CIRCULAR
Regulations on Reporting System for Civil Service Work
___________
Pursuant to Decree No. 34/2017/NĐ-CP dated April 3, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Decree No. 09/2019/NĐ-CP dated January 24, 2019 of the Government on the reporting system of administrative agencies;
Pursuant to Decree No. 45/2020/NĐ-CP dated April 8, 2020 of the Government on handling administrative procedures in an electronic environment;
Pursuant to Decree No. 47/2020/NĐ-CP dated April 9, 2020 of the Government on Management, Connection, and Sharing of Digital Data of State Agencies;
Pursuant to Decision No. 28/2018/QĐ-TTg dated July 12, 2018 of the Prime Minister on the Sending and Receiving of Electronic Documents Among Agencies in the Administrative System;
At the proposal of the Director of the Office of the Ministry of Home Affairs;
The Minister of Home Affairs issues this Circular stipulating the reporting system for civil service work.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
1. This Circular stipulates the principles, authority, and requirements for issuing the reporting system for civil service work; responsibilities of agencies and organizations in implementing the reporting system for civil service work and managing, using, and exploiting the Information Reporting System of the Ministry of Home Affairs.
2. This Circular does not regulate the statistical reporting system, confidential reporting, and internal reporting within each administrative agency related to civil service work areas.
3. Matters related to the implementation of the reporting system for civil service work not specified in this Circular shall be implemented in accordance with the provisions of Decree No. 09/2019/NĐ-CP dated January 24, 2019 of the Government on the reporting system of administrative agencies (hereinafter referred to as Decree No. 09/2019/NĐ-CP).
Article 2. Applicability
1. Ministries, ministerial-level agencies, and agencies under the Government.
2. People's Committees of provinces and centrally governed cities (hereinafter referred to as Provincial People's Committees).
Article 3. Explanation of Terms
The Information Reporting System of the Ministry of Home Affairs (hereinafter referred to as the Reporting System) is an electronic management system operating on a network environment with the function of collecting, summarizing information and data reports within the scope of state management of the Ministry of Home Affairs; analyzing, extracting, providing information and data reports to serve the guidance and management work of the Ministry of Home Affairs and connecting and interlinking with the National Information Reporting System.
A management account is an account granted management rights by the Ministry of Home Affairs to ministries, ministerial-level agencies, agencies under the Government, and Provincial People's Committees when registering on the electronic identity exchange platform in accordance with Decree No. 45/2020/NĐ-CP dated April 8, 2020 of the Government on Implementing Administrative Procedures in an Electronic Environment.
A user account is an account registered by officials, civil servants, and employees on the electronic identity exchange platform to use and exploit the Reporting System.
Article 4. Principles for Issuing the Reporting System for Civil Service Work
1. Ensuring timely, accurate, and complete provision of information to effectively support management, guidance, and control activities in the fields of civil service work; serving as a basis for the Ministry of Home Affairs to report to the Government, Prime Minister, National Assembly, and Standing Committee of the National Assembly; and for Provincial People's Committees to implement the reporting system to the People's Councils at the same level in the field of civil service work.
2. The content of the reporting system for civil service work must comply with regulations stipulated in documents issued by competent authorities. Data implementing the reporting system for civil service work must be consistent, accurate, and facilitate consolidation, updating, sharing, exploitation, and utilization.
4. The reporting system for civil service work must be appropriate regarding the issuance authority as stipulated in Article 7 of this Circular and Article 6 of Decree No. 09/2019/NĐ-CP; the reporting subjects must be clear, consistent, synchronized, feasible, and non-overlapping with other reporting systems.
5. Implementation of the reporting system for civil service work through electronic documents, signed digitally on the Reporting System.
Chapter II
REQUIREMENTS, CONTENTS, AND AUTHORITY FOR ISSUING THE REPORTING SYSTEM FOR CIVIL SERVICE WORK
Article 5. Reporting Systems for the Civil Service Sector
1. Regular reporting systems for the Civil Service Sector are issued to meet the requirements of comprehensive information to serve the guidance, management, and implementation of state administrative functions of the Ministry and the Civil Service Sector, carried out according to a defined cycle and repeated multiple times.
2. Specialized reporting systems for the Civil Service Sector are issued to meet the requirements of specialized information on a specific topic within the Civil Service Sector to serve the guidance, management, and implementation of state administrative functions of the Ministry and the Civil Service Sector, and must be implemented once or more within a specified period of time.
3. Ad hoc reporting systems for the Civil Service Sector are issued to meet the requirements of information on urgent issues arising in the Civil Service Sector.
Article 6. Requirements for Regular Reporting Systems, Ad Hoc Reporting Systems, Specialized Reporting Systems, and Other Reports as stipulated in Legal Normative Documents in the Civil Service Sector
1. Requirements for issuing regular reporting systems for the Civil Service Sector
a) The regular reporting system for the Civil Service Sector must be issued in legal normative documents of the competent authority;
b) The regular reporting system issued must include the components of content prescribed in Clause 2, Article 11 of Decree No. 09/2019/NĐ-CP.
