CIRCULAR
Repealing certain regulatory legal documents issued by the Minister of Home Affairs

Pursuant to the Law on Legislative Regulatory Documents 2015;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents 2020;

Pursuant to the Government's Decree No. 34/2016/NĐ-CP dated May 14, 2016 detailing certain provisions and measures for implementing the Law on Legislative Acts of Regulations;

Pursuant to Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing certain provisions of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and measures for implementing the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 34/2017/NĐ-CP dated April 3, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

At the request of the Director of the Legal Department,

The Minister of Home Affairs issues this Circular to repeal certain regulatory legal documents issued by the Minister of Home Affairs.

Article 1. Repeal the entirety of seven regulatory legal documents

1. Circular No. 01/2009/TT-BNV dated March 19, 2009 of the Minister of Home Affairs guiding the procedures and formalities for appointing, dismissing, and removing the Chairman, Vice Chairmen, and Members of the People's Committee at the district, town, and ward levels where there is no People's Council.

2. Circular No. 02/2009/TT-BNV dated March 19, 2009 of the Minister of Home Affairs guiding the implementation of pilot programs without establishing a People's Council at the district, town, and ward levels.

3. Circular No. 04/2009/TT-BNV dated April 29, 2009 of the Minister of Home Affairs amending Clause 3 and Clause 4, Article 5 of Circular No. 02/2009/TT-BNV dated March 19, 2009 of the Minister of Home Affairs guiding the implementation of pilot programs without establishing a People's Council at the district, town, and ward levels.

4. Circular No. 04/2013/TT-BNV dated April 16, 2013 of the Minister of Home Affairs guiding the development of regulations on archival work for agencies and organizations.

5. Circular No. 02/2016/TT-BNV dated February 1, 2016 of the Minister of Home Affairs guiding the organizational work for the election of members of the National Assembly, term 2016-2021, and members of People's Councils at all levels.

6. Decision No. 82/2004/QĐ-BNV dated November 17, 2004 of the Minister of Home Affairs promulgating standards for Directors of Departments and equivalent positions under Provincial People's Committees.

7. Decision No. 83/2004/QĐ-BNV dated November 17, 2004 of the Minister of Home Affairs promulgating standards for Department Heads under Ministries, agencies with ministerial status, and government agencies.

Article 2. Effective Date

This Circular takes effect from December 20, 2021.

Article 3. Implementation Organization

The Head of the Legal Department, Heads of units under and affiliated with the Ministry of Home Affairs, and relevant agencies, organizations, and individuals shall be responsible for implementing this Circular./.
