CIRCULAR
Amending and supplementing certain articles of circulars related to management, exploitation, use, maintenance, and protection of roads
On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;
Pursuant to Decree No. 56/2022/NĐ-CP dated August 24, 2022 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Transport;
Considering the proposal of the Director of the Infrastructure Department and the Director General of the Vietnam Highway Administration;
The Minister of Transport issues this Circular amending and supplementing certain articles of circulars related to management, exploitation, use, maintenance, and protection of roads.
1. Amend and supplement Clause 2 of Article 9 as follows:
"2. Based on the number of collisions, the number of traffic accidents in one year (12 months), the severity level regarding the number of deaths, the number of injuries, the value of damaged property, compare with the criteria stipulated in Articles 4 and 5 of this Circular to preliminarily arrange the priority order for handling, report to the direct road management authority (Zone Road Management, Department of Transport for national highways managed; Department of Transport for local systems), the investor for roads being exploited under PPP project contracts, agencies, organizations, and individuals having dedicated roads."
2. Amending and supplementing Point a Clause 1 Article 14 as follows:
"a) Vietnam Highway Administration for the national highway system; Vietnam Expressway Administration for expressways classified and authorized;"
3. Amending and supplementing Clause 3 Article 17 as follows:
"3. Vietnam Highway Administration, Vietnam Expressway Administration shall perform the responsibilities prescribed in Point a Clause 1 of this Circular."
4. Amending and supplementing Article 21 as follows:
"Article 21. Implementation organization
1. The Director of the Ministry's Office, the Director of the Ministry's Inspectorate, the Heads of Departments, the Directors of Vietnam Highway Administration, the Directors of Vietnam Expressway Administration, the Chairmen of Provincial People's Committees, and the Heads of relevant agencies, organizations, and individuals shall be responsible for implementing this Circular.
2. During the implementation process, if any difficulties arise, agencies, organizations, and individuals shall reflect them to Vietnam Highway Administration, Vietnam Expressway Administration for consolidation and reporting to the Ministry of Transport for consideration and decision."
Article 2. Amending and supplementing certain articles of Circular No. 11/2014/TT-BGTVT dated April 29, 2014, issued by the Minister of Transport guiding design, construction, and acceptance of pedestrian suspension bridges (amended and supplemented by Circular No. 38/2015/TT-BGTVT dated July 30, 2015)
1. Replacing the phrase “Director General of Vietnam Highway Administration” with the phrase “Director of Vietnam Highway Administration” in Clause 1 Article 33.
2. Replacing the phrase “Vietnam Highway Administration” with the phrase “Director of Vietnam Highway Administration” in Clause 2 Article 33.
Replacing the phrase “Director General of Vietnam Highway Administration” with the phrase “Director of Vietnam Highway Administration” in Article 25.
Article 4. Amending and supplementing certain articles of Circular No. 17/2014/TT-BGTVT dated May 27, 2014, issued by the Minister of Transport stipulating standards for job titles at vehicle weight control stations on roads
Replacing the phrase “Director General of Vietnam Highway Administration” with the phrase “Director of Vietnam Highway Administration, Director of Vietnam Expressway Administration” in Article 12.
Article 5. Amending and supplementing some articles of Circular No. 22/2014/TT-BGTVT dated June 6, 2014, issued by the Minister of Transport guiding the construction of operating procedures for ferry terminals and passenger ferries crossing rivers
1. Amending and supplementing the name of Article 15 as follows:
“Article 15. Responsibilities of Vietnam Highway Administration”.
2. Replacing the phrase “Director General of Vietnam Highway Administration” with the phrase “Director of Vietnam Highway Administration” in Clause 1 Article 24.
Replacing the phrase “Director General of Vietnam Highway Administration” with the phrase “Director of Vietnam Highway Administration” in Article 25.
