CIRCULAR
PROVISIONS ON PROFESSIONAL TITLES AND CHANGES TO PROFESSIONAL TITLES FOR CIVIL SERVANTS
Circular No. 12/2012/TT-BNV dated December 18, 2012, issued by the Minister of Home Affairs, on professional titles and changes to professional titles for civil servants, which took effect from February 15, 2013, was amended and supplemented by:
1.[1] Circular No. 03/2019/TT-BNV dated May 14, 2019, issued by the Minister of Home Affairs, amending and supplementing certain provisions on recruitment of public officials and civil servants, promotion of ranks for public officials, promotion of professional titles for civil servants, and implementation of employment contracts for certain types of work in administrative state agencies and public service units, which took effect from July 1, 2019.
Pursuant to the Law on Civil Servants dated November 15 200810;
Pursuant to Decree No. 249/2009/NĐ-CP9/2012dated November 12 2009 4 of the Government on recruitment, utilization, and management2 of civil servants Pursuant to Decree No.;
29/2012/NĐ-CP 61/2012dated November 10 2009 8 dated April 1212 2012of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home AffairsThe Minister of;
Home Affairs hereby issues this Circular on professional titles and changes to professional titles for civil servants. This Circular stipulates the procedures and formalities for establishing professional titles and changing professional titles for civil servants in public service units. Article 2. Management content regarding professional titles 1. Professional titles are names that reflect the level of expertise and professional skills of civil servants in specific fields; they serve as a basis for implementing recruitment, utilization, and management of civil servants.
Chapter I. GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
2. The Ministry of Home Affairs shall specify the list, code numbers, and classification of professional titles for civil servants.
3. The specialized civil servant management ministry (hereinafter referred to as the specialized civil servant management ministry) shall establish the professional standards for each professional title of civil servants within the specific sector or field under its management, after reaching consensus with the Ministry of Home Affairs. These professional standards include a list of professional titles and specific criteria for each professional title, classified into levels from Class I to Class IV as prescribed in Clause 2, Article 3 of Decree No. 29/2012/NĐ-CP dated April 12, 2012, of the Government on recruitment, utilization, and management of civil servants (hereinafter referred to as Decree No. 29/2012/NĐ-CP).
Article 3. Organization of examinations or reviews for promotion of professional titles
1. The specialized civil servant management ministry shall specify detailed criteria and conditions for registration to participate in examinations or reviews for promotion of professional titles for civil servants, after obtaining the agreement of the Ministry of Home Affairs.
2. The organization of examinations or reviews for promotion of professional titles must be carried out in accordance with the regulations of the Examination Regulations and Promotion Review Regulations.
3. Based on the characteristics of professional activities and specific conditions of the unit, industry, or field of activity, the agencies or units authorized to organize examinations or reviews for promotion of professional titles shall decide on the examination form or review form for promotion of professional titles for civil servants according to the authority stipulated in Article 30 of Decree No. 29/2012/NĐ-CP.
ESTABLISHING PROFESSIONAL TITLES
Article 4. Procedures and formalities for establishing professional titles
1. The specialized civil servant management ministry, based on requirements, characteristics, and nature of professional activities, shall take the lead and coordinate with relevant agencies to develop and issue the professional standards for civil servants in the sectors or fields under its management through the following steps:
Chapter II. a) Conduct surveys, assessments, and evaluations of the current status of the number, structure, and quality of the civil servant workforce in the sector or field; the current status of training systems according to professional title requirements; the existing civil servant rank systems and their standards;
b) Based on the results of the surveys, assessments, and evaluations of the current status of the civil servant workforce as specified in Point a of this Clause and strategic development directions for the managed sector or field, determine the necessity to establish new or amend and improve standards, propose a list and standards for professional titles of specialized civil servants and the classes of these titles;
c) Draft the professional standards for each professional title of specialized civil servants;
2. The Ministry of Home Affairs shall reach consensus with the specialized civil servant management ministry on the draft professional standards for each professional title of specialized civil servants; assign code numbers to each specific professional title.
3. The specialized civil servant management ministry shall incorporate and finalize the draft professional standards for each professional title of civil servants based on the opinions of the Ministry of Home Affairs, and issue them according to its authority.
c) Draft Code of occupational titles for specialized civil servants;
2. The Ministry of Home Affairs coordinates with the management ministry of specialized civil servants on the draft Code of occupational titles for specialized civil servants; assigns a code number to each specific occupational title.
3. The management ministry of specialized civil servants incorporates and perfects the draft Code of occupational titles for specialized civil servants based on the opinions of the Ministry of Home Affairs, and promulgates the Code according to its authority.
Article 5. General Structure of Professional Title Standards
Each professional title shall consist of the following:
1. Name and grade of the professional title.
2. Duties: list in detail and specifically the tasks to be performed at a level of complexity appropriate to the grade of the professional title.
3. Professional ethics standards.
4. Education and training standards.
5. Specialized knowledge and skills standards.
Chapter III. CHANGE OF PROFESSIONAL TITLE
Article 6. Review for Transfer of Professional Titles
1. The review for transferring from one professional title to another of the same grade for civil servants must ensure the following conditions:
a)[2] The civil servant is assigned to a new position requiring a different professional title of the same grade or having the same educational qualification requirements as the current professional title;
b) The civil servant meets the standards of the new professional title.
2. The review for transferring to a different professional title of the same grade for civil servants shall be conducted as follows:
a) The head of the public service unit organizes the examination of the certificates and training certificates of the civil servant; checks and tests their knowledge, specialized knowledge, vocational skills, and other requirements according to the standards of the new professional title corresponding to the new position through interviews or practical exercises;
b) If the civil servant meets all the standards of the new professional title corresponding to the new position, the head of the public service unit issues a decision on appointment within their authority or proposes the competent authority managing civil servants to appoint them to the new professional title.
3. When reviewing for transfer to a different professional title of the same grade without combining with a salary increase for civil servants.
Article 7. Building a Plan for Promotion Examination or Review for Promotion of Professional Titles
1. Based on the proposed promotion quota of professional titles of units reported in Model 1 issued together with this Circular, the agency authorized to organize the promotion examination or review for promotion of professional titles shall build a plan to organize the promotion examination or review for promotion of professional titles to implement according to the provisions of Article 30 of Decree No. 29/2012/ND-CP.
2. The agency authorized to organize the promotion examination or review for promotion of civil servants' professional titles shall send the project and plan to the agencies specified in Clause 1 and Clause 2 of Article 31 of Decree No. 29/2012/ND-CP.
Article 8. Basis for Promoting Professional Titles[3]
1. Based on the nature, characteristics of professional activities and specific conditions of the unit, industry, field of public service activities, agencies and units assigned to organize examinations or reviews for promotion of professional titles Pursuant to Decree No. stipulated in Article 30 of Decree No. 29/2012/ND-CP amended and supplemented in Clause 14 of Article 2 of Decree No. 161/2018/ND-CP decide the form of examination or review for promotion of professional titles for civil servants under their management authority.
2. VPromotion examination or review for promotion of civil servants' professional titles is based on:
a) List, number of job positions and organizational structure of civil servants by professional titles approved by the competent authority;
b) Number of civil servants lacking in the required professional titles according to job position requirements;
c) Public service units with a need to promote civil servants' professional titles;
d) Standards and conditions of the registered professional titles for examination or review for promotion.
Article 9. Standards and Conditions for Registration for Promotion Examination or Review for Promotion of Professional Titles
Civil servants may register for promotion examination or review for promotion of professional titles when they meet the following standards and conditions:
1. There is a need from the public service unit.
2. They have satisfactorily completed their duties during the last three consecutive years of work; possess professional qualities and ethics; are not currently undergoing disciplinary action or have been notified about the consideration of disciplinary action by the competent authority.
3. They have sufficient education, training, and specialized knowledge and skills of the higher-grade professional title in the same field as the current held grade.
4. They meet other requirements set by the Ministry managing the relevant civil servants.
Article 10. Application for Registration for Promotion Examination or Review for Promotion of Professional Titles
1. The application for registration for promotion examination or review for promotion of professional titles includes:
a) Application for registration for promotion examination or review for promotion of professional titles;
b) Brief curriculum vitae of the civil servant according to Model 2 issued together with this Circular, confirmed by the employing or managing agency;
c) Comments and evaluations by the head of the employing agency who does not hold a managerial position or by the head of the agency or organization authorized to appoint managerial civil servants;
d) Copies of certificates and training certificates according to the requirements of the registered professional title for examination or review, certified by the competent authority;
đ) Other requirements according to the standards of the grade of the professional title that the civil servant is applying for examination or review for promotion.
2. The retention and management of applications for registration for promotion examination or review for promotion of professional titles of civil servants shall be carried out as follows:
a) For the examination or review for promotion of professional titles from Grade II to Grade I, the application of the civil servant sent to participate in the examination or review for promotion shall be submitted to the Ministry of Home Affairs for consideration, decision, and retention and management;
b) For the examination or review for promotion of professional titles from Grade IV to Grade III and from Grade III to Grade II, the application of the civil servant sent to participate in the examination or review for promotion shall be retained and managed by the agency authorized to send civil servants to participate in the examination or review for promotion of professional titles.
Article 11. Procedures, formalities, and authority for nominating officials to participate in examinations or promotions to occupational titles
1. Based on guidelines for organizing examinations or promotions to occupational titles issued by the competent authority organizing such examinations or promotions, public service units shall prepare lists and files of officials meeting all standards and conditions, and submit them to the competent authority for nominating officials to participate in examinations or promotions, along with reports on the job position directory and occupational title structure that have been approved by the competent authority; and reports on the current quality status of the official workforce of the unit.
2. The competent authority for nominating officials to participate in examinations or promotions to occupational titles shall compile the proposals from public service units under its management, conduct preliminary screening, and nominate officials who meet the required standards and conditions to participate in examinations or promotions to occupational titles as prescribed.
3. The document nominating officials to participate in examinations or promotions to occupational titles shall be sent to the competent authority organizing the examination or promotion, accompanied by a list of officials participating in the examination or promotion according to Model No. 3 issued together with this Circular.

Article 12. Organization of Examinations or Promotions to Occupational Titles[5]
1. When organizing examinations or promotions to occupational titles for officials, the competent authority organizing such examinations or promotions must develop an Examination or Promotion Plan. The plan includes the following contents:
a) Report on the quantity and structure of officials by occupational titles currently held by agencies, organizations, and units within their management scope;
b) The number of officials needed for the occupational titles being examined or promoted to meet the requirements of job positions;
c) List of officials meeting the standards and conditions to be nominated to participate in examinations or promotions to occupational titles;
d) Objectives, standards, conditions, and application forms for those registering to participate in examinations or promotions to occupational titles; examination or promotion content, form, and time;
đ) Proposed members to join the Examination or Promotion Board;
e) Proposed time, location, and other details for organizing the examination or promotion to occupational titles.
2. The organization of examinations or promotions to occupational titles for officials equivalent to Senior Specialist, Chief Specialist, Specialist, and Staff positions shall be carried out as follows:
a) The occupational title of officials equivalent to Senior Specialist includes the occupational titles of type A3 (groups A3.1 and A3.2) in Table 3 - Professional and Technical Salary Scale for cadres and officials in state public service units issued together with Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary systems for cadres, civil servants, officials, and armed forces personnelá(hereinafter referred to as Decree No. 204/2004/ND-CP) and Decree No. 17/2013/ND-CP dated February 19, 2013 of the Government amending and supplementing certain articles of Decree No. 204/2004/ND-CP (hereinafter referred to as Decree No. 17/2013/ND-CP)After receiving comments from the Ministry of Home Affairs on the content of the Examination or Promotion Plan, the head of the ministry managing the occupational titles of specialized officials shall establish the Examination or Promotion Board; organize examinations or promotions to occupational titles for officials in accordance with the law.b) The occupational title of officials equivalent to Chief Specialist includes the occupational titles of type A2 (groups A2.1 and A2.2) in Table 3 - Professional and Technical Salary Scale for cadres and officials in state public service units issued together with Decree No. 204/2004/ND-CP andDecree No. 17/2013/ND-CPAfter receiving comments from the Ministry of Home Affairs on the content of the Examination or Promotion Plan, the heads of ministries, ministerial-level agencies, government agencies; Chairpersons of provincial and centrally-administered city People's Committees shall establish the Examination or Promotion Board; organize examinations or promotions to occupational titles for officials in accordance with the law.c) The occupational title of officials equivalent to Specialist (occupational title of type A1 in Table 3 - Professional and Technical Salary Scale for cadres and officials in state public service units issued together with Decree No. 204/2004/ND-CP andDecree No. 17/2013/ND-CP); the occupational title of officials equivalent to Staff (occupational title of type A0 in Table 3 - Professional and Technical Salary Scale for cadres and officials in state public service units issued together with Decree No. 204/2004/ND-CP and Decree No. 17/2013/ND-CP):
Based on the delegation of authority of the competent authority organizing examinations or promotions to occupational titles of officials as stipulated in Article 30 of Decree No. 29/2012/ND-CP amended and supplemented at Clause 14 of Article 2 of Decree No. 161/2018/ND-CP, the head of the agency or unit with the authority to organize examinations or promotions to occupational titles shall establish the Examination or Promotion Board; organize examinations or promotions to occupational titles for officials in accordance with the law.
b) Occupational title equivalent to Senior Specialist, including occupational titles of type A2 (groups A2.1 and A2.2) in Table 3 - Salary Table for Professional and Technical Staff for State Officials and Civil Servants in Public Service Units issued together with Decree No. 204/2004/ND-CP and Decree No. 17/2013/ND-CP:
After receiving the opinion of the Ministry of Home Affairs on the content of the examination or promotion proposal, the head of the ministry, agency at ministerial level, or agency under the Government; the Chairman of the People's Committee of a province or centrally governed city shall establish an Examination Board or Promotion Board; organize the examination or promotion of civil servant occupational titles in accordance with the provisions of the law.
c) Occupational title equivalent to Specialist (occupational title of type A1 in Table 3 - Salary Table for Professional and Technical Staff for State Officials and Civil Servants in Public Service Units issued together with Decree No. 204/2004/ND-CP and Decree No. 17/2013/ND-CP);occupational title equivalent to Assistant (occupational title of type A0 in Table 3 - Salary Table for Professional and Technical Staff for State Officials and Civil Servants in Public Service Units issued together with Decree No. 204/2004/ND-CP and Decree No. 17/2013/ND-CP):
Based on the delegation of authority from the competent agency organizing the examination or promotion of civil servant occupational titles as stipulated in Article 30 of Decree No. 29/2012/ND-CP amended and supplemented in Clause 14 of Article 2 of Decree No. 161/2018/ND-CP, the head of the agency or unit with the authority to organize the examination or promotion of civil servant occupational titles shall establish an Examination Board or Promotion Board; organize the examination or promotion of civil servant occupational titles in accordance with the provisions of the law.
Article 13. Examination Board or Promotion Board for Professional Title Rank[6]
1. The Examination Board or Promotion Board for Professional Title Rank (hereinafter referred to collectively as the Promotion Board for Professional Title Rank) shall be established by the head of the agency assigned or delegated to organize examinations or promotions for professional title rank for civil servants as stipulated in Article 30 of Decree No. 29/2012/NĐ-CP, amended and supplemented in Clause 14 of Article 2 of Decree No. 161/2018/NĐ-CP. The Board shall consist of 5 or 7 members, including the Chairman of the Board who is the head or deputy head of the agency assigned or delegated to organize examinations or promotions for professional title rank, and other Board members, among whom there is 1 member兼任秘书。
2. The Promotion Board for Professional Title Rank operates on the principle of collective decision-making, majority voting, and performs tasks and powers prescribed in Clause 4 of Article 31 of Decree No. 29/2012/NĐ-CP.
