CIRCULAR
Regulations on sets of data, data standards, and construction and management of national meteorological and hydrological databases
Construction and management of national meteorological and hydrological databases
Pursuant to the Law on Meteorology and Hydrology dated November 23, 2015;
Pursuant to Decree No. 21/2013/NĐ-CP dated March 4, 2013, promulgated by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
At the proposal of the Director of the Meteorology, Hydrology, and Climate Change Department and the Legal Affairs Department;
The Minister of Natural Resources and Environment promulgates this Circular stipulating sets of data, data standards, and construction and management of national meteorological and hydrological databases.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular provides detailed regulations for Clause 2, Article 31 of the Law on Meteorology and Hydrology regarding sets of data, data standards, and construction and management of national meteorological and hydrological databases.
Article 2. Applicability
This Circular applies to agencies, organizations, and individuals involved in activities related to the construction and management of national meteorological and hydrological databases.
Chapter II
DETAILED REGULATIONS
Section 1
SETS OF METEOROLOGICAL AND HYDROLOGICAL DATA AND DATA STANDARDS
Article 3. Sets of meteorological and hydrological data
Sets of meteorological and hydrological data include all information and data specified in Article 29 and information and data on climate change monitoring as specified in Clause 2, Article 34 of the Law on Meteorology and Hydrology, organized into the following sets:
1. Set of observation, survey, and investigation data on meteorology, hydrology, marine meteorology, atmospheric environment, and water environment including the information and data specified in Clause 1, Article 29 and points a and d, Clause 2, Article 34 of the Law on Meteorology and Hydrology:
a) Information and data on meteorology comprising 12 parameters: Radiation, atmospheric pressure, wind, evaporation, temperature (air, soil), humidity (air, soil), clouds, rainfall, visibility, sunshine duration, other meteorological phenomena according to technical measurement regulations;
b) Information and data on hydrology comprising 4 parameters: Water level, flow rate, suspended sediment load, water temperature;
c) Information and data on marine meteorology comprising 10 parameters: Surface sea wind, sea visibility, sea level, sea waves, sea surface state, sea water temperature, sea water salinity, sea brightness, dangerous meteorological marine phenomena (seasickness, tsunami, etc.), currents at sea;
d) Information and data on ozone-ultraviolet radiation comprising: Total ozone, ultraviolet radiation intensity;
đ) Information and data on atmospheric environment comprising: Chemical composition of rainwater, physical parameters, chemical parameters of atmospheric environment;
e) Information and data on water environment comprising: Physical parameters, chemical parameters of river, lake, and sea water environments;
2. Set of forecast and warning meteorological and hydrological data including the information and data specified in Clauses 2, 3, and 4, Article 29 of the Law on Meteorology and Hydrology:
a) Forecast and warning meteorological and hydrological bulletins;
b) Products from forecasting models;
c) Charts, maps, satellite images;
d) Reports on meteorological and hydrological conditions;
đ) Information and data obtained from international organizations and foreign organizations and individuals;
e) Information and data on meteorological and hydrological disasters.
3. Set of technical files of stations and forecast and warning meteorological and hydrological permits including the information and data specified in Clauses 5 and 6, Article 29 and point h, Clause 2, Article 34 of the Law on Meteorology and Hydrology:
a) Technical files of meteorological and hydrological stations, facilities, and measuring instruments;
b) Files on issuance, extension, suspension, and revocation of forecast and warning meteorological and hydrological activity permits;
c) Technical files of climate change monitoring stations.
4. Set of climate change data including the information and data specified in points b, c, đ, e, and g, Clause 2, Article 34 of the Law on Meteorology and Hydrology:
a) National climate standard set;
b) Results of national climate assessment;
c) Climate change scenarios;
d) Information and data on greenhouse gas emissions and economic and social activities related to greenhouse gas emissions;
đ) Information and data on the impact of meteorological and hydrological disasters and climate change on natural resources, environment, ecosystems, living conditions, and economic and social activities.
