CIRCULAR
Amending and supplementing certain Articles of Circular No. 01/2013/TT-BTP dated January 3, 2013 of the Ministry of Justice guiding the Reporting System for Civil Enforcement Statistics guiding the Reporting System for Civil Enforcement Statistics

Pursuant to the Civil Enforcement Act on November 14, 2008 and the Law Amending and Supplementing Certain Provisions of the Civil Enforcement Act on November 25, 2014 (hereinafter referred to collectively as the Civil Enforcement Act);
Pursuant to the Statistics Law on June 17, 2003;
Pursuant to the Administrative Litigation Procedure Act on January 24, 2010;
Pursuant to Decree No. 22/2013/NĐ-CP dated March 13, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;
The Minister of Justice promulgates this Circular amending and supplementing certain Articles of Circular No. 01/2013/TT-BTP dated January 3, 2013 of the Ministry of Justice guiding the Reporting System for Civil Enforcement Statistics as follows:
Article 1
Amending and supplementing certain Articles of Circular No. 01/2013/TT-BTP dated January 3, 2013 of the Ministry of Justice guiding the Reporting System for Civil Enforcement Statistics.
1. Amending and supplementing Clause 1 of Article 1 as follows:
"1. Scope of application: This Circular guides the Reporting System for Civil Enforcement Statistics, including the enforcement of administrative acts (hereinafter collectively referred to as civil enforcement); the use and publication of information; the implementation, inspection, supervision, commendation, and handling of violations in the implementation of the Reporting System for Civil Enforcement Statistics".
2. Amending and supplementing Points b and d Clause 2 Article 2 as follows:
"b) Results of civil enforcement calculated according to the requirements of the enforcement request;"
"d) Results of civil enforcement calculated in monetary terms according to the requirements of the enforcement request."
3. Amending and supplementing Clause 2 of Article 10 as follows:
"2. Time limit for submitting reports on civil enforcement statistics:
a) Not later than the second day of the next reporting period, the Enforcement Officer shall submit a report on the results of the previous period's civil enforcement to the Head of the Civil Enforcement Agency where they work;
b) Not later than the fourth day of the next reporting period, the Civil Enforcement Agency must submit a report on the results of its unit from the previous period to the Provincial Civil Enforcement Agency and other agencies receiving such reports as prescribed;
c) Not later than the seventh day of the next reporting period, the Provincial Civil Enforcement Agency must submit a report on the results of its unit and the entire province from the previous period to the National Office of Civil Enforcement and other agencies receiving such reports as prescribed;
d) Not later than the second day of the next reporting period, the Enforcement Officer in the military must submit a report on the results of the previous period's civil enforcement to the Head of the Enforcement Department where they work;
đ) Not later than the fourth day of the next reporting period, the Enforcement Department of the Military Region must submit a report on the previous period's civil enforcement results of its unit to the Civil Enforcement Agency - Ministry of Defense and other agencies receiving such reports as prescribed;
e) Not later than the seventh day of the next reporting period, the Civil Enforcement Agency - Ministry of Defense must submit a report on the previous period's civil enforcement results in the military to the Minister of Defense and the Minister of Justice (National Office of Civil Enforcement) and other agencies receiving such reports as prescribed;
g) Not later than the tenth day of the next reporting period, the National Office of Civil Enforcement must submit a report on the previous period's civil enforcement results to the Minister of Justice."
4. Amendment and supplementation of Article 13 as follows:
"Article 13. Publication and dissemination of civil enforcement statistics information
1. The Minister of Justice shall publish information on civil enforcement statistics data or authorize the Director of the National Office of Civil Enforcement to do so.
2. Monthly, civil enforcement statistics data of the Civil Enforcement Agencies and Provincial Civil Enforcement Agencies shall be published on the website of the Provincial Civil Enforcement Agency; national civil enforcement statistics data shall be published on the website of the National Office of Civil Enforcement."
5. Supplementing Clause 7, Clause 8 Article 15 as follows:
"7. Prioritize investment in information technology, communication, and advanced statistical methods for civil enforcement statistics activities; develop software and electronic databases for civil enforcement statistics.
8. The National Office of Civil Enforcement and Provincial Civil Enforcement Agencies shall allocate civil servants and staff specifically responsible for implementing the civil enforcement statistics system."
6. Replacing Appendix 1 "Civil Enforcement Statistics Form System" and Appendix 2 "Guidelines for Recording Forms and Calculation Methods for Certain Indicators in Civil Enforcement Statistics Reports" of Circular No. 01/2013/TT-BTP with Appendix 1 and Appendix 2 issued together with this Circular.
Article 2
1. This Circular takes effect from October 1, 2015.
2. During the implementation process, if there are any difficulties, they should be promptly reported to the Ministry of Justice for study and resolution./.
