CIRCULAR
HGuidelines on the work of competition and rewards
in the Agriculture and Rural Development sector
Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Law on Competition and Rewards dated December 26,Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards dated June 14,2005 and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards dated December 16,11/2003, Pursuant to Decree No. 91Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards dated June 14,/ND-CP dated July 31,6/2017 of the Government detailing the implementation of certain provisions of the Law on Competition and Rewards;Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards dated June 14,The Minister of Agriculture and Rural Development issues this Circular guiding the work of competition and rewards in the Agriculture and Rural Development sector.11/2013;
Article 1. This Circular stipulates the work of competition and rewards in the Agriculture and Rural Development sector (hereinafter referred to as the "Agriculture and Rural Development sector")./2017Article 2. This Circular does not apply to the work of competition for awarding the "Vietnam Golden Rice Ear" Award and the title "Enterprise for Farmers".2017 This Circular applies to organizations and individuals related to the work of competition and rewards in the Agriculture and Rural Development sector.Clause 1. Agencies and units under the Ministry are administrative state agencies and public service units directly managed by the Ministry of Agriculture and Rural Development, and state-owned enterprises with more than 50% state capital represented by the Ministry of Agriculture and Rural Development as the state owner.
The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.
Clause 2. Agencies and units under the Ministry are administrative state agencies and public service units directly managed by agencies and units under the Ministry.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
Clause 3. Agencies and units within the sector are agencies, units, and organizations operating in the field of Agriculture and Rural Development that do not fall under the provisions of Clauses 1 and 2 of this Article.
Principles of Competition and Rewards
Article 2. Applicability
Implemented according to Clause 1, Article 6 of the Law on Competition and Rewards 2003; the provisions of Article 3 of Decree No. 91/2017/ND-CP dated July 31, 2017 of the Government detailing the implementation of certain provisions of the Law on Competition and Rewards (hereinafter referred to as Decree No. 91/2017/ND-CP), and the following provisions:
Article 3Definitions
Point 1. Do not consider for annual commendation titles those collectives and individuals who have not registered competition targets or competition movements.
Point 2. Rewards for heads and deputies of heads of agencies and units shall be based on both individual achievements and the overall achievements of the agency or unit they are responsible for.
Article 5. Inventions, research topics recognized for consideration of commendation titles and reward forms
4. Collectives eligible for consideration for commendation titles and reward forms are organizations established by competent authorities in accordance with the law.
Article 4. Point 1. Individuals whose inventions are recognized according to the provisions of Decree No. 13/2012/ND-CP dated March 2, 2012 of the Government promulgating the Charter of Inventions; Circular No. 18/2013/TT-BKHCN dated August 1, 2013 of the Ministry of Science and Technology guiding the implementation of some provisions of the Charter of Inventions issued pursuant to Decree No. 13/2012/ND-CP.
Point 2. Individuals serving as chair, vice-chair, secretary of the Steering Committee, Drafting Group for normative legal documents, strategies, programs, projects at the ministry level or higher, issued by competent state authorities during the appraisal period for commendation titles and reward forms.
Point 3. Individuals serving as principal or co-principal investigator and those primarily involved in research topics at the institutional level or higher, which have been successfully evaluated and applied in practice.
2. The awarding of commendations for the heads and deputies of the heads of agencies and units shall be based on both the individual's achievements and the overall achievements of the agency or unit under their responsibility.
Article 5. Initiatives and scientific research topics recognized for consideration of commendation titles and forms of reward
1. Individuals with initiatives recognized according to the provisions of Decree No. 13/2012/NĐ-CP dated March 2, 2012 of the Government promulgating the Charter of Initiatives; Circular No. 18/2013/TT-BKHCN dated August 1, 2013 of the Ministry of Science and Technology guiding the implementation of certain provisions of the Charter of Initiatives issued pursuant to Decree No. 13/2012/NĐ-CP.
2. Individuals serving as chair, deputy chair, secretary of the Steering Committee, Drafting Group of regulatory legal documents, strategies, programs, projects at the ministry level or higher, established by competent state authorities during the appraisal period for commendation titles and forms of reward.
3. Individuals serving as principal or co-principal investigator of scientific research topics at the grassroots level or higher that have been successfully evaluated and whose research results have been applied in practice.
