Circular No. 05/2024/TT-NHNN Abolishing Certain Legal Normative Documents Issued by the Governor of the State Bank of Vietnam

CIRCULAR

Repealing certain regulatory legal documents issued by the Governor of the State Bank of Vietnam

Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

On the basis of Law Issuing regulatory legal documents dated 22 June 2015;

Based on the Law Amending and Supplementing Certain Provisions of the Law on Enactment of Legislative Acts dated June 18, 2020;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some articles and implementing mechanisms for the Law on Issuing Regulatory Legal Documents;

Pursuant to Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing some articles of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some articles and implementing mechanisms for the Law on Issuing Regulatory Legal Documents;

Pursuant to Decree No. 102/2022/NĐ-CP dated December 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;

At the proposal of the Director of the Legal Department;

The Governor of the State Bank of Vietnam issues this Circular to repeal certain regulatory legal documents issued by the Governor of the State Bank of Vietnam.

This Circular takes effect from January 25, 2026.

Repealing all regulatory legal documents issued by the Governor of the State Bank of Vietnam as follows:

1. Circular No. 07/1997/TT-NHNN7 dated December 4, 1997 of the Governor of the State Bank of Vietnam guiding the implementation of Decision No. 802/TTg dated September 24, 1997 of the Prime Minister regarding the handling of existing issues related to issuing letters of credit.

2. Decision No. 403/1997/QĐ-NHNN2 dated December 5, 1997 of the Governor of the State Bank of Vietnam allowing the Project Management Board of the banking sector to apply the accounting system of the State Bank of Vietnam issued together with Decision No. 269/QĐ-NH2 dated December 4, 1992 of the Governor of the State Bank of Vietnam.

3. Decision No. 456/2003/QĐ-NHNN dated May 12, 2003 of the Governor of the State Bank of Vietnam amending and supplementing Clause 1, Article 1 of the "Regulation on Interbank Electronic Settlement" issued together with Decision No. 1557/2001/QĐ-NHNN dated December 14, 2001 of the Governor of the State Bank of Vietnam.

4. Circular No. 34/2012/TT-NHNN dated December 27, 2012 of the Governor of the State Bank of Vietnam stipulating the development and maintenance of business software for the State Bank of Vietnam.

5. Circular No. 13/2021/TT-NHNN dated August 23, 2021 of the Governor of the State Bank of Vietnam amending and supplementing some articles of Circular No. 26/2013/TT-NHNN dated December 5, 2013 of the State Bank of Vietnam promulgating the Service Fee Schedule for Payment through the State Bank of Vietnam.

Article 2. Effective Date

This Circular takes effect from July 22, 2024.

Article 3. Implementation Organization

The Head of the Legal Department, Heads of units under the State Bank of Vietnam, Governors of the State Bank of Vietnam branches in provinces and centrally-administered cities; Credit organizations, foreign bank branches are responsible for implementing this Circular./.
