Regarding the issuance of Regulations on the Management and Use of Boar Breeding Stock

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Animal Breed Law;

At the proposal of the Director of the Department of Agriculture,

DECISION:

Article 1. These Regulations on the Management and Use of Boar Breeding Stock are hereby issued together with this Decision.

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

Article 3. The Heads of the Ministry's Office, the Directors of the Department of Agriculture, the Directors of Provincial Departments of Agriculture and Rural Development, the Heads of units, and individuals concerned are responsible for implementing this Decision.

REGULATIONS ON THE MANAGEMENT AND USE OF BOAR BREEDING STOCK

(Issued together with Decision No. 07/2005/QĐ-BNN dated January 31, 2005)

PART I

GENERAL PROVISIONS

Article 1. These regulations apply to organizations and individuals in Vietnam, as well as foreign organizations and individuals breeding boar breeding stock for the production of semen for artificial insemination or direct mating (hereinafter referred to as breeders of boar breeding stock).

Article 2. Breeders of boar breeding stock must comply with other relevant legal documents concurrently.

Article 3. The terms used in these regulations are understood as follows:

1. Boar Breeding Stock Farm is a place where boars are raised for direct mating or for producing semen for artificial insemination, including:

a) Enterprises, research institutions, and livestock farms;

b) Artificial Insemination Station for Pigs;

c) Family livestock households.

2. Quality certification is a document issued by the agricultural management agency certifying the breed quality of boar breeding stock according to current regulations.

Article 4. Breeders of boar breeding stock must declare the breed quality in accordance with the provisions of the Ministry of Agriculture and Rural Development in Decision No. 61/2002/QĐ-BNN dated July 8, 2002 on the list of animal breeding stock products that must declare quality standards; Decision No. 66/2002/QĐ-BNN on economic and technical criteria for breeding stock that must declare quality standards; and Decision No. 67/2002/QĐ-BNN on temporary economic and technical criteria for breeding stock.

Chapter II

REGULATIONS ON THE MANAGEMENT AND USE OF BOAR BREEDING STOCK

FOR ARTIFICIAL INSEMINATION

Article 5. Breeders of boar breeding stock for producing semen for artificial insemination must ensure the conditions specified in points a, b, c, d, and e of Clause 1, Article 19 of the Animal Breed Law, while also ensuring the following conditions:

1. Boars raised for producing semen for artificial insemination must be individually tested for productivity and meet the requirements of the individual productivity testing standard. Boar breeding stock must have clear pedigrees accompanied by veterinary quarantine certificates and breed quality certificates issued by authorized state management agencies in the agricultural sector. Each boar breeding stock must be numbered and recorded in the tracking book according to current regulations.

2. The number of boar breeding stock in an artificial insemination station must not be less than four, and in a farm, it must be appropriate to the size of the sow herd.

3. Housing facilities must ensure veterinary hygiene and environmental protection according to laws on veterinary medicine and environmental protection. The minimum housing area must be 5 square meters per boar for indigenous pigs and 6 square meters per boar for exotic pigs.2/boar for indigenous pigs and 6 m2/boar for exotic pigs.

4. There must be or hire technical staff with at least a secondary level of livestock veterinary training and trained and certified in semen collection, preparation, preservation, and transportation techniques.

5. There must be record books for monitoring semen quality, sufficient equipment and supplies as specified in Appendices 1, 2, 3, 4, and 5 attached to this document.

Article 6. During the period of semen production, boar breeding stock must be monitored and inspected monthly for sperm resistance index (R) and abnormal sperm percentage (K). Each time semen is collected, the following indicators must be checked: color, smell, filtered volume of ejaculation (V), sperm motility (A), and sperm concentration (C). The results of semen quality inspections must be accurately recorded in the record books and forms as specified in the appendices attached to this document.

Article 7. The production, preparation, quality inspection, conservation, distribution, transportation, and veterinary hygiene of pig semen must comply with the technical procedures for artificial insemination of pigs issued by the Ministry of Agriculture and Rural Development. Semen containers must be labeled with the name and number of the boar breeding stock; semen quantity; name of the production facility; main quality indicators; and expiration date.

Article 8. Breeders of boar breeding stock must strictly implement annual culling and evaluation of breeding stock according to the standards issued by the agricultural sector. If a boar does not meet the breeding standards, the breeder must immediately stop semen collection and promptly cull the boar while reporting to the authority that issued the breed quality certificate.

Article 9. Breeders of boar breeding stock for producing semen for artificial insemination must report the quality of breeding stock and semen quality every six months to the competent state management agency in the agricultural sector.

Article 10. Boar breeding stock must be vaccinated regularly against diseases and tested for infectious disease antibodies according to veterinary regulations. It is strictly prohibited to collect, circulate, and use semen from boar breeding stock that are diseased.