Article 6. Examination and Recognition of the Scope of Influence and Effectiveness of Application at the Ministry Level and Nationwide for Inventions and Research Topics
1. The Ministry's Invention Council shall examine and propose to the Minister of Agriculture and Rural Development to recognize the effectiveness of application and scope of influence at the Ministry level and nationwide for inventions and research topics.
2. Technological progress and innovations that have been recognized according to the law or awarded the Labor Creativity Certificate by the Vietnam General Confederation of Labor; the Vietnam Intellectual Achievement Award (VIFOTEC), KOVALEVSKAYA.
Chapter II
ORGANIZING THE MOVEMENT OF COMPETITION AND LEADERSHIP
, Clause 1, Clause 2 Article 7a of this Regulation.. Procedures for organizing the movement of competition and leadership
1. Develop plans to organize the movement of competition clearly defining: objectives and requirements; scope, subjects, name of the movement and implementation period; contents of competition, competition indicators, competition groups (if any) and feasible organizational measures suitable to reality.
2. Launching the competition shall be widely organized through appropriate, practical, and effective forms to create a response to the movement of competition from related subjects.
3. Implementation organization: promote propaganda, encouragement, and attract a large number of agencies, units, and individuals to participate in the movement of competition. For wide-ranging competition movements, it may be necessary to organize pilot guidance to draw lessons for wider implementation; inspect and evaluate the implementation process of the competition movement, promptly identify and adjust contents not suitable with reality, while discovering, nurturing, and promoting exemplary models.
4. Organize interim and final reviews: assess results of implementation, select and commend outstanding collectives and individuals in the competition movement.
Article 8. Responsibilities of organizationsand individuals in organizing and implementing the competition movement
1. The Minister of Agriculture and Rural Development shall launch responses to competition movements initiated by the President, Prime Minister, Vietnam Fatherland Front, and those of the sector. The Standing Committee of the Competition and Commendation Council shall be responsible for advising and assisting the Minister in launching, organizing, and implementing competition movements within the agriculture and rural development sector.
2. Heads of agencies and units under the Ministry and sector shall be responsible for launching competitions, organizing competition movements, and conducting interim and final reviews of competition movements within their units; closely coordinate with the same-level party committees and mass organizations within the agriculture and rural development sector to organize and implement competition movements.
3. Leaders of competition groups shall be responsible for primarily organizing and implementing competition movements, and organizing interim and final reviews of competition movements within their groups.
4. Vietnam Agricultural Newspaper, Rural Development Journal, and other units under the Ministry of Agriculture and Rural Development shall be responsible for publicizing the Party's policies and State laws on competition and commendation; identifying, promoting, disseminating, and setting examples of advanced models and good people and deeds in competition movements; participating in struggles to prevent violations of laws on competition and commendation.
Article 9. Competition Groups
1. Organization of Competition Groups
The Ministry of Agriculture and Rural Development shall organize regular annual competition groups including: the group of agencies and units directly under the Ministry and the group of agencies and units under the Ministry according to separate decisions of the Minister.
2. Activities of Competition Groups
a) Seminars and roundtable discussions on the implementation of competition and commendation work, exchanging professional knowledge, management experience suitable to the realities of each group;
b) Organizing interim and final reviews of group activities;
c) Electing group leaders and deputy leaders on a rotational basis annually;
d) Implementing information and reporting systems to the Competition and Commendation Council of the Ministry.
3. Rights and responsibilities of Group Leaders
a) Drafting programs, plans, contents, and competition indicators for signing competition agreements; group operation regulations; criteria and point scales for scoring and electing competition titles;
b) Organizing the signing of competition agreements, launching competition movements within the group; coordinating to organize common activities within the group;
c) Chairing the scoring of competition achievements, selecting, and honoring units with outstanding and exemplary achievements to propose for consideration of receiving the Government Flag of Merit, the Flag of Merit of the Ministry of Agriculture and Rural Development.
4. Rights and responsibilities of Deputy Group Leaders
a) Cooperating with the Group Leader to draft plans, programs, and manage group activities;
b) Handling tasks when authorized by the Group Leader.
