Council, with the Council Chair serving as the Team Leader.

c) Responsibilities of the Expert Team:

Checking, evaluating, and reviewing scientific and technological products with measurable technical parameters of the scientific and technological task against the contract requirements and preparing a review report with the main contents as follows:

- Degree of completion of the basic volume compared to the contract;

- Degree of completion and authenticity of the basic indicators of the products of the scientific and technological task compared to the requirements stated in the contract;

- Comments, evaluations, and recommendations for improving the products of the scientific and technological task.

4. Ministry-level Acceptance Council:

a) Number and composition:

The Ministry-level Acceptance Council consists of nine to eleven members who are capable scientists and managers knowledgeable in the specialized field of the scientific and technological task, not involved in the implementation of the task, and not affiliated with the organizing entity. The Council includes a Chair, two opposing members, a secretary member, and other members.

b) Responsibilities of the Ministry-level Acceptance Council members:

- Studying the file, examining, and evaluating the results of the scientific and technological task in writing according to the prescribed model (Annex 9); - Not disclosing, providing information, or using the results of the scientific and technological task without the consent of the Ministry of Culture, Sports and Tourism, the organizing entity, and the principal individual implementing the task;

- Proposing issues to be supplemented or modified to improve the products of the scientific and technological task;

c) In addition to the responsibilities of the Council members stipulated in point b Clause 4 of this Article, the Chair, opposing members, and secretary members also have the following responsibilities:

- Being personally responsible for their evaluation and classification of the scientific and technological task.

- The Chair is responsible for checking the conditions specified in point b Clause 5 of this Article to conduct the Council meeting; chairing and controlling the program of the Ministry-level Acceptance Council meeting;

- Opposing members are responsible for reviewing and verifying the entire file of the scientific and technological task against the contract and task description; providing opposing opinions, comprehensive evaluations of the task's results, and recommendations for issues to improve and perfect the task.

- The reviewer member is responsible for checking and appraising the entire File of the scientific and technological task against the Contract and the Task Description of the scientific and technological task; providing comprehensive comments and evaluations on the results of the scientific and technological task and recommending issues to revise and perfect the scientific and technological task;

- The secretary member is responsible for recording and finalizing the Minutes of the meeting and the documents of the session of the Ministry-level Acceptance Council.

5. Session of the Ministry-level Acceptance Council:

a) The main components participating in the session of the Ministry-level Acceptance Council include: Members of the Council; members of the Expert Group who are not members of the Council and are invited to attend; representatives of the Ministry of Culture, Sports and Tourism; representatives of the organization primarily implementing the scientific and technological task and other organizations and individuals related to the implementation of the scientific and technological task;

b) The session of the Council shall be held when the following conditions are met:

- The dossier for the Ministry-level acceptance evaluation is complete and valid;

- There are written comments from two (2) Reviewing Members and other members of the Ministry-level Acceptance Council;

- The assessment report of the Expert Group (if any);

- At least two-thirds (2/3) of the members of the Ministry-level Acceptance Council are present at the session, including the Chairman of the Council and two (2) Reviewing Members.

6. Evaluation and classification of the scientific and technological task in the session of the Ministry-level Acceptance Council:

a) The Ministry-level Acceptance Council bases its evaluation on the signed Contract; the Task Description; the research results presented through the comprehensive research result report and the presentation content by the principal before the Ministry-level Acceptance Council; the assessment report of the Expert Group (if any) to score the scientific and technological task;

b) Based on the opinions of the members, the Ministry-level Acceptance Council proceeds to discuss and score the scientific and technological task according to a scale of 100 points (Annex 10) with the following contents:

- Research methodology;

- Scientific value of the research results;

- Practical value of the research results;

- Implementation organization.

c) Based on the score of the scientific and technological task, the Ministry-level Acceptance Council will proceed with the classification as follows:

- Classify as "outstanding" if the average score is 85 (eighty-five) points or higher, where the scientific value part reaches 55 (fifty-five) points or higher and the application value and practical value of the scientific and technological task's results reach 20 (twenty) points or higher;

- Classify as "good" in cases where the average score is from 65 (sixty-five) to less than 85 (eighty-five) points or the average score is 85 points or higher but the score for the scientific value part is below 55 (fifty-five) or the score for the application value and practical value of the scientific and technological task's results is below 20 (twenty);

- Classify as "average" if the average score is from 50 (fifty) to less than 65 (sixty-five) points;

- Classify as "unsatisfactory" if the average score is below 50 (fifty) points;

- In cases where the acceptance dossier is submitted late compared to the signed scientific contract without a written agreement from the Ministry of Culture, Sports and Tourism, the scientific and technological task will be downgraded by one level in classification.

d) The results of the voting for the evaluation and classification of the scientific and technological task by the Council are recorded in the Minutes according to the prescribed form (Annex 11);

đ) In necessary cases, the Council may request the principal to submit the scientific product of the scientific and technological task for revision to the designated members of the Council for verification and comparison with the Council's conclusion. The comments of the members are an indispensable part of the dossier for the Ministry of Culture, Sports and Tourism to consider and officially accept the results of the scientific and technological task.