5. Set of scientific research, programs, and projects on meteorology and hydrology including the information and data specified in Clause 3, Article 29 and point i, Clause 2, Article 34 of the Law on Meteorology and Hydrology:
a) Results of scientific and technological research topics on meteorology and hydrology, climate change monitoring;
b) Programs, plans, and projects on meteorology and hydrology, climate change monitoring;
c) Films and photographs of meteorological and hydrological research subjects;
d) Plans and results of weather modification activities.
6. Set of legal regulatory documents on meteorology and hydrology including the information and data specified in Clause 8, Article 29 and points d and k, Clause 2, Article 34 of the Law on Meteorology and Hydrology:
a) Legal regulatory documents on meteorology and hydrology, climate change monitoring;
b) Standards and technical specifications, economic and technical norms on meteorology and hydrology, climate change monitoring;
c) Technical procedures and technical guidance on meteorology and hydrology, climate change monitoring;
d) Information and data on ozone layer protection activities and management of substances depleting the ozone layer.
Article 4. Meteorological and Hydrological Data Standards
1. Standardization is the content aimed at helping to organize data in databases effectively. The purpose of standardization is to reduce redundant data, ensure data independence to minimize space usage in databases and store data logically.
2. Data before being entered into the national meteorological and hydrological database must be checked and standardized according to technical standards for meteorology and hydrology and international and national data standards to ensure management and exchange, connection with other databases.
3. The standardization of meteorological and hydrological data shall be carried out according to the detailed procedures for building resource and environmental databases as prescribed in Circular No. 26/2014/TT-BTNMT dated May 28, 2014, issued by the Ministry of Natural Resources and Environment on procedures and economic-technical norms for building resource and environmental databases.
Section 2
BUILDING AND MANAGING THE NATIONAL METEOROLOGICAL AND HYDROLOGICAL DATABASE
Article 5. Submission of Meteorological and Hydrological Information and Data
1. Agencies and organizations using state budget funds or having origins from the state budget for meteorological and hydrological observation, investigation, survey, and other meteorological and hydrological activities shall be responsible for submitting meteorological and hydrological information and data to the national meteorological and hydrological database in accordance with the provisions of the Law on Meteorology and Hydrology and relevant laws on meteorology and hydrology.
2. Submitted meteorological and hydrological information and data must have their sources approved or confirmed as legitimate and valuable by competent authorities.
Article 6. Management of Meteorological and Hydrological Information and Data
1. The National Meteorological and Hydrological Center under the Ministry of Natural Resources and Environment manages national meteorological and hydrological information and data, and is responsible for:
a) Receiving meteorological and hydrological information and data as prescribed in Clause 1, Article 5 of this Circular, implemented by agencies and organizations under the Ministry of Natural Resources and Environment;
b) Receiving meteorological and hydrological information and data provided by Ministries, ministerial-level agencies, government-affiliated agencies (hereinafter referred to as Ministries and sectors), provincial People's Committees in accordance with the provisions of this Clause;
c) Storing, preserving, and providing meteorological and hydrological information and data in accordance with regulations;
d) Guiding and inspecting the submission and receipt of meteorological and hydrological information and data as prescribed in this Circular; compiling reports on the receipt, storage, preservation, and provision of meteorological and hydrological information and data supplied by Ministries, sectors, localities, organizations, and individuals to serve the construction of the national meteorological and hydrological database;
e) Annually reviewing and reporting to the Ministry of Natural Resources and Environment on the receipt, storage, preservation, and provision of meteorological and hydrological information and data.
2. Ministries and sectors are responsible for:
a) Receiving meteorological and hydrological information and data as prescribed in Clause 1, Article 5 of this Circular, implemented by agencies and organizations under Ministries and sectors;
b) Organizing the storage, preservation, utilization, and provision of meteorological and hydrological information and data to the national meteorological and hydrological database;
c) Regularly sending annual reports on the work of receiving, storing, preserving, and providing meteorological and hydrological information and data to the Ministry of Natural Resources and Environment (through the General Department of Meteorology, Hydrology, and Climate Change);
d) Guiding and inspecting the implementation of the contents prescribed in points a, b, and c of Clause 2 of this Article;
e) Notifying the Ministry of Natural Resources and Environment of the focal point for managing meteorological and hydrological information and data to coordinate in implementation.