5. Rights and responsibilities of heads of members in the competition group
a) Registering competition contents and indicators to send to the Group Leader;
b) Participating in drafting competition contents, criteria, point scales, evaluations, and implementing signed competition agreements; organizing the launch of competitions within the unit;
c) Promoting and introducing new and effective models, advanced examples within the group;
d) Fully and responsibly participating in group activities; reporting on the implementation of competition movements; self-scoring according to registered competition contents and criteria and submitting reports to the Group Leader as stipulated.
Chapter III
COMPETITION TITLES AND REWARD FORMS
Article 10. National Awards
The objects, standards for examination and awarding of competition titles, and forms of national commendations shall be implemented according to the provisions of the Law on Competition and Commendation, Decree No. 91/2017/ND-CP, and Circular No. 08/2017/TT-BNV dated October 27, 2017 of the Ministry of Home Affairs detailing the implementation of certain articles of Decree No. 91/2017/ND-CP dated July 31, 2017 of the Government detailing the implementation of certain articles of the Law on Competition and Commendation.
Article 11. Title "Outstanding Soldier"
1. The criteria for the title "Outstanding Soldier" at all levels shall be implemented in accordance with the provisions of Article 9 of Decree No. 91/2017/NĐ-CP.
2. Individuals proposed for the award of the title "Outstanding Soldier" at the grassroots level, ministry level, and national level must have an innovation or research topic that has been recognized as effective and influential in scope corresponding to the proposed title of Outstanding Soldier.
3. The time for considering the title "Outstanding Soldier of the Ministry of Agriculture and Rural Development" shall be carried out concurrently with the year receiving the third award of the title "Outstanding Soldier at the grassroots level."
4. The time for considering the title "National Outstanding Soldier" is the year immediately following the second year of receiving the title "Outstanding Soldier of the Ministry of Agriculture and Rural Development."
Article 12. Titles "Advanced Labor Collective," "Excellent Labor Collective"
1. The criteria for the titles "Advanced Labor Collective" and "Excellent Labor Collective" shall be implemented in accordance with the provisions of Articles 27 and 28 of the Law on Competition and Merit Awarding 2003.
2. The Minister shall examine and decide to recognize the titles "Advanced Labor Collective" and "Excellent Labor Collective" for agencies and units directly under the Ministry.
3. Heads of agencies and units directly under the Ministry shall specify the recipients and decide to recognize the titles "Advanced Labor Collective" and "Excellent Labor Collective" for collectives within their units.
Article 13. The Flag of Excellence of the Ministry
The Flag of Excellence of the Ministry shall be awarded to collectives meeting the standards specified in Article 26 of the Law on Competition and Merit Awarding 2003, specifically as follows:
1. To be awarded to collectives selected and honored as leading units in regular competition groups organized by the Ministry annually. The number of collectives proposed for the Flag of Excellence of the Ministry shall not exceed 20% of the total members in the competition group.
2. To be awarded to collectives with outstanding achievements in competitions initiated by the President, Prime Minister, Minister, or units under the Ministry lasting three years or more. The awarding of the Flag of Excellence of the Ministry shall be conducted during the mid-term and final reviews of the competitions.
Article 14Certificate of Merit from the Minister
The Certificate of Merit from the Minister shall be awarded to individuals and collectives who serve as models, comply well with the policies of the Party and laws of the State, and meet the standards specified in Article 39 of Decree No. 91/2017/NĐ-CP, specifically as follows:
1. Merit based on achievement and merit
a) Individuals: meeting the criteria specified in point c, Clause 1, Article 39 of Decree No. 91/2017/NĐ-CP. For workers and employees, having two consecutive years of outstanding performance in assigned tasks;
b) Collectives: meeting the criteria specified in point c, Clause 2, Article 39 of Decree No. 91/2017/NĐ-CP.
2. Merit based on campaigns and special topics
Individuals and collectives with outstanding achievements in campaigns initiated by the Minister, heads of agencies and units in the sector, or those responding to campaigns initiated by higher authorities.
3. Immediate Merit
Individuals and collectives achieving outstanding results beyond their regular duties.
4. Merit for international contributions
Individuals and collectives making significant contributions to the development of the agricultural and rural sector.
5. Other special cases decided by the Minister.
Article 15. Certificate of Merit from the Head of an Agency or Unit under the Ministry
The Certificate of Merit from the Head of an Agency or Unit under the Ministry shall be implemented in accordance with Clause 42, Article 1 of the Law on Competition and Merit Awarding 2013 and Article 40 of Decree No. 91/2017/NĐ-CP.
