JOINT CIRCULAR

Guidelines for Implementing Policies to Support Military Personnel Leaving Service to Learn Trades

Pursuant to Decision No. 121/2009/QĐ-TTg dated October 9, 2009 of the Prime Minister on the operational mechanism of vocational training institutions under the Ministry of National Defense and policies to support military personnel leaving service to learn trades;

The Ministry of National Defense and the Ministry of Finance hereby issue guidelines for implementing policies to support military personnel leaving service to learn trades as stipulated in Decision No. 121/2009/QĐ-TTg dated October 9, 2009 of the Prime Minister as follows:

Article 1. Scope of Regulation

These Circulars provide guidance on implementing policies to support military personnel leaving service to learn trades at college, intermediate, and basic levels at vocational schools, job placement centers (hereinafter referred to as vocational training institutions) both within and outside the military.

Article 2. Applicability

These Circulars apply to non-commissioned officers and soldiers of the Vietnam People's Army who have completed their mandatory service according to the Law on Military Service dated December 30, 1981 and subsequent amendments and supplements to the Law on Military Service dated December 22, 1990, June 22, 1994, and June 14, 2005; have a decision to leave service and wish to learn trades at vocational training institutions both within and outside the military.

Article 3. Support Policies for Military Personnel Leaving Service to Learn Trades

1. Support for military personnel leaving service to learn trades at intermediate and college levels.

Military personnel leaving service to learn trades at intermediate and college levels shall study according to the order-based mechanism for vocational training institutions as prescribed in Decision No. 39/2008/QĐ-TTg dated March 14, 2008 of the Prime Minister; they may borrow money to pay for their studies according to Decision No. 157/2007/QĐ-TTg dated September 27, 2007 of the Prime Minister regarding credit for students and trainees.

2. Support for military personnel leaving service to learn trades at basic levels.

- Military personnel leaving service to learn trades at basic levels shall be issued a "Trade Learning Card" with a maximum value equal to 12 months of the minimum wage at the time of learning and valid for one year from the date of issuance. The value of the "Trade Learning Card" will be adjusted when the Government adjusts the minimum wage.

- Procedures for issuing the "Trade Learning Card": When military personnel complete their mandatory service and have the need and register to learn trades at the basic level at their unit, they shall be issued one "Trade Learning Card" (according to Model No. 1 attached to this Circular) issued by the Ministry of National Defense, signed and stamped by the head of the regiment-level unit or equivalent. The "Trade Learning Card" must be submitted to vocational training institutions both within and outside the military.

- The "Trade Learning Card" must be carefully preserved, not erased, damaged, or lent to others. If lost, it must be reported to the issuing authority to obtain a replacement.

Article 4. Budget Preparation, Settlement, and Finalization

1. Preparing budgets

Based on the needs and registration of military personnel, units prepare budgets (according to Models No. 2 and No. 3 attached to this Circular) and submit them to the Ministry of National Defense. The Ministry of National Defense (Financial Department) aggregates and submits them to the Ministry of Finance in accordance with the State Budget Law and related guiding documents.

2. Settlement and Finalization

a) For basic level trade learning:

Vocational training institutions both within and outside the military shall be reimbursed for the "Trade Learning Card" as prescribed.

The "Trade Learning Card" serves as the basis for reimbursement and is the documentation for finalization by vocational training institutions.

Military personnel leaving service to learn trades at the basic level shall submit the following documents to vocational training institutions both within and outside the military as the basis for settlement and finalization:

- Discharge decision (certified copy),

-"Trade Learning Card" (original),

- Graduation certificate and personal identification documents with photographs (certified copy).

Based on these documents, vocational training institutions both within and outside the military aggregate and finalize as other state budgets according to regulations. Vocational training institutions outside the military shall be reimbursed through the provincial military command.

b) For intermediate and college level trade learning:

Based on the results of service provision and contracts placed, the Ministry of National Defense shall conduct contract acceptance and payment according to current regulations.

The procedures and formalities for settlement and finalization of public services procured through bidding and orders shall be carried out in accordance with Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the State Budget Law and related guiding documents.

Article 5. Funding Implementation

The budget to implement the policy to support military personnel leaving service to learn trades as stipulated in this Circular shall be allocated in the annual budget of the Ministry of National Defense.

Article 6. Implementation Clauses.

1. This Circular shall take effect 45 days from the date of signature.

2. The systems and policies guided by this Circular shall take effect from November 23, 2009.