2. Requirements for issuing specialized reporting systems for the Civil Service Sector
a) The specialized reporting system for the Civil Service Sector must be issued in legal normative documents or administrative documents of the competent authority;
b) The specialized reporting system must include the components of content prescribed in Clause 2, Article 10 of Decree No. 09/2019/NĐ-CP.
3. Requirements for issuing ad hoc reporting systems for the Civil Service Sector
a) The ad hoc reporting system for the Civil Service Sector must be issued in administrative documents of the competent authority;
b) The ad hoc reporting system must include the components of content prescribed in Clause 2, Article 9 of Decree No. 09/2019/NĐ-CP.
Article 7. Authority to Issue Reporting Systems for the Civil Service Sector
1. The Minister of the Ministry of Civil Affairs shall issue or submit to the Government, the Prime Minister for issuance, the regular, specialized, and ad hoc reporting systems within the scope of the Ministry's state administrative management to request Ministries, agencies at the level of ministries, government agencies, and provincial People's Committees to implement nationwide.
2. Provincial People's Committees shall issue regular, specialized, and ad hoc reporting systems regarding civil service sector work to request subordinate administrative agencies and organizations and individuals related to the province's management to implement.
Article 8. Regular Reporting System for the Civil Service Sector
1. Report Name
a) Report on the results of six-month and annual work (report year) and directions for tasks in the last six months and next year (following year) of the Civil Service Sector;
b) Administrative reform report quarterly, semi-annually, annually;
c) Local administration field report (annually);
d) Youth work report (annually).
2. Content Required for Six-Month and Annual Reports of the Civil Service Sector
a) Results of implementing tasks according to the fields of work of the Civil Service Sector, including: Work on drafting legal normative documents, projects, plans, professional documents; progress in implementing resolutions, decisions, policies of competent authorities; planning and programs of work for the year as prescribed;
b) Guidance, management, coordination in implementing tasks of the Civil Service Sector;
c) Inspection, supervision, handling of complaints, denunciations, reception of citizens, suggestions, and reflections, and anti-corruption work in the Civil Service Sector;
d) Evaluation of advantages, difficulties, and obstacles in implementing tasks; highlighting strengths, weaknesses, and limitations and identifying causes of weaknesses and limitations;
đ) Plan for implementing tasks in the last six months of the year and the following year of the report; organizational measures for implementation, lessons learned, and recommendations to competent authorities (if any).
3. Entities Implementing Reports as stipulated in Article 2 of this Circular
4. Receiving Agency and Method of Submission
a) The receiving agency is the Ministry of Civil Affairs;
b) Submit reports in electronic form with digital signatures of authorized persons to the Ministry of Civil Affairs via the national document transmission network.
5. Deadline for Finalizing Report Data as stipulated in Article 12 of Decree No. 09/2019/NĐ-CP
6. Deadline for Submitting Reports
a) For quarterly reports, submit before the 20th day of the last month of the quarter;
b) For mid-year reports, submit before June 20 each year;
b) For annual reports, submit before December 20 each year.
7. Report Outline Template
a) Report on the results of six-month and annual work (report year) and directions for tasks in the last six months and next year (following year) of the Civil Service Sector, implemented according to Appendix 1;
b) Administrative reform report quarterly, semi-annually, annually, implemented according to Appendix 3;
c) Local administration field report (annually), implemented according to Appendix 4;
d) Youth work report (annually), implemented according to Appendix 5.
Article 9. Regarding periodic reporting systems for the Civil Service sector not specified in this Circular
Periodic reporting systems for the Civil Service sector currently in force pursuant to regulations stipulated in legal documents issued by the Government or the Prime Minister shall be implemented in accordance with Clause 3, Article 32 of Decree No. 09/2019/NĐ-CP.
Chapter III
MANAGEMENT, USE AND EXPLOITATION OF THE INFORMATION REPORTING SYSTEM OF THE MINISTRY OF CIVIL AFFAIRS
Article 10. Standardization and integration of the list of periodic reporting systems for the Civil Service sector on the Information Reporting System of the Ministry of Civil Affairs
1. The report on the results of work in the first six months of the year and the annual plan (reporting year) and the direction of tasks for the last six months of the year and the following year of the Civil Service sector shall be carried out according to Appendix No. 1.
2. The list of reporting systems in the fields of organization and staffing; civil servants and public officials; salary policies; training and capacity building for cadres, civil servants, and public officials; management of associations, funds, and non-governmental organizations, as prescribed in legal documents of the Civil Service sector, shall be carried out according to Appendix No. 2.