3. The Promotion Board for Professional Title Rank may use the seal and account of the agency or unit assigned or delegated to organize examinations or promotions for civil servants during the period of performing its tasks and powers, as decided by the head of the agency or unit authorized to establish the Board.
4. The Promotion Board for Civil Servants' Professional Title Rank is responsible for organizing the promotion examination for civil servants according to the Regulations and Internal Rules issued together with this Circular.
Article 14. Determination of Successful Candidates in Examinations or Promotions for Professional Title Rank[7]
1. A civil servant successfully passing the examination for promotion to a professional title rank must take all examination subjects except those exempted under the law; each subject score must reach 50 points or above, with grading on a scale of 100 points.
2. A civil servant successfully passing the promotion examination for professional title rank shall follow the guidelines provided by the Ministry managing the professional title rank of the relevant field regarding the content and form of promotion examination for civil servants within that sector.
3. Results of professional title rank promotion examinations will not be carried forward.
Article 15. Appointment and Salary Classification for Professional Title Rank for Successful Candidates in Examinations or Promotions for Professional Title Rank
1. Based on the announcement from the competent authority organizing the examination or promotion for professional title rank, the appointment to a professional title rank for successful candidates in the examination or promotion for professional title rank shall be carried out as follows:
a)[8] For the examination or promotion for professional title rank equivalent to Senior Officer:
Minister, Head of a ministry-level agency, agency under the Government, Chairman of the People's Committee of a province or centrally governed city, based on the successful admission decision and the recommendation of the competent authority managing civil servants, shall issue a decision on the appointment to the professional title rank and salary classification for the successful candidate after obtaining opinions on conditions and criteria as prescribed by the Ministry of Home Affairs (for state agencies and public service units of the State) or the Central Organization Commission (for public service units of the Communist Party of Vietnam and political-social organizations);
b) For the examination or promotion from Class III to Class II, based on the decision recognizing the results and the recommendation of the competent authority managing civil servants, the Minister, Head of a ministry-level agency, agency under the Government, Chairman of the People's Committee of a province or centrally governed city shall decide on the appointment to the Class II professional title rank for the successful candidate. Subsequently, report the results according to Model No. 4 issued together with this Circular to the Ministry of Home Affairs and the competent authority organizing the examination or promotion for professional title rank for general oversight;

2. The salary classification for civil servants appointed to a professional title rank after successfully passing the examination or promotion for professional title rank shall be implemented in accordance with the regulations and guidance of the Ministry of Home Affairs.
Chapter IV. IMPLEMENTING PROVISIONS
Article 16. Implementation Organization
1. The Ministries managing specialized civil servants shall be responsible for:
a) Organizing the development of the Standard Occupational Titles for specialized civil servants to issue according to the provisions of this Circular;
b)[9] Specifying in detail the criteria, conditions, contents, examination or assessment forms for promotion to higher occupational titles for civil servants under their management after reaching a consensus with the Ministry of Home Affairs.
2. Ministries, ministerial-level agencies, government agencies, provincial People's Committees, and municipal People's Committees directly under the central government shall implement the determination of job positions and the construction of occupational title structures in public service units under their management as a basis for implementing examinations or assessments for promotion to higher occupational titles for civil servants.
Article 17. Effective Date[10]
1. This Circular takes effect from February 15, 2013.
2. Repeal the following documents:
a) Circular No. 10/2004/TT-BNV dated February 19, 2004, issued by the Ministry of Home Affairs guiding the implementation of certain provisions of Government Decree No. 116/2003/NĐ-CP dated October 10, 2003 on recruitment, utilization, and management of cadres and civil servants in state-owned public service units (hereinafter referred to as Decree No. 116/2003/NĐ-CP);
b) Circular No. 04/2007/TT-BNV dated June 21, 2007, issued by the Ministry of Home Affairs guiding the implementation of certain provisions of Decree No. 116/2003/NĐ-CP and Decree No. 121/2006/NĐ-CP dated October 23, 2006, amending and supplementing certain provisions of Decree No. 116/2003/NĐ-CP.
3. Repeal the provisions applicable to civil servants in the following documents:
a) Decision No. 10/2006/QĐ-BNV dated October 5, 2006, issued by the Minister of Home Affairs on the issuance of Regulations on organizing examinations for recruitment and promotion of cadres and civil servants;
b) Decision No. 12/2006/QĐ-BNV dated October 5, 2006, issued by the Minister of Home Affairs on the issuance of Examination Rules for recruitment and promotion of cadres and civil servants.
Article 18. Responsibility for Enforcement[11]
Ministers, heads of ministerial-level agencies, heads of government agencies, Chairmen of provincial People's Committees, and municipal People's Committees directly under the central government, and related agencies, organizations, and individuals are responsible for enforcing this Circular.

Chapter I. GENERAL PROVISIONS ON THE EXAMINATION BOARD
Section 1. EXAMINATION BOARD FOR CIVIL SERVICE EXAMINATIONS AND PROMOTIONS, CIVIL SERVANT RANK PROMOTION EXAMINATIONS, AND PROFESSIONAL RANK PROMOTION EXAMINATIONS OF CIVIL SERVANTS
Article 1. Examination Board
1. The Examination Board for civil service examinations, civil servant promotions, civil servant rank promotions, and civil servant professional rank promotions (hereinafter collectively referred to as the Examination Board) shall be established by the head of the agency or unit authorized to recruit civil servants, promote civil servants, conduct civil servant rank promotions, and conduct civil servant professional rank promotions. The Examination Board operates for each examination period and dissolves itself after completing its tasks.
2. Individuals who have familial relationships such as father, mother, brother, sister, or spouse of the candidate or those currently under disciplinary review or serving a disciplinary decision shall not be appointed as members of the Examination Board.
3. The Examination Board for civil service recruitment shall perform the duties and powers stipulated in Clause 2, Article 7 of Government Decree No. 24/2010/NĐ-CP dated March 15, 2010, on Recruitment, Utilization, and Management of Civil Servants (hereinafter referred to as Decree No. 24/2010/NĐ-CP), amended and supplemented in Clause 3, Article 1 of Government Decree No. 161/2018/NĐ-CP dated November 29, 2018, amending and supplementing certain provisions on civil servant recruitment, civil servant promotion, civil servant rank promotion, and implementation of employment contracts for certain types of work in administrative state agencies and public service units (hereinafter referred to as Decree No. 161/2018/NĐ-CP).
4. The Examination Board for civil servant recruitment shall perform the duties and powers stipulated in Clause 3, Article 6 of Government Decree No. 29/2012/NĐ-CP dated April 12, 2012, on Recruitment, Utilization, and Management of Civil Servants (hereinafter referred to as Decree No. 29/2012/NĐ-CP), amended and supplemented in Clause 2, Article 2 of Decree No. 161/2018/NĐ-CP.
5. The Examination Board for civil servant rank promotion shall perform the duties and powers stipulated in Clause 2, Article 32 of Decree No. 24/2010/NĐ-CP.
6. The Examination Board for civil servant professional rank promotion shall perform the duties and powers stipulated in Clause 4, Article 31 of Decree No. 29/2012/NĐ-CP.
7. The Examination Board may use the seal and account of the agency or unit authorized to recruit civil servants, promote civil servants, conduct civil servant rank promotions, and conduct civil servant professional rank promotions or of the direct advisory agency in the activities of the Examination Board as decided by the head of the agency or unit authorized to establish the Examination Board.
8. In cases where the agency or unit authorized to organize civil servant rank promotions and civil servant professional rank promotions for civil servants under its management decides to organize both civil servant rank promotions and civil servant professional rank promotions simultaneously, a single Examination Board shall be established to organize these promotions. The Examination Board for civil servant rank promotion and civil servant professional rank promotion shall perform the duties and powers as stipulated in Clauses 5 and 6 of this Article.
Article 2. Tasks, powers, and responsibilities of members participating in the Examination Council
1. Chairman of the Examination Council:
a) Shall be responsible for organizing the implementation of the tasks of the Examination Council and directing the organization of civil servant recruitment examinations, public official recruitment examinations, civil servant grade promotion examinations, public official career rank advancement examinations to ensure compliance with examination rules and regulations as prescribed by law;
b) Shall assign specific and clear responsibilities and tasks to each member of the Examination Council;
c) Shall decide on the establishment of the Question Setting Committee, Examination Supervision Committee, Sealing Committee, Marking Committee, Re-examination Committee, and Examination Inspection Committee when conducting interviews at the second round; establish other necessary working groups;
d) Shall organize the development, selection, storage, and retention of questions in accordance with the provisions of this Regulation and ensure the confidentiality of the questions under the "Secret" document classification system;
đ) Shall specify the start time for each section of the multiple-choice test in the first round to ensure uniform implementation;
e) Shall organize the supervision of examinations, management of answer sheets, sealing, unsealing, management of sealed packages, marking, and other operations as prescribed in this Regulation;
g) Shall report to the head of the agency or unit authorized to recruit civil servants, recruit public officials, conduct civil servant grade promotion examinations, and public official career rank advancement examinations for consideration and decision on recognizing the examination results;
h) Shall direct the resolution of recommendations, complaints, and accusations during the organization of the examination period.
2. Vice-Chairman of the Examination Council:
Shall assist the Chairman of the Examination Council in managing the activities of the Examination Council and performing specific tasks assigned by the Chairman of the Examination Council.
3. Members of the Examination Council:
The Chairman of the Examination Council shall assign specific tasks to the members of the Examination Council to ensure that the activities of the Examination Council comply with the provisions of the law.
4. Member兼任书记员协助主席:
a) Prepare necessary documents and materials for the Examination Council; record minutes of meetings and activities of the Examination Council;
b) Organize and prepare study guidance materials for candidates (if applicable);
c) Organize the collection of fees for civil servant recruitment, public official recruitment, civil servant grade promotion examinations, and public official career rank advancement examinations; manage income and expenditure and settle accounts in accordance with the law;
d) Receive and store candidates' answer sheets enclosed in bags or envelopes (hereinafter referred to collectively as answer sheet bags) still sealed from the Head of the Examination Supervision Committee;
đ) Hand over answer sheets enclosed in bags still sealed to the Head of the Sealing Committee;
e) Receive and store answer sheets that have been unsealed and enclosed in bags still sealed from the Head of the Sealing Committee;
g) Hand over answer sheets that have been unsealed enclosed in bags still sealed to the Head of the Marking Committee along with the Marking Score Sheets and perform related operational tasks;
h) Receive and store answer sheet seals enclosed in bags still sealed from the Head of the Sealing Committee after the marking of all subjects has been completed;
i) Receive and store interview and practical performance results enclosed in bags still sealed from the Examination Inspection Committee if interviews and practical performances are conducted at the second round;
k) Match seals, compile, and report results to the Examination Council;
l) Perform other tasks assigned by the Chairman of the Examination Council.
Section 2. ASSISTANT COMMITTEES OF THE EXAMINATION COUNCIL
Article 3. Question Setting Committee
1. The Question Setting Committee shall be established by the Chairman of the Examination Council and consist of the Head and members, including one member兼任秘书。
2. Tasks, powers, and responsibilities of the Head of the Question Setting Committee:
a) Shall organize the implementation of question bank construction and question setting in accordance with the provisions;
b) Shall direct and manage all activities of question bank construction and question setting; shall be responsible to the Chairman of the Examination Council and the law for the work of question bank construction and question setting;
c) Shall maintain the confidentiality of the question bank and questions under the "Secret" document classification system.
3. Tasks, powers, and responsibilities of members of the Question Setting Committee:
a) Shall participate in question bank construction and question setting according to the assignment of the Head of the Question Setting Committee;
b) Shall maintain the confidentiality of questions and the question bank under the "Secret" document classification system.
4. Tasks, powers, and responsibilities of the member兼任秘书:
Record minutes of meetings and activities of the Question Setting Committee and perform other tasks assigned by the Head of the Question Setting Committee.
5. Qualifications of members of the Question Setting Committee:
a) The person appointed as a member of the Question Setting Committee must be a civil servant or public official with professional qualifications and experience in the relevant field corresponding to the requirements of the position to be recruited or the requirements of the civil servant grade or public official career rank being tested;
b) Those who have familial relationships such as father, mother, brother, sister, or spouse of the candidate or their children, or those currently under disciplinary review or serving a disciplinary decision, shall not be appointed as members of the Question Setting Committee;
c) A person appointed as a member of the Question Setting Committee shall not participate in the Examination Supervision Committee.
6. Working principles of the Question Setting Committee:
a) Each member of the Question Setting Committee must individually bear responsibility for the content, confidentiality, and security of the questions in accordance with their duties and the principle of protecting state secrets;
b) Members of the Question Setting Committee shall work independently and directly with the Head of the Question Setting Committee; the person assigned a task shall be responsible for completing that task and shall not participate in other tasks of the Question Setting Committee.
7. Examination question preparation area and confidentiality requirements
a) Unpublished examination questions, marking guidelines, answers, and grading scales belong to the "Secret" level of state secrets. Unused backup examination questions shall be classified as "Secret" after the examination ends;
b) Examination question preparation must be carried out in a secure, isolated location, protected with sufficient confidentiality equipment, fire prevention, and firefighting facilities;
c) The list of participants in the Question Setting Committee must be kept confidential during the examination period. All members involved in preparing questions must be isolated from the outside from the time they gather to prepare questions until the end of the examination. In case of necessity, with the written consent of the Head of the Question Setting Committee, members may be allowed to go out or contact the outside world through fixed-line telephones, conversations must be recorded and monitored or witnessed by members of the Supervisory Committee and representatives of the police department (if invited to participate);
đ) Envelopes containing examination questions for handover, receipt, and transportation from the preparation site to the outside must be made of paper with sufficient durability, tightness, darkness, and securely sealed without peeling edges, and sealed;
e) The entire process of handover, receipt, and transportation of examination questions must be supervised by members of the Supervisory Committee and representatives of the police department (if invited to participate); envelopes containing examination questions must be stored in metal boxes with locks and sealed during handover, receipt, and transportation;
g) Machinery and equipment at the examination question preparation site, whether damaged or unused, can only be removed from the isolation area after the last subject examination has ended;
h) Members of the Question Setting Committee and other related persons must strictly keep the examination questions and multiple-choice questions, interview questions, and practical questions confidential; they are not allowed to disclose them in any form until the end of the examination period assigned to them.
