JOINT CIRCULAR
REGULATIONS ON CODES AND STANDARDS FOR PROFESSIONAL TITLES OF SPECIALIST CIVIL SERVANTS IN THE FIELD OF FINE ARTS
Pursuant to the Civil Servant Law No. 58/2010/QH12 dated November 15, 2010;
Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, utilization, and management of civil servants;
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, public officials, and armed forces; Decree No. 17/2013/NĐ-CP dated December 19, 2013 of the Government amending and supplementing certain articles of Decree No. 204/2004/NĐ-CP;
Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
The Minister of Culture, Sports and Tourism and the Minister of Home Affairs issue this Joint Circular regulating codes and standards for professional titles of specialist civil servants in the field of fine arts.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Joint Circular stipulates codes, standards for professional titles, appointment, and grading according to professional titles for specialist civil servants in the field of fine arts working in public service units.
2. Specialist civil servants in the field of fine arts as specified in Clause 1 of this Article include painters performing the following tasks: puppet figure creation; animation film action design; stage decoration design; make-up and costume design for stage and cinema.
Article 2. Codes and classification of professional titles for specialist civil servants in the field of fine arts
Occupational titles for specialized art personnel include:
a) Painter Class I Code: V.10.08.25
b) Painter Class II Code: V.10.08.26
c) Painter Class III Code: V.10.08.27
d) Painter Class IV Code: V.10.08.28
Article 3. Professional ethics standards for professional titles of specialist civil servants in the field of fine arts
1. High sense of responsibility, love for the profession, enthusiasm for assigned work, always comply with laws, fulfill all obligations of a civil servant in professional activities.
2. Concerned about the development of fine art; always aware of preserving, protecting, and promoting traditional fine art values of ethnic communities in Vietnam.
3. Honest, objective, straightforward, with clear opinions; have a humble attitude when interacting with the public; combat wrongful and negative behaviors; practice thrift and oppose waste.
4. Respectful, cooperative, and supportive of colleagues, sharing experiences in work.
Chapter II
OCCUPATIONAL STANDARDS
Article 4. Artist Grade I - Code Number: V.10.08.25
1. Duties:
a) Lead and direct the creation and implementation of large-scale, complex fine art projects and works;
b) Promote new trends in fine art creation; summarize experiences, conduct research, and propose issues related to the creative process;
c) Lead research topics, analyze trends in fine art creation both domestically and internationally; prepare materials for creative works; lead the preparation of content for domestic and international specialized industry seminars;
d) Monitor and evaluate the social impact of works after their wide release to draw lessons and propose new trends in creating works;
đ) Lead the development of content, programs, and materials and organize training to improve skills for lower-ranked civil servants;
2. Qualifications regarding education and training:
a) Hold a bachelor's degree or higher in a relevant fine arts specialty;
b) Hold a certificate for the standard title of Painter Class I;
3. Standards for professional competence:
a) Proficiently grasp and implement Party viewpoints, policies, and State laws;
b) Proficiently grasp comprehensive knowledge of various forms of fine arts; characteristics of related arts; proficiently grasp scientific and technological achievements both domestically and internationally related to fine arts;
c) Be familiar with various forms, methods of creation, and related technical procedures;
d) Skillfully exploit and utilize materials, with extensive experience in creative activities and the realization of works;
đ) Have the ability to direct and coordinate with colleagues in organizing professional fine arts activities; capable of researching and proposing innovative solutions in the field of fine arts;
e) Have at least two works recognized by a Ministry-level or equivalent Art Council regarding artistic quality;
4. Civil servants promoted to the title of Painter Class I shall meet one of the following conditions:
a) Awarded the title of People's Artist;
b) Meet the standards prescribed in Clause 2 and Clause 3 of this Article and must have held the title of Painter Class II or equivalent for at least six years, including at least two years as Painter Class II;
Article 5. Second-Class Painter - Code: V.10.08.26
1. Duties:
a) Lead the organization of creation and direct the implementation of medium-scale fine art works with moderate complexity;
b) Summarize, draw lessons, research, and propose issues related to the creative process of the arts;
c) Participate in research topics, analyzing trends in fine art creation both domestically and internationally;
d) Monitor and evaluate the social impact of works after their wide release to draw lessons and propose new trends in creating works;
đ) Participate in developing content, programs, materials, and organizing training to improve skills for lower-ranked civil servants;
2. Qualifications regarding education and training:
a) Hold a bachelor's degree or higher in a relevant fine arts specialty;
b) Hold a certificate for the standard title of Painter Class II;
3. Standards for professional competence:
a) Proficiently grasp and implement Party viewpoints, policies, and State laws;
b) Grasp comprehensive knowledge of various forms of fine arts; characteristics of related arts; grasp scientific and technological achievements both domestically and internationally related to fine arts;
c) Understand the forms, methods of creation, and related technical procedures;
d) Be proficient in utilizing materials and have experience in creative activities;
đ) Capable of researching and coordinating with colleagues in organizing professional fine arts activities;
e) Have at least one work recognized by a Ministry-level or equivalent Art Council regarding artistic quality;
4. Civil servants promoted to the title of Painter Class II shall meet one of the following conditions:
a) Awarded the title of Meritorious Artist;
b) Meet the standards prescribed in Clause 2 and Clause 3 of this Article and must have held the title of Painter Class III or equivalent for at least nine years, including at least two years as Painter Class III.