3. The reporting system in the field of administrative reform shall be carried out according to Appendix No. 3.
4. The reporting system in the field of local administration shall be carried out according to Appendix No. 4.
5. The reporting system on youth work shall be carried out according to Appendix No. 5.
Article 11. Management, use and exploitation of the Information Reporting System of the Ministry of Civil Affairs
1. The reporting system meets the requirements stipulated in Articles 17 and 18 of Decree No. 09/2019/NĐ-CP and operates, is exploited, and maintained at the address: http://baocaobnv.moha.gov.vn, including:
a) Management of information and data collection, updating of reports in the Civil Affairs field from ministries, sectors, and localities to the Ministry of Civil Affairs;
b) Analysis and provision of data to serve management and operational activities of the Ministry of Civil Affairs;
c) Connection, interconnection, and integration with the National Information Reporting System to provide data serving government and Prime Minister's guidance and operations.
2. Administrative accounts for managing, using, and exploiting the reporting system
a) The Ministry of Civil Affairs grants rights and provides administrative accounts for the reporting system to ministries, ministerial-level agencies, governmental agencies, provincial People's Committees on the reporting system;
b) Ministries, ministerial-level agencies, governmental agencies, provincial People's Committees use digital certificates for electronic signatures issued by authorized agencies under Decree No. 130/2018/NĐ-CP dated September 27, 2018, detailing the Law on Electronic Transactions regarding digital signatures and digital signature certification services to register administrative accounts on the electronic identity exchange platform;
c) Ministries, ministerial-level agencies, governmental agencies, provincial People's Committees grant rights to administrative accounts to subordinate units, district People's Committees, and commune People's Committees to manage the system; the agencies and units granted rights must use their agency's digital certificate to register administrative accounts on the electronic identity exchange platform in accordance with the Ministry of Civil Affairs' regulations;
d) Ministries, ministerial-level agencies, governmental agencies, provincial People's Committees implement granting rights to usage accounts to subordinate agencies and units based on job positions and assigned tasks to exploit and use the system; they also carry out account transfers when there are changes in personnel exploiting and using the reporting system;
đ) Officials and civil servants who are granted rights to register accounts on the electronic identity exchange platform shall be managed by the administrative account management authority to exploit and use the reporting system; they are responsible for protecting their accounts and passwords in accordance with the law.
Article 12. Responsibilities of agencies and units in managing, using, and exploiting the Reporting System
1. Agencies and units with assigned accounts shall be responsible for:
a) Assisting the Minister, Head of a ministry-level agency, Head of a government-affiliated agency, and Chairperson of the People's Committee at provincial level to implement registration and management of the administrative account of the ministry, agency, or locality;
b) Granting permissions to staff accounts of subordinate agencies and units, People's Committees at district and commune levels to participate in exploiting and using the Reporting System according to corresponding groups, including: Data entry, verification, approval, administration; participating in updating common directories of the Reporting System;
c) Exploiting aggregated information and stored data on the Reporting System in accordance with their assigned functions and tasks, or exploiting publicly available information and data on the Reporting System to serve professional work.
2. The Ministry of Home Affairs shall be responsible for:
a) Compiling and drafting the Mid-Year Work Report and the Annual Work Report (report year) of the Home Affairs sector, the Administrative Reform Report, the Local Government Sector Report, and the Youth Work Report to report to the Government and the Prime Minister, and sending them to relevant ministries, sectors, and provincial People's Committees as prescribed;
b) Managing and operating the Reporting System to ensure connectivity and synchronization with the National Reporting Information System; granting permissions to the administrative accounts of ministries, sectors, and localities; managing reporting information directories on the Reporting System; guiding, urging, and inspecting the use and exploitation of the Reporting System; urging ministries, sectors, and localities to strictly comply with reporting regulations;
c) Implementing the consolidation, extraction, and public disclosure of information on the implementation of reporting work on the Reporting System. Promptly addressing technical issues when detected and proposing solutions to update and upgrade the system to meet requirements for expansion, development, and stable operation of the Reporting System; developing and implementing technical solutions to ensure information security and safety of the Reporting System.
Chapter IV
IMPLEMENTATION
Article 13. Effective Date
1. This Circular takes effect from February 15, 2022.
2. This Circular replaces Circular No. 08/2019/TT-BNV dated June 10, 2019, issued by the Minister of Home Affairs, stipulating the reporting regime for Home Affairs sector work.
1. The Minister, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of provincial People's Committees under the central government, and related agencies, units, and individuals are responsible for implementing this Circular.
1. Ministries, ministry-level agencies, government-affiliated agencies; provincial People's Committees shall be responsible for organizing the strict implementation of the reporting regimes for Home Affairs sector work as prescribed in the competent authority's regulatory legal documents and this Circular.
2. The Ministry of Home Affairs shall be responsible for:
a) Guiding, monitoring, urging, and inspecting the implementation of this Circular and managing, storing, and sharing information on the Reporting System of the Ministry of Home Affairs as prescribed;
b) Announcing periodic reporting directories as prescribed in regulatory legal documents issued by the Minister of Home Affairs or advising the competent authority to issue them as prescribed.
3. During the implementation process, if there are any difficulties, ministries, ministry-level agencies, government-affiliated agencies, and provincial People's Committees are requested to reflect these issues to the Ministry of Home Affairs for consolidation, consideration, and resolution./.
