Provisions on the management of inland waterway transport activities
Government Decree No. 08/2021/NĐ-CP dated 28 the 01 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;21 of the Government stipulating on the management of inland waterway transport activities, effective from March 15, 2021, amended and supplemented by:
1. Decree No. 54/2022/NĐ-CP dated August 22, 2022 of the Government amending and supplementing some articles of Decree No. 78/2016/NĐ-CP dated July 1, 2016 of the Government stipulating conditions for operating training services for seafarers and inland waterway vessel operators and Decree No. 08/2021/NĐ-CP dated January 28, 2021 of the Government stipulating the management of inland waterway transport activities, effective from November 1, 2022;
2. Decree No. 06/2024/NĐ-CP dated January 25, 2024 of the Government amending and supplementing some articles of Decree No. 08/2021/NĐ-CP dated January 28, 2021 of the Government stipulating the management of inland waterway transport activities, effective from March 10, 2024.
Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004, and the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Traffic dated June 17, 2014;
At the proposal of the Minister of Transport;
The Government promulgates this Decree stipulating the management of inland waterway transport activities[1].
Chapter I. GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates the management of inland waterway transport activities, including: Investment in construction, operation, maintenance, and protection of inland waterway infrastructure; ensuring safety, security, and environmental protection on inland waterways, ports, inland waterway wharfs, anchorage areas; management of activities of vessels, ships, seaplanes, foreign inland waterway vessels at ports, inland waterway wharfs, anchorage areas; state management responsibilities in inland waterway transport activities.
Article 2. Applicability
This Decree applies to organizations and individuals related to inland waterway transport activities in Vietnam.
Article 3. Explanation of Terms
In this Decree, the following terms are understood as follows:
1. Inland waterway transport infrastructure includes: Inland waterway channels, channel protection zones, ports, inland waterway wharfs, anchorage areas, ship berths, structures for vessel passage over dams and rapids; revetments, traffic dams; inland waterway navigation aids and auxiliary facilities such as high-water marks, coordinate markers, channel protection zone boundary markers, station houses; structures, architectural works, equipment directly serving inland waterway transport management and operation.
2. Vessel navigation channels are water areas delineated by inland waterway navigation aids to ensure smooth and safe passage for vessels (referred to in this Decree as inland waterway channels).
3. Dedicated ports and wharfs are ports and wharfs exclusively used for loading and unloading raw materials, fuels, minerals, supplies, and equipment for production purposes of the port or wharf owners or for new construction, conversion, repair, and restoration of vessels, ships, and foreign inland waterway vessels.
4. River passenger wharfs are inland waterway wharfs specifically serving passenger and cargo transportation across rivers, canals, creeks, lakes, and lagoons. A wharf position on each riverbank constitutes a river passenger wharf.
5. Mooring wharfs are inland waterway wharfs using floating structures, pontoons placed at stable positions on water areas to receive vessels for mooring, loading and unloading goods, picking up and dropping off passengers, and providing other support services.
6. Anchorage areas are water areas outside the water areas of ports, wharfs established by mooring buoys, mooring piles, or self-mooring systems for vessels, ships, seaplanes to anchor, transfer cargo and passengers, or perform other activities as prescribed.
7. Port, wharf, and anchorage area owners are organizations or individuals owning port, wharf, and anchorage area structures and granted the right to use land and water areas of ports, wharfs, and anchorage areas.
8. Port, wharf, and anchorage area operators are port, wharf, and anchorage area owners directly operating ports, wharfs, and anchorage areas or organizations or individuals leasing ports, wharfs, and anchorage areas for operation or organizations or individuals authorized to manage and operate ports, wharfs, and anchorage areas.
9. Persons applying procedures for vessels, ships, seaplanes, foreign inland waterway vessels entering and leaving ports, wharfs, and anchorage areas are the owners of vessels, ships, seaplanes, foreign inland waterway vessels, crew members, vessel operators, seaplane operators, or persons authorized to apply entry and departure procedures at ports, wharfs, and anchorage areas (hereinafter referred to as the person handling procedures).
10. Inland waterway vessels are boats, ships, and other floating structures with or without engines, specifically operating on inland waterways (referred to in this Decree as vessels).
11. Foreign inland waterway vessels are vessels flying the flag of another country.
Chapter II. MANAGEMENT OF INLAND WATERWAY INFRASTRUCTURE
Section 1. GENERAL PROVISIONS ON MANAGEMENT OF INLAND WATERWAY INFRASTRUCTURE
Article 4. Principles for Investment and Construction of Inland Waterway Infrastructure
1. Organizations and individuals, both domestic and foreign, investing in and constructing inland waterway infrastructure must comply with the provisions of this Decree, investment regulations, public investment regulations, construction regulations, land regulations, mineral resources regulations, environmental regulations, and other relevant legal provisions.
2. Investment in the construction of inland waterway channels, ports, inland waterway wharfs (except for inland waterway wharfs serving construction projects), and anchorage areas must be consistent with the planning of inland waterway infrastructure and related plans as stipulated by laws on planning. In cases where an investment project for the construction of inland waterway channels, ports, inland waterway wharfs, and anchorage areas does not have a plan or differs from the approved plan, during the project preparation process, the investor must report to the competent authority for examination and adjustment to supplement the plan according to the legal provisions on planning.
Article 5. Organization of Management and Maintenance of Inland Waterway Infrastructure
1. Organization of Management
a) The Vietnam Inland Waterways Administration organizes the management and maintenance of inland waterway infrastructure within the scope of management of the Ministry of Transport;
b) Provincial People's Committees (hereinafter referred to as provincial-level People's Committees) organize the management and maintenance of inland waterway infrastructure within their scope of management;
c) Organizations and individuals investing in and constructing inland waterway infrastructure without using state funds decide on the organization of management and maintenance of the works in accordance with the provisions of this Decree and other relevant legal provisions.
2. Maintenance of Inland Waterway Infrastructure
a) Works belonging to inland waterway infrastructure are maintained to ensure normal operation and safety of the works;
b) The content of management and maintenance work for works belonging to inland waterway infrastructure includes: Management work; regular maintenance; periodic and emergency repairs, restoration of damaged works; activities aimed at improving the current condition of the works; supplementation, replacement of signals, parts of the works, and equipment attached to the works; establishment of monitoring records for the works, obstructions; traffic safety assurance activities, and other activities as prescribed by relevant laws;
c) The Minister of Transport shall provide detailed regulations on the content of management and maintenance of works belonging to inland waterway infrastructure.
Article 6. Ensuring Safety and Security in Inland Waterway Activities
1. Works and activities related to inland waterways must be ensured safe and secure in accordance with the provisions of this Decree and other relevant legal provisions.
2. Responsibilities for Ensuring Safety and Security in Inland Waterway Activities
a) Owners of works belonging to inland waterway infrastructure, operators of ports, inland waterway wharfs, and anchorage areas; organizations and individuals organizing activities on inland waterways are responsible for ensuring and maintaining the safety and security of works and activities during the investment and construction, management, and exploitation processes in accordance with the law;
b) All levels of People's Committees, specialized agencies managing inland waterway transport, and related agencies have the responsibility to promote and guide the implementation of regulations on ensuring safety and security for works and activities related to inland waterways, ports, inland waterway wharfs, and anchorage areas; inspect and handle violations of regulations on ensuring safety and security for inland waterways, ports, inland waterway wharfs, and anchorage areas according to the law.
M ||| Section 2. MANAGEMENT OF INVESTMENT IN WATERWAY CONSTRUCTION AND EXPLOITATION OF INLAND WATERWAYS
A ||| Article 7. Classification and Technical Level of Inland Waterways
1. Inland waterways are classified into three types, including: National inland waterways (hereinafter referred to as national waterways), provincial inland waterways (hereinafter referred to as provincial waterways), and specialized inland waterways (hereinafter referred to as specialized waterways).
2. National waterways are those that meet one of the following conditions:
a) Passing through two or more provinces or centrally governed cities playing an important role in serving the economy, national defense, and security;
b) Waterways within the territory of a province or centrally governed city directly connecting with coastal transport routes or directly connecting with two national waterways;
c) Waterways crossing borders or on borders.
3. Provincial waterways are waterways within the territory of a province or centrally governed city, except for cases specified in points b and c of Clause 2 of this Article.
4. Specialized waterways are waterways connecting specialized port areas with national waterways or provincial waterways.
5. Inland waterways are classified into technical levels as prescribed by the Minister of Transport.
A ||| Article 8. Agreement on Technical Specifications for Construction of Inland Waterways
1. Before approving the investment project for construction of inland waterways, the investor must agree on the technical specifications of the waterway with the competent authority as stipulated in Clause 2 of this Article.
