Guidelines for awarding the Commemorative Medal "For the Cause of Mobilization and Reward"

Pursuant to the Law on Mobilization and Reward dated November 26, 2003 and the Law Amending and Supplementing Certain Articles of the Law on Mobilization and Reward dated June 14, 2005;

Pursuant to the Law on Legislative Activities dated June 3, 2008;

Pursuant to the Government Decree No. 178/2007/NĐ-CP dated December 3, 2007 stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to the Government Decree No. 48/2008/NĐ-CP dated April 17, 2008 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to the Government Decree No. 121/2005/NĐ-CP dated September 30, 2005 detailing and guiding the implementation of certain articles of the Law on Mobilization and Reward and the Law Amending and Supplementing Certain Articles of the Law on Mobilization and Reward;

Pursuant to the Prime Minister's Decision No. 59/2009/QĐ-TTg dated April 16, 2009 regarding the functions, tasks, powers, and organizational structure of the Central Mobilization and Reward Board under the Ministry of Home Affairs;

Chapter I GENERAL PROVISIONS

Article 1. Form and Purpose of Awarding the Commemorative Medal

The Commemorative Medal "For the Cause of Mobilization and Reward" (hereinafter referred to as the Commemorative Medal) is a form of reward granted by the Ministry of Home Affairs to individuals who have contributed to the development of the mobilization and reward sector, aiming to recognize their efforts and achievements; at the same time, encourage, educate, and set examples for civil servants, public officials, and employees to uphold traditions and strive to fulfill their political tasks well, contributing to the country's construction and defense.

Article 2. Scope of Regulation

These guidelines specify the principles, recipients, criteria, documentation, procedures, authority to propose and decide, and organization of presenting the Commemorative Medal.

Article 3. Principles for conferring titles

1. The Commemorative Medal is awarded annually on the occasion of the National Patriotic Mobilization Day (June 11) and is given only once to each individual; there is no posthumous award.

2. The awarding of the Commemorative Medal must be carried out in accordance with regulations, ensuring accuracy, fairness, transparency, democracy, and timeliness.

Chapter II RECIPIENTS, CRITERIA, AND CONDITIONS FOR THE AWARDING OF COMMENDATION PLAQUES

Article 4. Recipients and Criteria

1. For individuals working in the Mobilization and Reward Sector:

a. Leaders of the Order Institute, the Central Mobilization Board, the State Mobilization and Reward Institute, the Central Mobilization and Reward Board; members of the Patriotic Mobilization Campaign Promotion Board and the Central Mobilization and Reward Council.

b. Leaders of Departments under the Central Mobilization and Reward Board; Department Heads and Deputy Department Heads of the Mobilization and Reward Department; Heads and Deputy Heads of Mobilization and Reward Sections (Heads and Deputy Heads of Mobilization and Reward Boards) under central ministries, agencies, mass organizations, state-owned corporations, and economic groups established by the Prime Minister's decision; Heads and Deputy Heads of Mobilization and Reward Boards in centrally-administered cities and provinces with a tenure of five years or more.

c. Civil servants, public officials, employees, officers, and soldiers specializing in mobilization and reward work for ten years or more.

d. Civil servants, public officials, employees, officers, and soldiers concurrently engaged in mobilization and reward work with a total tenure of fifteen years or more.

2. Leaders of the Party and State; leaders of central ministries, agencies, mass organizations; centrally-administered cities and provinces; state-owned corporations, and economic groups established by the Prime Minister's decision who have made significant contributions to the development of the mobilization and reward sector.

3. Foreigners, Vietnamese citizens, and overseas Vietnamese who have made significant contributions to the mobilization and reward sector may be proposed by ministries, sectors, and localities.

Article 5. Conditions

- Not to consider awarding Commemorative Medals to individuals who have been disciplined at a level higher than a warning.

- Individuals currently under discipline may only be considered for awards after the disciplinary period has expired. The time spent under discipline shall not be counted towards consideration for Commemorative Medals.

- Not to consider rewarding individuals who are awaiting disciplinary review.

Chapter III PROCEDURE FOR CONSIDERING AWARDS, APPLICATION FILES AND ORGANIZING THE BESTOWAL OF COMMENDATION MEDALS

Article 6. Procedure for considering awards

1. For individuals specified in Clause 1, Article 4:

The Department of Awards and Honors Promotion of Ministries, central agencies, and state-owned corporations established by the Prime Minister's decision; Provincial Departments of Home Affairs (Awards and Honors Promotion Boards) of centrally governed cities shall accept application files from units, compare them with standards, compile lists, report to the Awards and Honors Promotion Councils, and leaders of the same-level agencies for their review and recommendation to the Minister of Home Affairs for bestowal of Commemorative Medals.