3. Departments of Natural Resources and Environment assist provincial People's Committees in responsibilities:
a) Receiving meteorological and hydrological information and data as prescribed in Clause 1, Article 5 of this Circular, implemented by agencies and organizations under various levels of People's Committees within the province;
b) Organizing the storage, preservation, utilization, and provision of meteorological and hydrological information and data to the national meteorological and hydrological database;
c) Regularly sending annual reports on the work of receiving, storing, preserving, and providing meteorological and hydrological information and data to the Ministry of Natural Resources and Environment (through the General Department of Meteorology, Hydrology, and Climate Change);
d) Guiding and inspecting the implementation of the contents prescribed in points a, b, and c of Clause 3 of this Article.
Article 7. Receipt of Meteorological and Hydrological Information and Data
1. The agencies and organizations specified in point b, Clause 1, Article 6 of this Circular (hereinafter referred to as the submitting party) shall notify the submission of meteorological and hydrological information and data to the agency managing meteorological and hydrological information and data (hereinafter referred to as the receiving party).
2. Upon receipt of the notification of submission of meteorological and hydrological information and data, the receiving party shall develop a detailed plan for receipt and notify the submitting party. The plan includes the following contents: time, location, method of submission and receipt, storage warehouse, equipment and means of receipt, and other related matters.
3. The submitting party shall prepare a submission dossier of meteorological and hydrological information and data to be sent to the receiving party. The dossier includes:
a) One (01) statistical table of the list of meteorological and hydrological information and data submitted according to the form prescribed in Appendix 01 of this Circular;
b) One (01) summary report on the submitted information and data according to the form prescribed in Appendix 02 of this Circular for research topics, programs, projects, and plans;
c) One (01) copy of the acceptance dossier as prescribed by the competent authority (if any);
d) Types of meteorological and hydrological information and data with officially confirmed sources, original documents or final products of research topics, programs, projects, and plans.
4. The receiving party shall verify the list and quantity of information and data submitted and issue a Receipt for Submission of Meteorological and Hydrological Information and Data according to the form prescribed in Appendix 03 of this Circular, to be handed over to the submitting party.
5. The receiving party shall conduct a check on the submitted meteorological and hydrological information and data and issue a Record of Inspection Opinions on Submitted Meteorological and Hydrological Information and Data according to the form prescribed in Appendix 04 of this Circular.
The content of the inspection of submitted meteorological and hydrological information and data includes:
a) Checking the completeness and validity of the submitted information and data based on the results already accepted, approved, published, or recognized by the competent authority;
b) Checking the consistency between the information and data in printed form and those in electronic form;
c) Checking the format and specifications of the submitted types of data.
In cases where the submitted information and data do not meet the requirements as stipulated, the Record of Inspection Opinions on Submitted Meteorological and Hydrological Information and Data must clearly state the requirements for correction and improvement. In case of disagreement between the submitting party and the receiving party, the agency responsible for receiving meteorological and hydrological information and data shall report to the competent authority for consideration and resolution.
6. Within the maximum period of ten working days from the date of receipt of meteorological and hydrological information and data, the receiving party shall complete the inspection according to the content prescribed in Clause 5 of this Article and issue a Confirmation Certificate for Submission of Meteorological and Hydrological Information and Data to the agencies, organizations, and individuals who have submitted the information and data. In cases where a Confirmation Certificate is not issued, the agency receiving the data shall provide a written response stating the reasons. The model of the Confirmation Certificate for Submission of Meteorological and Hydrological Information and Data is prescribed in Appendix 05 of this Circular.