Article 16. Commemorative Medal "For the Cause of Agriculture and Rural Development"
1. The Commemorative Medal "For the Cause of Agriculture and Rural Development" (hereinafter referred to as the Commemorative Medal) shall be awarded once by the Minister of Agriculture and Rural Development to individuals who have made a long-term contribution or have contributed to the cause of developing agriculture and rural areas in Vietnam without violating the law to the extent of being subject to disciplinary action, specifically as follows:
a) Individuals currently working or retired from agencies and units in the sector, having worked in the sector for 15 years or more for women, and 20 years or more for men.
For individuals transferred to work in the agricultural and rural development sector, having a total working period of 20 years or more for men, and 15 years or more for women, including at least 10 years or more for men, and 7 years or more for women in the agricultural and rural development sector;
b) Leaders of the Ministry of Agriculture and Rural Development;
c) Leaders of general bureaus, departments, and equivalent units under the Ministry, having held leadership positions for 5 years or more for chief positions and 7 years or more for deputy positions.
Leaders of departments, bureaus, and equivalent units under general bureaus and equivalent units, having held leadership positions in the sector for 7 years or more for chief positions and 9 years or more for deputy positions;
d) Individuals currently working in the agricultural and rural development sector who have been conferred the titles of "Heroic Laborer," "Hero of Labor," "Professor," "People's Teacher," "People's Doctor," "National Artist;"
đ) Individuals currently working in the agricultural and rural development sector who have received the title of "National Outstanding Soldier," "Associate Professor," "Outstanding People's Teacher," "Outstanding People's Doctor," "Outstanding National Artist" may be considered for the award five years earlier than the general rule;
e) Chairmen (Directors) of Agricultural Cooperatives continuously for 10 years or more;
g) Owners of farms, private enterprises operating in the agricultural field for five consecutive years recognized by districts, towns, or cities as excellent farm or business owners;
h) Leaders of the Party, State, and central ministries, departments, mass organizations, and leaders of provinces and centrally-administered cities who have made contributions and achievements in leadership and guidance contributing to the development of agriculture and rural areas;
i) Individuals who have invented, created patents, or scientific research projects winning State Awards in the fields of agriculture and rural development;
k) Foreign individuals who have made positive contributions to the agricultural and rural development sector;
l) Other special cases decided by the Minister.
2. The Commemorative Medal "For the Cause of Agriculture and Rural Development" shall not be awarded to individuals who are currently working in the sector or have retired and have already been awarded one of the following Medals or Commemorative Medals: "For the Cause of Agricultural Development"; "For the Cause of Forest Protection and Development"; "For the Cause of Vietnam Water Resources Sector Development"; "For the Cause of Agriculture and Rural Development"; "For the Cause of Fisheries"; "For the Development of the Aquatic Products Industry".
Article 17||| The Banner of the Ministry of Agriculture and Rural Development
The Minister shall grant the Banner to agencies and units under the Ministry; Provincial Departments of Agriculture and Rural Development; Associations and Trade Unions within the agricultural sector on the occasion of celebrating traditional anniversaries (every ten years) or five-year anniversaries or term congresses.
Chapter IV
||| AWARD AND RECOGNITION COUNCIL - REWARDING, ||| INNOVATION COUNCIL
Article 18. Award and Recognition Council of the Ministry
1. The Award and Recognition Council of the Ministry shall be established by the Minister's decision.
2. The composition of the Award and Recognition Council of the Ministry includes:
a) Chairman: The Minister;
b) First Vice-Chairman: Deputy Minister responsible for award and recognition work;
c) Permanent Vice-Chairman: Director of the Cadre and Civil Servant Organization Department;
d) Vice-Chairman: Chairman of the Vietnam Agricultural Union;
đ) Members are heads of some agencies and units under the Ministry;
e) The Standing Committee of the Council consists of the Chairman, Vice-Chairmen, and other members appointed by the Minister.
3. The tasks and powers of the Award and Recognition Council of the Ministry shall be implemented according to the provisions of Clause 3, Article 62 of Decree 91/2017/NĐ-CP.
4. Principles of operation of the Award and Recognition Council of the Ministry
The Council operates based on the principles of centralization, democracy, and majority decision-making. At each meeting, at least two-thirds of the members must be present. In case of absence, the person must report to the session chairperson, and if approved, another person may attend the meeting instead. The substitute attendee can participate in discussions and vote. The absent member and the substitute attendee are responsible for their opinions and votes at the Council meeting.
