CIRCULAR
Guidelines for Adjusting Pensions, Social Insurance Benefits, and Monthly Allowances

Pursuant to Decree No. 62/2022/NĐ-CP dated 12 the 9 year 2022 of the Government Sports. defining the functions, tasks, powers, and organizational structure of the Ministry SOCIAL động - AFFAIRS SECTOR of Labor, Invalids, and Social Affairs;
Pursuant to Decree No. 42/2023/NĐ-CP dated 29 the 6 year 2023 of the Government adjusting pensions, social insurance benefits, and monthly allowances (hereinafter referred to as Decree No. 42/2023/NĐ-CP); here is written as Decree No. 42/2023/NĐ-CP);
the Director at the request of the Director of the Social Insurance Department;
Minister of SOCIAL động - AFFAIRS SECTOR of Labor, Invalids, and Social Affairs VIOLATION issues this Circular guiding the adjustment of pensions, social insurance benefits, and monthly allowances.
Article 1. Scope of application
1. The subjects specified in points a, b, c, h, and i Clause 1 Article 1 of Decree No. 42/2023/NĐ-CP receiving pensions, social insurance benefits, and monthly allowances before July 1, 2023.
2. The subjects specified in points a, b, and c Clause 1 Article 1 of Decree No. 42/2023/NĐ-CP retiring to receive pensions, social insurance benefits, and monthly allowances before January 1, 1995 (including those who had retired to receive disability allowances before January 1, 1995, and subsequently continued to receive allowances under Decision No. 91/2000/QĐ-TTg dated August 4, 2000 of the Prime Minister on providing allowances to those who have reached retirement age at the time they stopped receiving monthly disability allowances and Decision No. 613/QĐ-TTg dated May 6, 2010 of the Prime Minister on providing monthly allowances to those with from 15 to less than 20 years of actual service who have reached the end of their entitlement to disability allowances) shall, after implementing the adjustment as stipulated in Clause 1 Article 2 of this Circular, have their pensions, social insurance benefits, and monthly allowances below VND 3,000,000/month.
Article 2. Adjustment of Pensions, Social Insurance Benefits, and Monthly Allowances
1. From July 1, 2023, the pensions, social insurance benefits, and monthly allowances of the subjects specified in Clause 1 Article 1 of this Circular shall be adjusted as follows:
a) Increase by 12.5% over the pension, social insurance benefit, and monthly allowance of June 2023 for the subjects specified in Clause 1 Article 1 of this Circular that have been adjusted according to Decree No. 108/2021/NĐ-CP dated December 7, 2021 of the Government adjusting pensions, social insurance benefits, and monthly allowances. Article 3. Implementation Organization
1. Provincial People's Committees are responsible for directing the Departments of Labor, Invalids, and Social Affairs and relevant agencies to disseminate, publicize, inspect, and urge the implementation of the regulations on adjusting pensions, social insurance benefits, and monthly allowances as stipulated in this Circular.
2. The Vietnam Social Security is responsible for implementing the adjustment of pensions, social insurance benefits, and monthly allowances as prescribed in Decree No. 42/2023/NĐ-CP and guided in this Circular; prepare reports according to the model attached to this Circular and submit them to the Ministry of Labor, Invalids, and Social Affairs and the Ministry of Finance before December 31, 2023.
Article 4. Effective date
1. This Circular takes effect from August 14, 2023. The provisions of this Circular shall be implemented from July 1, 2023.
2. The provisions of Clause 1, Clause 2 Article 1, Article 2, Article 4, and Clause 2 Article 5 of Circular No. 37/2021/TT-BLDTBXH dated December 31, 2021 of the Minister of Labor, Invalids, and Social Affairs guiding the adjustment of pensions, social insurance benefits, and monthly allowances, and the date of entitlement to pensions for cases without original files cease to be effective from the date this Circular takes effect. In the course of implementation, if there are difficulties, please reflect them to the Ministry of Labor, Invalids, and Social Affairs for research and resolution.
