Amending and supplementing some articles of Circular No. 36/2015/TT-GTVT

Pursuant to the Civil Aviation Law of Vietnam No. 66/2006/QH11 dated June 29, 2006 and the Law Amending and Supplementing Some Articles of the Civil Aviation Law of Vietnam No. 61/2014/QH13 dated November 21, 2014;

Pursuant to the Price Law No. 11/2012/QH13 dated June 20, 2012;

Pursuant to Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Price Law and Decree No. 149/2016/NĐ-CP dated November 11, 2016 of the Government amending and supplementing some articles of Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Price Law;

Pursuant to Decree No. 05/2021/NĐ-CP dated January 25, 2021 of the Government on management and operation of airports and airfields;

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

PURSUANT TO THE PROPOSAL OF THE DIRECTOR OF THE TRANSPORT DEPARTMENT AND THE DIRECTOR OF THE VIETNAM CIVIL AVIATION ADMINISTRATION;

The Minister of Transport hereby issues this Circular amending and supplementing some articles of Circular No. 36/2015/TT-GTVT dated July 24, 2015 of the Minister of Transport on price management for domestic air cargo transportation services and aviation-related services.

Article 1. Amending and supplementing some articles of Circular No. 36/2015/TT-GTVT dated July 24, 2015 of the Minister of Transport on price management for domestic air cargo transportation services and aviation-related services (hereinafter referred to as Circular No. 36/2015/TT-GTVT).

1. Supplementing Point i Clause 3 Article 5 as follows:

“i) Air service franchise rights, including the following franchised services: passenger terminal; cargo terminal, warehouse; ground commercial technical services; maintenance and repair of aircraft and equipment; aviation technology; provision of airline meals; provision of aviation fuel.”

2. Amend and supplement Article 8 as follows:

“Article 8. Price Declaration

1. Organizations and individuals providing services listed in Article 7 of this Circular shall be responsible for declaring prices.

2. The Civil Aviation Administration of Vietnam shall be responsible for receiving price declaration documents from organizations and individuals providing services as stipulated in Clause 1 of this Article.

3. The method of declaration and receipt of declarations shall be carried out in accordance with the provisions of Circular No. 56/2014/TT-BTC dated April 28, 2014 of the Minister of Finance guiding the implementation of Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Price Law; and Circular No. 233/2016/TT-BTC dated November 11, 2016 of the Minister of Finance amending and supplementing some articles of Circular No. 56/2014/TT-BTC dated April 28, 2014 of the Minister of Finance guiding the implementation of Decree No. 177/2013/NĐ-CP dated November 14, 2013 of the Government detailing and guiding the implementation of certain provisions of the Price Law."

3. Amending the name of Section 3 Chapter II as follows:"PUBLISHING AND PUBLIC ANNOUNCEMENT OF PRICES".

Article 2. Replacing and abolishing some points, clauses, articles, and Appendices of Circular No. 36/2015/TT-GTVT

1. Abolishing Article 9, Article 10, and Clause 2 Article 16.

2. Abolishing Appendix 2.

Article 3. Implementation Provisions

1. This Circular takes effect from July 15, 2022.

2. Abolishing Circular No. 07/2017/TT-GTVT dated March 14, 2017 of the Minister of Transport amending and supplementing some articles of Circular No. 36/2015/TT-GTVT dated July 24, 2015 of the Minister of Transport on price management for domestic air cargo transportation services and aviation-related services.

3. In cases where the legal normative documents cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the amended, supplemented, or replaced legal normative documents.

4. The Director of the Office, the Inspector General, the Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, and the Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