2. Competent Authority for Agreement
a) The Vietnam Inland Waterways Administration agrees on the technical specifications of national waterways and specialized waterways connected to national waterways;
b) The Department of Transport of a province or centrally governed city agrees on the technical specifications of provincial waterways and specialized waterways connected to provincial waterways.
3. Content of Agreement
a) Compliance with planning;
b) Scale and technical specifications.
4. Agreement Documents
a) Request for agreement on technical specifications for construction of inland waterways according to Form No. 01 attached to this Decree;
b) Copy of the approval document for the investment project's policy from the competent authority (if any);
c) Preliminary design documents for inland waterways.
5. Procedure for Agreement
The investor submits one set of documents directly or by other appropriate means to the competent authority as stipulated in Clause 2 of this Article to agree on the technical specifications for construction of inland waterways.
Within five working days from the date of receipt of complete documents as prescribed, the competent authority as stipulated in Clause 2 of this Article issues an agreement document on technical specifications for construction of inland waterways and sends it to the investor.
A ||| Article 9. Competence and Procedures for Announcing Opening and Managing Inland Waterways
1. Inland waterways must be announced open by the competent authority before they are put into operation.
2. Competence for Announcing Opening
a) The Ministry of Transport decides to announce the opening of national waterways and specialized waterways connected to national waterways;
b) The People's Committee of a province decides to announce the opening of provincial waterways and specialized waterways connected to provincial waterways.
3. Application Documents for Announcing Opening
a) Request for announcing opening of inland waterways according to Form No. 02 attached to this Decree;
b) Completion acceptance report for construction projects put into use, final drawings of waterway construction projects, and inland waterway navigation signal systems for new construction projects or improved and upgraded waterways;
c) Current map of the proposed waterway showing place names, mileage, signal positions, and existing structures on the waterway for waterways without construction projects.
4. Procedure for Announcing Opening
a) For national waterways: The Vietnam Inland Waterways Administration prepares the documents and reports to the Ministry of Transport; within five working days from the date of receipt of complete documents, the Ministry of Transport issues a decision to announce the opening of the waterway;
b) For provincial waterways: The Department of Transport prepares the documents and reports to the People's Committee of a province; within five working days from the date of receipt of complete documents, the People's Committee of a province issues a decision to announce the opening of the waterway;
c) For specialized waterways connected to national waterways: Organizations or individuals submit one set of documents directly or send them by other appropriate means to the Vietnam Inland Waterways Administration. Within five working days from the date of receipt of complete documents, the Vietnam Inland Waterways Administration reviews the documents, if they meet the requirements, then reports to the Ministry of Transport; within five working days from the date of receipt of the documents and report from the Vietnam Inland Waterways Administration, the Ministry of Transport issues a decision to announce the opening of the waterway;
d) For specialized waterways connected to provincial waterways: Organizations or individuals submit one set of documents directly or send them by other appropriate means to the Department of Transport. Within five working days from the date of receipt of complete documents, the Department of Transport reviews the documents, if they meet the requirements, then reports to the People's Committee of a province; within five working days from the date of receipt of the documents and report from the Department of Transport, the People's Committee of a province issues a decision to announce the opening of the waterway;
e) Decision to announce the opening of the waterway according to Form No. 03 attached to this Decree.
5. If inland waterways already included in approved planning only require surveying and setting up signals for exploitation, the Ministry of Transport assigns the Vietnam Inland Waterways Administration, and the People's Committee of a province assigns the Department of Transport to organize surveys and set up signals. After completing the surveys and setting up signals, the procedures for announcing the opening of the waterway shall be carried out as prescribed in this Decree. The survey and signal setup costs are guaranteed by the state budget from regular expenditure according to budget classification.
6. Management of Inland Waterways
a) The Vietnam Inland Waterways Administration organizes the management of national waterways;
b) The People's Committee of a province directs the Department of Transport to organize the management of provincial waterways;
c) Organizations or individuals with specialized waterways organize the management of specialized waterways.
7. Establishment and Announcement of List of Inland Waterways
a) The Vietnam Inland Waterways Administration compiles the list of national waterways and specialized waterways connected to national waterways, and submits it to the Ministry of Transport for announcement.
b) The Department of Transport shall prepare a list of local waterways and specialized waterways connecting to local waterways for submission to the People's Committee at the provincial level for publication. After publication, the list shall be sent to the Vietnam Inland Waterway Administration for consolidation and monitoring;
c) Organizations and individuals with specialized waterways shall be responsible for reporting technical specifications of such waterways to the Vietnam Inland Waterway Administration and the Department of Transport to serve the preparation and publication of the list of inland waterways;
d) The list of inland waterways shall be updated, adjusted, and published every three years. The Vietnam Inland Waterway Administration shall compile the list of inland waterways nationwide and post it on the electronic information website of the Vietnam Inland Waterway Administration;
Article 10. Conversion of Inland Waterways
1. Conditions for converting inland waterways
a) Complying with the approved planning for inland waterway infrastructure;
b) Meeting the conditions stipulated in Article 7 of this Decree.
2. Authority for converting inland waterways
a) The Ministry of Transport shall decide on converting local waterways and specialized waterways into national waterways and vice versa;
b) The People's Committee at the provincial level shall decide on converting specialized waterways into local waterways and vice versa;
3. Documents for converting waterways
a) A request letter accompanied by a report on the current status of the proposed converted waterway from the Vietnam Inland Waterway Administration (for national waterways) and the Department of Transport (for local waterways);
b) A request letter from the People's Committee at the provincial level (for cases of converting local waterways into national waterways or vice versa);
4. In cases where local waterways are converted into national waterways or vice versa: The Vietnam Inland Waterway Administration shall take the lead in coordinating with the Department of Transport to prepare the documents and report to the People's Committee at the provincial level and the Ministry of Transport. Within five working days from the date of receipt of all required documents, the People's Committee at the provincial level shall issue a letter to the Ministry of Transport. Within ten working days from the date of receipt of the letter from the People's Committee at the provincial level, the Ministry of Transport shall issue a decision to announce the conversion of the waterway;
5. In cases where specialized waterways are converted into national waterways: The Vietnam Inland Waterway Administration shall take the lead in coordinating with organizations and individuals owning specialized waterways to prepare the documents and submit them to the Ministry of Transport. Within ten working days from the date of receipt of all required documents, the Ministry of Transport shall issue a decision to announce the conversion of the waterway;
6. In cases where specialized waterways are converted into local waterways or vice versa: The Department of Transport shall take the lead in coordinating with organizations and individuals owning specialized waterways to prepare the documents and submit them to the People's Committee at the provincial level. Within ten working days from the date of receipt of all required documents, the People's Committee at the provincial level shall issue a decision to announce the conversion of the waterway;
7. Upon issuance of a decision to convert the waterway, the Ministry of Transport and the People's Committee at the provincial level shall coordinate with the Ministry of Finance to implement asset transfers in accordance with laws governing the management and use of public assets. After receiving approval for the asset transfer, the agency or unit receiving the assets shall manage, use, and operate them in accordance with regulations;
8. In cases where specialized waterways are converted into national waterways or local waterways, partial investment capital (if any) may be refunded to organizations and individuals owning specialized waterways in accordance with laws and guidelines issued by the Ministry of Finance.
Article 11. Announcing the Closure of Inland Waterway Channels
1. Inland waterway channels shall be considered for announcement of closure in the following cases:
a) When they do not ensure safe exploitation and transportation;
b) For reasons of ensuring national defense and security;
c) When there is no longer a need for exploitation and use.
2. Authority to announce the closure of inland waterway channels
The agency responsible for deciding to announce the opening of channels as stipulated in Clause 2, Article 9 of this Decree is also the agency with authority to decide on announcing the closure of channels.
3. Documents for channel closure
a) For the case stipulated in Point a, Clause 1 of this Article, there must be a report on the current status of the channel by the Vietnam Inland Waterways Administration (for national channels), the Department of Transport (for local channels); a report on the current status of the channel between the Vietnam Inland Waterways Administration and organizations or individuals having dedicated channels connected to national channels, or between the Department of Transport and organizations or individuals having dedicated channels connected to local channels. The report must include conclusions about the channel's unsuitability for safe exploitation;
b) A request document from the Ministry of National Defense or the Ministry of Public Security requiring the closure of channels for the case stipulated in Point b, Clause 1 of this Article;
c) A proposal form for announcing the closure of inland waterway channels according to Form No. 04 attached to this Decree for the case stipulated in Point c, Clause 1 of this Article;
d) A plan for removing inland waterway navigation signals established by the agency, organization, or individual managing the channel.