8. Requirements for question setting:
a) General requirements:
Ensure accuracy, scientific rigor, clear wording, and sentence structure;
Must be consistent with the requirements of the civil servant grade or public official career rank corresponding to the position being applied for;
Questions must have reasoning and analytical elements, avoiding rote memorization;
Each question must clearly indicate its point value;
Questions must clearly indicate the word "END" at the end and specify the number of pages (for questions with two or more pages);
Each subject or section of an examination must have a main examination question, a backup examination question, and accompanying marking guidelines and answers. Marking guidelines and answers must include detailed grading scales up to five points.
b) For essay-type questions:
Based on the examination requirements, the Examination Question Committee is responsible for drafting and revising the examination questions, answers, and marking guidelines (both primary and backup versions) for each subject. After drafting and revising, the examination questions, answers, and marking guidelines must be reviewed and proposals for revisions and corrections made if necessary. The review of examination questions, answers, and marking guidelines shall be conducted by members of the Examination Question Committee.
c) For multiple-choice examinations:
The construction of the question bank for multiple-choice examinations must ensure that the number of questions built is at least three times the number specified for each section of the examination. The Chairperson of the Examination Question Committee organizes for members of the Examination Question Committee to review each multiple-choice question according to the requirements of the position being applied for or the professional standards of the civil servant rank or vocational title being tested; after the final revision, the Chairperson of the Examination Question Committee randomly selects questions to form multiple versions of the multiple-choice examination. After reviewing each version of the multiple-choice examination, the Chairperson of the Examination Question Committee signs off on each version and hands it over to the Chairman of the Examination Board for the Chairman to decide on the official and backup examination papers.
d) For interview examinations:
The content of the interview questions must be based on the requirements of the position being applied for or the professional standards of the civil servant rank or vocational title being tested; the structure and content of the interview and practical tests must ensure accuracy, scientific rigor, and comprehensive evaluation of the candidate's abilities and capabilities. Interview questions must have accompanying answers and grading scales, sealed in envelopes, and stored under "Confidential" document regulations.
Article 4. Examination Supervision Committee
1. The Examination Supervision Committee is established by the Chairman of the Examination Board, consisting of: the Chairperson, Deputy Chairperson, and members, including one member兼任秘书。
2. Duties, powers, and responsibilities of the Chairperson of the Examination Supervision Committee:
a) Assist the Examination Board in organizing the examination according to the examination rules and regulations;
b) Arrange examination rooms; assign tasks to the Deputy Chairperson of the Examination Supervision Committee; assign invigilators for examination rooms and corridors for each subject;
c) Receive and store examination papers as prescribed; hand over examination papers to invigilators. When handing over and receiving examination papers, a record must be made to confirm the condition of the examination papers;
d) Temporarily suspend the invigilation duties of invigilators, promptly report to the Chairman of the Examination Board for consideration and decision; terminate the examination for candidates if there is evidence of violation of examination rules and regulations;
đ) Organize the collection of candidates' examination papers, seal the examination papers and hand them over to the Secretary of the Examination Board.
3. Duties, powers, and responsibilities of the Deputy Chairperson of the Examination Supervision Committee:
Assist the Chairperson of the Examination Supervision Committee in managing certain activities of the Examination Supervision Committee as assigned by the Chairperson.
4. Duties, powers, and responsibilities of members of the Examination Supervision Committee assigned as room invigilators:
a) Carry out invigilation duties as assigned by the Chairperson of the Examination Supervision Committee;
b) Must be present on time at the examination venue to perform duties;
c) During the performance of invigilation duties, mobile phones, audio recorders, cameras, computers, technical devices for transmitting and receiving information, data storage devices, other information-containing devices, and related examination materials may not be brought into the examination room; personal work is not allowed; smoking is prohibited; alcoholic beverages or stimulants may not be consumed;
d) Allow candidates to leave the examination room earliest two-thirds of the examination time for written subjects or after the candidate has submitted the examination paper, examination questions, and scratch paper (if any) and signed the submission form. For multiple-choice subjects, allow candidates to leave the examination room only after the examination time has ended and the candidate has submitted the examination paper and signed the submission form. In case a candidate must temporarily leave the examination room, the room invigilator must immediately inform the corridor invigilator who will then report to the Chairperson of the Examination Supervision Committee for consideration and resolution;
đ) If a candidate violates examination rules and regulations, the room invigilator must prepare a record of handling according to regulations. In case of unusual situations, immediately report to the Chairperson of the Examination Supervision Committee;
5. Duties, powers, and responsibilities of room invigilators兼任计算机技术员(适用于计算机化考试):
a) Ensure that the computer system in the examination room operates well; if a computer malfunctions, it must be repaired or replaced promptly;
b) Enter examination data into the server; seal the server and data storage devices when concluding, witnessed by representatives from the Examination Board, Examination Supervision Committee, Examination Oversight Committee, and public security (if invited to participate);
c) Inspect computers in the examination room before, during, and after the examination process;
d) Cooperate with corridor invigilators and room invigilators to check items brought into the examination room by candidates, guide candidates to sit in the correct positions; prevent candidates from bringing prohibited materials into the examination room;
đ) At the end of each session, print the candidates' examination papers, seal the examination paper bags (with signatures of two invigilators), and hand them over to the Chairperson of the Examination Supervision Committee. A record must be made and both parties must sign to confirm when handing over;
e) At the end of each day, seal the server and data storage devices;
g) At the end of the subject, back up all data onto storage devices, seal them, and hand them over to the Chairperson of the Examination Supervision Committee; then delete all data stored on the server. A record must be made and both parties must sign to confirm when handing over.
6. Duties, powers, and responsibilities of members of the Examination Supervision Committee assigned as corridor invigilators:
a) Maintain order and ensure safety outside the examination room;
b) Detect, remind, criticize, and together with the room invigilator prepare a record of candidates violating examination rules and regulations in the corridor area. In case of serious violations such as disrupting order and safety in the corridor area, immediately report to the Chairperson of the Examination Supervision Committee for consideration and resolution;
c) Not allowed to enter the examination room.
7. Duties, powers, and responsibilities of the member兼任秘书:
Record minutes of meetings and activities of the Examination Supervision Committee and carry out other tasks as assigned by the Chairperson of the Examination Supervision Committee.
8. Standards for members of the Examination Supervision Committee:
a) Those appointed as members of the Examination Supervision Committee must be civil servants or staff members;
b) Those who have familial relationships such as parents, siblings, spouses, children (biological or adopted) of the candidates or those currently under disciplinary review or serving disciplinary decisions shall not be appointed as members of the Examination Supervision Committee;
c) Those appointed as members of the Examination Supervision Committee shall not participate in the Examination Question Committee, Marking Committee, Grading Committee, or Re-grading Committee (if applicable).
Article 5. Sealing Committee
1. The Sealing Committee shall be established by the Chairman of the Examination Board, consisting of the Head and members, including one member兼任秘书。
2. Duties, powers, and responsibilities of the Head of the Sealing Committee:
a) Receive examination papers sealed in envelopes still intact from the Secretary Member of the Examination Board.
b) Assign specific tasks to members of the Sealing Committee to organize the numbering and unsealing of examination papers, ensuring that the sealing numbers do not overlap with the candidates' registration numbers.
c) Hand over the sealed examination papers to the Secretary Member of the Examination Board.
d) Seal the sealing numbers and store them under "Confidential" regulations throughout the marking period until the marking is completed.
e) Hand over the sealed examination papers to the Secretary Member of the Examination Board after the marking of all subjects has been completed.
f) Maintain confidentiality of the sealing numbers.
3. Duties, powers, and responsibilities of members of the Sealing Committee:
a) Carry out the numbering and unsealing of examination papers according to the assignment of the Head of the Sealing Committee.
b) Maintain confidentiality of the sealing numbers.
4. Tasks, powers, and responsibilities of the member兼任秘书:
Record minutes of meetings and activities of the Sealing Committee and perform other tasks assigned by the Head of the Sealing Committee.
5. Qualifications of members of the Sealing Committee:
a) Persons appointed as members of the Sealing Committee must be civil servants or public officials.
b) Individuals who have familial relationships such as father, mother, brother, sister, or son-in-law, daughter-in-law, husband, wife, biological or adopted child of the candidate, or those currently under disciplinary review or serving a disciplinary decision shall not be appointed as members of the Sealing Committee.
c) Persons appointed as members of the Sealing Committee shall not participate in the Examination Supervision Committee, the Marking Committee, or the Re-examination Committee (if any).
Article 6. Marking Committee
1. The Marking Committee shall be established by the Chairman of the Examination Board, consisting of the Head and members, including one member兼任秘书。
2. Duties, powers, and responsibilities of the Head of the Marking Committee:
a) Assign marking tasks to members of the Marking Committee, ensuring that each examination paper is marked by at least two members, and organize the marking process in accordance with the examination rules.
b) Before marking, organize and ensure that members of the Marking Committee understand the marking guidelines, answer content, and marking scale. In case of inconsistencies or errors found in the examination questions and marking guidelines, answers, immediately report to the Chairman of the Examination Board for review and decision. Only proceed with marking after receiving instructions from the Chairman of the Examination Board. Do not arbitrarily change the marking guidelines, answers, or marking scale.
c) Receive and store sealed examination papers from the Secretary Member of the Examination Board, then distribute the examination papers along with the marking sheets to members of the Marking Committee.
d) Suspend or replace members of the Marking Committee who lack responsibility or violate examination rules.
e) Compile marking results, seal them, and hand them over to the Secretary Member of the Examination Board. A handover record must be established when handing over the marking results.
f) Maintain confidentiality of the marking scores.
3. Duties, powers, and responsibilities of members of the Marking Committee:
a) Mark examination papers strictly according to the marking guidelines, answer keys, and marking scale. Only mark examination papers on the examination paper format specified by the Examination Board.
b) Report signs of violations in examination papers to the Head of the Marking Committee and propose handling measures.
c) Maintain confidentiality of the marking scores.
4. Tasks, powers, and responsibilities of the member兼任秘书:
Record minutes of meetings and activities of the Marking Committee and perform other tasks assigned by the Head of the Marking Committee.
5. Qualifications of members of the Marking Committee:
a) Persons appointed as members of the Marking Committee must be civil servants or public officials with professional qualifications and work experience relevant to the position required for recruitment or the civil service grade or public official job title being applied for.
b) Individuals who have familial relationships such as father, mother, brother, sister, or son-in-law, daughter-in-law, husband, wife, biological or adopted child of the candidate, or those currently under disciplinary review or serving a disciplinary decision shall not be appointed as members of the Marking Committee.
c) Persons appointed as members of the Marking Committee shall not participate in the Examination Supervision Committee or the Sealing Committee.
Article 7. The Examination Board shall organize interviews at the second round when recruiting civil servants and public officials
1. The Examination Board shall be established by the Chairman of the Examination Council, consisting of the Head and members, including one member兼任秘书。
2. Duties, powers, and responsibilities of the Head of the Examination Board:
a) Organize the interview process according to regulations, ensuring that each candidate must be evaluated by at least two members or more.
b) Compile the interview results along with individual interview score sheets for each candidate, seal them in envelopes, affix seals, and hand over to the Secretary Member of the Examination Council.
c) Maintain confidentiality of the interview scores.
3. Duties, powers, and responsibilities of members of the Examination Board:
a) Conduct interviews and score candidates strictly according to the answer key and grading scale of the interview questions.
b) Report any violations during the interview process to the Head of the Examination Board and recommend appropriate disciplinary actions.
c) Maintain confidentiality of the interview scores.
4. Tasks, powers, and responsibilities of the member兼任秘书:
Record meeting minutes and other activities of the Examination Board and perform other tasks assigned by the Head of the Examination Board.
5. Qualifications for members of the Examination Board:
a) Members of the Examination Board shall be civil servants or public officials with relevant professional qualifications and work experience in the field corresponding to the position being recruited.
b) Individuals who have familial relationships such as parents, siblings, spouses, children (biological or adopted), or those currently under disciplinary review or serving a disciplinary decision shall not be appointed as members of the Examination Board.
Chapter II. ORGANIZATION OF CIVIL SERVICE EXAMINATIONS AND PROMOTIONS, EXAMINATIONS FOR CIVIL SERVANT RANK PROMOTIONS, AND EXAMINATIONS FOR PROFESSIONAL RANK PROMOTIONS OF CIVIL SERVANTS
Section 1. PREPARATION WORK FOR THE EXAMINATION
Article 8. Examination preparation work
1. At least 15 days before the examination date, the Examination Council shall issue a notice summoning candidates to take the exam, specifying: specific time and location for registration procedures; examination fee collection; time and location for preparatory training sessions (if applicable); time and location for the examination; examination format, schedule for each round, section, and subject; and inform all candidates.
2. At least one working day before the examination date, the Examination Council shall post the list of candidates by registration number and examination room, layout diagrams of examination rooms, examination rules, formats, and times for each section and subject at the examination venue.
3. At least one working day before the examination date, the Secretary Member of the Council must complete the following examination preparation tasks:
a) Allocate examination rooms and prepare lists of candidates to enter the examination rooms; lists for candidates to sign and submit their examination papers.
b) Prepare records, including: handover records from the Examination Council to the Printing and Copying Team for examination questions, from the Printing and Copying Team to the Supervision Board, from the Head of the Supervision Board to the invigilators in each examination room; confirmation records of the condition of the question envelopes before cutting open the envelopes to distribute the questions; handling records of examination rule violations; handover records of examination papers and other records necessary for the examination process.
b) Prepare identification cards for members of the Council, Supervision Board, and service teams. Identification cards for the Chairman, Deputy Chairmen, Council Members, and Head of the Supervision Board shall include full name and title. Identification cards for other members shall only include titles.
Article 9. Opening Ceremony
1. Before the start of the examination, an opening ceremony shall be organized.
2. The procedure for organizing the opening ceremony is as follows: flag-raising ceremony; statement of purpose; introduction of representatives; announcement of the decision to establish the Examination Council; announcement of the decision to organize the examination; announcement of the decision to establish the Examination Oversight Board; announcement of the decision to establish the Supervision Board; the Chairman of the Examination Council declares the opening of the examination; dissemination of the examination plan, examination rules, and examination regulations.
Article 10. Organization of Supervision Board Meetings
1. After the opening ceremony, the Head of the Supervision Board shall convene a meeting of the Supervision Board to disseminate the examination plan, rules, regulations, duties, powers, and responsibilities of the Supervision Board members; unify necessary guidelines for invigilators to know and implement to guide candidates uniformly during the examination process.
2. For each subject, at least 60 minutes before the examination begins, the Head of the Supervision Board shall convene a meeting of the Supervision Board to assign invigilators to each examination room according to the principle of not repeating invigilators for different subjects in the same examination room; disseminate necessary guidelines and reminders for invigilators regarding the subject.
3. If necessary, after the end of the subject, the Head of the Supervision Board may convene a meeting of the Supervision Board to draw lessons learned.
Article 11. Arrangement and Layout in Examination Rooms
1. For computer-based multiple choice tests: The examination room shall be arranged with computers to meet the requirement that each examinee uses one computer to directly complete the test.
2. For written tests and paper-based multiple choice tests: Each examination room shall accommodate a maximum of fifty (50) examinees, with each examinee sitting at one desk or being seated at least one (1) meter apart from others. Thirty (30) minutes before the start of the test, the invigilator shall record the registration number of the examinees in the examination room and call them into the examination room.
3. For interview tests: The examination room shall be arranged with tables for examinees to prepare their answers after randomly drawing questions and tables for conducting the interview.
Article 12. Organization of Multiple Choice Tests in Round 1
1. After completing one section of the test, the next section shall be organized.
2. The time from the end of the first section to the start of the subsequent section shall be determined by the Chairman of the Examination Board.
3. Examinees exempted from a particular section may be absent during the examination of that section.
Section 2. ORGANIZATION OF COMPUTER-BASED MULTIPLE CHOICE TESTS
Article 13. Explanation of Terms
In this Regulation, the following terms shall be understood as follows:
1. "Examination Room for Multiple Choice Tests" means a computer room designed and installed with software for multiple choice tests and used to organize examinations in subjects conducted through multiple choice formats.
2. "Server" means a computer used to store test question software, grade tests, and collect test papers from candidates.
3. "Workstation" means a computer used by candidates to receive test questions, complete test papers, and submit test papers.
4. "Multiple Choice Test Software" means software used to organize computer-based multiple choice tests.
