JOINT CIRCULAR

Guidelines for implementing the adjustment of monthly allowances from May 1, 2011 for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers,

On the basis of Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

On the basis of Clause 2, Article 4 of Decree No. 23/2011/NĐ-CP dated April 4, 2011 of the Government adjusting pensions, social insurance allowances, and monthly allowances for village cadres who have retired;

After exchanging with relevant ministries, the Ministry of Home Affairs and the Ministry of Finance provide guidelines for implementing the adjustment of monthly allowances from May 1, 2011 for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers as follows:

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

The subjects to which this Circular applies are village cadres who have retired and are receiving monthly allowances according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers (hereinafter referred to as elderly village cadres who have retired).

From May 1, 2011, implement the adjustment of monthly allowances for elderly village cadres who have retired according to the provisions of Article 2 of Decree No. 23/2011/NĐ-CP dated April 4, 2011 of the Government adjusting pensions, social insurance allowances, and monthly allowances for village cadres who have retired (hereinafter referred to as Decree No. 23/2011/NĐ-CP), increasing the monthly allowance by 13.7% over the monthly allowance received at the time of April 2011, specifically as follows:

Article 1. Scope of application

1. Formula for adjusting the monthly allowance from May 1, 2011:

In which: The monthly allowance received at the time of April 2011 is the allowance prescribed in Clause 2, Article 2 of Circular Joint No. 02/2010/TTLT-BNV-BTC dated April 26, 2010 of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of the adjustment of monthly allowances from May 1, 2010 for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.

2. The monthly allowance received from May 1, 2011 for elderly village cadres who have retired (rounded off according to the calculation formula in Clause 1 of this Article) is as follows:

a) For former Secretaries of the Party Committee, Chairmen of the People's Committee of villages: VND 1,047,000/month.

b) For former Deputy Secretaries, Deputy Chairmen, Permanent Members of the Party Committee, Secretaries of the People's Committee, Secretaries of the People's Council, Village Militia Chiefs, Chiefs of Public Security Police Stations: VND 1,009,000/month.

c) For other positions: VND 926,000/month.

1. Provincial People's Committees and municipal people's committees directly under the central government guide and implement the payment of monthly allowances from May 1, 2011 according to these guidelines for subjects within their jurisdiction.

3. Elderly village cadres who have retired when moving to a new legal place of residence within the same district must have a transfer certificate of allowance issued by the People's Committee of the commune; within the same province, a transfer certificate of allowance issued by the Department of Home Affairs of the district; outside the province, a transfer certificate of allowance issued by the Department of Home Affairs; the transfer certificate must be accompanied by the retirement file and decision (in case of loss, there must be a confirmation certificate from the competent authority at the same level). The place of transfer will continue to pay the allowance to the transferred cadre. Elderly village cadres who have retired and moved to a new legal place of residence before the effective date of Decree No. 23/2011/NĐ-CP shall continue to be paid by the current paying entity.

Article 3. Implementation Organization

1. This Circular takes effect from May 19, 2011.

2. The source of funds for adjusting the monthly allowance for retired elderly village cadres shall be implemented according to the guidance of the Ministry of Finance.

2. The regulations stipulated in this Circular shall be implemented from May 1, 2011.

Article 4. Effective date

3. Abolish Circular Joint No. 02/2010/TTLT-BNV-BTC dated April 26, 2010 of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of the adjustment of monthly allowances from May 1, 2010 for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers, Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.

During the implementation process, if there are difficulties, ministries, sectors, and localities should report to the Ministry of Home Affairs for coordination with the Ministry of Finance to study and resolve them./.