Article 7. Amend and supplement some articles of Circular No. 84/2014/TT-BGTVT dated December 31, 2014, issued by the Minister of Transport stipulating traffic organization and weight limit signs for vehicles passing over road bridges
1. Amending and supplementing Clause 15 Article 3 as follows:
“15. The agency or unit directly managing the bridge (abbreviated as the Direct Bridge Management Agency) includes: Vietnam Expressway Administration, Zone Road Management Units, Departments of Transport, District People's Committees, Commune People's Committees, Investors for PPP projects, and other agencies or units assigned tasks by competent authorities.”
2. Amending and supplementing Clause 2 Article 8 as follows:
“2. Installing weight limit signs
a) Zone Road Management Units shall install on national highways under their management;
b) Departments of Transport shall install on national highways under their management, and local road systems under their management;
c) District People's Committees, Commune People's Committees, and other agencies or units (assigned tasks by competent authorities) shall install on local road systems under their management;
d) Investors shall install on PPP projects or dedicated roads;
đ) Vietnam Expressway Administration for expressways classified and authorized.”
3. Amending and supplementing Point a Clause 4 Article 8 as follows:
“a) Vietnam Highway Administration decides for bridges on the national highway system (including PPP projects), Vietnam Expressway Administration for expressways classified and authorized (including PPP projects);”
4. Amending and supplementing Article 9 as follows:
“Article 9. Implementation organization
1. Vietnam Highway Administration shall guide the installation of weight limit signs nationwide; implement on the national highway system.
2. Vietnam Expressway Administration shall guide and implement the installation of weight limit signs on expressways classified and authorized.
3. Zone Road Management Units, Departments of Transport shall guide and inspect the installation of weight limit signs on local road systems and dedicated roads within their management area.”
4. The Highway Management Zone (for the national highway system), the Vietnam Expressway Corporation (for expressways under its classification and authorization), the Department of Transport (for local road systems) shall be responsible for updating bridges that require weight restrictions on vehicles, width limits, and publishing such information on their official websites, and immediately reporting to the Vietnam Road Administration for timely updates and nationwide publication.
5. Annually, the Vietnam Road Administration and the Vietnam Expressway Corporation shall compile the situation regarding bridge load reviews, adjustments, and publications; and report to the Ministry of Transport before March 31 of the following year.
5. Amend and supplement Clause 4, Clause 5 of Article 10 as follows:
a) Amend and supplement Clause 4 as follows:
“4. The Director of the Ministry's Office, the Director of the Ministry's Inspectorate, the Heads of Departments, the Directors of the Vietnam Road Administration, the Directors of the Vietnam Expressway Corporation, the Heads of the Highway Management Zones, the Directors of the Provincial Departments of Transport, and the Heads of related agencies, organizations, and individuals shall be responsible for implementing this Circular.”
b) Amend and supplement Clause 5 as follows:
“5. During the implementation process, agencies, organizations, and individuals shall promptly reflect any arising difficulties to the Ministry of Transport, the Vietnam Road Administration, and the Vietnam Expressway Corporation for guidance and resolution.”
1. Amending and supplementing Point a Clause 1 Article 7 as follows:
“a) The Vietnam Road Administration shall publish for expressways managed by the central government;”
2. Amend and supplement Clause 4 of Article 7 as follows:
“4. For expressway construction projects invested in by the Ministry of Transport, provincial People's Committees, and municipal People's Committees directly under the Central Government, the agencies, organizations entrusted with the direct management and use of capital for investment activities shall be responsible for organizing the preparation of documents to propose the publication of expressway projects for exploitation according to the provisions of Clause 2 of this Article, and submit them to the Vietnam Road Administration and the provincial People's Committee, municipal People's Committee directly under the Central Government for decision.”
3. Amend and supplement Point a of Clause 2 of Article 10 as follows:
“a) The Vietnam Road Administration shall approve traffic organization plans for expressways managed by the central government based on the proposals of investors and project sponsors;”
Article 9. Amend and supplement some articles of Circular No. 08/2015/TT-BGTVT dated April 14, 2015, issued by the Minister of Transport stipulating rescue operations and budget estimates for rescue operations on expressways
1. Replace the phrase "General Department of Transportation" with the phrase "Vietnam Expressway Corporation" at: Clause 2 of Article 2, Point a of Clause 4 of Article 6, Clause 2 of Article 10.