The Chairman of the Council may invite representatives from related agencies and units to attend Council meetings; these representatives can provide opinions but cannot vote.
5. Methods of operation of the Award and Recognition Council of the Ministry
a) During meetings, the Council examines and decides on the awarding of commendations and forms of recognition through secret ballot voting. For other matters, they follow the conclusions of the session chairperson.
In cases of emergency, the Council may convene extraordinary meetings called by the Chairman of the Council;
b) Organizing written consultations: In cases where it is impossible to hold a Council meeting, the Chairman of the Council decides to seek opinions from individual members in writing.
Article 19||| AWARD AND RECOGNITION COUNCIL AT THE BASE LEVEL
1. The Award and Recognition Council at the base level shall be established and have its operational regulations issued by the head of the agency or unit.
The head of the agency or unit is the Chairman, and other members are determined by the head of the agency or unit.
2. Tasks and powers of the Award and Recognition Council at the base level
a) Advising and consulting on award and recognition work;
b) Selecting outstanding collectives and individuals both inside and outside the sector who have made significant contributions to the cause of agriculture and rural development, recommending them for recognition by the head of the agency or unit and submitting them for higher-level recognition as prescribed.
Article 20. The Ministry's Initiative Council
1. The Ministry's Initiative Council shall be established and its operational regulations issued by the Minister.
2. The composition of the Ministry's Initiative Council includes:
a) Chairperson: One Deputy Chairman of the Ministry’s Competition and Reward Council;
b) Vice-Chairpersons and other members shall be decided by the Minister.
3. Tasks of the Council
Examining and evaluating the effectiveness of application and the scope of impact at the Ministry level and nationwide of initiatives and scientific research topics.
4. Principles of Operation of the Ministry's Initiative Council
The Ministry's Initiative Council operates under a collective system, implementing the principle of democratic centralism. Meetings of the Council must have at least two-thirds of the official members present to be considered valid. Members who are absent may appoint substitutes to attend meetings, which must be reported and approved by the Chairman; substitutes have the right to participate in discussions and vote at the meeting. Absent members who do not appoint substitutes must submit their opinions in writing to the Council's permanent office for consolidation of results.
At meetings, when necessary, the Council may invite representatives from relevant agencies and units specializing in the field related to the initiative or research topic.
5. Methods of Operation of the Ministry's Initiative Council
The Council organizes regular meetings and makes decisions through secret ballot voting.
In cases of necessity, the Chairman of the Council decides to convene extraordinary meetings.
If it is impossible to hold a meeting, the Chairman of the Council decides to seek opinions individually in writing from each member.
Article 21. The Initiative Council at the grassroots level
1. The Initiative Council at the grassroots level shall be established and its operational regulations issued by the head of the agency or unit directly under the Ministry.
The Chairman and members of the Council shall be appointed by the head of the agency or unit.
2. Duties of the Council
a) Receiving, examining applications and deciding on recognition of initiatives;
b) Reviewing and submitting to the head of the agency or unit for decision on recognizing the effectiveness of application and the scope of impact at the grassroots level of initiatives and scientific research topics;
c) Examining and submitting to the Ministry's Initiative Council for recognition of the effectiveness of application and the scope of impact at the Ministry level and nationwide of initiatives and scientific research topics for individuals from the agency or unit.
Article 22. Permanent Office of the Council Competition and KReward and the Initiative Council
1. The Cadre Organization Department is the permanent office of the Ministry’s Competition and Reward Council and the Ministry’s Initiative Council.
2. The heads of agencies and units directly under the Ministry shall assign organizations or individuals as the permanent office of the Competition and Reward Council and the Initiative Council in accordance with the actual situation of the agency or unit.
Chapter V
AUTHORITY TO DECIDE ON REWARDS, PROCEDURES FOR RECOMMENDING AWARDS,,
FILES AND PROCEDURES FOR REVIEWING AND ORGANIZING THE BESTOWAL
COMPETITION TITLES AND REWARD FORMS
Article 23. Authority of the Minister
1. Recommending to the Prime Minister for awarding the Flag of Excellence of the Government, the Certificate of Merit of the Prime Minister, the title of National Labor Hero, various types of Orders, the title of Hero of Labor, and other forms of reward as prescribed.
