Amending and supplementing some articles of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, public officials, and armed forces, amended and supplemented by Decree No. 76/2009/NĐ-CP, Decree No. 14/2012/NĐ-CP, Decree No. 17/2013/NĐ-CP, and Decree No. 117/2016/NĐ-CP On the basis of Law on Government Organization No. 63/2025/QH15;On the basis ofLaw on Local Administration Organization No. 72/2025/QH15;
On the basis of Law on Cadres and Civil Servants No. 80/2025/QH15;
Law on Public Officials No. 58/2010/QH12; Law Amending and Supplementing Certain Articles of the Law on Cadres and Civil Servants and the Law on Public Officials No. 52/2019/QH14;
On the basis of Law on Inspection No. 84/2025/QH15; At the proposal of the Minister of Home Affairs; The Government promulgates this Decree amending and supplementing some articles of Decree No. 204/2004/NĐ-CP on the salary system for cadres, civil servants, public officials, and armed forces, amended and supplemented by Decree No. 76/2009/NĐ-CP, Decree No. 14/2012/NĐ-CP, Decree No. 17/2013/NĐ-CP, and Decree No. 117/2016/NĐ-CP.
Article 1. Amending, supplementing, and abolishing certain points and clauses of the Table of Position Allowances (Elected, Appointed) in state agencies, state-owned units, military units, and police units issued together with Decree No. 204/2004/NĐ-CP on the salary system for cadres, civil servants, public officials, and armed forces, amended and supplemented by Decree No. 76/2009/NĐ-CP, Decree No. 14/2012/NĐ-CP, Decree No. 17/2013/NĐ-CP, and Decree No. 117/2016/NĐ-CP as follows: 1. Amending and supplementing Point a Clause 4 Section I as follows:
"a) The position allowance coefficient for leaders of Cục under Ministries

Article 2. Effectiveness |

1. This Decree takes effect from January 10, 2026.
|
2. The allowances prescribed in this Decree shall be applied from January 1, 2026. |
3. Abolishing the provisions on leadership position allowances for the positions of Chairman of People's Committee at commune level and Vice Chairman of People's Committee at commune level in Decree No. 33/2023/NĐ-CP on cadres, civil servants at commune level and non-professional staff at commune level, village, and residential ward. |
Article 3. Transitional Provisions |
1. For leadership positions of People's Committee of communes, wards, special administrative zones that have retained leadership position allowances due to the impact of organizational restructuring or administrative unit reorganization as stipulated by the Standing Committee of the National Assembly, the Government, or have not yet received the leadership position allowance coefficient, they shall implement the leadership position allowance as follows: |
|
a) In cases where retaining the leadership position allowance coefficient is higher than the leadership position allowance coefficient prescribed in Clause 2 Article 1 of this Decree, it shall be implemented according to the principle: Continue to enjoy the retained leadership position allowance until the end of the specified period, after which the leadership position allowance prescribed in Clause 2 Article 1 of this Decree shall be enjoyed. |
b) In cases where during the period from July 1, 2025 to before January 1, 2026, the leadership position allowance coefficient has not been applied or the retained leadership position allowance is lower than the leadership position allowance prescribed in Clause 2 Article 1 of this Decree, it shall be implemented according to the principle: Backpay the leadership position allowance and backpay social insurance according to the leadership position allowance coefficient prescribed in Clause 2 Article 1 of this Decree or the difference between the leadership position allowance coefficient prescribed in Clause 2 Article 1 of this Decree and the retained leadership position allowance coefficient, from the date of holding the leadership position of the People's Committee of communes, wards, special administrative zones. |

2. For leadership positions of Cục under Ministries when there is no decision on classification of Cục, they shall implement the leadership position allowance as follows: |

a) Apply the leadership position allowance coefficient of Type 2 Cục prescribed in Clause 1 Article 1 of this Decree. |

b) In cases where holding a leadership position retains a higher leadership position allowance (due to organizational restructuring from March 1, 2025 according to the Government's Decree) than the leadership position allowance of Cục under Ministries prescribed in Clause 1 Article 1 of this Decree, continue to enjoy the retained leadership position allowance until the end of the specified period; thereafter apply the leadership position allowance prescribed in Clause 1 Article 1 of this Decree and Point a of this Clause. In cases where the leadership position allowance has not been applied or the retained leadership position allowance is lower than the leadership position allowance of Cục under Ministries prescribed in Clause 1 Article 1 of this Decree and Point a of this Clause, the leadership position allowance of Cục under Ministries shall be enjoyed according to the principle in Point b of Clause 1 of this Article.
Article 2. Effective Date
1. This Decree shall take effect from January 10, 2026.
2. The allowance regime prescribed in this Decree shall be applied from January 1, 2026.
3. The provisions on leadership position allowances for the positions of Chairman of the People's Committee at the commune level and Deputy Chairman of the People's Committee at the commune level as stipulated in Decree No. 33/2023/NĐ-CP on cadres, civil servants at the commune level and non-professional staff at the commune, village, and ward levels are hereby abolished.
Article 3. Transitional Provisions
1. For the leadership positions of the People's Committees at the commune and ward levels, special administrative-economic zones that have retained leadership position allowances due to the impact of organizational restructuring or administrative unit reorganization as provided by the Standing Committee of the National Assembly or the Government, or have not yet received the leadership position allowance coefficient, shall implement leadership position allowances as follows:
a) In cases where the retained leadership position allowance coefficient is higher than the leadership position allowance coefficient specified in Clause 2, Article 1 of this Decree, they shall continue to enjoy the retained leadership position allowance until the end of the specified period, after which they shall receive the leadership position allowance as specified in Clause 2, Article 1 of this Decree.
b) In cases where, during the period from July 1, 2025 to before January 1, 2026, the leadership position allowance coefficient has not been applied or the retained leadership position allowance is lower than the leadership position allowance coefficient specified in Clause 2, Article 1 of this Decree, they shall make up for the leadership position allowance and social insurance contributions according to the leadership position allowance coefficient specified in Clause 2, Article 1 of this Decree or the difference between the leadership position allowance coefficient specified in Clause 2, Article 1 of this Decree and the retained leadership position allowance coefficient, starting from the date of assuming the leadership position of the People's Committee at the commune and ward levels.
2. For the leadership positions of Bureaus under Ministries that have not yet received classification decisions, the leadership position allowances shall be implemented as follows:
a) Apply the leadership position allowance coefficient of Class 2 Bureau as stipulated in Clause 1, Article 1 of this Decree.
b) In cases where the retained leadership position allowance (due to organizational restructuring from March 1, 2025 as stipulated in the Government's Decree) is higher than the leadership position allowance of a Bureau under a Ministry as specified in Clause 1, Article 1 of this Decree and Point a of this Clause, they shall continue to enjoy the retained leadership position allowance until the end of the specified period; thereafter, apply the leadership position allowance as specified in Clause 1, Article 1 of this Decree and Point a of this Clause. In cases where the leadership position allowance has not been applied or the retained leadership position allowance is lower than the leadership position allowance of a Bureau under a Ministry as specified in Clause 1, Article 1 of this Decree and Point a of this Clause, they shall enjoy the leadership position allowance of a Bureau under a Ministry according to the principle specified in Point b of Clause 1 of this Article.
Article 4. Responsibility for Implementation
The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the central city, are responsible for implementing this Decree./.