2. Replace the phrase "Director-General of the General Department of Transportation" with the phrase "Director of the Vietnam Expressway Corporation" at Clause 1 of Article 10.
Article 10. Amend and supplement some articles of Circular No. 46/2015/TT-BGTVT dated September 7, 2015, issued by the Minister of Transport stipulating vehicle loads, width limits on roads; circulation of overloaded vehicles, oversized vehicles, tracked vehicles on roads; transportation of extra-long, extra-heavy goods; cargo stacking limits on road transport vehicles when participating in road traffic (amended and supplemented by Circular No. 36/2020/TT-BGTVT dated December 24, 2020)
1. Amend and supplement Article 6 as follows:
"Article 6. Announcing the load capacity and width limits of roads and the technical condition of level crossings
1. The Vietnam Road Administration shall be responsible for publishing the load and width limits of national highways; updating the load and width limits of roads and the technical condition of level crossings within the country on the Vietnam Road Administration’s official website.
2. The Vietnam Expressway Corporation shall be responsible for publishing the load and width limits of expressways under its classification and authorization; and simultaneously sending data to the Vietnam Road Administration for updating on the Vietnam Road Administration’s official website.
3. The Vietnam Railway Administration shall be responsible for publishing the technical condition of level crossings on the railway network in Vietnam; and simultaneously sending data to the Vietnam Road Administration for updating on the Vietnam Road Administration’s official website.
4. The provincial People's Committee shall be responsible for publishing the load and width limits of local roads; and simultaneously sending data to the Vietnam Road Administration and the Vietnam Expressway Corporation for updating on the Vietnam Road Administration’s official website.
“1. The procedure for appointing, reappointing accounting managers and accounting supervisors, and assigning accounting supervisors shall be carried out according to the procedure for appointing mid-level professional positions as prescribed in Circular No. 29/2017/TT-BCA dated September 1, 2017 of the Minister of Public Security stipulating the procedures and formalities for appointing, dismissing, demoting, and changing positions within the People's Police, amended and supplemented by Circular No. 49/2023/TT-BCA dated October 18, 2023; Circular No. 77/2021/TT-BCA dated July 15, 2021 of the Minister of Public Security stipulating the list of positions and titles and the allocation and use of titles for police officers and non-commissioned officers of the People's Police, and Circular No. 78/2021/TT-BCA dated July 15, 2021 of the Minister of Public Security stipulating the standards for titles of police officers and non-commissioned officers of the People's Police, and any amendments and supplements to these Circulars (if any) and the following provisions:”
“Article 7. Adjustment of Public Announcement of Load Limits and Width Restrictions for Roads and Technical Condition of Level Crossings
1. The Vietnam Road Administration shall be responsible for updating the load and width limits of roads and the technical condition of level crossings within the country on a six-month basis (before June 20 and December 20 each year).
2. The Vietnam Expressway Corporation shall be responsible for updating the load and width limits of expressways under its classification and authorization; and simultaneously sending data to the Vietnam Road Administration for updating on the Vietnam Road Administration’s official website on a six-month basis (before June 15 and December 15 each year).
3. The Vietnam Railway Administration shall be responsible for updating the technical condition of level crossings on the railway network in Vietnam; and simultaneously sending data to the Vietnam Road Administration for updating on the Vietnam Road Administration’s official website on a six-month basis (before June 15 and December 15 each year).
4. The Department of Transport shall be responsible for updating the load and width limits of local roads; and simultaneously sending data to the Vietnam Road Administration for updating on the Vietnam Road Administration’s official website on a six-month basis (before June 15 and December 15 each year).
5. Investors in PPP projects shall be responsible for updating the load and width limits of road sections within their management scope; and simultaneously sending data to the Department of Transport (for local roads), the Vietnam Road Administration (for national highways), and the Vietnam Expressway Corporation (for expressways under classification and authorization) for updating on the Vietnam Road Administration’s and Vietnam Expressway Corporation’s official websites on a six-month basis (before June 10 and December 10 each year).