Article 6. Third-Class Painter - Code: V.10.08.27
1. Duties:
a) Carry out medium-sized and small-scale art projects with moderate complexity; represent paintings, sculptures, artistic designs... on one material or different materials ensuring the content and form according to the assigned tasks;
b) Research topics, prepare materials and documents; coordinate with relevant persons to unify creative ideas, ensure the completion process of assigned projects and works; implement shaping solutions (complete sketches, represent works);
c) Develop plans, propose measures to implement projects and works; estimate budgets, materials... for creative work or representation of works;
2. Qualifications regarding education and training:
a) Hold a bachelor's degree or higher in a relevant fine arts specialty;
b) Hold a certificate for upgrading the standard title of third-class artist;
3. Standards for professional competence:
a) Understand the viewpoints, policies, guidelines of the Party, state policies, and laws;
b) Understand the forms and methods of conducting creative work;
c) Be proficient in utilizing one material in creation and expression of works and pieces;
d) Possess the ability to collaborate with colleagues in professional artistic activities;
đ) Possess the ability to apply scientific progress to enhance the effectiveness of artistic activities;
4. A staff member promoted from the fourth-class artist title to the third-class artist title must meet the standards prescribed in Clause 2 and Clause 3 of this Article and have held the fourth-class artist title for at least two years for college level or three years for vocational school level;
Article 7. Category IV Painter - Code: V.10.08.28
1. Duties:
a) Represent the author's works such as paintings, sculptures, artistic designs... on one material or different materials according to the required content and form;
b) To prepare relevant materials, documents, supplies related to the implementation of projects and works; to carry out shaping solutions ensuring the completion process of projects and works.
2. Qualifications regarding education and training:
Hold a diploma in fine arts or higher education suitable for the specialty;
3. Standards for professional competence:
a) Understand basic scientific achievements related to professional activities;
b) Understand various forms and methods of creation;
c) Know how to exploit and use one material in creative work;
d) Possess the ability to collaborate with colleagues in professional activities;
Chapter III
GUIDELINES FOR APPOINTMENT AND SALARY GRADING BY PROFESSIONAL TITLES
Article 8. Principles for appointment and salary grading according to professional titles for staff members;
1. The appointment to professional titles for staff members stipulated in this Joint Circular must be based on the job position, responsibilities, and professional expertise currently undertaken by the staff member, and in accordance with Article 9 of this Joint Circular;
2. When appointing from the current civil servant rank to the corresponding professional title in the fine arts specialty, it shall not combine with salary grade increase or promotion (except in cases where the professional title in the fine arts specialty is appointed as prescribed in Article 9 and Clause 3 of Article 10 of this Joint Circular);
Article 9. Cases of appointment to professional titles;
Staff members who have been appointed to the civil servant rank in the fine arts specialty according to Decision No. 428/TCCP-VC dated June 2, 1993 issued by the Minister - Head of the Civil Service Department of the Government (now the Minister of Home Affairs) promulgating the professional standards of the civil service rank in the culture and information sector, now can be appointed to the professional title of staff member in the fine arts specialty as prescribed in this Joint Circular, as follows:
1. Appointment to the professional title of first-class artist (code V.10.08.25) for staff members currently holding the senior artist rank (code 17.160); staff members who have been conferred the title of People's Artist;
2. Appointment to the professional title of second-class artist (code V.10.08.26) for staff members currently holding the principal artist rank (code 17.161); staff members who have been conferred the title of Meritorious Artist;
3. Appointment to the professional title of third-class artist (code V.10.08.27) for staff members currently holding the artist rank (code 17.162);
4. Appointment to the professional title of fourth-class artist (code V.10.08.28) for staff members currently holding the intermediate artist rank (code 17.163).