Article 23. Handling the Results of Scientific and Technological Task Acceptance Evaluation

1. For scientific and technological tasks classified as excellent, good, or average:

a) The organization or individual primarily responsible for implementing the scientific and technological task must supplement and complete the task according to the comments of the Ministry-level Acceptance Council, submit the research product of the scientific and technological task along with a report explaining the adoption and revision based on the Council's opinions, and any review documents from designated members checking the adoption and revision (if applicable) to the Ministry of Culture, Sports and Tourism within 15 (fifteen) days from the date of the acceptance council's evaluation results and classification;

b) The Science, Technology and Environment Department shall be responsible for reviewing the application for recognition of the results of the implementation of the scientific and technological task, and submitting it to the Minister of Culture, Sports and Tourism for a decision to recognize the results of the implementation of the scientific and technological task based on the evaluation opinions, conclusions, and classifications of the Ministry-level Acceptance Council;

c) The classification result will be recorded in the decision recognizing the results of the implementation of the scientific and technological task by the Minister of Culture, Sports and Tourism.

2. For scientific and technological tasks classified as "unsatisfactory":

a) The Ministry-level Acceptance Council may recommend re-acceptance or not to re-accept. Within 15 (fifteen) days from the date of the Ministry-level Acceptance Council's conclusion, the Ministry of Culture, Sports and Tourism decides whether to extend the deadline for repairing and completing the scientific and technological task and redoing the Ministry-level acceptance evaluation process based on the recommendation for re-acceptance from the Ministry-level Acceptance Council. The extension period for repairing and completing the scientific and technological task shall not exceed 90 (ninety) days from the date of the Ministry-level Acceptance Council's conclusion;

b) In cases where the scientific and technological task is not extended or extended but still fails upon the second Ministry-level acceptance, the primary individual responsible for the scientific and technological task will not be allowed to lead a Ministry-level scientific and technological task for the next three years and must compensate for the expenses according to regulations.

3. Contract Termination:

a) For scientific and technological tasks that have ended and been evaluated by the Ministry-level Acceptance Council as meeting requirements, when the Ministry of Culture, Sports and Tourism makes a decision recognizing the results of the implementation of the scientific and technological task, the relevant parties shall proceed with contract termination according to regulations;

b) When the scientific and technological task has ended but does not meet the requirements upon acceptance, the ordering party shall consider settling the payment to the receiving party based on the Council's conclusion regarding responsibility and determination of the work content completed by the receiving party.

4. Settlement of Financial Expenses for Implementing Scientific and Technological Tasks:

a) The financial expenses allocated for the implementation of scientific and technological tasks in a given year must be settled according to the budget year's fiscal regulations. For scientific and technological tasks implemented over multiple years, the organization or individual primarily responsible must settle annually according to the budget year for the actual received and expended funds. Upon completion of the scientific and technological task, a cumulative settlement from the start of implementation to the reporting year must be conducted;

b) After the decision recognizing the results of the implementation of the scientific and technological task by the Minister of Culture, Sports and Tourism, the organization or individual primarily responsible for implementing the scientific and technological task must register, hand over, and retain the results of the scientific and technological task according to Article 24 of this Circular. The organization or individual primarily responsible for implementing the scientific and technological task shall proceed with the financial settlement procedures for the scientific and technological task according to current regulations.

Chapter 6

REGISTRATION, RETENTION AND USE OF RESEARCH RESULTS

Article 24. Registration, handover, and storage of results from implementing scientific and technological tasks

1. Within thirty (30) days from the date the Ministry of Culture, Sports and Tourism recognizes the results, the organization or individual primarily responsible for the scientific and technological task must complete registration procedures for research results and submit them for archival storage at the National Science and Technology Information Center in accordance with Decision No. 03/2007/QĐ-BKHCN dated March 16, 2007, issued by the Minister of Science and Technology on the issuance of the Regulation on "Registration, Storage, and Utilization of Results from Implementing Scientific and Technological Tasks."

2. The organization or individual primarily responsible for the scientific and technological task must hand over the research results to the Ministry of Culture, Sports and Tourism (Department of Science, Technology, and Environment). Paper-based results must be bound in hard covers and accompanied by electronic versions (recorded on CDs or USB drives). The handover of research results shall be documented in a Record.

3. In cases where the organization or individual primarily responsible for the scientific and technological task fails to register or submit the results of the implementation of the scientific and technological task, they will be subject to penalties as stipulated in Decree No. 127/2004/NĐ-CP dated May 31, 2004, issued by the Government regarding administrative sanctions for violations in scientific and technological activities.

Article 25. Publication and utilization of research results from scientific and technological tasks

1. Responsibilities of the Department of Science, Technology, and Environment:

a) Annually inform relevant agencies and units under the Ministry about the research results of completed scientific and technological tasks so that these agencies and units can apply for registration (according to plan or on an ad hoc basis) to utilize the research results;

b) Lead the development of an electronic information page on scientific and technological tasks of the Ministry and manage the database, regularly updating the database and publishing bibliographic information on recognized research results from implemented scientific and technological tasks;

c) Preserve research results and related documents of recognized scientific and technological tasks to disseminate and hand over (copies) all research results of the scientific and technological task to agencies and units that have registered to apply the research results;

d) Annually coordinate with agencies and units that have registered and implemented the application of research results from scientific and technological tasks to conduct surveys and evaluate the effectiveness of such applications.