6. Bridges on road sections that have been published but not yet upgraded to match the published load and width limits of roads must have signs indicating the actual load and width limits of the bridge placed by the road administration authority.”
3. AMEND AND SUPPLEMENT Article 22 AS FOLLOWS:
“Article 22. Competence to Issue Vehicle Operation Permits
“1. The Director of the Department of Transport, the Director of the Highway Management Zone shall issue permits for vehicles to operate on the national road network throughout the country.
2. In special cases serving security, defense, energy projects, disaster prevention and rescue operations, such decisions shall be made by the Director General of the Vietnam Highway Administration.”
4. AMEND AND SUPPLEMENT Clause 3, Clause 4 of Article 23a (supplemented by Circular No. 36/2020/TT-BGTVT dated December 24, 2020) AS FOLLOWS:
a) To amend and supplement Clause 3 as follows:
“3. Reporting entities: Highway Management Zones, Departments of Transport.”
b) Amend and supplement Clause 4 as follows:
“4. Receiving entity: Vietnam Highway Administration.”

“Article 26. Implementation
1. The Vietnam Highway Administration shall be responsible for:
a) Organizing, inspecting, and supervising the implementation of the provisions of this Circular; taking the lead and coordinating with issuing authorities in connecting data networks to the Vietnam Highway Administration; managing vehicle permit issuance data in accordance with regulations;
b) Organizing training on the implementation of this Circular; guiding the use of software for vehicle permit issuance to issuing authorities;
c) Regularly, periodically, and randomly inspecting the issuance activities of issuing authorities; handling or recommending the handling of violations by organizations and individuals issuing vehicle permits in accordance with the law.
2. Highway Management Zones, Departments of Transport shall be responsible for:
a) Adhering to the provisions of this Circular;
b) Publicizing procedures, fees, and processing times for vehicle permits;
c) Implementing record-keeping and reporting systems in accordance with regulations; connecting, securing passwords, and updating data from the network provided by the Vietnam Highway Administration;
d) Complying and facilitating inspections, checks, and supervision of vehicle permit issuance activities by competent authorities.
3. The Heads of the Ministry's Office, the Inspectorate, the Heads of Departments, the Directors of the Vietnam Highway Administration, the Vietnam Expressway Administration, the Vietnam Vehicle Inspection Administration, the Vietnam Railway Administration, the Departments of Transport, and other relevant agencies and individuals shall be responsible for implementing this Circular.
4. During the implementation process, agencies, organizations, and individuals shall promptly report any arising issues to the Ministry of Transport for consideration and resolution./.”

6. AMEND AND SUPPLEMENT the name of Clause 2 of Article 13 (amended and supplemented by Clause 2 of Article 1 of Circular No. 39/2021/TT-BGTVT dated December 31, 2021) AS FOLLOWS:
“2. The Vietnam Highway Administration shall approve the construction of essential works within the scope of protection of highway infrastructure for national highways in the following cases:”
7. ADD Clause 2a AFTER Clause 2 of Article 13 AS FOLLOWS:
“2a. The Vietnam Expressway Administration shall approve the construction of essential works within the scope of protection of highway infrastructure for expressways under its jurisdiction.”
8. AMEND AND SUPPLEMENT Clause 1 of Article 14 (amended and supplemented by Clause 2 of Article 1 of Circular No. 13/2020/TT-BGTVT dated June 29, 2020) AS FOLLOWS:
“1. The authority to issue construction permits is the Vietnam Expressway Administration, Highway Management Zones, and Departments of Transport responsible for managing national highways, expressways, and roads constructed, operated, and managed through public-private partnerships within their jurisdiction.”
9. AMEND AND SUPPLEMENT Clause 4 of Article 16 AS FOLLOWS:
“4. The Vietnam Expressway Administration, Highway Management Zones, and Departments of Transport shall approve and issue permits for the construction of temporary advertising signs within the safety zone of national highways under their jurisdiction.”