Article 10. Salary Classification
1. The occupational titles of specialized art officials as stipulated in Article 2 of this Joint Circular shall apply the Professional and Technical Pay Scale for Officials and Staff in State-run Units (Table 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for cadres, civil servants, staff, and armed forces as follows:
a) The occupational title of First-Rank Painter (code V.10.08.25) shall apply the salary coefficient of Category A3, Group 1 (A3.1) from coefficient 6.20 to coefficient 8.00;
b) The occupational title of Second-Rank Painter (code V.10.08.26) shall apply the salary coefficient of Category A2, Group 1 (A2.1) from coefficient 4.40 to coefficient 6.78;
c) The occupational title of Third-Rank Painter (code V.10.08.27) shall apply the salary coefficient of Category A1 from coefficient 2.34 to coefficient 4.98;
d) The occupational title of Fourth-Rank Painter (code V.10.08.28) shall apply the salary coefficient of Category B from coefficient 1.86 to coefficient 4.06.
2. Salary classification upon completion of probationary period and appointment to occupational title.
After completing the probationary period as prescribed and being appointed to an occupational title by the competent authority managing officials, the following salary classification shall be implemented in the appointed occupational title:
a) In case of having a doctoral degree relevant to the field of fine arts, the third level, with a salary coefficient of 3.00 of the occupational title of Third-Rank Painter (code V.10.08.27) shall be assigned;
b) In case of having a master's degree relevant to the field of fine arts, the second level, with a salary coefficient of 2.67 of the occupational title of Third-Rank Painter (code V.10.08.27) shall be assigned;
c) In case of having a bachelor's degree relevant to the field of fine arts, the first level, with a salary coefficient of 2.34 of the occupational title of Third-Rank Painter (code V.10.08.27) shall be assigned;
d) In case of having a college degree relevant to the field of fine arts, the first level, with a salary coefficient of 1.86 of the occupational title of Fourth-Rank Painter (code V.10.08.28) shall be assigned.
đ) In case of having a vocational college degree relevant to the field of fine arts, the second level, with a salary coefficient of 2.06 of the occupational title of Fourth-Rank Painter (code V.10.08.28) shall be assigned.
3. Salary classification into occupational titles of specialized art officials as stipulated in Article 9 and Clause 1 of this Article for officials who have been classified into specialized art official ranks according to Decision No. 428/TCCP-VC dated June 2, 1993 of the Minister - Head of the Organizational and Cadre Department of the Government (now the Minister of Home Affairs) promulgating the professional standards for the rank of cultural and information officials, Decision No. 78/2004/QĐ-BNV dated November 3, 2004 of the Minister of Home Affairs on the issuance of the list of civil servant and official ranks, and Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for cadres, civil servants, staff, and armed forces, as follows:
a) In case of officials meeting the conditions for appointment to the occupational title of specialized art officials with the same grade salary coefficient as the old rank, the same grade salary and percentage of seniority allowance exceeding the ceiling (if any) currently enjoyed in the old rank (including the time for the next salary grade increase examination or the enjoyment of seniority allowance exceeding the ceiling if any in the old rank) shall be applied to the newly appointed occupational title.
Example 1: Mr. Nguyen Van H was appointed and classified into the Painter rank (code 17.162), grade 5, coefficient 3.66 since January 1, 2014. Now he meets the conditions and has been appointed by the competent authority to the occupational title of Third-Rank Painter (code V.10.08.27). He will be classified into grade 5, coefficient 3.66 of the occupational title of Third-Rank Painter from the date of the decision; the time for the next salary grade increase examination will be counted from January 1, 2014.
b) In case of officials with a vocational college degree in fine arts who were hired and classified into Category A0 according to Decree No. 204/2004/NĐ-CP, now they are appointed to the occupational title of Fourth-Rank Painter (code V.10.08.28), the classification of salary grades within the occupational title of Fourth-Rank Painter shall be based on the years of compulsory social insurance contributions according to the state-defined wage scale as follows:
Starting from the second grade of the occupational title of Fourth-Rank Painter, every two years (24 months) thereafter, one grade salary will be assigned (if there are interrupted periods without enjoying social insurance benefits, these periods can be accumulated). In case of failing to complete tasks or being disciplined during the working period, the time for the next salary grade increase will be extended according to the regular salary grade increase system.
After transferring to the salary classification into the occupational title of Fourth-Rank Painter mentioned above, if the salary coefficient assigned at the occupational title of Fourth-Rank Painter plus the seniority allowance exceeding the ceiling (if any) is lower than the salary coefficient already enjoyed in the old rank, the difference coefficient will be retained to equalize the salary coefficient (including seniority allowance exceeding the ceiling, if any) currently enjoyed in the old rank. This retained difference coefficient will be enjoyed throughout the period when the official is classified into the occupational title of Fourth-Rank Painter. If the official is promoted to a higher occupational title, the retained difference coefficient will be added to the current salary coefficient (including seniority allowance exceeding the ceiling, if any) to classify the salary into the newly appointed occupational title upon promotion and stop enjoying the retained difference coefficient from the date of receiving salary in the new occupational title.
