REGULATING CONTENT AND CURRICULA FOR TRAININGfor seafarers and inland waterway vessel operators

BASED ON THE INLAND WATERWAY TRANSPORT LAW dated June 15, 2004 and THE AMENDMENT AND SUPPLEMENT TO CERTAIN PROVISIONS OF THE INLAND WATERWAY TRANSPORT LAW dated June 17, 2014;
Pursuant to the Law on Vocational Education dated November 27, 2014;
BASED ON DECREE NO. 78/2016/NĐ-CP dated July 1, 2016 of the Government stipulating conditions for operating waterway transport crew training services;
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
AT THE SUGGESTION OF THE HEAD OF THE ORGANIZATION AND STAFF AFFAIRS DEPARTMENT AND THE DIRECTOR OF THE VIETNAM INLAND WATERWAY ADMINISTRATION;
The Minister of Transport hereby promulgates this Circular stipulating the content and training program for seafarers and inland waterway vessel operators.
Chapter I
GENERAL PROVISIONS
Article 1. Scope of Regulation
THIS CIRCULAR REGULATES THE CONTENT AND CURRICULA FOR TRAINING WATERWAY TRANSPORT CREWS AND WATERWAY VESSEL OPERATORS.
Article 2. Applicability
1. THIS CIRCULAR APPLIES TO ENTITIES OPERATING WATERWAY TRANSPORT CREW TRAINING SERVICES (HEREINAFTER REFERRED TO AS TRAINING ENTITIES) AND AUTHORITIES, ORGANIZATIONS, AND INDIVIDUALS RELATED TO WATERWAY TRANSPORT CREW TRAINING ACTIVITIES IN VIETNAM.
2. THIS CIRCULAR DOES NOT APPLY TO WATERWAY TRANSPORT CREW TRAINING ACTIVITIES CONDUCTED BY MILITARY AND POLICE FOR NATIONAL DEFENSE AND SECURITY TASKS.
Chapter II
REGULATIONS ON THE CONTENT AND TRAINING PROGRAM FOR SEAFARERS AND INLAND WATERWAY VESSEL OPERATORS
Article 3. Curricula for Training Waterway Transport Crews and Waterway Vessel Operators
1. The curriculum for first-class seafarer training is specified in Appendix I attached to this Circular.
2. The curriculum for first-class engineer training is specified in Appendix II attached to this Circular.
3. The curriculum for first-class waterway vessel operator training is specified in Appendix III attached to this Circular.
Article 4. Curricula for Upgrading Competency Certificates of Waterway Transport Crews and Waterway Vessel Operators
1. The curriculum for upgrading competency certificates for fourth-class master is specified in Appendix IV attached to this Circular.
2. The curriculum for upgrading competency certificates for third-class master is specified in Appendix V attached to this Circular.
3. The curriculum for upgrading competency certificates for second-class master is specified in Appendix VI attached to this Circular.
4. The curriculum for upgrading competency certificates for first-class master is specified in Appendix VII attached to this Circular.
5. The curriculum for upgrading competency certificates for third-class chief engineer is specified in Appendix VIII attached to this Circular.
6. The curriculum for upgrading competency certificates for second-class chief engineer is specified in Appendix IX attached to this Circular.
7. The curriculum for upgrading competency certificates for first-class chief engineer is specified in Appendix X attached to this Circular.
Article 5. Curricula for Issuing Specialized Certificates for Waterway Transport Crews and Waterway Vessel Operators
1. The curriculum for issuing certificates for controlling high-speed vessels of type I is specified in Appendix XI attached to this Circular.
2. The curriculum for issuing certificates for controlling high-speed vessels of type II is specified in Appendix XII attached to this Circular.
3. The curriculum for issuing certificates for controlling inland waterway vessels navigating coastal waters is specified in Appendix XIII attached to this Circular.
4. The curriculum for issuing certificates for safe work on inland waterway vessels navigating coastal waters is specified in Appendix XIV attached to this Circular.
5. The curriculum for issuing certificates for safe work on vessels carrying petroleum products is specified in Appendix XV attached to this Circular.
6. The curriculum for issuing certificates for safe work on vessels carrying chemicals is specified in Appendix XVI attached to this Circular.
7. The curriculum for issuing certificates for safe work on vessels carrying liquefied gases is specified in Appendix XVII attached to this Circular.
8. The curriculum for issuing second-class seafarer certificates is specified in Appendix XVIII attached to this Circular.
9. The curriculum for issuing second-class engineer certificates is specified in Appendix XIX attached to this Circular.
10. The curriculum for issuing second-class waterway vessel operator certificates is specified in Appendix XX attached to this Circular.
11. The curriculum for issuing certificates of study on inland waterway transport laws is specified in Appendix XXI attached to this Circular.
Chapter III
IMPLEMENTING PROVISIONS
Article 6. Responsibility for Implementation
1. DIRECTOR OF THE VIETNAM INLAND WATERWAY ADMINISTRATION:
a) IMPLEMENTS THIS CIRCULAR; MONITORS TRAINING ACTIVITIES FOR WATERWAY TRANSPORT CREWS AND WATERWAY VESSEL OPERATORS.
b) CHAIRS AND COORDINATES WITH TRAINING ENTITIES TO COMPILE AND ANNOUNCE A QUESTION BANK FOR EXAMS AND TESTS AND THEIR ANSWERS AS OFFICIAL EXAMINATION AND TESTING MATERIALS ACROSS THE COUNTRY.
2. DIRECTORS OF PROVINCE TRANSPORT DEPARTMENTS IMPLEMENT THIS CIRCULAR WITHIN THEIR RESPONSIBILITIES; ENSURE REPORTING IN ACCORDANCE WITH REGULATIONS.
3. HEADS OF TRAINING ENTITIES:
a) ENSURE REPORTING AND ARE SUBJECT TO SUPERVISION, GUIDANCE ON BUSINESS PROCEDURES FROM THE VIETNAM INLAND WATERWAY ADMINISTRATION, PROVINCE TRANSPORT DEPARTMENTS, AND OTHER RELEVANT GOVERNMENT AUTHORITIES.
b) ORGANIZE THE COMPOSITION AND APPROVAL OF TEXTBOOKS OR SELECT APPROPRIATE TEXTBOOKS AS OFFICIAL TEACHING AND LEARNING MATERIALS.
Article 7. Effective Date
1. THIS CIRCULAR TAKES EFFECT FROM MARCH 15, 2017.
2. REPLACES CIRCULAR NO. 57/2014/TT-BGTVT DATED OCTOBER 24, 2014 OF THE MINISTER OF TRANSPORTATION REGULATING PHYSICAL AND TECHNICAL INFRASTRUCTURE OF TRAINING ENTITIES AND TRAINING CURRICULA FOR WATERWAY TRANSPORT CREWS AND WATERWAY VESSEL OPERATORS.
Article 8. Implementation organization
THE HEAD OF THE MINISTRY'S OFFICE, THE HEAD OF THE MINISTRY'S INSPECTION DEPARTMENT, DEPARTMENT HEADS, DIRECTOR OF THE VIETNAM INLAND WATERWAY ADMINISTRATION, DIRECTORS OF PROVINCE TRANSPORT DEPARTMENTS, HEADS OF AUTHORITIES, ORGANIZATIONS, AND INDIVIDUALS RELATED TO THIS CIRCULAR ARE RESPONSIBLE FOR ITS IMPLEMENTATION./.