10. AMEND AND SUPPLEMENT Clause 1, Clause 2 of Article 18 AS FOLLOWS:
a) Amend and supplement Clause 1 as follows:
"1. Prior to submitting the competent authority for approval of new construction projects, upgrading, or renovation of road works within the scope of land allocated for roads (excluding projects approved by the Ministry of Transport, Vietnam Road Administration as the investment decision-making body or project sponsor), the project sponsor shall submit the application for approval of the scale and design solutions to the Vietnam Road Administration (for national highways) or the Vietnam Expressway Corporation (for expressways under delegated authority) for review and resolution."
b) Amend and supplement Clause 2 as follows:
"2. The project sponsor or contractor of a road work on a highway that is currently in operation must request the Vietnam Expressway Corporation, Highway Management Zone, or Department of Transport responsible for managing the route to issue a Construction Permit."
11. Amend and supplement Point c Clause 1 Article 20 (amended and supplemented at Clause 3 Article 1 Circular No. 39/2021/TT-BGTVT dated December 31, 2021) as follows:
"c) Not connecting to a section of a national highway that has been planned as an expressway, except in special cases including: important national projects, group A projects, projects in the transportation sector groups B and C (as stipulated in the Public Investment Law); these cases will be connected to the bypass road or side road when the section of the national highway is constructed and completed according to expressway standards;"
12. Amend and supplement Point b Clause 3 Article 26 as follows:
"b) Deciding on connection points to national highways that have been approved by the provincial People's Committee (certified copy or copy with original for verification);"
13. Amend and supplement Clause 2 Article 31 as follows:
"2. The Vietnam Road Administration and the Vietnam Expressway Corporation shall be responsible for:"
a) The Vietnam Road Administration, based on the provisions of this Circular, shall organize the management and protection of road traffic infrastructure for national highways;
b) The Vietnam Expressway Corporation, based on the provisions of this Circular, shall organize the management and protection of road traffic infrastructure for expressways under delegated authority;"
14. Amend and supplement Point c Clause 2 Article 45 as follows:
"c) In case the time limit specified in Point a of this Clause is exceeded, it must be approved by the Vietnam Road Administration (for national highways) or the Vietnam Expressway Corporation (for expressways under delegated authority), and approved by the Department of Transport for local roads;"
Article 12. Amend and supplement some articles of Circular No. 29/2017/TT-BGTVT dated September 1, 2017 of the Minister of Transport on training inspection officers and managing inspection certificates for road traffic safety
1. Replace the phrase “Vietnam Highway Administration General Department” with the phrase “Vietnam Road Administration” at: Point a Clause 3 Article 5; Point c Clause 1 Article 6; Clause 1 Article 7; Clause 8 Article 8; Point c Clause 1, Point c Clause 2 Article 9; Article 12.
2. Amend and supplement the name of Article 9 as follows:

3. Replace the phrase “Highway Management Bureau” with the phrase “Highway Management Zone” at:
a) Clause 5 Article 2; Point b Clause 1, Clause 2 Article 5; Point a Clause 1 Article 18;
b) Point b Clause 4 Article 19 (amended and supplemented at Point a Clause 13 Article 1 of Circular No. 41/2021/TT-BGTVT dated December 31, 2021);
c) Clause 1 Article 25 (amended and supplemented according to the provisions of Article 4 of Circular No. 36/2020/TT-BGTVT dated December 24, 2020).
4. Replace the phrase “Vietnam Highway Administration General Department” with the phrase “Vietnam Road Administration” at:
a) Point c Clause 6 Article 16 (amended and supplemented according to the provisions of Clause 9 Article 1 of Circular No. 41/2021/TT-BGTVT dated December 31, 2021);
b) Point a, Point c, Point d, Point đ Clause 2 Article 17 (amended and supplemented at Clause 11 Article 1 of Circular No. 41/2021/TT-BGTVT dated December 31, 2021);
c) Point a Clause 1 Article 18;
d) Point b, Point c, Point d Clause 4 Article 19 (amended and supplemented at Point a Clause 13 Article 1 of Circular No. 41/2021/TT-BGTVT dated December 31, 2021).