2. Deciding to award the titles "Advanced Labor Collective" and "Outstanding Labor Collective" to units directly under the Ministry. Awarding the Flag of Excellence of the Ministry, the title of Advanced Worker of the Ministry, the Certificate of Merit of the Minister, Commemorative Medals, and Scrolls.
3. Agreeing to rewards upon recommendation of the Central Competition and Reward Board.
"d) Within no more than one working day from the date of receiving the dossier submitted for administrative procedures by the specialized agency assigned by the Provincial People's Committee, the Chairman of the Provincial People's Committee shall issue a notification of the result of the inspection of plant-based food exports or a certificate at the request of the importing country.". Procedures for recommending awards
Implemented according to Article 46 of Decree No. 91/2017/NĐ-CP and the following provisions:
1. A superior level only organizes the examination of rewards or recommends a competent authority to grant rewards upon receipt of the reward recommendation file from the immediate subordinate level; does not accept and examine files sent beyond the immediate level.
2. The level that manages organizational structure, cadres, civil servants, public officials, employees, and salary funds shall grant rewards or recommend a higher level to examine rewards.
3. Specialized and emergency rewards are proposed or recommended to the Ministry for rewards by the head of agencies and units directly under the Ministry, the head of ministries, sectors, mass organizations at the central level, the Chairman of the People's Committee of provinces and centrally-administered cities, the Director of the Provincial Department of Agriculture and Rural Development, and the Chairman of associations operating in the agriculture and rural development sector.
4. For collectives and individuals outside the sector, if there has been a process of cooperation, the head of agencies and units directly under the Ministry, the Director of the Provincial Department of Agriculture and Rural Development, and the Chairman of associations operating in the agriculture and rural development sector may propose to the Ministry for rewards.
The International Cooperation Department is the lead unit in compiling files for the Ministry to review and award rewards to international organizations and foreign individuals.
Article 25. Application for Awards
1. The application for awards includes:
a) A proposal from the Head of the unit (or the Head of the Competition and Reward Group) according to Model No. 2 attached as an appendix to this Circular;
b) Minutes of the meeting of the Competition and Reward Council of the unit according to Model No. 3 attached as an appendix to this Circular;
c) Reports on achievements of the collective and individual applying for awards following Models No. 01 to No. 09 attached as an appendix to Decree No. 91/2017/NĐ-CP, specifically:
Report on achievements proposing to be awarded with Orders, Certificates of Merit from the Prime Minister, Flags of Excellence from the Government; Flags of Excellence and Certificates of Merit at the Ministry level; Excellent Labor Collectives; Certificates of Merit for collectives with outstanding achievements in performing tasks and work (according to Model No. 1).
Report on achievements proposing to be awarded with Orders, Certificates of Merit from the Prime Minister, National Model Workers; Model Workers, Certificates of Merit at the Ministry level and Certificates of Merit for individuals with outstanding achievements in performing tasks and work (according to Model No. 2).
Report on achievements proposing to be awarded or posthumously awarded Orders for individuals with a history of dedication in organizations, agencies, and mass organizations (according to Model No. 3).
Report on achievements proposing to be conferred the title of Heroic Motherland Collective for collectives with exceptionally outstanding achievements in work (according to Model No. 4).
Report on achievements proposing to be conferred (posthumously) the title of Heroic Motherland for individuals with exceptionally outstanding achievements in work (according to Model No. 5).
Report on achievements proposing to be awarded Orders, Certificates of Merit from the Prime Minister, Certificates of Merit at the Ministry level; Certificates of Merit for individuals and collectives with outstanding and sudden achievements (according to Model No. 6).
Report on achievements proposing to be awarded Orders during competition periods or special topics for collectives and individuals (according to Model No. 7).
Report on achievements proposing to be awarded Friendship Orders, Friendship Medals, Orders, Certificates of Merit from the Prime Minister, Certificates of Merit at the Ministry level and Certificates of Merit for foreign organizations (according to Model No. 8).
Report on achievements proposing to be awarded Friendship Orders, Friendship Medals, Orders, Certificates of Merit from the Prime Minister, Certificates of Merit at the Ministry level and Certificates of Merit for foreign individuals (according to Model No. 9).