5. "Test Questions" means a set of questions generated by the software based on the test structure prepared by the Question Bank Committee.
6. "Incident" means events occurring during the organization of computer-based multiple choice tests that interrupt or prevent the conduct of such tests.
7. "Abnormal Situation" means a unique phenomenon occurring at a specific time and place that has negative consequences for society and individuals.
8. "Question Bank" means a collection of all test questions and answers used to create multiple choice test questions.
Article 14. Responsibilities in Building the Question Bank and Answers
1. Prepare test questions and answers to be included in the computer-based multiple choice test question bank according to the required quantity and design specifications for the multiple choice test software.
2. Direct the typing, coding, sealing, storage, and security of the question bank prior to handing it over to the Examination Board for the conduct of the examination.
Article 15. Construction of the Question Bank
1. Test questions and answers for each section of the computer-based multiple choice test must cover the entire content corresponding to the civil servant rank or vocational title of the candidate.
2. Test questions and answers for computer-based multiple choice tests must be coded according to the requirements of the computer-based multiple choice test software.
3. The content of questions in the question bank must ensure scientific accuracy, coherence, clarity, logical flow, grammatical correctness, analytical reasoning, and avoid rote learning.
Article 16. Responsibilities of Invigilators, Computer Technicians, and Hall Monitors
1. General Provisions:
Must be present on time at the examination venue to perform duties. During the examination supervision, they shall not bring mobile phones, audio recorders, cameras, computers, technical transmission devices, data backup devices, other information-containing devices, or any documents related to the examination content into the examination room; they shall not engage in personal work; they shall not smoke; they shall not consume alcoholic beverages or stimulants.
2. Responsibilities of Examination Room Invigilators:
a) Inspect the examination room; guide candidates to sit in the correct positions;
b) When the signal is given, Invigilator 1 calls candidates into the examination room; Invigilator 2 checks the items brought into the examination room by candidates, guides them to sit in the correct positions, and signs the list of candidates;
c) Prevent candidates from bringing prohibited materials into the examination room; instruct candidates on test-taking rules and examination regulations; fulfill examination supervision duties according to the examination regulations and rules;
d) Examination room invigilators can only answer candidates' inquiries within the prescribed scope. They shall not allow candidates to leave the examination room during the test unless there is an urgent need due to illness or other legitimate reasons, in which case they must promptly report to the Chief Supervisor for review and resolution;
đ) Invigilators must record violations according to the prescribed procedures against candidates who violate examination regulations and rules;
e) Invigilators must immediately report to the Chief Supervisor for review and resolution when abnormal situations occur;
g) Invigilators must protect the test questions during the examination, preventing them from leaking outside the examination room. Invigilators and those serving the examination period shall not discuss, copy, solve, take out, or explain test questions to candidates;
h) Sign the seal on the envelope containing the test scores of candidates for each examination session;
i) At the end of the examination session, proceed to seal the multiple choice examination room.
3. Responsibilities of Invigilators兼任计算机技术人员:
a) Ensure that the computer system in the examination room operates well; if a computer malfunctions, it must be repaired or replaced promptly;
b) Enter the test questions into the server; seal the server and data storage devices for the test questions under the witness of representatives from the Examination Board, Supervision Committee, and Public Security Bureau (if invited to participate). Data entry must be completed within twenty-four (24) hours before the start of the first examination session and documented with confirmation from all parties involved;
c) Inspect computers in the examination room before, during, and after the examination process;
d) Cooperate with corridor invigilators and room invigilators to check items brought into the examination room by candidates, guide candidates to sit in the correct positions; prevent candidates from bringing prohibited materials into the examination room;
đ) After each examination session, print the test papers of the candidates, seal the envelopes containing the test papers (with signatures of two examination room invigilators), and hand them over to the Chief Supervisor. A record must be made and signed by both parties upon handover;
e) At the end of each day, seal the server and data storage devices;
g) At the end of the subject, back up all data onto storage devices, seal them, and hand them over to the Chairperson of the Examination Supervision Committee; then delete all data stored on the server. A record must be made and both parties must sign to confirm when handing over.
4. Responsibilities of Hall Monitors:
a) Monitor all activities outside the examination room;
b) Coordinate with examination room invigilators and computer technicians, guiding candidates before, during, and after the examination process;
c) Observe candidates when they leave the examination room during the examination period (if applicable).
5. Invigilators violating regulations and rules will be dealt with according to the law on cadres, civil servants, and public officials depending on the severity of the violation.
Article 17. Responsibilities of Candidates
1. Candidates must be present in the examination room before the examination time as prescribed to complete registration procedures.
2. Candidates shall not bring into the examination room any types of documents, telephones, cameras, technical devices for receiving or transmitting information, data storage devices, audio or video recording equipment, or any devices containing or transmitting information. If candidates bring any of these items into the examination room, whether used or unused, they will be considered to have violated the examination rules and regulations and must be dealt with according to the provisions.
3. When entering the examination room, candidates must present their Identity Card or Citizen Identification Card or other valid identification documents for the invigilator to check; sign the candidate list; if any errors or mistakes regarding name, date of birth, or other related information are discovered, they must immediately report to the invigilator for correction.
4. In the examination room, candidates must comply with the following regulations:
a) Obey all instructions from the invigilators; maintain order in the examination room; smoking or using stimulants is strictly prohibited in the examination room;
b) If a non-functional computer is detected, candidates must promptly report it to the invigilator for inspection and resolution. Any acts that damage the computer system used for the examination are strictly forbidden;
c) Candidates who have questions must ask the invigilator publicly; in case of unexpected illness, they must report to the invigilator for handling. Candidates may only move around within the examination room or leave the examination room with the invigilator's consent;
d) Any acts of copying or transmitting examination-related information out of the examination room or receiving information from outside are strictly prohibited.
5. Candidates may only leave the examination room after submitting their answer sheets and signing the examination result sheet. If candidates do not sign the examination result sheet, they will receive zero points. If the invigilator discovers that someone signed on behalf of another candidate, both the signer and the person signed for will receive zero points.
Article 18. Rights of Candidates
1. In case candidates encounter technical issues with the terminal during the examination, they must immediately inform the invigilator to record the incident and be allowed to retake the examination in the same session.
2. Candidates have the right to report violations of examination rules and regulations to the invigilator, Examination Board Chairperson, or members of the Examination Council.
Article 19. Handling Appeals Regarding Examinations
1. There will be no re-examination for multiple-choice examinations conducted on computers.
2. If candidates discover errors in examination questions, they must submit an appeal letter immediately after the examination session ends to the Examination Board. The Examination Board Chairperson is responsible for reporting to the Examination Council Chairperson for immediate review and resolution during the examination session. Appeals regarding computer-based examinations received after the specified time will not be processed.
Section 3. ORGANIZATION OF PAPER-BASED MULTIPLE CHOICE EXAMINATIONS, WRITTEN EXAMINATIONS, AND INTERVIEWS
Article 20. Examination Question Preparation Work
1. The Examination Council Chairperson directs the Examination Question Committee to organize the development of examination questions and report to the Examination Council Chairperson for decision on selecting the examination questions.
2. The content of the examination questions must align with the requirements of the position being recruited and based on the professional standards of the civil servant grade or vocational title of the candidate. Each set of examination questions must include marking guidelines, answers, and detailed grading scales. Examination questions must be sealed in envelopes, sealed, and stored according to the "Confidential" document management system. All handovers, receipt, and opening of examination questions must be documented in a record.
3. For written examinations: At least one main examination question and one backup examination question must be prepared. Examination questions are duplicated and distributed to each candidate.
4. For multiple-choice examinations: At least two main examination questions and two backup examination questions with different question codes must be prepared. Examination questions are duplicated and distributed to each candidate. Candidates sitting next to each other must not use identical examination questions.
5. For interview examinations: A surplus number of candidates must be ensured compared to the number of candidates called for each recruitment position to allow candidates to draw lots randomly.
6. Duplication of examination questions (written and multiple-choice) is decided by the Examination Council Chairperson, ensuring completion at least 30 minutes before the Examination Board meeting to assign invigilators. After duplication, examination questions are sealed in bags, sealed, and stored according to the "Confidential" document management system. Participants involved in duplicating examination questions must be isolated until the end of the examination session.
7. Copying, Transporting, and Handing Over Examination Questions:
a) Examination Question Copying Team:
The Examination Question Copying Team is established by the Examination Council Chairperson, including the Team Leader and team members.
The Examination Question Copying Team works in isolation from the moment the examination questions are unsealed for copying until the end of the examination session for the subject that has been copied.
The Team Leader of the Examination Question Copying Team is personally responsible to the Examination Council Chairperson and under the law for the following tasks: Receiving original examination questions, organizing the copying of examination questions, storing and handing over examination questions sealed in bags to the Examination Board Chairperson in the presence of the Council Secretary, Examination Supervision Board member, and police representative (if invited).
b) Copying Examination Questions:
Examination questions are copied sequentially for each subject; after copying, they are sealed and packaged according to the examination room, cleaned up, and then moved on to copy the next subject's examination questions. During the copying process, the quality of the copies must be checked; defective copies must be collected, bagged, sealed, and destroyed after the examination session ends.
Record the examination venue, examination room, subject, and number of examination questions on each bag before packaging the examination questions.
Package the correct number of examination questions according to the subject listed on the bag, providing enough examination questions for each examination room. Each subject must have one backup bag (for multiple-choice questions, all question codes must be included); the number of backup examination questions is determined by the Examination Question Copying Team Leader. After copying, seal and store in a metal box with a lock.
During the copying process, the Examination Question Copying Team is responsible for managing all examination question envelopes, including excess, defective, blurry, damaged, or dirty copies that have been discarded.
c) Transporting and Handing Over Examination Questions:
When transporting and handing over examination questions from the Examination Question Copying Team to the Examination Board Chairperson, the examination questions must be stored in a metal box with a lock and sealed; when handing over, a record must be made with the presence of the Council Secretary, Examination Supervision Board member, and police representative (if invited).
Article 21. Examination Paper and Scratch Paper
1. For written examination format, the examination paper shall be pre-printed according to the model determined by the Examination Board and signed by the invigilators in the examination room.
2. For multiple-choice examination on paper, candidates shall directly answer questions on the Multiple Choice Examination Answer Sheet as decided by the Examination Board.
3. Scratch Paper: A uniform type of scratch paper shall be provided by the Examination Board and signed by the invigilator in the examination room.
Article 22. Confirmation of Exam Question Status and Opening of Exam Questions
1. The invigilator in the examination room invites two candidate representatives to check the sealing of the envelope containing the exam questions and sign the confirmation record for the sealed envelope.
2. In case the envelope containing the exam questions loses its seal or shows other suspicious signs, the invigilator in the examination room shall prepare a report (with confirmation from two candidate representatives) in the examination room; simultaneously, notify the Chief Invigilator to report to the Chairman of the Examination Board for consideration and resolution.
3. After opening the exam questions, if errors in the exam questions (errors in the questions, wrong exam questions, missing pages, extra pages) or discrepancies in the number of exam questions are discovered, the first invigilator in the examination room must immediately inform the Chief Invigilator to prepare a report; at the same time, the Chief Invigilator must immediately report to the Chairman of the Examination Board for consideration and resolution.
4. The use of backup exam questions shall be decided by the Chairman of the Examination Board.
Article 23. Calculation of Examination Time
1. For written examination format: The examination time starts from the moment when the invigilator finishes distributing the exam questions to each candidate and reads out the entire content of the exam questions. The time for the invigilator to distribute the exam questions is five minutes. The total examination time is recorded on the exam questions. The invigilator in the examination room records the start time and submission time on the board in the examination room.
2. For multiple-choice examination: The examination time starts five minutes after the invigilator in the examination room finishes distributing the exam questions to the candidates. The time for the invigilator to distribute the exam questions is ten minutes. The total examination time is recorded on the exam questions. The invigilator in the examination room records the start time and submission time on the board in the examination room.
3. For interview examination format: The maximum preparation and response time for each candidate is thirty minutes.
Article 24. Supervision of Examinations and Collection of Examination Papers
1. Supervision of Examinations:
Each examination room is assigned two invigilators, one of whom is designated by the Chief Invigilator to be primarily responsible for supervising the examination in the room (referred to as the first invigilator). When assigned the duty to supervise the examination in the room, the invigilator in the examination room performs the following steps:
a) Inspect the examination room, assign registration numbers to candidates in the room;
b) Upon receiving the signal, call candidates into the room; check the Identity Card or Citizen Identification Card or other valid identification of the candidates; guide candidates to sit in their designated seats; only allow candidates to bring into the room items permitted by regulations, not allowing them to bring in prohibited materials and items as stipulated in this Regulation;
c) Upon receiving the signal, the first invigilator collects the exam questions, the second invigilator reminds candidates of necessary examination room discipline; clearly write their names and sign on enough answer sheets and scratch papers to be distributed to candidates (without signing extra); guide and inspect candidates folding the answer sheets properly, writing registration numbers and filling in necessary information of candidates on the answer sheets before starting the examination. If candidates request additional answer sheets or scratch papers, the invigilator must sign these sheets before distributing them to candidates;
d) Upon receiving the signal, the first invigilator holds up the envelope containing the exam questions so that candidates can see both sides and the sealing status of the envelope, then ask two witnesses to sign the confirmation record of the exam question status; subsequently open the envelope containing the exam questions, check the number of exam questions; upon receiving the signal or at the time of distributing the exam questions, proceed to distribute the exam questions to candidates;
đ) During the examination period, one invigilator oversees from the front to the back of the room, the remaining invigilator oversees from the back to the front until the end of the examination; invigilators may not stand next to any candidate or assist candidates in completing the examination under any form; they may only publicly answer candidates' questions within the scope specified by regulations;
e) The invigilator in the examination room is responsible for protecting the exam questions during the examination, preventing them from being leaked outside the room. Fifteen minutes after the examination time has been calculated, the invigilator in the examination room hands over any excess sealed exam questions to the member designated by the Chief Invigilator;
g) Fifteen minutes before the end of the examination time (for written and multiple-choice examinations), the invigilator in the examination room informs candidates of the remaining time to check and complete necessary information on the answer sheets before submitting them;
2. Collection of Examination Papers:
a) For written examinations:
Only collect examination papers from candidates at least two-thirds of the examination time has passed.
At the end of the examination time, the invigilator requests candidates to stop working; the first invigilator calls each candidate's name to submit their papers while collecting them, and must count the total number of answer sheets submitted by each candidate, requiring the candidate to correctly record the total number of sheets and sign the collection list after submitting the papers; only then can the candidate leave the room. The second invigilator maintains order and discipline in the room;
b) For multiple-choice examinations on paper:
Collect examination papers from candidates only after the examination time has ended.
At the end of the examination time, both invigilators in the room collect all candidates' papers, then call each candidate individually to sign and submit their papers; during the signing process, the invigilator must recheck the candidate's submitted papers; only after signing and submitting the papers can the candidate leave the room;
c) The invigilator in the examination room checks and arranges the collected papers in ascending order of registration numbers. Any violation handling records (if any) must be attached to the candidate's papers. The invigilator in the examination room hands over the collected papers to the members designated by the Chief Invigilator for the task of collecting papers after each session. Each envelope of collected papers must be publicly checked and compared with the number of papers, total number of sheets of each paper, collection list, and any disciplinary records (if any);
d) After checking, the envelope containing the collected papers and the collection list of each room are sealed on the spot by the member designated by the Chief Invigilator for the task of collecting papers together with the two invigilators in the room; simultaneously, they sign the handover record. The envelope containing the collected papers is sealed in the middle of the edges. Finally, the Chief Invigilator seals the envelope containing the collected papers before handing it over to the Secretary of the Examination Board.