4. Procedures for closing national and local channels
a) In the case of closure as stipulated in Point a, Clause 1 of this Article: After inspection, if it does not ensure safe exploitation and transportation, the Vietnam Inland Waterways Administration or the Department of Transport shall issue a notice temporarily suspending exploitation and transportation sent to the direct management unit of the channel and published on mass media, while preparing a proposal for announcing the closure of the channel to submit to the competent authority for closure;
b) In the case of closure as stipulated in Point b, Clause 1 of this Article, the Ministry of National Defense or the Ministry of Public Security proposing the closure of the channel must notify in writing the reasons for closure and the closure date to the Vietnam Inland Waterways Administration or the Department of Transport. The notification period before the required closure date must be at least 30 days. Within five working days from receiving the notification from the Ministry of National Defense or the Ministry of Public Security, the Vietnam Inland Waterways Administration reports to the Ministry of Transport, and the Department of Transport reports to the provincial People's Committee;
c) In the case of closure as stipulated in Point c, Clause 1 of this Article, the Vietnam Inland Waterways Administration (for national channels) or the Department of Transport (for local channels) prepares a proposal for channel closure to submit to the Ministry of Transport or the provincial People's Committee and organizes the removal of inland waterway navigation signals within 60 days from the effective date of the decision to close the channel;
d) Within ten working days from receiving all required documents, the Ministry of Transport or the provincial People's Committee issues a decision to announce the closure of the channel within their jurisdiction.
5. Procedures for closing dedicated channels
a) For the case stipulated in Point a, Clause 1 of this Article, the Vietnam Inland Waterways Administration or the Department of Transport must require organizations or individuals with dedicated channels to temporarily suspend exploitation and transportation and report to the Ministry of Transport or the provincial People's Committee;
b) For the case stipulated in Point b, Clause 1 of this Article, the Ministry of National Defense or the Ministry of Public Security proposing the closure of the channel must notify in writing the reasons and closure date to the organizations or individuals with dedicated channels, the Vietnam Inland Waterways Administration or the Department of Transport, and the Ministry of Transport or the provincial People's Committee. The notification period before the required closure date must be at least 30 days;
c) For the case stipulated in Point c, Clause 1 of this Article, organizations or individuals with dedicated channels directly submit one set of documents or through other appropriate means to the Vietnam Inland Waterways Administration (for national channels or dedicated channels connected to national channels) or the Department of Transport (for local channels or dedicated channels connected to local channels);
d) Within ten working days from receiving all required documents, the Vietnam Inland Waterways Administration reviews the documents, if conditions are met, reports to the Ministry of Transport, and the Department of Transport reviews the documents, if conditions are met, reports to the provincial People's Committee. Within ten working days from receiving all documents and reports from the Vietnam Inland Waterways Administration and the Department of Transport, the Ministry of Transport or the provincial People's Committee issues a decision to announce the closure of the channel within their jurisdiction;
e) Organizations or individuals with dedicated channels are responsible for removing inland waterway navigation signals within 60 days from the effective date of the closure decision.
6. The decision to announce the closure of channels according to Form No. 05 attached to this Decree must be sent to relevant agencies, organizations, or individuals within two days from the date of signing the decision.
7. Costs for implementing the closure of national and local channels are guaranteed by the state budget from regular expenditure according to budget classification.
8. Costs related to the closure of dedicated channels are borne by the organizations or individuals with dedicated channels, except for the case stipulated in Point b, Clause 1 of this Article, which is borne by the proposing agency.
Article 12. Survey of inland waterway channels
1. Inland waterway channels must be surveyed regularly, periodically, and urgently during exploitation.
2. Responsibilities for surveying and drawing charts
a) The Vietnam Inland Waterways Administration, Provincial Departments of Transport, and organizations or individuals with dedicated channels shall organize surveys, draw charts, digitize charts (if applicable), establish, maintain, and provide databases of survey results and charts to serve management, announcement, and exploitation of channels;
b) Organizations or individuals conducting channel surveys must provide survey results to the agency specified in Clause 4, Article 13 of this Decree for channel announcements and bear responsibility for the data and information provided.
3. Funding for channel surveys and chart creation
a) Funding for surveys serving national and local channel management and announcements as stipulated in this Decree shall be guaranteed from the state budget's regular expenditure according to budget classification;
b) Organizations or individuals managing dedicated channels shall allocate funding for surveys serving management and announcements as stipulated in this Decree.
4. The Ministry of Transport shall specify detailed procedures for inland waterway channel surveys.
Article 13. Announcement of inland waterway channels
1. The announcement of inland waterway channels is a document issued and published by the agencies or organizations specified in Clause 4 of this Article based on survey results to serve management and provide information and guidance to crew members, drivers, and related organizations and individuals to ensure safe transportation.
2. Content of channel announcements
a) For initial channel announcements before exploitation: Name of the channel, length, coordinates of the start and end points, key points along the channel; technical grade; shoals on the channel, names of obstructions and river-crossing structures on the channel;
b) For periodic channel announcements: Name of the channel, length, start and end points, coordinates of key points, width, depth, radius of curvature of the channel, technical grade; representative height of shoals on the channel, name and coordinates, height of obstructions and river-crossing structures on the channel that do not meet the waterway dimensions according to the technical grade, water level at the time of survey, and other issues requiring attention;
c) For regular channel announcements: Name of the channel; width and depth of the channel in areas with shoals and obstructions; water level at the time of survey; necessary warnings;
d) For urgent channel announcements: Name of the channel; description of the emergency situation; location (coordinates, mileage, depth, clearance height) of the emergency situation; width and depth of the channel in areas affected by the emergency situation; water level at the time of survey and impact of the emergency situation on transport activities; necessary warnings.
3. Forms of channel announcements
Announcements of inland waterway channels are made in writing; posted on electronic information websites, updated in databases, digital channel maps (if available) of the announcing agency specified in Clause 4 of this Article, or through mass media.
4. Responsibilities for announcements
a) The Vietnam Inland Waterways Administration announces initial national channels and dedicated channels connected to national channels;
b) Regional Inland Waterways Management Agencies announce periodic, regular, and urgent national channels and dedicated channels connected to national channels;
c) Provincial Departments of Transport announce initial, periodic, regular, and urgent local channels and dedicated channels connected to local channels;
d) When there is an urgent situation on a channel affecting transportation safety, the direct management and maintenance unit must promptly issue warnings directly in the affected area and report to the Vietnam Inland Waterways Administration, Regional Inland Waterways Management Agency, or Provincial Department of Transport.
5. Time for announcing national and local channels: Within two working days from the date of receiving the survey result report, the agency specified in Clause 4 of this Article shall check the data and announce inland waterway channels according to Form No. 06, Form No. 07, and Form No. 08 attached to this Decree;
6. Time for announcing dedicated channels: Organizations or individuals with dedicated channels shall submit a request for announcement publication according to Form No. 09 attached to this Decree to the agency specified in Clause 4 of this Article. Within three working days from the date of receipt of the organization or individual's report, the responsible agency shall check the data and announce inland waterway channels.
Mục 3. MANAGEMENT OF INVESTMENT IN CONSTRUCTION AND OPERATIONS OF INLAND WATERWAY PORTS, WHARVES, AND ANCHORAGE AREAS
Article 14. General Provisions on Investment in Construction and Operations of Inland Waterway Ports, Wharves, and Anchorage Areas
1. Investment in construction of inland waterway ports, wharves, and anchorage areas must be carried out in accordance with the laws on investment in construction and the provisions of this Decree.
2. The water area of inland waterway ports, wharves, and anchorage areas shall not overlap with the inland waterway channel; the length of the water area of the port and wharf shall not exceed the reach adjacent to the river, canal, or stream that has been granted permission for construction of the port and wharf by the competent authority.
3. Inland waterway ports, wharves, and anchorage areas must be announced for operation by the competent authority in accordance with the law before being put into exploitation and use. During the exploitation of inland waterway ports, wharves, and anchorage areas, the investor and the operator must comply with the regulations of the law on inland waterway transport and other relevant laws, and the contents of the announcement decision; all equipment and devices for loading and unloading goods and anchoring services for the operations of the port, wharf, and anchorage area must meet technical safety requirements.
4. For inland waterway ports, wharves, and anchorage areas involved in the handling and transshipment of dangerous goods, they must comply with the regulations of the law on the storage and transportation of dangerous goods.
5. Inland waterway ports, wharves, and anchorage areas that have exceeded their operational period as stated in the announcement decision, if not extended, the port owner, wharf owner, and anchorage area owner must dismantle structures and equipment affecting traffic safety, clear and remove obstructions in the water area of the port, wharf, and anchorage area within sixty days from the end of the operational period. The competent authority announcing the operation of the port, wharf, and anchorage area will coordinate with the People's Committee of the commune, ward, town (hereinafter referred to as the People's Committee at the commune level) to supervise the dismantling of port and wharf structures, clearing, and removal of obstructions in the water area of the port, wharf, and anchorage area.
