CIRCULAR
Amending and supplementing certain articles of Circular No. 35/2011/TT-BTNMT dated August 31, 2011 of the Ministry of Natural Resources and Environment on detailed implementation of the regulation on tropical depression, typhoon, and flood warnings dated August 31, 2011 of the Ministry of Natural Resources and Environment
Pursuant to Decree No. 25/2008/NĐ-CP dated March 4, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment, which has been amended and supplemented by Decree No. 19/2010/NĐ-CP dated March 5, 2010 and Decree No. 89/2010/NĐ-CP dated August 16, 2010 of the Government;
Pursuant to Decision No. 17/2011/QĐ-TTg dated March 14, 2011 of the Prime Minister promulgating the Regulation on tropical depression, typhoon, and flood warnings;
At the proposal of the Director of the Meteorology, Hydrology, and Climate Change Department and the Legal Affairs Department;
The Minister of Natural Resources and Environment issues this Circular amending and supplementing certain articles of Circular No. 35/2011/TT-BTNMT dated August 31, 2011 of the Ministry of Natural Resources and Environment on detailed implementation of the Regulation on tropical depression, typhoon, and flood warnings.
Article 1. Amending and supplementing certain articles of Circular No. 35/2011/TT-BTNMT dated August 31, 2011 of the Ministry of Natural Resources and Environment on detailed implementation of the Regulation on tropical depression, typhoon, and flood warnings:
1. Economic organizations conducting foreign exchange trading agency activities; economic organizations conducting foreign currency receipt and payment service provision activities; economic organizations conducting border country currency exchange agency activities.
“Article 1. Scope of Regulation
This Circular specifies the contents of warning and forecast bulletins for tropical depressions, typhoons, and floods; the responsibilities of agencies issuing bulletins; the responsibility to provide bulletins to agencies directing prevention and control efforts, mass media organizations, and the public; and the responsibilities of agencies receiving warning and forecast bulletins.”
2. Repeal Articles 14, 15, 16, 17, 18, 19, 20, 21, 22, and 23.
3. Clause 3 of Article 24 shall be amended and supplemented as follows:
“3. Mass media organizations, organizations, and individuals when broadcasting warning and forecast bulletins for tropical depressions, typhoons, and floods without indicating the source of the information, disseminating unverified information, or distorting the content of the bulletins provided by authorized agencies will be subject to penalties under Article 8 and Article 9 of Decree No. 61/2008/NĐ-CP dated May 9, 2008 of the Government on administrative sanctions in the field of meteorology and hydrology.”
4. Repeal Models 15, 16, 17, 18, 19, and 20 issued together with Circular No. 35/2011/TT-BTNMT dated August 31, 2011 of the Ministry of Natural Resources and Environment on detailed implementation of the Regulation on tropical depression, typhoon, and flood warnings.
Article 2. Responsibility for implementation
Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of the Central Steering Committee for Flood and Storm Prevention and Control, Chairperson of the National Committee for Search and Rescue, Chairpersons of People's Committees of provinces and centrally-run cities, and relevant organizations and individuals within their assigned tasks and authorities shall be responsible for organizing and implementing the provisions of this Circular.
Article 3. Effectiveness
This Circular takes effect from June 20, 2013.
Any difficulties encountered during implementation should be reported to the Ministry of Natural Resources and Environment for consideration and resolution./.