Article 25. Grading Written Exams and Paper-Based Multiple Choice Tests
1. The grading process shall be uniformly conducted at one location, equipped with fire prevention and firefighting facilities.
2. Examination rooms containing answer sheets, cabinets, boxes, or other equipment for storing answer sheets must be locked and sealed; keys shall be kept by the Member兼任秘书的考试委员会; when opening or closing, a record shall be made and signed to confirm, witnessed by members of the Examination Supervision Committee and representatives of the public security agency (if invited to participate).
3. Answer sheets of candidates shall not be removed from the grading site.
4. Mobile phones, audio recorders, cameras, computers, technical devices for transmitting and receiving information, data backup devices, other information storage devices, personal papers, erasers, pencils, and other types of pens not specified by the Grading Committee shall not be brought into or out of the grading area. The type of pen used for grading shall be determined by the Head of the Grading Committee and recorded in the minutes of the Grading Committee meeting.
5. Before grading, the Head of the Grading Committee shall organize a meeting of the Grading Committee to assign tasks; the grading process shall be carried out in accordance with the marking guidelines, answers, and scoring criteria of the examination questions.
6. The grading process shall be conducted according to the principle of two independent rounds of grading as follows:
a) First round of grading (Grader 1):
The Head of the Grading Committee shall randomly draw original envelopes containing answer sheets and distribute them individually to each grader.
Prior to grading, each grader shall check each answer sheet to ensure the correct number of pages and page numbers, and cross out all blank spaces left unused by the candidate.
Answer sheets completed on paper different from that provided for the examination shall not be scored. In cases where answer sheets are found to be missing pages or page numbers, or are completed on scratch paper, or on paper different from that provided for the examination, or contain writing by more than one person, or writing in different ink colors including red ink, pencil, or unrelated content drawn or written, or crumpled answer sheets, or those with suspicious markings, the grader shall return these answer sheets to the Head of the Grading Committee for review and handling.
During the first round of grading, apart from crossing out unused spaces, graders shall not write any additional content or marks on the answer sheets or envelopes. Individual item scores, total score of the answer sheet, and comments (if any) shall be detailed recorded on the grading sheet and attached together with the answer sheet; the grading sheet shall clearly state the name and signature of the grader.
b) Second round of grading (Grader 2):
After the graders assigned to the first round of grading have completed their work, the Head of the Grading Committee shall remove the grading sheets from the envelopes and randomly draw new envelopes containing answer sheets and distribute them individually to each grader for the second round, ensuring that the same grader does not receive the same envelope again.
Grader 2 shall not write any additional content or marks on the answer sheets or envelopes.
Grader 2 shall grade directly on the answer sheets. Points for each sub-item must be recorded at the margin of the answer sheet next to the graded item; subsequently, the partial score and total score shall be recorded in the designated space on the answer sheet according to regulations, with the full name and signature clearly recorded on all examination papers.
Upon completion of grading for each envelope, Grader 2 shall return the envelope to the Head of the Grading Committee.
7. Handling of grading results after two graders have completed their work:
a) If the total scores of the two graders differ by five points or less (excluding cases of incorrect point addition), the average score of the two graders shall be taken as the official score of the answer sheet and recorded in the designated space. All graders involved in grading this answer sheet shall sign and clearly record their full names on all examination papers.
b) If the total scores of the two graders differ by more than five points but less than ten points (excluding cases of incorrect point addition), the Head of the Grading Committee shall discuss with the two graders. If consensus cannot be reached, the Head of the Grading Committee shall determine the official score of the answer sheet. All graders involved in grading this answer sheet shall sign and clearly record their full names on all examination papers.
c) If the total scores of the two graders differ by ten points or more, the Head of the Grading Committee shall assign a third grader to grade the answer sheet.
8. Handling of results after the third grader has completed grading:
a) If the results of two out of three graders are the same, that score shall be taken as the official score of the answer sheet and recorded in the designated space. All graders involved in grading this answer sheet shall sign and clearly record their full names on all examination papers.
b) If the results of the three graders differ by up to ten points, the average score of the three graders shall be taken as the official score. All graders involved in grading this answer sheet shall sign and clearly record their full names on all examination papers.
c) If the results of the three graders differ by ten points or more, the Head of the Grading Committee shall organize a collective grading session and determine the official score. All graders involved in grading this answer sheet shall sign and clearly record their full names on all examination papers.
9. After completing the grading of all answer sheets for each subject, the Head of the Grading Committee shall compile the scores into a comprehensive summary with signatures of all graders and the Head of the Grading Committee, accompanied by individual grading sheets of each grader, placed in sealed envelopes, sealed, and handed over to the Member兼任秘书的考试委员会 for subsequent procedures. The handover shall be documented with the presence of members of the Examination Supervision Committee and representatives of the public security agency (if invited to participate).
Article 26. Rechecking written exams and multiple-choice paper-based exams
1. The deadline for submitting rechecking requests and conducting rechecks during civil servant recruitment examinations, public official recruitment examinations, and civil servant grade promotion examinations shall be carried out in accordance with the provisions of Decree No. 161/2018/NĐ-CP.
2. The deadline for submitting rechecking requests and conducting rechecks during examinations for upgrading vocational titles of public officials shall be implemented according to the deadline for submitting rechecking requests and conducting rechecks for civil servant grade promotion examinations as stipulated in Clause 1 of this Article.
3. Rechecking will not be conducted for rechecking request forms received after the prescribed deadline (counted from the date of sending the form as evidenced by the postmark on the envelope if sent via postal service); rechecking will not be conducted for rechecking request forms submitted via email, fax, or telex.
4. The Chairman of the Examination Board shall decide to establish the Rechecking Committee, excluding members who have participated in the Marking Committee. The results of the rechecking shall be incorporated into the examination results, and the Chairman of the Examination Board shall report to the head of the competent authority responsible for recruiting civil servants and public officials, civil servant grade promotion examinations, and examinations for upgrading vocational titles of public officials for review and recognition of the examination results. The rechecking results shall be notified to the person who submitted the rechecking request form.
5. The criteria for members of the Rechecking Committee shall be implemented in accordance with the criteria for members of the Marking Committee.
6. Duties of the Rechecking Committee:
a) Checking errors such as incorrect point addition, misrecording of test scores;
b) Re-marking tests based on candidates' rechecking request forms.
7. Procedure for rechecking tests:
a) Rechecking shall be conducted subject-by-subject under the direct management of the Head of the Rechecking Committee.
b) Before handing over the test papers to the Head of the Rechecking Committee, the Council Member兼任秘书进行以下工作:

c) Rechecking written exams and multiple-choice paper-based exams shall be conducted in accordance with the regulations set forth in Article 25 of these Rules and must be marked using ink of a different color than that used previously on the candidate's test paper.
8. Handling rechecking results:
a) If the results of two rechecking committee members are identical, then those results shall be taken as the rechecking score, recorded in the designated box. All members participating in the rechecking of that test shall sign and clearly write their names on each page of the test paper;
b) If the results of two rechecking committee members differ, the Head of the Rechecking Committee shall assign the third rechecking committee member to directly recheck the candidate's work. If the results of two out of three rechecking committee members are identical, then those identical results shall be taken as the rechecking score. In the case where the rechecking scores of all three rechecking committee members differ, the average of the three rechecking scores shall be taken as the official score. All members participating in the rechecking of that test shall sign and clearly write their names on all pages of the test paper;
c) Test papers with rechecking scores differing from the initial marking scores (already announced) by 2.5 points or more shall be adjusted. In cases where the rechecking score differs from the initial marking score (already announced) by 5 points or more, the Head of the Rechecking Committee must report to the Chairman of the Examination Board to organize a direct dialogue between the initial marking committee members and the rechecking committee members (with minutes recorded). After the dialogue, the Head of the Rechecking Committee shall report to the Chairman of the Examination Board to determine the rechecking score and the adjustment of the score. If there are signs of misconduct, the Head of the Rechecking Committee has the responsibility to report to the Chairman of the Examination Board for handling according to regulations;
d) The rechecking score is the official score of the candidate.
9. The Head of the Rechecking Committee shall seal and hand over the rechecking scores along with the individual rechecking score sheets of each rechecking committee member for the test, the dialogue record (if any), and the rechecked test papers to the Council Member兼任秘书for consolidation into the overall test score results as required. When handing over, a record must be made with the presence of the Examination Supervision Committee member and the representative of the Public Security Department (if invited to participate).
Article 27. Interview Scoring
1. When scoring interviews, each member scores independently on the score sheet for each candidate. The interview score is the average of the scores given by the participating scorers.
a) In cases where the scores given by the interview scorers differ from five points up to less than ten points, the Head of the Examination Supervision Board shall discuss with the participating scorers and then decide on the interview score.
b) In cases where the scores given by the interview scorers differ by ten points or more, the Head of the Examination Supervision Board shall report to the Chairman of the Examination Council to organize a dialogue between the participating scorers, and then decide on the interview score.
2. The results of the interview scoring must be compiled into a general table of interview scores and signed by the interview scorers and the Head of the Examination Supervision Board; thereafter, the Head of the Examination Supervision Board shall seal and hand over the table to the Council Member who also serves as the Secretary immediately upon the conclusion of the interview session.
Article 28. Matching Scores and Compiling Test Results
1. After completing the test scoring and rechecking (if applicable), the matching of scores can be organized.
2. The Council Member who also serves as the Secretary is responsible for matching scores, compiling test results after matching, and reporting to the Chairman of the Examination Council.
3. Following the Examination Council meeting on the test scoring results, the Chairman of the Examination Council reports to the head of the agency or unit authorized to recruit civil servants and public officials, to conduct civil servant grade promotion exams, and to conduct public official career rank advancement exams about the exam results for review and recognition according to the law.
Chapter III. OTHER TASKS OF THE EXAMINATION PERIOD
Article 29. Monitoring the Examination Period
1. The head of the agency authorized to recruit civil servants and public officials, to conduct civil servant grade promotion exams, and to conduct public official career rank advancement exams must establish an Examination Monitoring Board consisting of: the Head and members.
2. Those who participate in the Examination Council or in the Examination Council's assisting boards shall not be appointed as members of the Examination Monitoring Board.
3. Individuals who have familial relationships such as father, mother, brother, sister, or half-sibling of the spouse or partner; spouse or partner; biological or adopted child of the examinee; or those currently under disciplinary review or serving a disciplinary decision shall not be appointed as members of the Examination Monitoring Board.
4. The content of monitoring includes: Implementation of regulations on organizing the examination period; implementation of examination rules and internal regulations; performance of duties and responsibilities of Examination Council members and members of the Examination Council's assisting boards.
5. Location of monitoring: At the Examination Council's workplace and that of its assisting boards.
6. Members of the Examination Monitoring Board have the right to enter examination rooms during the examination period, marking rooms during the marking period, and rechecking; they have the right to remind candidates, examination room supervisors, hall supervisors, other Examination Council members, and members of the Examination Council's assisting boards regarding compliance with examination rules and internal regulations; they have the right to request examination room supervisors to prepare records for candidates violating examination rules and internal regulations (if any).
7. Upon discovering violations of examination rules and internal regulations by Examination Council members or members of the Examination Council's assisting boards, members of the Examination Monitoring Board have the right to prepare records of such violations and propose that the head of the agency or unit authorized to organize recruitment of civil servants and public officials consider and handle them according to the law on cadres, civil servants, and public officials.
8. If members of the Examination Monitoring Board fail to fulfill their assigned duties and responsibilities, they will be subject to disciplinary action according to the law on cadres, civil servants, and public officials.
Article 30. Handling Complaints and Accusations
1. During the organization of the examination period, if there are petitions, complaints, or accusations, the Examination Council must examine and resolve them according to the law on complaints and accusations.
2. If there are petitions, complaints, or accusations related to the examination period after the Examination Council has been dissolved, the authorized agency organizing the examination shall examine and resolve them according to the law on complaints and accusations.
Article 31. Archiving Documents
1. Examination-related documents include: Organizational documents for examinations issued by the head of the agency or unit with authority to recruit civil servants and public officials, examination promotion for civil servants, and rank advancement for public officials; examination council documents, minutes of examination council meetings, consolidated lists of candidates, handover records for examination questions, confirmation records of question sealing status, violation records under examination regulations, handover records for examination papers and original questions, marking records, summary result sheets, decisions recognizing examination results, re-examination minutes, complaint and accusation resolution records, and other related minutes must be archived as a set of documents.
2. Within thirty days from the end date of the examination, the Council Member兼任秘书应负责将本条第一款规定的考试相关文件,连同密封的试卷袋和密封的答题卡袋一并移交给有权招聘公务员和职员、考试晋升公务员职级和提升职员职务级别的机关或单位,以便按照法律规定进行保管和管理。
REGULATIONS
ORGANIZING THE SELECTION OF CIVIL SERVANTS AND PUBLIC OFFICIALS, ASSESSING RANK ADVANCEMENT FOR PUBLIC OFFICIALS[13]
Chapter I. SELECTION OF CIVIL SERVANTS AND PUBLIC OFFICIALS
Article 1. Examination Selection Council for Civil Servants and Public Officials
1. The Examination Selection Council for Civil Servants and Public Officials (hereinafter referred to collectively as the Examination Selection Council) shall be established by the head of the agency or unit with authority to recruit civil servants and public officials. The Examination Selection Council operates on a per-examination basis and automatically dissolves upon completion of its tasks.
2. The Examination Selection Council for civil servants shall perform duties and powers as stipulated in Clause 2, Article 7 of Decree No. 24/2010/ND-CP dated March 15, 2010 of the Government on Recruitment, Employment, and Management of Civil Servants (hereinafter referred to as Decree No. 24/2010/ND-CP), amended and supplemented in Clause 3, Article 1 of Decree No. 161/2018/ND-CP dated November 29, 2018 of the Government amending and supplementing certain provisions on recruitment of civil servants and public officials, promotion of civil servant ranks, advancement of public official positions, and implementation of employment contracts for certain types of work in administrative state agencies and public service units (hereinafter referred to as Decree No. 161/2018/ND-CP).
3. The Examination Selection Council for public officials shall perform duties and powers according to Clause 3, Article 6 of Decree No. 29/2012/ND-CP dated April 12, 2012 of the Government on Recruitment, Employment, and Management of Public Officials (hereinafter referred to as Decree No. 29/2012/ND-CP), amended and supplemented in Clause 2, Article 2 of Decree No. 161/2018/ND-CP.
4. The Examination Selection Council may use seals and accounts of the agency or unit with authority to recruit civil servants and public officials or of the directly advising agency in the activities of the Examination Selection Council as decided by the head of the agency or unit that establishes the Examination Selection Council.
Article 2. Duties and Powers of Members of the Examination Selection Council
1. Chairman of the Examination Selection Council:
a) Shall be responsible for organizing the implementation of the Council's tasks as prescribed, directing the selection process in accordance with examination regulations and internal rules;
b) Assign specific tasks to each member of the Examination Selection Council;
c) Decide on the establishment of the Examination Application Review Committee and the Examination Assessment Committee;
d) Organize the development of interview and practical test questions in accordance with regulations, ensuring confidentiality of interview and practical test questions under "Confidential" document classification;
đ) Organize interviews and practical tests and compile results as prescribed;
e) Report to the head of the agency with authority to recruit civil servants and public officials for review and decision on recognizing the selection results;
g) Resolve complaints and accusations during the organization of the selection period.