6. The management regulations on investment in construction and exploitation of inland waterway ports, wharves, and anchorage areas set forth in this Decree shall not apply to inland waterway ports, wharves, and anchorage areas serving national defense and security purposes.
Article 15. Agreement on Technical Specifications for Construction of Inland Waterway Ports
1. Content of the Agreement
a) Location for constructing inland waterway ports;
b) Functionality of inland waterway ports;
c) Scale of construction of inland waterway ports.
2. Competent Authority for Agreement
a) The Ministry of Transport agrees on technical specifications for construction of inland waterway ports receiving foreign watercraft;
b) The Vietnam Directorate of Inland Waterways agrees on technical specifications for construction of inland waterway ports on national inland waterways, specialized inland waterways connecting to national inland waterways, inland waterway ports with water and land areas both on national inland waterways and local inland waterways, inland waterway ports in the water area of seaports connected to national inland waterways, except cases stipulated in point a of this clause and other cases decided by the Ministry of Transport;
c)[2] The Department of Transport agrees on technical specifications for construction of inland waterway ports on local inland waterways, specialized inland waterways connecting to local inland waterways, inland waterway ports in the water area of seaports connected to local inland waterways within the province or centrally-administered city, except cases stipulated in point a of this clause and other cases decided by the Ministry of Transport.
d)[3] The People's Committee at the district level agrees on technical specifications for construction of inland waterway wharves within its jurisdiction.
3. Documents for agreement on technical specifications for construction of inland waterway ports include:
a) Request form for agreement on technical specifications for construction of inland waterway ports according to Model No. 10 attached to this Decree;
b) Project dossier;
c) Copy of the approval document for the project investment proposal issued by the competent authority (if any);
d) Plan showing the location for constructing inland waterway ports: Displaying place names, location of port facilities, warehouses, yards, water areas, river mileage (km), canal, and stream; land areas; adjacent structures (if any). The water area on the drawing must show the minimum width from the bank edge to the full width of the channel. The plan is established on the national coordinate system VN2000 and national elevation, with a scale of 1/500 to 1/1,000.
4. Documents for agreement on technical specifications for construction of inland waterway wharves include:
a) Request form for agreement on technical specifications for construction of inland waterway wharves according to Model No. 10 attached to this Decree;
b) Copy of the approval document for the investment project's policy from the competent authority (if any);
c) Layout plan showing the proposed location for constructing inland waterway wharves: Displaying place names, location of structures, land areas, water areas in front of the wharf, river mileage (km), canal, and stream, and adjacent structures (if any).
5. Procedure for Agreement
a) Inland waterway ports receiving foreign watercraft
The investor submits two sets of documents directly or through appropriate means to the Vietnam Directorate of Inland Waterways (for inland waterway ports specified in point b of Clause 2 of this Article) and the Department of Transport (for inland waterway ports specified in point c of Clause 2 of this Article) for review. Within five working days from the date of receipt of complete documents as prescribed, the Vietnam Directorate of Inland Waterways and the Department of Transport will review the documents, and if conditions are met, submit the review report and one set of documents to the Ministry of Transport.
Within five working days from the date of receipt of the review report from the Vietnam Directorate of Inland Waterways or the Department of Transport, the Ministry of Transport seeks opinions from the Ministry of National Defense, the Ministry of Public Security, and the People's Committee at the provincial level regarding the assurance of national defense and security for the construction of inland waterway ports; within five working days from the date of receipt of the request document from the Ministry of Transport, the Ministry of National Defense, the Ministry of Public Security, and the People's Committee at the provincial level provide written opinions to the Ministry of Transport. Within five working days from the date of receipt of the unified opinion document from the Ministry of National Defense, the Ministry of Public Security, and the People's Committee at the provincial level, the Ministry of Transport issues the agreement document on technical specifications for construction and sends it to the investor.
b) An inland waterway port shall not receive foreign watercraft.
The investor shall submit one set of documents directly or through other appropriate means to the Directorate of Inland Waterways of Vietnam or the Department of Transport. Within five working days from the date of receiving complete documents as prescribed, the Directorate of Inland Waterways of Vietnam or the Department of Transport shall issue a technical specification agreement document to the investor.
c)[4] Inland waterway wharf
The investor shall submit one set of documents directly or through other appropriate means to the People's Committee of the district. For inland waterway wharfs on national inland waterways or dedicated inland waterways connecting with national inland waterways, before issuing an agreement document, the People's Committee of the district shall seek opinions from the Regional Inland Waterway Management Agency. Within five working days from the date of receiving the request document from the People's Committee of the district, the Regional Inland Waterway Management Agency shall issue a reply document. Within five working days from the date of receiving the document from the Regional Inland Waterway Management Agency, the People's Committee of the district shall issue a technical specification agreement document to the investor.
d)[5] In cases where ports or wharfs are located within the port area waters, before assessing and agreeing on technical specifications for construction, the Directorate of Inland Waterways of Vietnam, the Department of Transport, and the People's Committee of the district shall seek opinions from the Port Maritime Office in writing. Within five working days from the date of receiving the request document, the Port Maritime Office shall issue a reply document.
6. The validity period of the technical specification agreement document for port and wharf construction shall not exceed twenty-four months from the date of signing the document. After the agreement document expires, if the investor has not commenced construction and wishes to continue with the construction of the port or wharf, they must reapply for the technical specification agreement according to the provisions of this Article.
Article 16. Agreement on Technical Specifications for Construction of River Passenger Wharfs and Inland Waterway Wharfs Serving Main Project Construction
1. Content of the Agreement
a) Location of the wharf construction;
b) Function of the wharf;
c) Scale of wharf construction.
2.[6] Competent Authority for Agreement
The People's Committee of the district shall agree on the technical specifications for construction of river passenger wharfs and inland waterway wharfs serving main project construction within its jurisdiction.
3. Documents for Agreement
a) Request for agreement on construction of inland waterway wharf according to Model No. 10 attached to this Decree;
b) Plan showing the proposed location for construction of the inland waterway wharf: Indicating place names, nearby works, land and water areas in front of the wharf, river, canal, and creek mileage (km).
4. Procedure for Implementing the Agreement Process
The investor shall submit one set of documents directly or through other appropriate means to the competent authority specified in Clause 2 of this Article; within five working days from the date of receiving complete documents as prescribed, the competent authority specified in Clause 2 of this Article shall issue a technical specification agreement document for the wharf to the investor.
5. The validity period of the agreement document shall not exceed twenty-four months for river passenger wharfs and three months for inland waterway wharfs serving main project construction. After the agreement document expires, if the investor has not commenced construction of the wharf and wishes to continue with the construction of the wharf, they must reapply for the construction agreement according to the provisions of this Article.
6. In cases where a river passenger wharf has one or more counterflow wharf locations in another province or city, before agreeing on the construction of the wharf, the competent authority specified in Clause 2 of this Article must reach consensus with the locality having the counterflow wharf.
Article 17. Naming and Renaming Inland Waterway Ports, Wharfs, Mooring Areas
1. Inland waterway ports, wharfs, mooring areas must be named according to the following principles:
a) Inland waterway ports, wharfs, mooring areas shall be named when investment projects for construction are established or when they are put into operation;
b) Names of inland waterway ports, wharfs, mooring areas within the same province shall not be duplicated, causing confusion with already announced names or not matching the name or function of such ports, wharfs, or mooring areas;
c) The names of state agencies, armed forces units, political organizations, and social-political organizations shall not be used to name or partially name inland waterway ports, wharfs, mooring areas without the consent of those agencies, units, or organizations;
d) Names of inland waterway ports, wharfs, mooring areas shall not use terms or symbols that violate historical traditions, culture, ethics, and national customs and practices;
đ) The name of inland waterway ports, wharfs, mooring areas shall be in Vietnamese, may include an English name, starting with the phrase "Inland Waterway Port" or "Inland Waterway Wharf" or "Mooring Area," followed by the specific name of the port, wharf, or mooring area.
2. When there is a need to rename an inland waterway port, wharf, or mooring area, the port, wharf, or mooring area owner shall submit a request form No. 11 attached to this Decree to the competent authority specified in Clause 2, Article 15 of this Decree. Within five working days from the date of receipt of the request from the port, wharf, or mooring area owner, the competent authority specified in Clause 2, Article 15 of this Decree shall issue a written approval for renaming the inland waterway port, wharf, or mooring area.
Article 18. Announcing Operation of Inland Waterway Ports
1. Authority to announce operations
The agency responsible for agreeing on technical specifications for constructing inland waterway ports and wharfs as stipulated in Clause 2, Article 15 of this Decree is also the competent authority to announce the operation of inland waterway ports and wharfs.
