CIRCULAR
Regarding the management of motor oil quality in business operations
Pursuant to the Law on Commerce dated May 10, 1997;
Pursuant to Decree No. 95/CP dated December 4, 1993 of the Government on the tasks, authorities, and organizational structure of the Ministry of Commerce;
Pursuant to Decree No. 11/1999/NĐ-CP dated March 3, 1999 of the Government on prohibited goods circulation and prohibited commercial services; restricted business goods and services and conditional business operations;
In order to strengthen state management over the quality of motor oils in business operations, the Ministry of Commerce issues guidelines on managing the quality of motor oils as follows:
Article 1. Scope of Application
1.1. This Circular applies to:
a) Organizations and individuals, including foreign organizations and individuals (hereinafter referred to as traders), currently engaged in motor oil business activities in Vietnam (including importation, blending, packaging, wholesale, and retail).
b) Types of motor oils used in piston engines, including four-stroke and two-stroke internal combustion engines using gasoline or diesel fuel (DO - Diesel Oil) or natural gas.
1.2. This Circular does not apply to aircraft lubricating oils.
Article 2. Regulations on product labeling for motor oils:
Motor oils consumed in the Vietnamese market must be labeled according to Decision No. 178/1999/QĐ-TTg dated August 30, 1999 of the Prime Minister on the Labeling System for Goods Circulating Domestically and Exported and Imported Goods; Circular guiding implementation No. 34/1999/TT-BTM dated September 15, 1999, and Circular No. 486/BTM-QLCL dated January 31, 2000 of the Ministry of Commerce.
Article 3. Regulations on viscosity classification and quality levels; minimum quality levels; testing methods; and actual quality levels of motor oils permitted for consumption in Vietnam.
3.1. Viscosity classification and quality levels:
The viscosity grade of motor oils mentioned in Clause b, Section 1.1, Article 1, displayed on product labels shall be used according to the viscosity grading system of the Society of Automotive Engineers (SAE) in Appendix 1, and the quality level displayed on product labels shall be used according to the quality level system of the American Petroleum Institute (API) in Appendix 2.
3.2. Minimum quality levels and testing methods for motor oils mentioned in Clause b, Section 1.1, Article 1 permitted for consumption in Vietnam are stipulated in Table 1 (corresponding to quality levels SC/CB).

3.3. Actual quality levels:
Traders are only allowed to trade motor oils with actual quality levels equal to or higher than those specified in Table 1. The actual quality levels correspond to the quality levels in the API system and the viscosity grades in the SAE system.
Article 4. Regulations on the management of motor oil imports
4.1. Traders importing motor oils for consumption in the Vietnamese market must comply with the provisions of Article 2 and the provisions of Article 3.
4.2. The actual quality levels, technical specifications published on product labels, purchase contracts, and the provisions of Articles 2 and 3 of this Circular serve as legal grounds for inspecting goods, supervising quality, and controlling the market for motor oils.
Article 5. Regulations on the management of motor oil blending and the importation of raw materials (base oils and additives) for motor oil blending.
5.1. Only traders with production facilities; blending facilities that meet the technical capacity, technology, and certification requirements may organize the blending of motor oils from base oils and additives.
5.2. The Ministry of Commerce shall coordinate with the Ministry of Science and Technology and Environment to assess: Technical capacity; Blending technology; Production environment; Safety equipment against fire and explosion; Professional certificates appropriate to the industry and profession of the blending facility, and certification for facilities permitted to blend motor oils.
The content of the certificate includes: Blending capacity, product types, quality levels achieved by products. Traders are only allowed to blend product types with quality levels as certified.
5.3. Traders granted the certificate as stated in Section 5.2 are entitled to import base oils and additives; The quantity of imported base oils and additives shall not exceed the certified blending capacity. Traders are not allowed to sell base oils and additives to the domestic market.
5.4. The certificate as stated in Section 5.2 serves as a legal basis for traders to proceed with the procedures for importing base oils and additives at customs authorities. Other legal procedures shall follow current regulations.
5.5. Traders must test the quality of domestically blended motor oils before putting them into circulation. The quality levels and technical specifications published on product labels must match the actual goods.
Article 6. Implementation Provisions
6.1. This Circular replaces the Joint Circular between the Ministry of Science and Technology and Environment and the Ministry of Commerce No. 565/KCM-TM dated May 15, 1997.
6.2. Traders as mentioned in Clause a, Section 1.1, Article 1, must comply with the provisions of this Circular. Violations will result in administrative penalties in the field of commerce and revocation of the certificate as stated in Section 5.2, Article 5.
6.3. This Circular takes effect thirty days from the date of issuance.