Number of applications: One original copy for award proposals at the Ministry level; three original copies for award proposals of Flags of Excellence from the Government, Certificates of Merit from the Prime Minister; four original copies for award proposals of various Orders, national honors.
d) Tax confirmation; confirmation regarding social insurance, health insurance, unemployment insurance contributions for employees; audit report of the authorized auditing agency on the unit's and heads' fulfillment of state budget obligations (Chairman of the Board of Members, Chairman of the Board of Directors, General Director, Director). The number of years confirmed corresponds to the number of years proposed in the achievement report for consideration of awards.
2. The application for Minister's Certificate of Merit for some special cases includes a proposal and a list of collective and individual nominees for awards by the Standing Council.
3. The application for recognition of the scope of influence at the ministry and nationwide level of an innovation includes one original copy, comprising:
a) A proposal from the Head of the unit according to Model No. 4 attached as an appendix to this Circular;
b) Certificate of innovation (photocopy);
c) Report on the results of applying the innovation according to Model No. 5 attached as an appendix to this Circular;
d) Confirmation letter from the competent authority recognizing the application of the innovation (if any).
4. The application for consideration of granting Commemorative Medals includes one original copy, comprising:
a) A proposal accompanied by a list of individuals nominated for Commemorative Medals by the Head of the unit according to Model No. 2 attached as an appendix to this Circular;
b) Report on the career of individuals proposed for Commemorative Medals according to Models No. 6, 7, 8, 9 attached as an appendix to this Circular.
Article 26. Place to submit files, time to receive files and notification of results
1. Place to submit files
Agencies and units shall directly submit or send by post in writing their commendation files to the Ministry of Agriculture and Rural Development (Department of Organization and Cadres), and simultaneously send electronic files through the Competition and Commendation Management Software for the Agriculture and Rural Development Sector (access address http://tdktbnn.com and http://tdktbnn.com/admin/). The commendation proposal file is eligible for review when the Department of Organization and Cadres receives both paper and electronic versions. http://tdktbnn.com and http://tdktbnn.com/admin/. The application dossier for rewards is eligible for review when the Cadre and Civil Servant Organization Department receives both the paper version and the electronic version.
2. Time to receive files (based on the postmark or receipt of the document at the Ministry)
a) For outstanding labor collectives and annual competition flags before January 31 each year;
b) For commendation files based on achievements and merits before February 28 each year. Commendation files for school groups before August 15 each year;
c) For commendation proposal files to recognize the scope of influence and effectiveness of application at the ministry level and nationwide for scientific research topics and initiatives, in two rounds: the first round before January 31 each year; the second round before August 15 each year;
d) Other forms of commendation: no specified time.
3. Notification of results
a) Within ten working days from the date the competent authority issues the commendation decision, the Standing Council shall notify the result to the unit that submitted the commendation request;
b) In cases where the conditions and criteria for commendation are not met, the Standing Council shall notify the requesting unit in writing within ten working days from the date the competent authority concludes.
Article 27. Procedures for awarding commendation titles, forms of commendation, and endorsement of commendation
1. Commendation based on achievements and merits, contributions, and exceptional commendation: After receiving the commendation proposal file from the unit, the Standing Council shall review the file and achievements, seek opinions from related agencies and units (if necessary), present to the Ministry's Competition and Commendation Council for examination or seek written opinions from Council members, compile the results for the Minister to consider and decide.
2. Commendation with Commemorative Medals and Scrolls: After receiving the commendation proposal file from the unit, the Standing Council shall review the file and achievements, compile and present to the Minister for consideration and decision.
3. Endorsement of commendation: The Standing Council shall compile, review, seek written opinions from relevant specialized agencies and units, and present to the Minister for decision.
4. The time for reviewing files and examining commendations shall be carried out according to the provisions of point b, Clause 2, Article 48 of Decree No. 91/2017/NĐ-CP.
Article 28. Organization of Presentation
Implement according to Decree No. 145/2013/NĐ-CP dated October 29, 2013 of the Government on organizing commemorative days; presentation and reception rituals for commendation forms and competition titles; diplomatic ceremonies and welcoming foreign guests, and in accordance with the guidance of the Ministry of Agriculture and Rural Development.