2. Documents for announcing operations of inland waterway ports
a) A request form for announcing operations of inland waterway ports according to Form No. 12 attached to this Decree;
b) A certified copy or a copy and presentation of the original for verification of the project approval decision for constructing inland waterway ports issued by the competent authority;
c) A certified copy or a copy and presentation of the original for verification of land use documents for constructing inland waterway ports issued by the competent authority;
d) A copy of the decision approving the project or technical design of the inland waterway port construction project;
đ) Completion acceptance records for construction works put into use; final completion drawings of the plan view, elevation view, and cross-section of the inland waterway port construction project;
e) Records of obstacle detection results in the port waters; confirmation records of signal establishment at the port;
g) A copy of the certificate of technical safety and environmental protection for pontoons, mooring buoys subject to inspection (if pontoons are used as port bridges);
h) A certificate of fire prevention and firefighting acceptance issued by the competent authority as prescribed;
i) A copy of the security suitability certificate for foreign inland waterway vessels received by inland waterway ports (for inland waterway ports receiving foreign inland waterway vessels);
k) A copy of the decision announcing the opening of dedicated channels issued by the competent authority (if applicable) for inland waterway ports with dedicated channels.
3. Documents for announcing operations of inland waterway wharfs
a) A request form for announcing operations of inland waterway wharfs according to Form No. 12 attached to this Decree;
b) A certified copy of the decision approving the investment project for constructing inland waterway wharfs issued by the competent authority or a copy and presentation of the original for verification for wharfs with investment projects;
c) A certified copy of land use documents for constructing inland waterway wharfs or a copy and presentation of the original for verification, except for buoy wharfs;
d) A certified copy of the decision approving the economic-technical report of the investor (for wharfs with investment projects) or the exploitation plan for inland waterway wharfs;
đ) Completion acceptance records for construction works, final completion drawings of the plan view, elevation view, and cross-section of the construction project for wharfs with investment projects;
e) A copy of the certificate of technical safety and environmental protection for floating structures, vessels, pontoons, or mooring buoys subject to inspection (if floating structures, vessels, or pontoons are used as wharf bridges or buoy wharfs).
4.[7] Procedure for announcing operations
Before putting inland waterway port or wharf construction projects into operation, the port or wharf owner shall directly submit or send through postal services or online public service gateways or other appropriate methods one set of documents requesting the announcement of operations as follows:
a) For inland waterway ports receiving foreign inland waterway vessels: Submit the documents to the Vietnam Inland Waterway Administration (for inland waterway ports on national inland waterways, dedicated inland waterways connecting to national inland waterways, inland waterway ports with waters and lands both on national inland waterways and local inland waterways, inland waterway ports within the waters of seaports connected to national inland waterways), Provincial Department of Transport (for inland waterway ports on local inland waterways, dedicated inland waterways connecting to local inland waterways, inland waterway ports within the waters of seaports connected to local inland waterways within provinces and centrally-administered cities) for review. Within five working days from the date of receipt of complete documents as prescribed, the Vietnam Inland Waterway Administration, Provincial Department of Transport will review the documents, and if conditions are met, report to the Ministry of Transport. Within five working days from the date of receipt of complete documents and the review report, the Ministry of Transport will issue a decision announcing the operation of inland waterway ports.
b) For inland waterway ports that do not accept foreign watercraft: Submit the application to the Directorate of Inland Waterways of Vietnam (for inland waterway ports specified in point b, Clause 2, Article 15 of this Decree) or the Department of Transport (for inland waterway ports specified in point c, Clause 2, Article 15 of this Decree).Within five working days from the date of receipt of complete applications as prescribed, the Directorate of Inland Waterways of Vietnam or the Department of Transport shall issue a decision announcing the operation of the inland waterway port.
c) For inland waterway wharfs: Submit the application to the People's Committee of the district. Within five working days from the date of receipt of complete applications as prescribed, the People's Committee of the district shall issue a decision announcing the operation of the inland waterway wharf.
d) In case of submitting the application online, the application components shall be the original or electronic copy of the corresponding application components as prescribed in Clause 2 (for the application for announcing the operation of inland waterway ports) or Clause 3 (for the application for announcing the operation of inland waterway wharfs) of Article 18 of this Decree;
đ) In case of receiving the application directly, if the application is complete, issue a receipt for the application and schedule the result delivery within the prescribed time limit; if the application is incomplete according to the regulations, return it immediately and guide organizations and individuals to perfect the application; in case of receiving the application through the postal service system or through the online public service system or by other appropriate means, if the application is incomplete according to the regulations, within two working days from the date of receipt of the application, the agency receiving the application shall send a document to the organization or individual through the postal service system or through the online public service system or by other appropriate means, clearly stating the reasons and requesting the supplementation and perfection of the application.
5. The decision announcing the operation of the port and wharf shall be in Form No. 13 attached to this Decree.
6. The validity period of the decision announcing the operation of the port and wharf shall be as requested by the port owner but shall not exceed the land use period for building the port and wharf or the operating period of the project recorded in the investment certificate issued by the competent authority.
7. In case an inland waterway port has completed one or more berths and the investor wishes to operate them immediately, the investor must prepare an application in accordance with Clause 2 of this Article to request the competent authority to announce temporary operation. The validity period of the decision announcing the temporary operation of the berth shall not exceed one year. This provision does not apply to inland waterway ports accepting foreign watercraft.
8. Announcing an inland waterway port accepting foreign watercraft at an inland waterway port that has already been announced operational
a) In case an inland waterway port that has already been announced operational needs to accept foreign watercraft, the port owner shall submit a report in writing to the Ministry of Transport; the Ministry of Transport shall seek opinions from the Ministry of National Defense, the Ministry of Public Security, and the People's Committee of the province regarding the security and defense of the inland waterway port as stipulated in point a, Clause 5, Article 15 of this Decree. Within two working days from the date of receipt of the unified opinion of the Ministry of National Defense, the Ministry of Public Security, and the People's Committee of the province, the Ministry of Transport shall issue a document approving the inland waterway port to accept foreign watercraft and send it to the port owner;
b) The port owner shall submit the application for announcing the operation of the inland waterway port as prescribed in point a and point i, Clause 2 of this Article to the Ministry of Transport. Within five working days from the date of receipt of the application from the port owner, the Ministry of Transport shall issue a decision announcing the operation of the inland waterway port accepting foreign watercraft.
9. Announcing the operation of an inland waterway port when there is no longer a need to accept foreign watercraft
a) In case an inland waterway port that has been approved to accept foreign watercraft no longer needs to accept such watercraft, the port owner shall submit a written document (stating the reasons) to the Ministry of Transport. Within five working days from the date of receipt of the request document from the port owner, the Ministry of Transport shall issue a document approving the port owner;
b) The port owner shall submit the application for announcing the operation of the inland waterway port as prescribed in point a, Clause 2 of this Article to the Directorate of Inland Waterways of Vietnam or the Department of Transport. Within five working days from the date of receipt of the application from the port owner, the Directorate of Inland Waterways of Vietnam or the Department of Transport shall issue a decision announcing the operation of the inland waterway port that does not accept foreign watercraft and send it to the port owner while simultaneously sending it to the Ministry of National Defense, the Ministry of Public Security, and the People's Committee of the province for monitoring.
10.[8] Within two working days from the date of signing the decision, the agency announcing the operation of the port and wharf shall be responsible for sending the decision announcing the operation to the following individuals and organizations:
a) Project sponsor;
b) The Ministry of National Defense, the Ministry of Public Security, the Ministry of Health, the Ministry of Agriculture and Rural Development, the People's Committee of the province (for ports accepting foreign watercraft);
c) The Directorate of Inland Waterways of Vietnam (for inland waterway ports);
d) The inland waterway port inspection offices, maritime port inspection offices (for inland waterway ports and wharfs within the port area), regional inland waterway transport inspection offices related to the area;
đ) The Department of Transport;
e) The People's Committee of the district and commune where the port and wharf are located;
g) Border guard agencies, customs, health (for ports and wharfs in border areas) and other relevant organizations and individuals.
Article 19. Announcing the operation of river passenger wharves and inland waterway wharves serving construction projects
1. Authority to announce operations
The agency responsible for agreeing to construct river passenger wharves and inland waterway wharves serving construction projects as stipulated in Clause 2 of Article 16 of this Decree is also the competent authority to announce the operation of river passenger wharves and inland waterway wharves serving construction projects. is also the authority responsible for announcing the operation of river passenger wharfs and inland waterway wharfs serving construction projects.
2. Documents for announcing operations
a) A request for announcing operations according to Model No. 12 attached to this Decree;
b) Technical design documents, completion acceptance records of the project (if applicable), certified copies of land use certificates for constructing the wharf (for river passenger wharves); certified copies of technical safety and environmental protection certificates of floating structures, vessels, pontoons, or mooring buoys subject to inspection (if using floating structures, vessels, or pontoons as wharves).