5. Amend and supplement the name of Clause 1 Article 5 as follows:
"1. Responsibilities of the Vietnam Road Administration."
6. Supplement Clause 1a after Clause 1 Article 5 as follows:
"1a. Responsibilities of the Vietnam Expressway Corporation
a) Organizing the management and operation of expressways under delegated authority;
b) Inspecting and guiding units and enterprises investing in construction and management of expressways under delegated authority in the management, operation, and maintenance of such expressways; ensuring safe and smooth traffic; ensuring compliance with maintenance procedures, operational procedures, technical standards, and regulations;
c) Handling or recommending competent authorities to handle organizations and individuals violating the management, operation, and maintenance of expressways under delegated authority;
d) Performing other rights and responsibilities related to the management and operation of expressways under delegated authority in accordance with relevant laws."
7. Amend and supplement the name of Clause 2 Article 17 (amended and supplemented at Clause 11 Article 1 of Circular No. 41/2021/TT-BGTVT dated December 31, 2021) as follows:
"2. Establishing, approving, and adjusting maintenance plans for national road works funded by the central budget:"
8. Repeal the phrase “review” at Point d Clause 2 Article 17 (as amended and supplemented by Clause 11 Article 1 of Circular No. 41/2021/TT-BGTVT dated December 31, 2021).
9. Replace the phrase “Director General of the Vietnam Highway Administration” with the phrase “Director of the Vietnam Highway Administration, Director of the Vietnam Expressway Administration” in Article 29.
Replacing the phrase “Director General of Vietnam Highway Administration” with the phrase “Director of Vietnam Highway Administration, Director of Vietnam Expressway Administration” in Article 12.
1. Replace the phrase “Vietnam Highway Administration” with the phrase “Vietnam Highway Administration” at Point b Clause 4 Article 10.
2. Replace the phrase “Director General of the Vietnam Highway Administration” with the phrase “Director of the Vietnam Highway Administration, Director of the Vietnam Expressway Administration” at Article 13.

Article 17. Amend and supplement some articles of Circular No. 39/2020/TT-BGTVT dated December 31, 2020 issued by the Minister of Transport guiding the method of building pricing schemes, managing prices of public service fees for the management and maintenance of road infrastructure and ferry terminal operation services on the national highway system using regular central government budget funds when implementing the procurement method
1. Replace the phrase “Vietnam Highway Administration” with the phrase “Vietnam Highway Administration” at Clause 1, Point b Clause 2 Article 13.
2. Replace the phrase “Director General of the Vietnam Highway Administration” with the phrase “Director of the Vietnam Highway Administration” at Article 15.
Article 18. Amend and supplement some articles of Circular No. 40/2020/TT-BGTVT dated December 30, 2020 issued by the Minister of Transport on tendering and ordering the provision of public service fees for ferry terminal operation services managed by the Ministry of Transport using regular central government budget funds
1. Replace the phrase “Director General of the Vietnam Highway Administration” with the phrase “Director of the Vietnam Highway Administration” at Clause 2 Article 7, Clause 1 Article 9, Article 11.
2. Replace the phrase “Director of the Road Management Bureau” with the phrase “Director of the Road Management Zone” at Clause 2 Article 9.
Article 19. Amending and supplementing some provisions of Circular No. 44/2021/TT-BGTVT dated December 31, 2021, issued by the Minister of Transport on standard rates for management and regular maintenance of national roads.
Replace the phrase "Director General of the Vietnam Highway Administration" with the phrase "Director of the Vietnam Road Administration, Director of the Vietnam Expressway Administration" in Article 4.
Article 20. Implementation Provisions
1. This Circular takes effect from July 1, 2023.
2. The Heads of the Ministry's Office, the Inspectorate, the Department Heads, the Directors of the Vietnam Road Administration, the Directors of the Vietnam Expressway Administration, the Directors of Provincial Departments of Transport, the Directors of Provincial Departments of Transport and Construction under centrally governed cities, the Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Circular./.
