CIRCULAR
Amending, supplementing, and abolishing certain provisions of legal documents issued by the Minister of Science and Technology in the field of standards, measurement, and quality

Pursuant to Decree No. 37/2026/NĐ-CP of the Government detailing certain provisions and measures for organizing and guiding the implementation of the Law on Product and Goods Quality;
Pursuant to Decree No. 78/2025/NĐ-CP of the Government detailing certain provisions and measures for organizing and guiding the implementation of the Law on Legislative Documents, amended and supplemented by Decree No. 187/2025/NĐ-CP;
Pursuant to Decree No. 79/2025/NĐ-CP of the Government on inspection, review, systematization, and handling of legislative documents, amended and supplemented by Decree No. 187/2025/NĐ-CP;
Pursuant to Decree No. 55/2025/NĐ-CP of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
At the proposal of the Chairman of the National Standardization, Metrology, and Quality Control Committee;
The Minister of Science and Technology issues this Circular amending, supplementing, and abolishing certain provisions of legal documents issued by the Minister of Science and Technology in the field of standards, measurement, and quality.
At the request of the Chairman of the National Standardization Measurement Quality Committee;
The Minister of Science and Technology issues the Circular amending, supplementing, and abolishing some Articles of the regulatory legal documents issued by the Minister of Science and Technology in the field of standardization, measurement, and quality.
Article 1. Amend and supplement some articles of Circular No. 22/2013/TT-BKHCN dated September 26, 2013 of the Minister of Science and Technology on measurement management in gold trading and quality management of jewelry and decorative gold circulating in the market as follows:
1. Amend and supplement Clause 1 of Article 4 as follows:
"1. Scales used to determine the weight of gold or gold content in transactions between organizations and individuals must meet the following requirements:
a) The measuring range and accuracy must be appropriate for the weight of gold to be measured. The scale capacity must be consistent with the value of the division of verification (e) specified in Table 1.

2. Amend and supplement Clause 3 of Article 4 as follows:
"3. The weight of gold in transactions with organizations and individuals or during inspections and checks shall not be less than the declared weight. The limit of error of the result of the weight measurement must comply with the requirements specified in Table 2.

The limit of error of the weight measurement result (m) not specifically provided in Table 2 shall be determined as follows:
a) For m < 30 g, the limit of error (S) is calculated according to the following formula and rounded to one (01) value of the division of verification (e) of the scale used.
Example 1:
The result of the weight measurement of a gold ring is 7.5 g (2 tael) when using a scale with e = 1 mg, the limit of error (S) is:
b) For 30 g < m < 6000 g, the limit of error (S) is calculated according to the following formula and rounded to one (01) value of the division of verification (e) of the scale used:

S: maximum allowable error;
m: weight of gold;
: two consecutive weights of gold in Table 2 corresponding to the number i and i+1 ensuring the condition

Example 2:
The result of the weight measurement of a gold necklace is 86 g (m = 86 g) when using a scale with e = 1 mg, from Table 2, we see that 50 g < 86 g < 100 g.
Therefore:
The limit of error (S) is:
c) For m > 6 kg, the limit of error (S) is calculated by multiplying the measurement result by 0.0175% and rounding to one (01) value of the division of verification (e) of the scale used.
Example 3:
The result of the weight measurement of a gold bar is 10 kg when using a scale with e = 100 mg, the limit of error (S) is:
S = (10 x 0.0175%) kg ~ 1.8 g"
Article 2. Amend and supplement Point b Item 3.4.2 National Technical Regulation QCVN 19:2019/BKHCN on LED lighting products issued together with Circular No. 08/2019/TT-BKHCN dated September 25, 2019 of the Minister of Science and Technology as follows:
"b. Testing for certification purposes must be carried out by a testing organization designated in accordance with the provisions of Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Product Quality and Goods, amended and supplemented by Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government amending and supplementing certain provisions of Decree No. 132/2008/NĐ-CP, Decree No. 154/2018/NĐ-CP, or recognized in accordance with the provisions of Circular No. 27/2007/TT-BKHCN. The scope of testing of the testing organization must meet the requirements stipulated in this Technical Regulation."
Article 3. Amend and supplement Section 4.4.3 of the National Technical Regulation QCVN 03:2019/BKHCN on children's toy safety issued together with Circular No. 09/2019/TT-BKHCN dated September 30, 2019 of the Minister of Science and Technology as follows: Article 4. Amend and supplement Clause 1 of Article 4 of Circular No. 23/2013/TT-BKHCN dated September 26, 2013 of the Minister of Science and Technology regarding measurement for Group 2 measuring instruments which have been amended and supplemented by Clause 2 of Article 1 of Circular No. 07/2019/TT-BKHCN dated July 26, 2019 of the Minister of Science and Technology amending and supplementing some articles of Circular No. 23/2013/TT-BKHCN and amended and supplemented by Article 1 of Circular No.
dated April 15, 2024 of the Minister of Science and Technology as follows:Article 4. Article 5. Repeal Point 5.3 of Article 5 of the National Technical Regulation QCVN 25:2025/BKHCN on electrical equipment for household electrical installations and similar systems issued together with Circular No. 01/2025/TT-BKHCN dated February 14, 2025, by the Minister of Science and Technology.
Article 6. Implementation Provisions
1. This Circular takes effect from April 15, 2026.
2. The provisions in Article 2 of this Circular cease to be effective from June 1, 2026.
3. In cases where the legal normative documents cited for application in this Circular are amended, supplemented, or replaced by other legal normative documents, they shall be implemented according to the amended, supplemented, or replacing documents.
4. The Director of the Office, the Chairman of the National Standardization, Metrology, and Quality Control Committee, the Heads of agencies and units under the Ministry of Science and Technology, and related organizations and individuals are responsible for implementing this Circular./.