2. Responsibilities of organizations and individuals primarily responsible for implementing scientific and technological tasks:

Guide and cooperate with applying agencies and units to implement the practical application of research results.

3. Responsibilities of agencies and units under the Ministry of Culture, Sports and Tourism:

a) Based on the functions and responsibilities of the agencies and units and the research results of recognized scientific and technological tasks, agencies and units under the Ministry of Culture, Sports and Tourism (especially those recommended to use the research results of scientific and technological tasks) should register to apply the research results with the Department of Science, Technology, and Environment;

b) According to the requirements of the Department of Science, Technology, and Environment, agencies and units applying the research results report on the evaluation of the effectiveness of the application periodically or on an ad hoc basis.

Article 26. Awards and Handling Violations

1. Rewards:

Organizations and individuals primarily responsible for implementing scientific and technological tasks that achieve outstanding results with significant scientific and practical value; agencies and units that effectively apply the research results of scientific and technological tasks in practice are recommended to be considered for awards by the Minister of Culture, Sports and Tourism according to current regulations.

2. Handling Violations:

a) Organizations and individuals primarily responsible for implementing scientific and technological tasks that fail to complete their assigned tasks as stipulated in the Contract and Detailed Task Description approved shall bear responsibility according to the terms of the Contract and relevant laws;

b) Heads of organizations primarily responsible for implementing scientific and technological tasks who fail to complete the tasks shall be subject to corresponding disciplinary actions by the Minister of Culture, Sports and Tourism depending on the nature and severity of the violation;

c) Organizations and individuals violating the provisions of this Circular shall be subject to handling according to current regulations based on the nature and severity of the violation.

Section 7

IMPLEMENTATION

Article 27. Implementation Provisions

1. This Circular takes effect from May 15, 2012.

2. The following Appendices are hereby promulgated:

- Appendix 1a: Sample Application Form for Ministry-level Scientific and Technological Tasks in the form of Research Topics;

- Appendix 1b: Sample Application Form for Ministry-level Scientific and Technological Tasks in the form of Pilot Production Projects;

- Appendix 2: Sample Application Form for Principal Implementation of Ministry-level Research Topics and Projects;

- Appendix 3a: Sample Detailed Description of Ministry-level Social Sciences and Humanities Research Topics;

- Appendix 3b: Sample Detailed Description of Ministry-level Scientific Research and Technological Development Topics;

- Appendix 4: Sample Summary of Scientific and Technological Activities of Organizations Applying to Be Principally Responsible for Research Topics and Projects;

- Appendix 5: Sample Academic Resume of Individuals Implementing Scientific and Technological Tasks;

- Appendix 6a: Sample Evaluation Form of the Advisory Committee for Selection and Review of Ministry-level Social Sciences and Humanities Research Topics;

- Appendix 6b: Sample Evaluation Form of the Advisory Committee for Selection and Review of Ministry-level Scientific Research and Technological Development Topics;

- Appendix 7: Sample Contract;

- Appendix 8: Sample Evaluation and Classification Form for Scientific and Technological Tasks (for Organizational Review Committees);

- Appendix 9: Sample Evaluation and Classification Form for Scientific and Technological Tasks (for Ministry-level Acceptance Review Committees);

- Appendix 10: Sample Scoring Form for Ministry-level Scientific and Technological Tasks;

- Appendix 11: Sample Consolidation Form of Scores for Acceptance Review of Ministry-level Scientific and Technological Tasks;

3. Repeal the following documents and provisions:

a) Decision No. 05/2007/QĐ-BVHTT dated February 12, 2007, issued by the Minister of Culture-Information on the Management Regulations for Scientific and Technological Tasks of the Ministry of Culture-Information;

b) Circular No. 05/2010/TT-BVHTTDL dated July 7, 2010, on the Examination and Approval of Scientific and Technological Research Topics and Pilot Production Projects of the Ministry of Culture, Sports and Tourism;

c) Provisions previously issued by the Ministry of Culture-Information, the Sports and Physical Training Commission, the General Administration of Tourism, and the Ministry of Culture, Sports and Tourism that are not included in the documents and provisions mentioned in points a and b of Clause 3 of this Article and which conflict with the provisions of this Circular are hereby repealed.

Article 28. Implementation Organization

1. The Department of Science, Technology, and Environment is responsible for monitoring, supervising, and inspecting the implementation of this Circular.

2. The heads of relevant agencies and units shall be responsible for widely and regularly disseminating, fully and accurately implementing, and publicly announcing the provisions of this Circular.

3. In the course of implementation, if there are issues requiring supplementation or amendment, the agencies and units, organizations, and individuals concerned shall report to the Ministry of Culture, Sports and Tourism for study and amendment./.