Article 8. Responsibilities and Authorities of Organizations and Individuals Submitting Meteorological and Hydrological Information and Data
1. Agencies and organizations specified in point b, Clause 1, Article 6 of this Circular that submit meteorological and hydrological information and data shall be issued a Confirmation Certificate for Submission of Meteorological and Hydrological Information and Data. The Confirmation Certificate for Submission of Meteorological and Hydrological Information and Data serves to confirm the completion of tasks related to the field of meteorology and hydrology using budget sources as stipulated in Clause 1, Article 5 of this Circular.
2. Timely notify the meteorological and hydrological information and data management agency about errors in the submitted information and data.
Article 9. Construction and Updating of the National Meteorological and Hydrological Database
1. The national meteorological and hydrological database shall be constructed uniformly and synchronously based on the collection, creation, and integration of information and data from the results of observations, surveys, and investigations from the national meteorological and hydrological station network, specialized meteorological and hydrological stations within the country's territory, and other meteorological and hydrological information and data sources as prescribed in Article 3 of this Circular.
2. The national meteorological and hydrological database shall be connected and share data with other national databases and databases of relevant ministries, sectors, and localities involved in meteorological and hydrological activities.
3. Data must be checked, evaluated for quality, and processed according to regulations before being updated into the database. Depending on the type, form, characteristics, nature of the data, level of processing, and degree of dissemination, data should be updated into the database ensuring rationality, scientific accuracy, and requirements for data security and safety.
4. The National Meteorological and Hydrological Center assists the Ministry of Natural Resources and Environment in building the national meteorological and hydrological database and is responsible for:
a) Collecting all meteorological and hydrological information and data of agencies and organizations under the Ministry of Natural Resources and Environment and other ministries, sectors, and localities nationwide in a unified manner;
b) Organizing the updating and management of meteorological and hydrological information and data.
Article 10. Management of the National Meteorological and Hydrological Database
1. Contents of managing the national meteorological and hydrological database
a) Building, updating, utilizing the national meteorological and hydrological database and implementing online public services in the field of meteorology and hydrology;
b) Integrating observation, survey, investigation results, and related meteorological and hydrological information and data provided by relevant ministries, sectors, and localities, monitoring climate change;
c) Establishing and submitting regulations on access permissions to the national meteorological and hydrological database; managing connections, sharing, and providing data with databases of ministries, sectors, and localities.
2. The National Meteorological and Hydrological Center is responsible for assisting the Ministry of Natural Resources and Environment in organizing the management, operation, and utilization of the national meteorological and hydrological database.
Article 11. Utilizing, exploiting the national meteorological and hydrological database and integrating, exchanging data with the databases of ministries, sectors, and localitiesIntegration, exchange of data from the national meteorological and hydrological database with the meteorological and hydrological databases of ministries, sectors, and localities
The exploitation, utilization, and integration, exchange of data from the national meteorological and hydrological database with the meteorological and hydrological databases of ministries, sectors, and localities shall be carried out in accordance with Article 32 of the Law on Meteorology and Hydrology and other laws on meteorology and hydrology.
Article 12. Meteorological and Hydrological Database of Ministries, Sectors, and Localities
1. Ministries and sectors shall base on the national meteorological and hydrological database prescribed in this Circular and their needs for exploitation and utilization to establish a meteorological and hydrological database within their management scope in accordance with their assigned functions and tasks.
2. Provincial People's Committees under the Central Government shall base on the national meteorological and hydrological database prescribed in this Circular and the provisions at point i, Clause 1, Article 53 of the Law on Meteorology and Hydrology to organize the establishment of a meteorological and hydrological database within their management scope.
3. The meteorological and hydrological databases established by ministries, sectors, and localities must ensure consistency and be exchangeable with the national meteorological and hydrological database.
Chapter III
IMPLEMENTING PROVISIONS
Article 13. Effective Date
This Circular takes effect from July 1, 2016.
1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, and related agencies, units, and individuals are responsible for implementing this Circular.

2. The Director of the General Meteorological and Hydrological Service and Climate Change Department is responsible for assisting the Minister of Natural Resources and Environment in guiding, urging, and inspecting the implementation of this Circular.
3. During the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to report them to the Ministry of Natural Resources and Environment for consideration and resolution./.