Article 29Management and storage of competition and commendation files, sector of
1. Implement according to the provisions of Circular No. 09/2011/TT-BNV dated June 3, 2011 of the Ministry of Home Affairs on the retention period for files and documents commonly formed in the activities of agencies and organizations. Agencies and units are responsible for storing commendation files of collectives and individuals under their management; the Department of Organization and Cadres stores the Ministry's competition and commendation files.
2. Agencies and units are responsible for ensuring equipment conditions, applying information technology, modernizing competition and commendation work management, monitoring, compiling, researching, searching, and confirming.
Chapter VI
ESTABLISHMENT, USE AND MANAGEMENT COMPETITION AND COMMENDATION FUND
Article 30. Sources and levels of contributions to the competition and reward fund
Implement according to the provisions of Article 65 of Decree No. 91/2017/NĐ-CP, specifically as follows:
1. The competition and reward fund of the Ministry shall be established from the annual budget expenditure plan allocated by the competent authority, from contributions by organizations and individuals both domestically and internationally for the purpose of competition and rewards, and from other lawful sources. The Ministry shall issue specific regulations on the level of establishment and use of the competition and reward fund of the Ministry in accordance with the law.
2. The maximum amount of the competition and reward fund of subordinate units of the Ministry shall be equal to 20% of the total salary fund based on rank and grade of officers, civil servants, and public officials within the establishment, approved annual wages, and contributions from domestic and foreign individuals and organizations, and other lawful income sources (if any).
Article 31. Management and use of the Ministry's competition and reward fund
Implement according to the provisions of Article 66 of Decree No. 91/2017/NĐ-CP, specifically as follows:
1. Annually, the Director of the Finance Department shall submit to the Minister for approval the budget estimate for revenue and expenditure of the Ministry’s competition and reward fund.
2. The Personnel and Cadres Department shall coordinate with the Ministry Office to advise the Minister on the establishment, management, use, and settlement of the Ministry’s competition and reward fund in accordance with the law. Any surplus in the competition and reward fund at the end of the year that has not been used shall be carried over to the next year.
3. Contents of expenditures from the competition and reward fund
a) Organizing meetings of the Competition and Reward Councils at the Ministry level;
b) Building, launching, and implementing competition campaigns;
c) Training in competition and reward procedures; signing competition agreements; holding mid-term and final summary meetings, promotional activities, and showcasing exemplary models;
d) Awarding cash prizes to groups and individuals (on the Ministry Office's salary fund) who have received awards and awarding cash prizes for exceptional and special cases;
đ) Purchasing tangible items for rewards and other items serving competition and reward work;
e) Expenditures for travel expenses and other administrative expenses serving the competition and reward work of the Ministry and sector.
Article 32. Provisions on awarding prizes
The head of the agency or unit under the Ministry shall be responsible for disbursing prize money to groups and individuals within their own management and accounting scope in accordance with the regulations.
Chapter VII
IMPLEMENTING PROVISIONS
Article 33Responsibility for Implementation
1. The Personnel and Cadres Department shall be responsible for organizing and implementing this Circular.
2. Units within the sector shall be responsible for organizing the implementation of the provisions of this Circular.
3. Reporting on competition and reward work
a) Each year, agencies and units under the sector shall organize evaluations of competition and reward work, conduct commendation reviews, and submit reports to the Ministry no later than December 15;
b) Educational institutions under the Ministry shall summarize and evaluate competition and reward work annually, and submit reports to the Ministry no later than August 15;
c) Agencies and units within the sector that launch competition campaigns shall be responsible for interim summaries, final summaries, competition reviews, and submitting interim and final reports to the Ministry.
Article 34. Effectiveness
1. This Circular takes effect from September 20, 2018.
2. Repeals Circular No. 47/2015/TT-BNNPTNT dated December 15, 2015, issued by the Minister of Agriculture and Rural Development guiding competition and reward work in the Agriculture and Rural Development sector; Abolishes Decision No. 89/2008/QĐ-BNN dated August 25, 2008, issued by the Minister of Agriculture and Rural Development establishing the Commemorative Medal and Regulations for awarding the "Commemorative Medal for the Agriculture and Rural Development Cause".
3. In case the provisions of the Law on Competition and Rewards, Decree No. 91/2017/NĐ-CP, and other legal documents referred to in this Circular are amended, the corresponding provisions of this Circular shall be amended accordingly./.