3. Procedures for announcement
3. Procedure for announcing operations is also the competent authority to announce the operation of river passenger wharves and inland waterway wharves serving construction projects. a) Before putting river passenger wharves and inland waterway wharves serving construction projects into operation, the wharf owner shall submit one set of documents directly or through other appropriate means to the competent authority as stipulated in

c) The decision announcing the operation of river passenger wharves and inland waterway wharves serving construction projects shall be made according to Model No. 13 attached to this Decree.
4. Validity period of the decision announcing operations
a) The validity period of the decision announcing the operation of river passenger wharves shall be as requested by the wharf owner, but not exceeding the land use period granted by the competent authority;
b) The validity period of the decision announcing the operation of inland waterway wharves serving construction projects shall be as requested by the wharf owner, but not exceeding the construction period of the main project.
5. Responsibilities of the authority announcing the operation of river passenger wharves and inland waterway wharves serving construction projects include sending the decision announcing operations to the project investor, Port Management Unit, People's Committee of the commune where the wharf is located, and related organizations and individuals within two working days from the date of signing the decision; updating information on announced river passenger wharves in the port and inland waterway wharf database software of the Vietnam Inland Waterways Administration.
Article 20. Re-announcing and extending operations of ports and inland waterway wharves
1. Ports and inland waterway wharves must re-announce their operations in the following cases:
a) Changing the scale or function of the port or wharf;
b) Changing the land or water area of the port or wharf;
c) Changing the owner of the port or wharf.
2. Competent authority for re-announcing and extending operations of ports and inland waterway wharves The authority announcing the operation of ports and inland waterway wharves as stipulated in Clause 1 of Article 18 and Clause 1 of Article 19 of this Decree
is also the competent authority for re-announcing and extending operations of ports and inland waterway wharves.
3. Documents for requesting re-announcement of operations
a) A request for re-announcing operations of ports and inland waterway wharves according to Model No. 14 attached to this Decree; b) Documents as prescribed in Points d, đ, e, g, h of Clause 2 of Article 18 of this Decree for changes in the structure of inland waterway wharves;
c) Documents as prescribed in Points d, đ, e of Clause 3 of Article 18 of this Decree for changes in the structure of inland waterway wharves; d) Certified copies or copies accompanied by original documents for verification of the competent authority's documents regarding changes in land or water areas (in the case stipulated in Point b of Clause 1 of this Article);
đ) Certified copies or copies presented with original documents for verification of documents proving changes in the owners of the port or wharf (in the case stipulated in Point c of Clause 1 of this Article).
4. Procedure for re-announcing operations
The procedure for re-announcing operations of ports and inland waterway wharves shall be carried out according to the procedure for announcing operations of ports and inland waterway wharves as stipulated in
a)[9] Clause 4 of Article 18 of this Decree d) In the case of changing the owner of the port or wharf, the new owner must request a re-announcement of operations within ten working days from the date of taking over the port or wharf.;
b)[10] (Repealed)
c)[11] (Repealed)
5. The decision re-announcing operations of ports and inland waterway wharves shall be made according to Model No. 13 attached to this Decree, only recording the changed contents in the decision.
6. Extending operations of ports and inland waterway wharves
a) When the operation period recorded in the decision expires, if the port or wharf owner wishes to continue operating and the competent authority extends the land use period, the extension of operations will be considered;
b) Documents for requesting an extension of operations include: A request for extending operations of ports and inland waterway wharves; documents related to the land use for constructing the port or wharf extended by the competent authority;
c) The port or wharf owner shall submit one set of documents directly or through other appropriate means to the authority announcing operations of ports and inland waterway wharves. Within five working days from the date of receiving complete documents as prescribed, the competent authority announcing operations of ports and inland waterway wharves shall issue a document extending the operations of the port or wharf.
7. Responsibilities of the authority re-announcing and extending operations of ports and inland waterway wharves include sending the decision re-announcing operations and the document extending operations of ports and inland waterway wharves to the port or wharf manager, Port Management Unit, People's Committee of the commune where the port or wharf is located, and related organizations and individuals within two working days from the date of signing the decision; updating information on announced ports and inland waterway wharves in the port and inland waterway wharf database software of the Vietnam Inland Waterways Administration.
7. The authority responsible for re-announcing and extending the operation of ports and inland waterway wharfs shall send the decision on re-announcement and the extension document of port and wharf operations to the port and wharf managers, Port Supervision Authority, People's Committee of the commune where the port and wharf are located, and related organizations and individuals within two working days from the date of signing the decision; update information about the announced ports and wharfs on the Vietnam Inland Waterways Administration's port and wharf database software.
Article 21. Quality Inspection of Inland Waterway Ports
1. The port owner or the person managing the port exploitation shall be responsible for conducting quality inspection of the construction works. The content and procedures for conducting quality inspection of inland waterway ports shall comply with the provisions of laws on construction quality management and maintenance.
2. The Vietnam Inland Waterways Administration and the Department of Transport shall organize inspections to ensure compliance with the regulations on quality inspection of inland waterway ports within their jurisdiction.
Article 22. Repairing, Dredging, Renovation, and Upgrading of Inland Waterway Ports and Wharfs
1. Inland waterway ports and wharfs may be renovated and upgraded to change their scale and functions from those specified in the published decision and in accordance with approved planning.
2. Before carrying out renovation and upgrading of ports and wharfs, the port or wharf owner shall directly submit or send in another appropriate form a written request to the competent authority as stipulated in Clause 2, Article 15 and Clause 2, Article 16 of this Decree to seek opinions on the renovation and upgrading of the ports and wharfs. The request must clearly state the anticipated scale of the renovation and upgrading project; the implementation time; the impact of the renovation and upgrading on vessel operations in the water area, cargo handling equipment, and passenger and cargo transportation activities; and adjacent structures.
Within five days from the date of receipt of the request from the port or wharf owner, the competent authority as stipulated in Clause 2, Article 15 and Clause 2, Article 16 of this Decree shall provide written opinions on the renovation and upgrading of the ports and wharfs.
3. The renovation and upgrading of ports and wharfs shall comply with the provisions of the Construction Law. Prior to repairing, renovating, upgrading, or dredging the water area of the ports and wharfs, the port or wharf owner, or the person managing the port or wharf exploitation, must notify the Port Management Unit (specifying the name of the port or wharf; time; scope of repair, renovation, upgrading, and dredging).
Article 23. Upgrading Inland Waterway Wharfs to Inland Waterway Ports
1. An inland waterway wharf can be upgraded to an inland waterway port if it meets the following conditions:
a) The inland waterway wharf has been officially put into operation;
b) It conforms to the approved planning by the competent authority.
2. Before implementing the upgrade of an inland waterway wharf to an inland waterway port, the wharf owner shall directly submit or send in another appropriate form a written request to the competent authority as stipulated in Clause 2, Article 15 of this Decree to seek agreement on the upgrade of the wharf. The request must clearly state the anticipated scale of the upgrade; the implementation time; the impact of the upgrade on vessel operations in the water area, cargo handling equipment, and passenger and cargo transportation activities; and adjacent structures.
Within five days from the date of receipt of the request from the wharf owner, the competent authority as stipulated in Clause 2, Article 15 of this Decree shall issue a technical specification agreement for the upgrade of the wharf to an inland waterway port.
3. The renovation and upgrade of the wharf shall comply with the provisions of the Construction Law.
Prior to the renovation and upgrade of the wharf, the wharf owner or the person managing the wharf exploitation must notify the Port Management Unit (specifying the name of the wharf; time; scope of renovation and upgrade).
4. After completion of the renovation and upgrade, the person managing the wharf exploitation must complete the procedures for announcing the inland waterway port according to the provisions at Article 18 of this DecreeIn cases where inland waterway ports have scale and technical parameters consistent with the technical level of inland waterway ports as prescribed (without implementing renovation or upgrading of facilities), the application dossier for announcing an inland waterway port shall be as follows:
a) A request form for announcing the conversion of an inland waterway wharf to an inland waterway port according to Model No. 15 attached to this Decree;
b) Documentation agreeing on the technical parameters of the competent authority regarding the upgrade of the inland waterway wharf to an inland waterway port;
c) As-built drawings of the inland waterway wharf;
d) Plan view drawings of the facility, land, and water areas of the inland waterway wharf;
đ) Actual calculation inspection files of the inland waterway wharf conducted by a consulting entity with legal personality for certification purposes.
Article 24. Closure and Temporary Suspension of Operations of Ports and Inland Waterway Wharfs
1. Ports and inland waterway wharfs may be announced closed in the following cases:
a) For reasons of ensuring national defense and security;
b) At the request of the port or wharf owner.