2. Vice-Chairman of the Examination Selection Council:
Assist the Chairman in managing the Council's operations and performing specific Council tasks as assigned by the Chairman.
3. Members of the Examination Selection Council shall be assigned specific tasks by the Chairman to ensure that Council activities comply with regulations.
4. Council Member兼任秘书协助主席:
a) Prepare necessary documents and records for the Council and record minutes of Council meetings;
b) Organize and prepare study guide materials for candidates (if applicable);
c) Organize the collection of application fees, manage income and expenditure, and settle accounts for application fees in accordance with regulations;
d) Compile and report selection results to the Examination Selection Council.
Article 3. Examination Registration Review Board
1. The Examination Registration Review Board shall be established by the Chairman of the Examination Council, consisting of the Head and members, including one member兼任秘书。
2. Duties, powers, and responsibilities of the Examination Registration Review Board:
a) The Head of the Examination Registration Review Board is directly responsible to the Chairman of the Examination Council and assigns specific tasks to the members.
b) Members of the Examination Registration Review Board perform the duty of checking the conditions and standards of candidates according to the requirements of the positions applied for on the Examination Registration Form.
c) The member兼任秘书shall carry out the task of recording meeting minutes, compiling lists of candidates eligible for the second round of examinations, and other tasks assigned by the Head.
3. Qualifications of members of the Examination Registration Review Board:
a) Those appointed as members of the Examination Registration Review Board must be civil servants or public officials with professional qualifications and work experience relevant to the position requirements.
b) Individuals who have familial relationships such as father, mother, brother, sister, or spouse, children (including adopted children) of the candidate, or those currently under disciplinary review or serving a disciplinary decision, shall not be appointed as members of the Examination Registration Review Board.
Article 4. Examination Assessment Review Board
1. The Examination Assessment Review Board shall be established by the Chairman of the Examination Council, consisting of the Head and members, including one member兼任秘书。
2. Duties and powers of the Head of the Examination Assessment Review Board:
a) Assist the Chairman of the Examination Council in developing interview and practical test questions to ensure there is a surplus relative to the number of candidates called for each recruitment position, allowing candidates to draw lots randomly. The content of the interview and practical test questions must be accurate, scientific, clear in wording, comprehensively evaluating the abilities and potential of the candidates; they must be consistent with the requirements of the civil service rank or professional title corresponding to the recruitment position. Interview and practical test questions must include answers and grading scales (detailed to five points), sealed in examination envelopes, and kept confidential according to the "Confidential" document management regulations.
b) Organize the arrangement for members of the Examination Assessment Review Board to conduct interviews and practical tests based on the principle that each candidate must be evaluated by at least two members.
c) Compile the results of interviews and practical tests and hand over the minutes and grading sheets to the Secretary Member of the Examination Council.
d) Maintain confidentiality regarding the scores of interviews or practical tests.
3. Duties and powers of members of the Examination Assessment Review Board:
a) Participate in developing interview and practical test questions as assigned by the Head of the Examination Assessment Review Board.
b) Conduct grading of interviews and practical tests according to the answers and grading scales provided in the interview and practical test questions.
c) Report any violations observed during the organization of interviews and practical tests to the Head of the Examination Assessment Review Board and recommend appropriate measures.
4. Qualifications of members of the Examination Assessment Review Board:
a) Members of the Examination Board shall be civil servants or public officials with relevant professional qualifications and work experience in the field corresponding to the position being recruited.
b) Individuals who have familial relationships such as parents, siblings, spouses, children (biological or adopted), or those currently under disciplinary review or serving a disciplinary decision shall not be appointed as members of the Examination Board.
Article 5. Organization of Civil Servant and Public Official Recruitment Examinations
1. Preparation for the recruitment examination:
a) Within five working days after the end of the first round of examination registration condition checks, notify candidates to attend interviews and practical tests, specifying the time and location for preparation sessions (if applicable) and the location for interviews and practical tests for candidates qualified for the examination.
b) One day before the interviews and practical tests, the Examination Council shall post the list of candidates by registration number and room for interviews and practical tests; the layout of rooms for interviews and practical tests; examination rules and regulations at the location of interviews and practical tests.
c) At least one day before the examination, the Secretary Member of the Examination Council must complete preparatory work for the examination period, including:
Preparing related forms for the examination organization: List of candidates to be interviewed and tested; list for candidates to sign confirmation after interviews and practical tests; form for handing over and receiving interview and practical test questions; form for opening interview and practical test questions; form for transferring interview and practical test results; form for handling violations of examination rules and regulations; form for temporarily holding papers and items of candidates violating examination rules and regulations, and other related forms.
Preparing identification cards for members of the Examination Council; Examination Assessment Review Board; and support staff for the examination period. Identification cards for the Chairman, Deputy Chairmen, and Members of the Examination Council, and the Head of the Examination Assessment Review Board should include full name and position. Identification cards for other members should only include position.
2. Conducting interviews and practical tests:
a) Each candidate's preparation and response time for interview questions shall not exceed thirty minutes.
b) The duration of practical tests shall be determined by the Chairman of the Examination Council, suitable for the nature of professional activities and job requirements.
c) When grading interviews and practical tests, members grade independently on grading sheets for each candidate. The interview and practical test score is the average of the scores given by participating graders. If the scores given by the graders differ by more than five points but less than ten points, the Head of the Examination Assessment Review Board shall discuss again with the participating graders and then determine the interview and practical test scores. If the scores given by the graders differ by ten points or more, the Head of the Examination Assessment Review Board shall report to the Chairman of the Examination Council to organize a dialogue between the participating graders, and then determine the interview and practical test scores.
3. Compilation and transfer of interview and practical test results:
a) Grading results of interviews and practical tests must be compiled into a general result sheet signed by the interview and practical test graders and the Head of the Examination Assessment Review Board.
b) After conducting interviews and practical tests, the Head of the Examination Assessment Review Board shall transfer the interview and practical test results of the candidates to the Secretary Member of the Examination Council.
c) The Secretary Member of the Examination Council is responsible for compiling the overall examination results of the candidates and reporting to the Chairman of the Examination Council.
d) The Chairman of the Examination Council reports to the head of the agency or unit authorized to recruit civil servants and public officials to recognize the examination results.
4. The transfer of interview and practical test results must be recorded in a protocol witnessed by members of the Supervisory Board and representatives of the police department (if invited to participate).
Article 6. Supervision of the recruitment examination period
1. The head of the agency with authority to recruit civil servants and public officials must establish a Supervisory Board for the recruitment examination period (hereinafter referred to collectively as the Supervisory Board) consisting of: Chairperson and members.
2. Individuals participating in the Recruitment Examination Council and the Supporting Boards of the Recruitment Examination Council shall not be appointed as members of the Supervisory Board.
3. Individuals who have familial relationships such as father, mother, brother, sister, or half-sibling of the spouse of the candidate; spouse; biological or adopted child of the candidate; or individuals currently under disciplinary review or serving a disciplinary decision shall not be appointed as members of the Supervisory Board.
4. The content of supervision includes: Implementation of regulations on organizing the recruitment examination period; implementation of the examination rules and internal regulations; performance of duties and responsibilities of members of the Recruitment Examination Council and members of the Supporting Boards of the Recruitment Examination Council.
5. Location of supervision: The workplace of the Recruitment Examination Council and the Supporting Boards of the Recruitment Examination Council.
6. Members of the Supervisory Board have the right to enter interview and practical rooms during the interview and practical periods; they have the right to remind candidates and members of the Recruitment Examination Council and members of the Supporting Boards of the Recruitment Examination Council regarding the implementation of examination rules and internal regulations; they have the right to request the invigilator to prepare a record for candidates violating examination rules and internal regulations (if any).
7. When violations of examination rules and internal regulations by members of the Recruitment Examination Council or members of the Supporting Boards of the Recruitment Examination Council are discovered, members of the Supervisory Board have the right to prepare a record of the violation and propose the Chairman of the Recruitment Examination Council to suspend their duties; at the same time, report to the head of the agency or unit with authority to organize the recruitment of civil servants and public officials for consideration and handling according to the law on cadres, civil servants, and public officials.
8. When members of the Supervisory Board fail to perform their assigned duties and responsibilities correctly or interfere in the work of members of the Recruitment Examination Council or members of the Supporting Boards of the Recruitment Examination Council with personal motives or purposes, members of the Recruitment Examination Council or members of the Supporting Boards of the Recruitment Examination Council have the right to request the Chairperson of the Supervisory Board to suspend their duties and report to the head of the agency or unit with management authority for consideration and handling responsibility according to the law on cadres, civil servants, and public officials.
Article 7. Handling complaints and reports
1. During the organization of the recruitment examination period, if there are letters of recommendation, complaints, or reports, the Recruitment Examination Council must consider and resolve them according to the law on complaints and reports.
2. If there are letters of recommendation, complaints, or reports about the recruitment examination period after the Recruitment Examination Council has been dissolved, the agency or unit with authority to recruit civil servants and public officials will consider and resolve them according to the law on complaints and reports.
Article 8. Archiving documents
1. Documents related to the recruitment examination period include: Documents on organizing the recruitment examination period signed and issued by the head of the agency with authority to recruit civil servants and public officials; documents of the Recruitment Examination Council; minutes of meetings of the Recruitment Examination Council; consolidated list of applicants; minutes of handover of interview or practical questions (with answers attached), minutes confirming the sealing status of interview or practical questions, minutes of violations of examination rules and internal regulations (if any); original questions for interviews or practicals; summary table of interview or practical scores; recruitment results; decision recognizing recruitment results; minutes of complaint and report resolution (if any) and other types of documents related to the recruitment examination period.
2. Within no more than thirty days from the end of the recruitment examination period, the Secretary Member of the Recruitment Examination Council is responsible for transferring these documents to the agency or unit with authority to organize the recruitment of civil servants and public officials for archiving and management according to the law on archiving.
Chapter II. PROMOTION OF PROFESSIONAL RANKS FOR PUBLIC OFFICIALS
Article 9. Recruitment Examination Council for Promotion of Professional Ranks for Public Officials
1. The Recruitment Examination Council for Promotion of Professional Ranks for Public Officials (hereinafter abbreviated as the Recruitment Examination Council for Promotion of Public Officials) is established by the head of the agency or unit with authority to organize the promotion of professional ranks for public officials. The Recruitment Examination Council for Promotion of Public Officials operates for each recruitment examination period and dissolves itself after completing its tasks.
2. The Recruitment Examination Council for Promotion of Public Officials performs its duties and powers as stipulated in Clause 4, Article 31 of Decree No. 29/2012/NĐ-CP.
3. In cases where the Ministry managing professional ranks for specialized public officials specifies the content and form of promotion of professional ranks involving the assessment and scoring of promotion application files or organizing inspections and examinations, the Chairman of the Recruitment Examination Council for Promotion of Public Officials establishes an Assessment Board to assess and score the promotion application files of public officials according to the provisions of Article 11 of this Regulation or establishes an Inspection and Examination Board and organizes inspections and examinations according to the provisions of Article 4 of this Regulation.
4. The Recruitment Examination Council for Promotion of Public Officials may use the seal and account of the agency or unit with authority to promote professional ranks for public officials in the activities of the Recruitment Examination Council for Promotion of Public Officials, as decided by the head of the agency or unit that established the Recruitment Examination Council for Promotion of Public Officials.
Article 10. Duties and Authorities of Members of the Promotion Council
1. The Chairman of the Promotion Council:
a) Is responsible for organizing the implementation of the duties of the Promotion Council and directing the promotion of occupational titles in accordance with the provisions of the law;
b) Assigns specific tasks to each member of the Council;
c) Decides on the establishment of the Appraisal Board or the Examination Board (if applicable);
d) Organizes the construction of interview questions, practical exercises, or survey papers (if applicable) in accordance with regulations, ensuring confidentiality at the "Secret" level;
đ) Reports to the head of the agency or unit authorized to promote occupational titles to recognize the results of the promotion of occupational titles;
g) Resolves complaints and denunciations during the organization of the promotion examination period.
2. Members of the Promotion Council shall perform specific tasks assigned by the Chairman of the Council.
3. The Deputy Chairman and Secretary of the Council assist the Chairman of the Council:
a) Prepare documents and materials of the Council and record minutes of Council meetings;
b) Organize the collection of fees for the examination, manage income and expenditure, and settle accounts for the promotion examination fees in accordance with regulations;
c) Summarize and report the results of the promotion examination to the Promotion Council.
Article 11. The Appraisal Board
1. The Appraisal Board for the promotion of occupational titles (hereinafter referred to as the Appraisal Board) is established by the Chairman of the Promotion Council, consisting of the Head and members, including one member兼任书记员。
2. Duties and authorities of the Head of the Appraisal Board:
a) Assign specific tasks to members of the Appraisal Board, ensuring that each application file for promotion must be reviewed and scored by at least two members;
b) Compile the results of the review and scoring of files and hand over the minutes to the Secretary of the Promotion Council;
c) Maintain the confidentiality of the review and scoring results of applicants.
3. Duties and authorities of members of the Appraisal Board:
a) Conduct the review and scoring of applicant files according to the assignment of the Head and in accordance with the law;
b) Report signs of violations during the organization of the review and scoring process to the Head and recommend disciplinary measures;
c) Maintain the confidentiality of the review and scoring results of applicants.
4. Qualifications of members of the Appraisal Board:
a) Individuals appointed as members of the Appraisal Board for the promotion of occupational titles must be professionals with relevant expertise and experience in the field corresponding to the occupational title being promoted;
b) Individuals who have familial relationships such as father, mother, brother, sister, spouse, children, or those currently under disciplinary review or serving a disciplinary decision shall not be appointed as members of the Appraisal Board.
Article 12. Organization of Promotion of Occupational Titles
1. Preparation for the promotion examination:
a) Based on the regulations of the Ministry managing the professional titles regarding standards, conditions, content, and form of the promotion examination, the Chairman of the Promotion Council shall publicize the specific content and form of the promotion examination and assign specific tasks to each member of the Promotion Council;
b) The content of the review and scoring of the promotion examination files must be based on the regulations and guidelines of the Ministry managing the professional titles and the requirements of the occupational title being promoted; it must ensure accuracy, fairness, objectivity, and scientificity; the handover and opening of files must all be recorded in minutes according to regulations;
c) In cases where the Ministry managing the professional titles stipulates that the promotion examination includes a practical test, at least 15 days before the practical test, the Promotion Council shall send a notice to summon candidates for the practical test, specifying the time and location of the practical test; the content and form of the practical test;
d) At least one working day before the practical test, the Promotion Council shall post the list of candidates for the practical test by registration number; the layout diagram of the examination rooms; the rules and regulations of the promotion examination at the examination site;
đ) At least one working day before the promotion examination, the Deputy Chairman and Secretary of the Promotion Council must complete the preparatory work for the promotion examination including:
Preparing related forms for the organization of the promotion examination: List of candidates to be called into the examination room; list for candidates to sign confirmation after the practical test; form for transferring examination papers; form for opening examination papers; form for transferring examination results; form for handling violations of rules and regulations; form for temporarily holding the documents and items of candidates violating the rules and regulations of the promotion examination and other related forms.
Preparing identification cards for members of the Promotion Council; the Appraisal Board; the Examination Board; the service department for the promotion examination. The cards of the Chairman, Vice-Chairman, and Council members, and the Head of the Examination Board should print full name and position. The cards of other members only print positions.