Article 11. The frequency of semen collection must not exceed two times per week for boar breeding stock under two years old and three times per week for those over two years old. The age for starting semen collection for boar breeding stock must not be less than eight months for indigenous pigs and ten months for exotic pigs, and their usage period must not exceed three and a half years.

Article 12. The dilution and preservation environment for newly produced domestic or imported semen must only be put into use and circulated in the market after being tested and approved for application in production based on the acceptance and evaluation results of the scientific council established by the Department. Testing fees are the responsibility of the organization or individual importing the semen.

Article 13. Organizations and individuals importing pig semen must submit an import application to the Department of Agriculture. The application includes:

a) An import application form for pig semen as prescribed;

b) A pedigree file of the boar breeding stock with confirmation from the authorized agency of the exporting country.

For pig semen not listed in the Catalogue of Breeding Animals Permitted for Production and Business in Vietnam, it may only be put into use and circulated in the market after being tested and having a decision from the Director of the Department of Agriculture to apply in production based on the acceptance and evaluation results of the Scientific Council established by the Department. The testing fee shall be borne by the organization or individual importing the semen.

Chapter III

REGULATIONS ON THE MANAGEMENT AND USE OF BOAR BREEDING STOCK

FOR DIRECT BREEDING

Article 15. Boars used for direct breeding must be produced from breeding farms that meet the conditions stipulated in Article 19 of the Breeding Animals Ordinance, have clear pedigrees, veterinary quarantine certificates, breeding quality certificates issued by the provincial-level agricultural management agency, and registered with the People's Committee of the commune where the breeding farm is located by the breeder.

Article 16. Boars used for direct breeding shall not exceed three times per week. The age at which boars begin direct breeding shall not be less than eight months old for indigenous pigs and ten months old for exotic breeds, and their usage period shall not exceed three years.

Article 17. Boars used for direct breeding must be regularly vaccinated against diseases and tested for infectious disease antibodies according to the regulations of the veterinary sector. It is strictly prohibited to exploit and use boars that are diseased.

Article 18. Pig breeders using boars for direct breeding must strictly implement annual selection and evaluation of breeding boars according to the standards issued by the agricultural sector. If the boars do not meet the standards, they must be promptly culled and reported to the People's Committee of the commune where the boar breeding registration is made.

Chapter IV

STATE MANAGEMENT RESPONSIBILITIES

REGARDING BOAR BREEDING

Article 19. State management levels for boar breeding are as follows:

1. The Department of Agriculture is responsible for:

a) Implement state management over the quality of breeding boars nationwide, manage and issue breeding quality certificates for boar breeding farms under the Ministry of Agriculture and Rural Development and companies with 100% foreign capital;

b) Organize the development and issuance of forms for monitoring and evaluating breeding quality, software for managing and standardizing numbering for breeding boars nationwide;

c) Review applications, organize testing, and grant permits for the importation of pig semen, dilution environments, and preservation of pig semen;

d) Annually organize inspections and audits of the implementation of management and use regulations for breeding boars at boar breeding farms under the Ministry of Agriculture and Rural Development and companies with 100% foreign capital.

2. Provincial Departments of Agriculture and Rural Development and municipal departments under the central government are responsible for:

a) Implement state management over the quality of breeding boars within the province or city; issue breeding quality certificates for boar breeding farms within the province or city, except those managed by the Ministry of Agriculture and Rural Development as specified in point a, Clause 1, Article 19;

b) Annually develop plans for the evaluation and selection of breeding boars within the local area; take the lead and coordinate with the county-level agricultural management agencies to organize the implementation of the selection and evaluation of breeding boar herds at boar breeding farms within the province or city's jurisdiction;

c) Annually organize inspections and audits of the implementation of management and use regulations for breeding boars at boar breeding farms within the province or city's jurisdiction;

d) Report annually to the Department of Agriculture on the work of state management over the quality of breeding boars within the province or city.

The county-level agricultural management agency has the responsibility to:

a) Manage the quality of breeding boars used for direct breeding at household farms within its jurisdiction;

b) Coordinate with the People's Committee of the commune to organize and guide the registration and issuance of breeding quality certificates for breeding boars used for direct breeding at household farms;

c) Organize the implementation of the evaluation and selection of breeding boars used for direct breeding within the county;

d) Report annually to the Department of Agriculture and Rural Development on the work of state management over the quality of breeding boars within the county.

Chapter V

IMPLEMENTING PROVISIONS

Article 20. The Director of the Department of Agriculture and the Directors of the Departments of Agriculture and Rural Development of provinces and centrally-administered cities shall be responsible for guiding the implementation of this Regulation within their respective functions, tasks, and authorities.

Any difficulties encountered during the implementation of this Regulation should be reported to the Ministry of Agriculture and Rural Development for consideration and resolution./.
