Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Fisheries Law 2017;

At the proposal of the Director of the Fisheries Department;

The Minister of Agriculture and Rural Development issues this Circular amending and supplementing certain Articles of Circular No. 23/2018/TT-BNNPTNT dated November 15, 2018 of the Minister of Agriculture and Rural Development stipulating fishery vessel inspectors; recognition of fishery vessel inspection facilities; ensuring technical safety of fishing vessels and fisheries surveillance vessels; registration of fishing vessels and fisheries service vessels; cancellation of fishing vessel registration and marking of fishing vessels.

Article 1. Amending and supplementing certain Articles of Circular No. 23/2018/TT-BNNPTNT dated November 15, 2018 of the Minister of Agriculture and Rural Development stipulating fishery vessel inspectors; recognition of fishery vessel inspection facilities; ensuring technical safety of fishing vessels and fisheries surveillance vessels; registration of fishing vessels and fisheries service vessels; cancellation of fishing vessel registration and marking of fishing vessels

1. Supplement Clause 6a following Clause 6 of Article 21 as follows:

"6a. Documents for fishing vessels as prescribed in Clause 4 of Article 27 of this Circular include:

a) A declaration form for registering fishing vessels with the confirmation of the People's Committee of the commune where the owner of the vessel has registered their permanent residence according to Appendix XII attached hereto;

b) A copy of the Technical Safety Certificate of fishing vessels with a maximum length of 12 meters or more;

c) The original Notice of payment of stamp duty for the vessel;

d) A color photograph (9cm x 12cm) showing the entire vessel from both sides."

2. Supplement Clause 4 of Article 27 as follows:

"4. Reviewing, compiling, and submitting to the People's Committee of the province for publication the list of newly built, modified, purchased, or gifted fishing vessels that were operating before the effective date of this Circular but do not have complete documents as required under Clauses 2, 3, 4, 6 of Article 21, and widely announcing it through local mass media."

3. Supplement Clause 5 of Article 32 as follows:

"5. The deadline for receiving documents for fishing vessels as prescribed in Clause 6a of Article 21 is until December 31, 2024."

4. Supplement Appendix XII with the Appendix attached hereto.

Article 2. Replacing and supplementing certain terms and phrases in Circular No. 23/2018/TT-BNNPTNT dated November 15, 2018 of the Minister of Agriculture and Rural Development stipulating fishery vessel inspectors; recognition of fishery vessel inspection facilities; ensuring technical safety of fishing vessels and fisheries surveillance vessels; registration of fishing vessels and fisheries service vessels; cancellation of fishing vessel registration and marking of fishing vessels

1. Replace the phrase "Director General of the Fisheries General Department" in the basis for issuing the document, Clause 2 of Article 10, Point d of Clause 3 of Article 12, Appendix II, and Appendix III with the phrase "Director of the Fisheries Department".

2. Replace the phrase "Fisheries General Department" in Articles 8, 9, 11, 12, 21, 26, 27, 28, 29, 33, and the Appendices with the phrase "Fisheries Department".

Article 3. Implementation Provisions

1. This Circular takes effect from May 6, 2024

2. During the implementation of this Circular, if there are any difficulties, please promptly report to the Ministry of Agriculture and Rural Development for guidance, research, and appropriate amendments and supplements./.
