Amending and supplementing certain Articles of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations for aircraft and aircraft operation

Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006 and the Law Amending and Supplementing Some Articles of the Civil Aviation Law of Vietnam dated November 21, 2014;

Pursuant to Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

On the basis of Government Decree No. Decision No. 92/2016/NĐ-CP July 1, 2016, of the Government stipulating business sectors and trades July 1, 2016, of the Government stipulating conditional business sectors and trades in the civil aviation sector amended and supplemented by Decree No. 89/2019/NĐ-CP dated November 15, 2019, of the Government and Government Decree No. 89/2025/ND-CP dated 13 April 2025 of the Government amending and supplementing certain articles of Decree No. 92/2016/NĐ-CP dated July 1, 2016, of the Government stipulating conditional business sectors and trades in the civil aviation sector;

PURSUANT TO THE PROPOSAL OF THE DIRECTOR OF THE TRANSPORT DEPARTMENT AND THE DIRECTOR OF THE ROAD SAFETY DEPARTMENT AND THE DIRECTOR OF THE VIETNAM CIVIL AVIATION ADMINISTRATION;

The Minister of Construction issues this Circular to amend and supplement certain articles of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations for aircraft and aircraft operation.

Article 1. Amends and supplements Clause c of Article 3.030 stipulated in Part 3 of the Civil Aviation Safety Regulations for aircraft and aircraft operation issued together with Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations for aircraft and aircraft operation, which has been amended at Section 1 of Appendix II amending and supplementing certain articles of Part 3 issued together with Circular No. 21/2017/TT-BGTVT dated June 30, 2017, issued by the Minister of Transport to amend and supplement certain articles of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations for aircraft and aircraft operation and Circular No. 03/2016/TT-BGTVT dated March 31, 2016, issued by the Minister of Transport to amend and supplement certain articles of Circular No. 01/2011/TT-BGTVT dated January 27, 2011, issued by the Minister of Transport on the Civil Aviation Safety Regulations for aircraft and aircraft operation as follows:

"c. The Civil Aviation Authority of Vietnam shall use the approval regulations of the following countries for aircraft to implement the issuance and recognition of certificates related to flight eligibility of aircraft, including:
1. The Federal Aviation Administration (FAA) of the United States for aircraft with type certificates issued by the FAA;
2. The European Union Aviation Safety Agency (EASA) for aircraft with type certificates issued by EASA;
3. The Canadian Aviation Authority for aircraft with type certificates issued by the Canadian Aviation Authority;
4. The Brazilian National Civil Aviation Authority for aircraft with type certificates issued by the Brazilian National Civil Aviation Authority;
5. The Russian Federation Civil Aviation Authority for aircraft with type certificates issued by the Russian Federation Civil Aviation Authority;
6. The United Kingdom Civil Aviation Authority for aircraft with type certificates issued by the United Kingdom Civil Aviation Authority;

7. The Civil Aviation Administration of China (CAAC) for aircraft with type certificates issued by the Civil Aviation Administration of China."

Article 2. Effective Date

This Circular takes effect from the date of issuance./.