2. Authority to Announce Closure of Ports and Inland Waterway Wharfs
2. Competent authority for re-announcing and extending operations of ports and inland waterway wharves The authority announcing the operation of ports and inland waterway wharves as stipulated in is also the authority responsible for announcing the closure of ports and inland waterway wharfs.
3. Dossier for Announcing Closure of Ports and Inland Waterway Wharfs
a) A proposal document from the Ministry of National Defense or the Ministry of Public Security for the case stipulated in point a, Clause 1 of this Article;
b) A request form for closing ports and inland waterway wharfs from the port or wharf owner for the case stipulated in point b, Clause 1 of this Article.
4. Procedures for Announcing Closure of Ports and Inland Waterway Wharfs
a) The Ministry of National Defense or the Ministry of Public Security must notify the port or wharf manager at least 60 days before the expected closure date for the case stipulated in point a, Clause 1 of this Article. The notification must clearly state the reason for the closure. Within ten days of receiving the notification, the port or wharf manager has the right to make recommendations and negotiate about the closure with the issuing agency;
b) The Ministry of National Defense, the Ministry of Public Security, and the port or wharf owner send the closure request documents to the authorized agency as stipulated in Clause 2 of this Article;
c) Within five working days of receiving the request documents from the agencies or owners as stipulated in point b of this clause, the authorized agency issues a decision to announce the closure of the port or wharf;
d) The decision to announce the closure of the port or wharf according to Model No. 16 attached to this Decree;
đ) The agency issuing the decision to announce the closure of the port or wharf must send the decision to the port or wharf owner, Port Management Unit, People's Committee of the commune where the port or wharf is located, related organizations and individuals, and the Ministry of National Defense and the Ministry of Public Security (for the case stipulated in point a, Clause 1 of this Article) within two working days of signing the decision and removing the name of the port or wharf from the registry of port and wharf management.
5. Within thirty working days of the effective date of the decision to announce the closure of the port or wharf, the port or wharf owner is responsible for clearing obstacles in the water area of the port or wharf (if any), dismantling inland waterway navigation signs of the port or wharf. Costs for clearing obstacles in the water area of the port or wharf (if any) and dismantling inland waterway navigation signs of the port or wharf are borne by the port or wharf owner, except in the case stipulated in point a, Clause 1 of this Article, where the cost is borne by the requesting agency.
6. Ports and inland waterway wharfs must suspend operations in the following cases:
a) Facilities have exceeded their service life;
b) Facilities encounter incidents posing risks to the safety of the structure, people, and vessels; affecting the safety of adjacent structures, the environment, and the community as prescribed.
7. Temporary Suspension of Operations of Ports and Inland Waterway Wharfs
a) The port or wharf manager must notify the Port Management Unit in writing about the suspension of operations of the port or wharf in the cases stipulated in Clause 6 of this Article;
b) Upon receipt of the notification from the port manager in the case stipulated in point a, Clause 6 of this Article, the Port Management Unit is responsible for notifying relevant agencies and units about the suspension of operations of the port or wharf;
c) Upon receipt of the notification from the port or wharf manager in the case stipulated in point b, Clause 6 of this Article, the Port Management Unit is responsible for sending a document to the port or wharf manager requiring them to cease operations to repair damage or incidents, while simultaneously notifying relevant agencies and units about the suspension of operations of the port or wharf;
d) Ports and inland waterway wharfs can only resume operations once the incident has been resolved or the risks to safety have been eliminated and confirmed by the Port Management Unit;
đ) If a port facility has exceeded its service life and there is a need to continue using it, the port or wharf manager must conduct quality inspections, carry out repairs or renovations (if necessary) to ensure the safety and functionality of the facility and apply for operation announcement according to this Decree.
Article 25. Establishment of Mooring Areas
1. Contents of the Agreement on Establishing Mooring Areas
a) Location and scope of the mooring area;
b) Purpose of use;
c) Scale of construction (scope, mooring equipment).
2. Competent Authority for Agreeing to Establish Mooring Areas
a) The Vietnam Inland Waterway Administration agrees to establish mooring areas on national inland waterways, specialized inland waterways connecting with national inland waterways, mooring areas with waters both on national inland waterways and local inland waterways, and other cases decided by the Ministry of Transport;
b) The Department of Transport agrees to establish mooring areas on local inland waterways, specialized inland waterways connecting with local inland waterways, and other cases decided by the Ministry of Transport.
3. Documents for Agreeing to Establish Mooring Areas
a) Application for agreement to establish a mooring area according to Form No. 17 attached to this Decree;
b) Copy of the approval document for investment orientation from the competent authority;
c) Map of the proposed mooring area: must show the scope of the mooring area, bottom elevation, channel position, adjacent structures (if any) on the national coordinate system VN2000 and national height system, scale of the drawing from 1/500 to 1/2,000.
4. Procedure for Agreeing to Establish Mooring Areas
a) Before establishing a mooring area, the investor submits one set of documents directly or by other appropriate means to the competent authority specified in Clause 2 of this Article requesting agreement to establish a mooring area;
b) Within five working days from the date of receiving complete documents as prescribed, the competent authority specified in Clause 2 of this Article issues an agreement document for establishing a mooring area and sends it to the investor.
Article 26. Announcement of Mooring Area Operations
1. Competent Authority for Announcing Mooring Area Operations
The authority agreeing to establish a mooring area as stipulated in Clause 2 of Article 25 of this Decree is also the competent authority for announcing mooring area operations.
2. Documents for Announcing Mooring Area Operations
a) Application for announcement of mooring area operations according to Form No. 18 attached to this Decree;
b) Completion acceptance record for the project put into use;
c) Map of the mooring area;
d) Technical safety and environmental protection certificate for buoys (if buoys are used);
đ) Acceptance record for obstacle clearance survey.
3. Procedure for Announcing Mooring Area Operations
a) The investor submits one set of documents directly or by other appropriate means to the competent authority specified in Clause 1 of this Article requesting announcement of mooring area operations;
b) Within five working days from the date of receiving complete documents as prescribed, the competent authority issues a decision announcing mooring area operations;
c) Decision announcing mooring area operations according to Form No. 19 attached to this Decree. The authority announcing mooring area operations is responsible for sending the announcement decision to the investor, Port Management Unit, Regional Inland Waterway Management Office, and related organizations and individuals within two working days from the date of signing the decision.
4. In necessary cases, the Vietnam Inland Waterway Administration and the Department of Transport decide to establish and announce mooring area operations to serve vessel mooring, typhoon and flood avoidance on inland waterways under their management. Prior to announcing mooring area operations, the Vietnam Inland Waterway Administration and the Department of Transport must conduct surveys and prepare documents as stipulated in Points b, c, d, and đ of Clause 2 of this Article.
Article 27. Announcement of Closure of Mooring Areas
1. A mooring area shall be announced closed in the following cases:
a) For reasons of ensuring national defense and security;
b) For reasons to ensure traffic safety;
c) At the proposal of the investor.
2. Authority for Announcing the Closure of Mooring Areas
The agency responsible for announcing the operation of mooring areas as stipulated in Clause 1, Article 26 of this Decree simultaneously has the authority to announce the closure of mooring areas.
3. Documents for Announcing the Closure of Mooring Areas
a) Documents from the Ministry of National Defense and the Ministry of Public Security for the case specified in point a, Clause 1 of this Article;
b) The investor's application to close the mooring area for the case specified in point b, Clause 1 of this Article. The application follows Model No. 20 attached to this Decree;
c) Records of completion of signal recovery and mooring equipment; records of completion of sweeping obstacles in the water area of the mooring area.
4. Procedures for Announcing the Closure of Mooring Areas
a) For the case specified in point a, Clause 1 of this Article: The Ministry of National Defense and the Ministry of Public Security notify the investor at least 60 days before the planned closure of the mooring area. The notification must clearly state the reason for closing the mooring area. If there is no objection from the investor, the Ministry of National Defense and the Ministry of Public Security send a document to the agency specified in Clause 2 of this Article;
b) For the case specified in point b, Clause 1 of this Article: The Vietnam Inland Waterway Administration and the Department of Transport and Communications notify the survey, record the current status of the mooring area that does not ensure traffic safety due to changes in inland waterway routes with the participation of the investor; request the investor to temporarily stop operating the mooring area;
c) For the case specified in point c, Clause 1 of this Article: The investor submits an application to close the mooring area directly or through other appropriate means to the agency specified in Clause 2 of this Article to request the announcement of the closure of the mooring area;
d) Within five working days from the date of receipt of the document from the Ministry of National Defense and the Ministry of Public Security or the field survey record of the mooring area or the application from the investor of the mooring area, the authorized agency specified in Clause 2 of this Article issues a decision to announce the closure of the mooring area.