Example 2: Mr. Nguyen Van B, with a vocational college degree in fine arts, was recruited as an official at the Cultural Center of Province H, started compulsory social insurance contributions from June 1, 2008, and was classified into grade 3, coefficient 2.72 of Category A0 since December 1, 2014, and has always completed assigned tasks without disciplinary actions during his working period. Now he has been appointed by the competent authority to the occupational title of Fourth-Rank Painter (code V.10.08.28). The salary grade classification within the occupational title of Fourth-Rank Painter will be as follows:
The period of service for Mr. Nguyen Van B starts from June 1, 2008, excluding the probationary period of six months, and he is classified at level 2 of the profession title of Painter Grade IV. For every two years, he is promoted to a higher level, so on December 1, 2014, Mr. Nguyen Van B was classified at level 5 with a salary coefficient of 2.66 for the profession title of Painter Grade IV; the time for enjoying the new salary grade at the profession title of Painter Grade IV begins from the date of signing the decision; the time for considering the next promotion will be calculated from December 1, 2014; simultaneously, he continues to enjoy the retention differential coefficient of 0.06 (2.72 - 2.66).
By December 1, 2016 (after two years), Mr. Nguyen Van B meets the conditions to be regularly promoted to level 6 with a salary coefficient of 2.86 for the profession title of Painter Grade IV and continues to enjoy the retention differential coefficient of 0.06 (total salary coefficient enjoyed is 2.92).
4. The promotion of rank for specialized art staff shall be implemented after being appointed to the profession title of specialized art staff as stipulated in this Joint Circular and implementing salary classification according to Clause 1, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007, issued by the Ministry of Home Affairs guiding salary classification when upgrading, transferring ranks, and types of civil servants and staff.
Chapter IV
IMPLEMENTING PROVISIONS
Article 11. Effective Date
1. This Joint Circular takes effect from August 15, 2016.
2. Abolish the provisions on professional standards, list of specialized staff ranks of Senior Painter, Chief Painter, Painter, and Intermediate Painter as stipulated in Decision No. 428/TCCP-VC dated June 2, 1993, of the Minister - Head of the Organizational and Cadre Department of the Government (now the Minister of the Ministry of Home Affairs) and Decision No. 78/2004/QĐ-BNV dated November 3, 2004, of the Minister of the Ministry of Home Affairs.
Article 12. Transitional Provisions
The competent authority managing and using staff has the responsibility to create conditions for staff to supplement the remaining criteria of the profession title of specialized art staff as stipulated in this Joint Circular for those staff who have been appointed to specialized art staff ranks according to Decision No. 428/TCCP-VC dated June 2, 1993, of the Minister - Head of the Organizational and Cadre Department of the Government (now the Minister of the Ministry of Home Affairs) promulgating professional standards for the rank of civil servant in the Culture and Information sector.
Article 13. Implementation Organization
1. This Joint Circular is one of the bases for implementing the recruitment, utilization, and management of specialized art staff in public institutions.
2. Non-public organizations, enterprises, and non-profit institutions may apply the provisions of this Joint Circular to recruit, utilize, and manage personnel working in the specialized art field.
3. The heads of public institutions directly managing and utilizing staff are responsible for:
a) Reviewing job positions within their units, developing plans for appointing profession titles of specialized art staff within their jurisdiction, submitting them to the competent authority for examination and decision-making or deciding according to the delegated authority;
b) Deciding on the appointment of profession titles of specialized art staff corresponding to public institutions according to their authority or delegated authority after the plan for appointing profession titles has been approved by the competent authority;
4. Ministries, agencies equivalent to ministries, agencies under the Government, People's Committees of provinces and centrally-administered cities are responsible for:
a) Directing subordinate units to implement the appointment of profession titles and salary classification for specialized art staff;
b) Approving plans for appointing profession titles and salary classification for specialized art staff within their jurisdiction from the current staff rank to corresponding profession titles of specialized art staff as stipulated in this Joint Circular; resolving issues within their authority during the process of appointing profession titles and salary classification;
c) Deciding on the appointment of profession titles and salary classification for specialized art staff within their jurisdiction to corresponding specialized art profession titles in subordinate units;
d) Before December 31 each year, reporting the results of appointing profession titles and salary classification for specialized art staff within their jurisdiction to the Ministry of Culture, Sports and Tourism and the Ministry of Home Affairs.
1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, and related agencies, units, and individuals are responsible for implementing this Circular.
1. The Ministers, heads of agencies equivalent to ministries, heads of agencies under the Government; Chairmen of People's Committees of provinces and centrally-administered cities are responsible for implementing this Joint Circular.
2. In the course of implementation, if there are difficulties, they are requested to reflect to the Ministry of Culture, Sports and Tourism for consolidation and coordination with the Ministry of Home Affairs to examine and resolve.
