CIRCULAR
Guidelines for issuing import permits for Cambodian timber raw materials
Raw timber originating from Cambodia
Pursuant to Decree No. 57/1998/NĐ-CP dated July 31, 1998 of the Government detailing the implementation of the Law on Trade regarding export, import, processing, and agency sales of goods with foreign countries;
Pursuant to Decision No. 65/1998/QĐ-TTg dated March 24, 1998 of the Prime Minister on the export of wood products and forest products and the import of wood raw materials and forest products;
Pursuant to document No. 281/CP-KTTH dated March 23, 2000 of the Government on the import of wood from Cambodia;
The Ministry of Trade guides the procedures for issuing import permits for Cambodian timber raw materials through formal channels as follows:
I. GENERAL PROVISIONS
1. This Circular regulates the import of Cambodian timber raw materials through formal channels via land borders.
2. The timber raw materials referred to in this Circular include round logs (peeled or unpeeled), sawn timber, and planks of all types.
Artificial boards, recycled wood from imported packaging, and other wooden products imported under Clause 8, Article 1 of Decision No. 65/1998/QĐ-TTg dated March 24, 1998 of the Prime Minister are not subject to the provisions of this Circular.
3. The transportation and delivery of imported timber may be carried out through the following international and national border gates:
1- Lệ Thanh (Route 19) 5- Mộc Bài (Route 22A)
2- Bu Pờ-răng (Route 14) 6- Tịnh Biên (Route 2)
3- Bô-nuê (Route 13) 7- Xà Xía (Route 17)
4- Xa Mát (Route 22B) 8- Vĩnh Xương-Thường Phước (Mekong River)
Enterprises with business registration certificates for relevant product lines, registered with enterprise codes for import and export, who have complete and valid documentation, are entitled to apply for the import of Cambodian timber raw materials.
II. APPLICATION DOCUMENTS FOR IMPORT PERMIT
The application documents for import permit include:
1. A letter from the enterprise requesting the issuance of an import permit, specifying the name of the selling enterprise, type of wood, specifications of the wood (round logs, sawn timber, or planks), quantity sold, and the port of entry.
2. Copies of the Business Registration Certificate and the Enterprise Code Registration Certificate for import and export activities.
3. The original principle contract signed directly between the Vietnamese enterprise and the Cambodian enterprise.
4. Copies of the export permit issued by the Cambodian Minister of Trade, clearly stating the name of the exporting Cambodian enterprise, the importing Vietnamese enterprise, type of wood, specifications, and quantity.
The Ministry of Trade will process the enterprise's application upon receipt of the export permit from the Cambodian Ministry of Trade sent officially to the Vietnamese Ministry of Trade (through the Embassy or trade office of Vietnam in Cambodia or through the Embassy or trade office of Cambodia in Vietnam). In cases where the export permit is issued by the Royal Cambodian Government Prime Minister and sent to the Vietnamese Prime Minister, the Ministry of Trade will process the enterprise's application upon receiving instructions from the Vietnamese Prime Minister.
III. IMPLEMENTATION PROVISIONS
1. Import permits for Cambodian timber raw materials issued by the Ministry of Trade prior to the issuance of this Circular remain valid.
2. Payment procedures for imported goods and customs clearance procedures for imported goods shall be carried out according to current regulations.
3. This Circular takes effect fifteen days from the date of signature and replaces Circulars No. 03/1998/TT-BTM dated February 24, 1998 and No. 27/1999/TT-BTM dated August 30, 1999 of the Ministry of Trade.