2. Organization of the review and scoring of files:
a) Members of the Appraisal Board organize the joint review and scoring of each file and record the scores (component scores and total scores) on the scoring sheet of each file, including additional points (if any); each member signs below the scoring sheet. The review and scoring of files must be carried out strictly in accordance with the regulations of the Ministry managing the professional titles regarding the content and form of the promotion examination.
b) When reviewing and scoring files, if members do not agree, the results will be transferred to the Head of the Examination Board for consideration and decision;
c) The results of the review and scoring of each applicant's file must be compiled into a comprehensive result table signed by the participating reviewers and scorers and the Head of the Appraisal Board, which will then be handed over to the Secretary of the Promotion Council.
3. Organization of the practical test:
a) For written tests and multiple-choice questions: The organization of the practical test must ensure that there are at least two members of the Examination Board supervising in one examination room, with a maximum of 25 candidates per room;
b) For interviews and practical exercises: The Head of the Examination Board assigns tasks to each member, dividing candidates into groups for interviews and practical exercises to ensure that there are at least two members of the Examination Board conducting scoring;
Re-examination is not conducted for interviews and practical exercises.
The organization of interviews and practical exercises follows the provisions of Clause 2, Article 5 of this Regulation.
4. Compilation and determination of promotion results:
a) The Secretary of the Promotion Council is responsible for compiling the promotion results of applicants to report to the Promotion Council;
b) The Chairman of the Promotion Council organizes a meeting to review the promotion results of applicants; members of the Council openly discuss and deliberate on the promotion results of applicants; the Promotion Council organizes the election of the Counting Committee and conducts voting to approve or disapprove the promotion results of applicants; successful candidates must obtain at least half of the votes from the total number of Council members participating in the meeting and directly voting; the Promotion Council approves the minutes and results of the promotion meeting;
c) The Chairman of the Promotion Council reports to the head of the agency or unit authorized to promote occupational titles to review and decide on the recognition of the promotion results.
5. The determination of successful candidates for the examination period to upgrade vocational titles shall be carried out in accordance with the guidelines of the Ministry managing vocational titles in the consolidated document stipulating standards, conditions, content, and form of the examination to upgrade vocational titles within the industry or field under management.
Article 13. Reviewing Examination Results for Upgrading Vocational Titles
1. Within fifteen days from the date of publicizing the examination results for upgrading vocational titles, candidates may submit a request for a review of the examination results. Requests for review received after the prescribed time limit (counted from the date of submission as evidenced by the postmark on the envelope if submitted via postal service) will not be reviewed. Electronic mail, fax, or telex requests for review will not be accepted for processing.
2. Within fifteen days from the deadline for receiving requests for review, a review panel must be organized. The Chairman of the Examination Board for Upgrading Vocational Titles shall decide to establish a Review Panel, excluding members who have participated in the Qualification Assessment Committee and the Examination Supervision Committee.
3. The Review Panel shall perform the tasks of reviewing qualifications, scoring applications, and conducting examinations or tests in the form of written exams or multiple-choice questions.
4. In cases where the review results differ from the initial results, the Chairman of the Examination Board for Upgrading Vocational Titles shall arrange for direct dialogue between the initial qualification assessors, scorers, and examiners and the review panel members (with minutes recorded) to consider and determine the review results.
5. The review results shall be the official results of the examination period for upgrading vocational titles. The Examination Board for Upgrading Vocational Titles shall notify the person who requested the review.
6. The criteria for members participating in the Review Panel shall be implemented according to the criteria for members of the Qualification Assessment Committee and the Scoring Committee; the Examination Supervision Committee.
Article 14. Oversight of the Examination Period for Upgrading Vocational Titles
1. The head of the agency or unit authorized to organize the upgrading of vocational titles must establish an Examination Oversight Committee (hereinafter referred to as the Oversight Committee), consisting of a Chairperson and other members.
2. Members of the Examination Board for Upgrading Vocational Titles and members of the Examination Board's supporting committees shall not be appointed as members of the Oversight Committee.
3. Individuals who are parents, siblings, spouses, children (biological or adopted) of the candidate for upgrading vocational titles, or those currently under disciplinary review or serving a disciplinary decision, shall not be appointed as members of the Oversight Committee.
4. The oversight content includes: Implementation of regulations regarding the organization of the examination period for upgrading vocational titles; compliance with laws governing the examination for upgrading vocational titles; performance of duties and responsibilities by members of the Examination Board and members of the Examination Board's supporting committees.
5. Location of oversight: The workplace of the Examination Board for Upgrading Vocational Titles and the Examination Board's supporting committees.
6. Members of the Oversight Committee have the right to remind candidates, other members of the Examination Board, and members of the Examination Board's supporting committees about their adherence to examination rules and regulations, and have the authority to require invigilators to record minutes for candidates violating examination rules and regulations (if any).
7. When violations of examination rules and regulations by members of the Examination Board or members of the Examination Board's supporting committees are discovered, members of the Oversight Committee have the right to record such violations and propose to the Chairman of the Examination Board for Upgrading Vocational Titles to suspend them from duty; simultaneously reporting to the head of the agency or unit authorized to organize the upgrading of vocational titles for consideration and handling in accordance with the law on civil servants.
8. When members of the Supervisory Board fail to perform their assigned duties and responsibilities correctly or interfere in the work of members of the Recruitment Examination Council or members of the Supporting Boards of the Recruitment Examination Council with personal motives or purposes, members of the Recruitment Examination Council or members of the Supporting Boards of the Recruitment Examination Council have the right to request the Chairperson of the Supervisory Board to suspend their duties and report to the head of the agency or unit with management authority for consideration and handling responsibility according to the law on cadres, civil servants, and public officials.
Article 15. Handling Complaints and Reports
1. During the organization of the examination period for upgrading vocational titles, in cases where there are letters of recommendation, complaints, or reports, the Examination Board for Upgrading Vocational Titles must examine and handle them in accordance with the law on complaints and reports.
2. In cases where there are letters of recommendation, complaints, or reports about the examination period for upgrading vocational titles after the Examination Board for Upgrading Vocational Titles has been dissolved, the agency or unit authorized to organize the examination for upgrading vocational titles must examine and handle them in accordance with the law on complaints and reports.
Article 16. Storage of Documents
1. Documents related to the examination period for promotion include: Organizational documents on the examination period for promotion issued by the head of the competent authority for promotion; documents of the Examination Board; minutes of Examination Board meetings; consolidated lists of civil servants participating in the examination for promotion; handover records; examination results; decisions recognizing examination results; minutes of complaints and denunciations resolution (if any) and other related documents.
2. Within no more than thirty days from the end date of the examination period for promotion, the Secretary Member of the Examination Board shall be responsible for:
a) Handing over to the competent authority organizing the promotion of occupational titles for civil servants for storage and management of documents related to the examination period for promotion according to the regulations on archiving;
b) Handing over to the agency managing the personnel files of civil servants the entire personal file of candidates for the examination period for promotion.
INTERNAL RULES
PERIOD OF CIVIL SERVICE RECRUITMENT, CIVIL SERVANT RANK PROMOTION EXAMINATION, AND PROFESSIONAL RANK PROMOTION FOR CIVIL SERVANTS[14]
Article 1. Regulations for Candidates
1. Must be present at the examination room at the designated time. Dress neatly, demonstrating civility and propriety.
2. Present Identity Card or Citizen Identification Card or another valid identification document for the invigilator to check before entering the examination room.
3. Sit in the seat corresponding to the registration number, place the Identity Card or Citizen Identification Card on the desk for the invigilators and members of the Examination Board to check.
4. Only writing pens and rulers may be brought into the examination room; mobile phones, recording devices, cameras, computers, technical means for receiving and transmitting information, data backup devices, other information-containing and transmitting devices, and any related papers or documents are not allowed (except where the examination has different provisions).
5. Only the examination paper provided may be used to answer questions; no other paper may be used. All required items must be fully completed on the examination paper. Each sheet of the examination paper must have signatures of two invigilators; an examination paper without signatures of two invigilators will be considered invalid.
6. The examination paper can only be written with blue or black ink. Other colored inks, glitter inks, reflective inks, or pencils cannot be used to write the examination paper.
7. Except for mandatory entries on the cover page, candidates are not allowed to write their names, signatures, positions, names of organizations, or any other identifying marks on the examination paper.
8. Follow all instructions given by the invigilator; maintain order and do not smoke or use stimulants in the examination room.
9. Do not communicate with others during the examination; do not exchange examination papers or scratch pads; do not copy answers from other candidates or engage in any form of cheating. Strictly prohibited are any actions of copying or transmitting examination-related information out of the examination room or receiving information from outside the examination room.
10. If clarification is needed, ask the invigilator publicly.
11. If rewriting is necessary, cross out or strike through the previously written portion of the examination paper (unless the examination has different provisions).
12. May leave the examination room only after half the allotted time has passed and with the invigilator's permission. Candidates will not be allowed to leave the examination room for examinations lasting less than sixty minutes.
In cases where the examination is conducted on a computer, candidates may leave the examination room only after submitting their work and signing the examination result sheet; if a candidate does not sign the examination result sheet before leaving the examination room, they will receive zero points.
If the invigilator discovers that someone signed for another person, both the signer and the person signed for will receive zero points.
The decision to award zero points in these cases is made by the Chairman of the Examination Board based on the report of the Chief Invigilator.
13. During the period when leaving the examination room is not permitted as stipulated in Clause 12 of this Article, if a candidate experiences unusual illness or pain, they must inform the invigilator, who must immediately report to the Chief Invigilator for consideration and resolution.
14. Stop working and submit the examination paper to the invigilator immediately upon announcement of the end of the examination time. Clearly indicate the total number of examination sheets submitted and sign the submission list. Even if unable to complete the examination, candidates must return the examination paper.
15. Strictly forbidden are actions that damage the computer systems used for the examination; if a non-functioning computer is discovered, it must be reported promptly to the invigilator for consideration and resolution.
Article 2. Handling violations by candidates
1. Candidates who violate examination rules must have their violation recorded in a report and depending on the severity of the violation, they will be disciplined according to the following forms:
a) Reprimand: The form of reprimand discipline is recorded by the examination room supervisor, publicly announced in the examination room, and applied to candidates who commit one of the following offenses:
Intentionally sitting in the wrong seat marked with their registration number;
Exchanging with others after being warned but still not complying;
Bringing materials into the examination room without using them (except when the exam allows bringing materials into the examination room).
b) Warning: The form of warning discipline is recorded by the examination room supervisor, publicly announced in the examination room, and applied to candidates who commit one of the following offenses:
Using materials during the examination (except when the exam allows using materials during the examination);
Exchanging answers or scratch paper with others;
Allowing others to copy their answers or copying others' answers;
Using mobile phones, audio recorders, cameras, computers, and other technical means for receiving and transmitting information, data storage devices, and other information-containing equipment during the examination (except when the exam allows different provisions).
c) Suspension from examination: The form of suspension from examination discipline is decided by the Examination Board Chairperson, publicly announced in the examination room, and applied to candidates who have been recorded with a warning but continue to intentionally violate examination rules.
d) Nullification of examination results: Based on the report of the Examination Council Chairman or upon review,the head of the agency or unit authorized to organize civil servant recruitment, career staff recruitment, civil servant grade promotion examination, career staff rank advancement examination decides to nullify the examination results for candidates who commit one of the following offenses:
Having two or more examination papers or sections scored zero (0) or achieving 0% correct answers (except in cases of abandonment);
Writing or drawing irrelevant content on the examination paper;
Swapping examination papers or taking the exam on behalf of another person or being suspended from the examination.
e) Candidates who intentionally cause safety issues in the examination room, in addition to being suspended and having their examination results nullified, may also be subject to criminal law penalties depending on the nature and severity of the offense.
2. Candidates who violate examination rules must have their violation recorded, and both the examination room supervisor and the candidate must sign the record. After recording and publicly announcing in the examination room, the examination room supervisor must immediately report to the Examination Board Chairperson. If the candidate does not sign the violation record, the examination room supervisor shall invite two adjacent candidates to sign and confirm.
3. Candidates have the right to report those who violate examination rules to the Examination Room Supervisor, Examination Board Chairperson, members of the Examination Council, and members of the Examination Supervision Board.
4. Deducting points from the examination:
a) Candidates who are reprimanded in any section or paper will have 25% deducted from the total number of correct answers in that section or 25% deducted from the total score of that paper;
b) Candidates who are warned in any section or paper will have 50% deducted from the total number of correct answers in that section or 50% deducted from the total score of that paper.
5. Scoring zero (0) for one of the following situations:
a) Having two or more answer sheets for one subject or section;
b) The examination paper has handwriting from two or more people;
c) The examination paper is written in two different ink colors or in ink color not in accordance with Clause 6, Article 1 of these Examination Rules;
d) The examination paper is written on scratch paper or paper not distributed by the examination room supervisor.
6. The deduction of points from the examination as stipulated in Clause 4, Article 2 or scoring zero (0) as stipulated in Clause 5, Article 2 is decided by the Examination Marking Board Chairperson based on a written report from the marking member.
7. In cases where civil servants, public officials, or career staff candidates are disqualified from the examination as stipulated in Clause 5, Article 2, they may also be subject to disciplinary action according to laws governing civil servants, public officials, and career staff.
Article 3. Provisions for Examination Room Supervisors, Hall Supervisors
1. Phải có mặt tại địa điểm thi đúng giờ quy định. Trang phục gọn gàng, văn minh, lịch sự.
2. Thực hiện đúng chức trách, nhiệm vụ được giao theo quy chế, nội quy của kỳ thi.
3. Giữ trật tự, không được hút thuốc, không được sử dụng điện thoại di động, máy ghi âm, máy ảnh, máy vi tính, các phương tiện kỹ thuật thu, phát truyền tin, phương tiện sao lưu dữ liệu, thiết bị chứa đựng, truyền tải thông tin khác trong phòng thi.
4. Không được trao đổi riêng với bất kỳ thí sinh nào trong thời gian thi.
Điều 4. Xử lý vi phạm đối với cán bộ, công chức, viên chức tham gia tổ chức thi và cá nhân liên quan khác vi phạm nội quy, quy chế thi
1. Người tham gia tổ chức thi (thành viên Hội đồng thi, thành viên các Ban giúp việc của Hội đồng thi, thành viên Tổ giúp việc của Hội đồng thi nếu được thành lập) là cán bộ, công chức, viên chức có hành vi vi phạm nội quy, quy chế thi ngoài việc bị đình chỉ làm công tác thi còn bị xem xét xử lý kỷ luật theo quy định của pháp luật về cán bộ, công chức, viên chức.
2. Cán bộ, công chức, viên chức không tham gia tổ chức thi nhưng có các hành vi, như: thi hộ; chuyển đề thi ra ngoài; đưa lời giải vào cho thí sinh; đưa thông tin sai lệch gây ảnh hưởng xấu đến kỳ thi; gây rối làm mất trật tự tại khu vực thi bị xử lý kỷ luật theo quy định của pháp luật về cán bộ, công chức, viên chức.
3. Người tham gia tổ chức thi và những người có liên quan đến việc tổ chức thi không phải là cán bộ, công chức, viên chức nếu có hành vi vi phạm nội quy, quy chế thi, tùy theo tính chất, mức độ bị cơ quan, đơn vị hiện đang quản lý chấm dứt hợp đồng đã ký kết.
4. Người tham gia tổ chức thi và những người có liên quan đến việc tổ chức thi vi phạm nội quy, quy chế thi thì cơ quan, đơn vị có thẩm quyền quản lý không để đảm nhiệm những công việc có liên quan đến công tác tổ chức thi từ 01 năm đến 03 năm kể từ năm tổ chức thi có hành vi vi phạm./.