2. For individuals specified in Clause 2 and Clause 3, Article 4:

The Department of Awards and Honors Promotion of Ministries, central agencies, and state-owned corporations established by the Prime Minister's decision; Provincial Departments of Home Affairs (Awards and Honors Promotion Boards) of centrally governed cities shall base on standards, compile lists, report to the Awards and Honors Promotion Councils, and leaders of the same-level agencies for their review and recommendation to the Minister of Home Affairs for bestowal of Commemorative Medals.

Article 7. Application Files

Application files for bestowal of Commemorative Medals include:

- A letter from Ministries, central agencies, and centrally governed provincial and municipal authorities regarding the request for consideration of bestowal of Commemorative Medals (Model 1).

- A list of individuals proposed for bestowal of Commemorative Medals (Model 2).

- A summary of individual achievements, confirmed by the head of the agency (Model 3).

- Minutes of the Awards and Honors Promotion Council meeting (kept by the unit).

Two sets of application files must be submitted to the Central Awards and Honors Promotion Board before April 1st each year.

Article 8. Acceptance, Review of Application Files and Decision on Bestowal

1. The Minister of Home Affairs assigns the Central Awards and Honors Promotion Board to accept and review application files, submit them for the Minister of Home Affairs' review and decision on bestowal of Commemorative Medals. The submission to the Minister must be made before May 1st each year.

2. After the Minister of Home Affairs makes the decision on bestowal of Commemorative Medals, the Central Awards and Honors Promotion Board is responsible for:

- Notifying relevant Ministries, sectors, and localities about the individuals receiving Commemorative Medals.

- Preparing the award items (medal stems, certificates) along with the Minister's Decision.

Article 9. Organization of Bestowal

1. The bestowal ceremony takes place during the National Patriotic Scholastic Day commemoration on June 11th each year.

2. Agencies and units requesting bestowal of Commemorative Medals shall collect the award items from the Central Awards and Honors Promotion Board and organize the bestowal ceremony for the individuals according to current regulations.

3. The Central Awards and Honors Promotion Board organizes the bestowal for individuals who are currently or previously worked at the Order Institute, Central Awards and Honors Promotion Board, National Awards and Honors Promotion Institute, Central Awards and Honors Promotion Board, members of the Patriotic Scholastic Mobilization Committee, members of the Central Awards and Honors Promotion Council, and other cases.

Chapter IV OTHER PROVISIONS

Article 10. Rights and responsibilities of individuals awarded the Commendation Medal

1. Individuals awarded the Commendation Medal shall be granted the Medal and Certificate pursuant to the Decision of the Minister of Home Affairs.

2. Individuals awarded the Commendation Medal shall have the responsibility to continue preserving and promoting the traditions of the Department of Mobilization and Awards, serving as exemplary models in implementing well the policies and laws of the Party and State.

Article 11. Handling violations, addressing complaints and reports

Organizations and individuals related to the awarding of the Commendation Medal shall bear legal responsibility for the accuracy of the nomination dossier.

Organizations and individuals have the right to lodge complaints and denunciations regarding the awarding of the Commendation Medal in accordance with the Law on Complaints and Denunciations and the Law on Mobilization and Awards. The authority to handle complaints and denunciations shall be carried out in accordance with the provisions of the law.

Article 12. Implementation Organization

1. This Circular takes effect 45 days from the date of issuance.

Repeal Decision No. 37/QĐ-TB dated April 7, 2008 of the Head of the Central Mobilization and Awards Board on the issuance of the Regulation on the Awarding of the Commendation Medal "For the Cause of Mobilization and Awards".

2. The Director of the Office of the Ministry, the Head of the Central Mobilization and Awards Board, the Heads of units and organizations under the Ministry of Home Affairs; the Mobilization and Awards Department (Mobilization and Awards Division) of central ministries, sectors, mass organizations, state-owned corporations and economic groups established by the Prime Minister's decision; the Provincial Departments of Home Affairs (Mobilization and Awards Boards) of centrally governed cities and provinces shall implement this Circular.

3. During the implementation process, if there are any difficulties, units shall promptly reflect them to the Central Mobilization and Awards Board for consolidation and reporting to the Minister of Home Affairs for consideration, amendment, and supplementation to ensure appropriateness.