Điều 4. Nghĩa vụ và quyền hạn của Người đứng đầu đơn vị sự nghiệp
1. Nghĩa vụ:
- Bảo đảm việc làm và thực hiện đầy đủ những điều đã cam kết trong Hợp đồng làm việc
- Thanh toán đầy đủ, đúng thời hạn các chế độ của người được tuyển dụng đã cam kết trong Hợp đồng làm việc.
2. Quyền hạn:
- Điều hành người được tuyển dụng hoàn thành công việc theo hợp đồng (Bố trí, điều động, tạm đình chỉ công tác...).
- Chấm dứt Hợp đồng làm việc, kỷ luật người được tuyển dụng theo quy định của pháp luật về viên chức.

1. Ghi cụ thể tên đơn vị sự nghiệp.
2. Ghi rõ Hợp đồng có thời hạn thì ghi cụ thể thời hạn bắt đầu và kết thúc.
3. Ghi cụ thể số nhà, phố, phường (thôn, xã), quận (huyện, thị xã), tỉnh, thành phố thuộc tỉnh hoặc Trung ương.

Điều 4. Nghĩa vụ và quyền hạn của Người đứng đầu đơn vị sự nghiệp
1. Nghĩa vụ:
- Bảo đảm việc làm và thực hiện đầy đủ những điều đã cam kết trong Hợp đồng làm việc
- Thanh toán đầy đủ, đúng thời hạn các chế độ của người được tuyển dụng đã cam kết trong Hợp đồng làm việc.
2. Quyền hạn:
- Điều hành người được tuyển dụng hoàn thành công việc theo hợp đồng (Bố trí, điều động, tạm đình chỉ công tác...).
- Chấm dứt Hợp đồng làm việc, kỷ luật người được tuyển dụng theo quy định của pháp luật về viên chức.
Điều 5. Điều khoản thi hành
- Những vấn đề về quyền lợi, nghĩa vụ và trách nhiệm của viên chức không ghi trong hợp đồng làm việc này thực hiện theo quy định của pháp luật về viên chức.
- Hợp đồng này làm thành 03 bản có giá trị ngang nhau, đơn vị sự nghiệp ký hợp đồng giữ 02 bản, viên chức được ký hợp đồng giữ 01 bản và hợp đồng có hiệu lực từ ngày..... tháng.... năm......

HƯỚNG DẪN GHI MẪU
HỢP ĐỒNG LÀM VIỆC XÁC ĐỊNH THỜI HẠN
(Dành cho đối tượng dưới 18 tuổi)
1. Ghi cụ thể tên đơn vị sự nghiệp.
2. Ghi rõ tên người đại diện theo pháp luật của người được tuyển dụng.
3. Ghi rõ Hợp đồng làm việc với thời hạn từ khi bắt đầu ký đến khi đủ 18 tuổi, ghi cụ thể thời hạn bắt đầu và kết thúc.
4. Ghi cụ thể số nhà, phố, phường (thôn, xã), quận (huyện, thị xã), tỉnh, thành phố thuộc tỉnh hoặc Trung ương.
5. Ghi cụ thể nhiệm vụ phải đảm nhiệm.
6. Ghi cụ thể số giờ làm việc trong ngày, hoặc trong tuần, hoặc làm việc theo giờ hành chính.
7. Phương tiện đi làm việc do đơn vị đảm nhiệm hoặc người được tuyển dụng tự túc.
8. Ghi cụ thể chức danh nghề nghiệp được xếp, mức lương chính, hình thức trả lương (lương thời gian, khoán...).
9. Ghi cụ thể tỷ lệ % các phụ cấp (nếu có) như: Khu vực, trượt giá, độc hại, thu hút, thâm niên, trách nhiệm v.v...
10. Ghi cụ thể quyền lợi bảo hiểm xã hội và trợ cấp khác mà người được tuyển dụng được hưởng. Ví dụ: Đối với người làm hợp đồng làm việc với thời hạn xác định từ 1 năm trở lên ghi là được hưởng quyền lợi bảo hiểm xã hội theo chế độ hiện hành của Nhà nước.
11. Ghi cụ thể người được tuyển dụng được hưởng quyền lợi nào đã nêu trong mục này.
12. Những thỏa thuận khác thường là những thỏa thuận khuyến khích và có lợi hơn cho người được tuyển dụng như: Những vật dụng rẻ tiền mau hỏng, khi hư hỏng, mất, không phải đền bù, thực hiện tốt Hợp đồng làm việc được đi du lịch, nghỉ mát, tham quan không mất tiền, được hưởng lương tháng thứ 13, 14, được nghỉ phép thêm vài ngày đến một tuần, tai nạn rủi ro ngoài giờ làm việc được trợ cấp thêm một khoản tiền, được tặng quà ngày sinh nhật,..../.

Bộ trưởng Bộ Nội vụ ban hành Thông tư sửa đổi, bổ sung một số điều về tuyển dụng công chức, viên chức, nâng ngạch công chức, thăng hạng chức danh nghề nghiệp viên chức và thực hiện chế độ hợp đồng một số loại công việc trong cơ quan hành chính nhà nước, đơn vị sự nghiệp công lập của Thông tư số 13/2010/TT-BNV ngày 30 tháng 12 năm 2010 của Bộ trưởng Bộ Nội vụ quy định chi tiết một số điều về tuyển dụng và nâng ngạch công chức của Nghị định số 24/2010/NĐ-CP ngày 15 tháng 3 năm 2010 của Chính phủ quy định về tuyển dụng, sử dụng và quản lý công chức; Thông tư số 12/2012/TT-BNV ngày 18 tháng 12 năm 2012 của Bộ trưởng Bộ Nội vụ quy định về chức danh nghề nghiệp và thay đổi chức danh nghề nghiệp đối với viên chức; Thông tư số 15/2012/TT-BNV ngày 25 tháng 12 năm 2012 của Bộ trưởng Bộ Nội vụ hướng dẫn về tuyển dụng, ký kết hợp đồng làm việc và đền bù chi phí đào tạo, bồi dưỡng đối với viên chức; Thông tư số 15/2001/TT-BTCCBCP ngày 11 tháng 4 năm 2001 của Bộ trưởng, Trưởng Ban Tổ chức - Cán bộ Chính phủ (nay là Bộ trưởng Bộ Nội vụ) hướng dẫn thực hiện Nghị định số 68/2000/NĐ-CP ngày 17 tháng 11 năm 2000 của Chính phủ về thực hiện chế độ hợp đồng một số loại công việc trong cơ quan hành chính nhà nước, đơn vị sự nghiệp.".
[2] Khoản này được sửa đổi, bổ sung theo quy định tại khoản 1 Điều 2 Thông tư số 03/2019/TT-BNV, có hiệu lực kể từ ngày 01 tháng 7 năm 2019.
[3] Điều này được sửa đổi, bổ sung theo quy định tại khoản 2 Điều 2 Thông tư số 03/2019/TT-BNV, có hiệu lực kể từ ngày 01 tháng 7 năm 2019.
[4] Khoản này được bãi bỏ theo quy định tại điểm d khoản 4 Điều 6 Thông tư số 03/2019/TT-BNV, có hiệu lực kể từ ngày 01 tháng 7 năm 2019.
[5] Điều này được sửa đổi, bổ sung theo quy định tại khoản 3 Điều 2 Thông tư số 03/2019/TT-BNV, có hiệu lực kể từ ngày 01 tháng 7 năm 2019.
[6] Điều này được sửa đổi, bổ sung theo quy định tại khoản 4 Điều 2 Thông tư số 03/2019/TT-BNV, có hiệu lực kể từ ngày 01 tháng 7 năm 2019.
[7] Điều này được sửa đổi, bổ sung theo quy định tại khoản 5 Điều 2 Thông tư số 03/2019/TT-BNV, có hiệu lực kể từ ngày 01 tháng 7 năm 2019.
[8] Khoản này được sửa đổi, bổ sung theo quy định tại khoản 6 Điều 2 Thông tư số 03/2019/TT-BNV, có hiệu lực kể từ ngày 01 tháng 7 năm 2019.
[9] Khoản này được sửa đổi, bổ sung theo quy định tại khoản 7 Điều 2 Thông tư số 03/2019/TT-BNV, có hiệu lực kể từ ngày 01 tháng 7 năm 2019.
[10] Thông tư số 13/2019/TT-BNV ngày 14 tháng 5 năm 2019 quy định:
"Điều 6. Điều khoản thi hành
1. Thông tư này có hiệu lực thi hành kể từ ngày 01 tháng 7 năm 2019.
2. Quy chế tổ chức thi tuyển công chức, viên chức, thi nâng ngạch công chức, thi thăng hạng chức danh nghề nghiệp viên chức; Quy chế tổ chức xét tuyển công chức, viên chức, xét thăng hạng chức danh nghề nghiệp viên chức; Nội quy kỳ tuyển dụng công chức, viên chức, thi nâng ngạch công chức, thăng hạng chức danh nghề nghiệp viên chức ban hành kèm theo Thông tư này có hiệu lực thi hành kể từ ngày 01 tháng 7 năm 2019.
3. Các cơ quan, tổ chức, đơn vị tiếp tục thực hiện đề án, kế hoạch tổ chức tuyển dụng công chức, viên chức (thi tuyển, xét tuyển, tuyển dụng không qua thi tuyển), thi nâng ngạch công chức, thăng hạng chức danh nghề nghiệp viên chức (thi hoặc xét thăng hạng) đã được cấp có thẩm quyền phê duyệt trước ngày 29 tháng 11 năm 2018 theo quy định tại khoản 2 Điều 4 Nghị định số 161/2018/NĐ-CP thì chưa áp dụng quy định tại Nghị định số 161/2018/NĐ-CP và phải hoàn thành trước ngày 15 tháng 7 năm 2019. Sau thời hạn này nếu không hoàn thành thì thực hiện theo quy định tại Nghị định số 161/2018/NĐ-CP.
4. Bãi bỏ một phần các văn bản quy phạm pháp luật sau:
a) Nội dung các điều, khoản, điểm sau đây tại Thông tư số 13/2010/TT-BNV ngày 30 tháng 12 năm 2010 của Bộ trưởng Bộ Nội vụ quy định chi tiết một số điều về tuyển dụng và nâng ngạch công chức của Nghị định số 24/2010/NĐ-CP ngày 15 tháng 3 năm 2010 của Chính phủ quy định về tuyển dụng, sử dụng và quản lý công chức: Điều 2 và Điều 7;
b) Nội dung khoản 2, khoản 3 Điều 1 Thông tư số 05/2012/TT-BNV ngày 24 tháng 10 năm 2012 của Bộ trưởng Bộ Nội vụ sửa đổi, bổ sung một số điều của Thông tư số 13/2010/TT-BNV ngày 30 tháng 12 năm 2010 của Bộ trưởng Bộ Nội vụ quy định chi tiết một số điều về tuyển dụng và nâng ngạch công chức của Nghị định số 24/2010/NĐ-CP ngày 15 tháng 3 năm 2010 của Chính phủ quy định về tuyển dụng, sử dụng và quản lý công chức;
c) Nội dung khoản 1, khoản 3 Điều 2 Thông tư số 05/2017/TT-BNV ngày 15 tháng 8 năm 2017 của Bộ trưởng Bộ Nội vụ sửa đổi, bổ sung một số điều của Thông tư số 11/2014/TT-BNV ngày 09 tháng 10 năm 2014 và Thông tư số 13/2010/TT-BNV ngày 30 tháng 12 năm 2010 của Bộ trưởng Bộ Nội vụ về tiêu chuẩn nghiệp vụ chuyên môn, bổ nhiệm ngạch và xếp lương đối với các ngạch công chức chuyên ngành hành chính và việc tổ chức thi nâng ngạch công chức;
d) Nội dung khoản 4 Điều 11 Thông tư số 12/2012/TT-BNV ngày 18 tháng 12 năm 2012 của Bộ trưởng Bộ Nội vụ quy định về chức danh nghề nghiệp và thay đổi chức danh nghề nghiệp đối với viên chức;
đ) Nội dung các điều, khoản, điểm sau đây tại Thông tư số 15/2012/TT-BNV ngày 25 tháng 12 năm 2012 của Bộ trưởng Bộ Nội vụ hướng dẫn về tuyển dụng, ký kết hợp đồng làm việc và đền bù chi phí đào tạo, bồi dưỡng đối với viên chức: Điều 2, Điều 4, Điều 7 và Điều 8.
5. Bãi bỏ Thông tư số 16/2012/TT-BNV ngày 28 tháng 12 năm 2012 của Bộ trưởng Bộ Nội vụ ban hành Quy chế thi tuyển, xét tuyển viên chức; Quy chế thi thăng hạng chức danh nghề nghiệp viên chức đối với viên chức và Nội quy kỳ thi tuyển, thi thăng hạng chức danh nghề nghiệp đối với viên chức.
6. Trong quá trình thực hiện nếu có vướng mắc, đề nghị phản ánh về Bộ Nội vụ để được hướng dẫn hoặc xem xét, giải quyết./.".
[11] - Thông tư số 03/2019/TT-BNV ngày 14 tháng 5 năm 2019 quy định:
"Điều 5. Trách nhiệm tổ chức thực hiện
1. Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương và các cơ quan, tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Thông tư này.
2. Trường hợp qua thanh tra, kiểm tra phát hiện việc tổ chức kỳ thi tuyển, xét tuyển công chức, viên chức, thi nâng ngạch công chức, thăng hạng chức danh nghề nghiệp viên chức không thực hiện đúng quy định của pháp luật hoặc việc chấm điểm, tổng hợp điểm các bài thi có sai sót ảnh hưởng trực tiếp đến kết quả thi hoặc xét của thí sinh thì căn cứ kết luận thanh tra, kiểm tra, người đứng đầu cơ quan, đơn vị có thẩm quyền tổ chức thi tuyển, xét tuyển công chức, viên chức, thi nâng ngạch công chức, thăng hạng chức danh nghề nghiệp viên chức hủy kỳ thi tuyển, xét tuyển công chức, viên chức, thi nâng ngạch công chức, thăng hạng chức danh nghề nghiệp viên chức không thực hiện đúng quy định đó hoặc hủy những bài thi, tổng hợp điểm thi hoặc xét có sai sót làm thay đổi kết quả thi hoặc xét; đồng thời, kiểm điểm làm rõ trách nhiệm để xử lý các tổ chức, cá nhân có hành vi vi phạm theo quy định của Đảng và của pháp luật.
3. Trường hợp công chức, viên chức sử dụng văn bằng, chứng chỉ không hợp pháp hoặc kê khai không đúng sự thật để đủ tiêu chuẩn, điều kiện dự thi nâng ngạch, thăng hạng chức danh nghề nghiệp thì bị xử lý kỷ luật theo quy định; đồng thời bị hủy kết quả thi nâng ngạch, thăng hạng chức danh nghề nghiệp và hủy quyết định bổ nhiệm vào ngạch, chức danh nghề nghiệp viên chức (nếu có). Công chức, viên chức bị hủy quyết định bổ nhiệm ngạch, chức danh nghề nghiệp thì xếp lại ngạch, chức danh nghề nghiệp, bậc, hệ số lương đúng với ngạch, chức danh nghề nghiệp, bậc, hệ số lương hưởng khi được cử dự thi nâng ngạch, thăng hạng chức danh nghề nghiệp.".