5. Decision on Announcing the Closure of Mooring Areas follows Model No. 21 attached to this Decree. The agency announcing the closure of the mooring area is responsible for sending the decision to announce the closure of the mooring area to the investor, the Port Management Unit, and related organizations and individuals within two days from the date of signing the decision.
6. Within fifteen working days from the date of receipt of the decision to announce the closure of the mooring area, the investor is responsible for recovering signals, mooring equipment, and sweeping obstacles in the water area of the mooring area. For the case specified in point a, Clause 1 of this Article, the costs for recovering signals, mooring equipment, and sweeping obstacles in the water area of the mooring area shall be borne by the agency proposing the closure of the mooring area.
Section 4. MANAGEMENT OF SIGNALS AND OTHER CONSTRUCTIONS BELONGING TO THE INFRASTRUCTURE OF INLAND WATERWAYS
Article 28. Establishment and Maintenance of Signals for Inland Waterways
1. Establishing signals for inland waterways is the act of agencies, organizations, and individuals installing signals on inland waterways, at the location of works, obstacles, and areas with activities affecting the safety of inland waterway traffic. Established signals must comply with national technical standards for inland waterway signals in Vietnam.
2. Works on inland waterways must establish signals, including:
a) Inland waterway channels;
b) Ports, inland waterway wharves, mooring areas;
c) Ship locks, structures for passing dams, rapids;
d) Dikes, dams, bridges, ferry terminals, fishing ports;
đ) Wind power plants, thermal power plants, hydroelectric power plants;
e) Structures crossing over the channel above or below the channel bottom;
g) Obstacles;
h) Floating restaurants, floating hotels (when moored);
i) Other structures.
3. Activities on inland waterways must establish signals, including:
a) Construction activities; exploration, resource extraction;
b) Aquaculture and marine farming areas (fish cages, fish pens, fish ponds, aquaculture and marine farming sites); organizing entertainment, sports events, festivals; markets, craft villages; training activities on inland waterways, channel protection zones, waters outside the channel range with transport activities, or within port and inland waterway wharf waters;
c) Areas organizing traffic regulation, permanent anti-drift support, traffic restriction;
d) Other activities affecting the safety of inland waterway traffic.
4. Responsibility for Approving Signal Plans and Establishing and Maintaining Signals on Inland Waterways
a) The Vietnam Inland Waterway Administration is responsible for approving signal plans and organizing the establishment and maintenance of the signal system on national channels;
b) The Department of Transport and Communications is responsible for approving signal plans and organizing the establishment and maintenance of the signal system on local channels;
c) Organizations and individuals with dedicated channels are responsible for establishing and maintaining the signal system on dedicated channels;
d) Owners of works, organizations, and individuals causing obstacles; organizations and individuals organizing activities on inland waterways are responsible for establishing and maintaining signals according to regulations throughout the construction period of the work, organization of activities, and the existence period of the work and obstacles;
đ) Units managing and maintaining inland waterways, organizations, and individuals managing dedicated inland waterways are responsible for establishing signals when vessels suffer accidents sinking, or other unexpected situations causing traffic safety hazards on channels and channel protection zones. They must report immediately to the Regional Inland Waterway Management Agency or the Department of Transport and Communications.
5. Costs for Establishing Signals for Inland Waterways
a) Funding for establishing and maintaining the signal system on national channels and local channels, except for signals specified in point e, Clause 4 of this Article, is guaranteed by the state budget according to the budget hierarchy;
b) Funding for establishing and maintaining the signal system on dedicated channels is borne by the organizations and individuals with dedicated channels;
c) Funding for establishing and maintaining signals at works, obstacles, and activity areas specified in point d, Clause 4 of this Article is borne by the owners of works and obstacles, and organizations and individuals organizing activities.
d) For traffic signs at waterway infrastructure projects funded from the state budget within the management scope of the Ministry of Transport on national inland waterways, after completing the installation of traffic signs, the project investor shall hand over the traffic signs as assets to the Vietnam Inland Waterways Administration for management and maintenance in accordance with regulations.
đ) For traffic signs at projects funded from the state budget within the management scope of the provincial People's Committee on local inland waterways, after completing the installation of traffic signs, the project investor shall hand over the traffic signs as assets to the Department of Transport for management and maintenance in accordance with regulations.
6. The Minister of Transport shall issue national technical standards for traffic signs on Vietnam's inland waterways.
Article 29. Competence and procedures for agreeing to establish traffic signs on inland waterways for construction works and activities
1. The following traffic signs must be agreed upon before establishment:
a) Special-purpose channel traffic signs;
b) Traffic signs for structures specified in points d, đ, e Clause 2 and those stipulated in Clause 3, Article 28 of this Decree.
2. Competence to agree to establish traffic signs
a) The Regional Inland Waterways Directorate agrees to establish traffic signs for special-purpose channels connecting to national channels, structures, and areas of activity specified in point b Clause 1 of this Article on national inland waterways and special-purpose channels connecting to national inland waterways, except for traffic signs established at ports and inland waterway wharves;
b) The Department of Transport agrees to establish traffic signs for special-purpose channels connecting to local channels, structures, and areas of activity specified in point b Clause 1 of this Article on local inland waterways and special-purpose channels connecting to local inland waterways.
3. Content of Agreement
a) Location of traffic signs;
b) Quantity, size of traffic signs;
c) Type of traffic signs.
4. Documents for agreeing to establish traffic signs
a) A request for agreement to establish traffic signs according to Model No. 22 attached to this Decree;
b) A schematic diagram of the proposed location of traffic signs.
5. Procedure for Agreement
a) Organizations or individuals establishing traffic signs submit one set of documents directly or through postal services or other appropriate means to the competent authority as stipulated in Clause 2 of this Article;
b) Within five working days from the date of receipt of complete documents as prescribed, the competent authority as stipulated in Clause 2 of this Article shall send a document agreeing to establish traffic signs to the project investor.
c) Organizations or individuals managing special-purpose waterways have the responsibility to notify the establishment and put traffic signs into use on special-purpose channels according to Model No. 23 attached to this Decree.
Article 30. Investment in constructing other infrastructure works on inland waterways
Investment in constructing berthing facilities, structures for vessel passage over dams and rapids; revetments, transport dams; high-water marks, coordinate markers, boundary markers for waterway protection zones, watch stations, and auxiliary structures must comply with laws on investment construction, fire prevention, environmental protection, and climate change adaptation; have technological plans and design suitable for construction quality, safety during operation, exploitation, and use of the works.
Mục 5. PROTECTION OF STRUCTURES IN THE INFRASTRUCTURE OF INLAND WATERWAYS
Article 31. General Provisions on Protection of Structures in the Infrastructure of Inland Waterways
1. Structures in the infrastructure of inland waterways must be protected to maintain their normal operation in accordance with the Law on Navigation of Inland Waterways and this Decree. Acts of encroachment, demolition, dredging, dismantling of the infrastructure of inland waterways contrary to regulations must be promptly detected, prevented, and dealt with according to the provisions.
2. Before putting structures in the infrastructure of inland waterways into operation and use, the project investor shall have the responsibility to notify in writing to the People's Committee of the commune where the structure is located for cooperation in protecting the structure. The notification content must clearly state the name of the structure, its scale, function, and the time of putting the structure into operation and use.
Article 32. Contents of Protection of Structures in the Infrastructure of Inland Waterways
1. Contents of protection of structures in the infrastructure of inland waterways as prescribed by the Law on Navigation of Inland Waterways and this Decree.
2. Protection of channels of inland waterways
a) Channels that are announced and put into use must be maintained according to design standards or channel standards based on technical levels and the ability to allocate state budget funds;
b) Structures passing through overhead, underwater, and land channels must ensure safe heights and depths of the channel bottom according to published technical standards for inland waterway channels;
c) Within the channel range, fixed fishing gear and unauthorized mineral extraction activities must not be placed;
d) It is not allowed to dump soil, mud, sand, or other waste materials causing sedimentation and changing the depth of the channel bottom.
3. Protection of Channel Protection Zones
a) The scope of the channel protection zone must be maintained at its size and not narrowed or illegally encroached upon;
b) Within the channel protection zone, buildings and other structures may not be constructed, natural resources may not be exploited without approval from competent authorities; fixed fishing gear may not be placed within the channel protection zone;
c) When the channel changes into the channel protection zone, structures, mining, aquaculture, craft villages, floating markets must be relocated, reduced in size, or cleared of obstructions within the new channel range.
4. For other structures in the infrastructure of inland waterways, the following acts shall not be carried out:
a) Storing materials, means of transport, equipment causing erosion or damage to the structures;
b) Anchoring or tying vessels, animals to warning buoys, signal poles, water level markers, measurement markers, coordinate markers, boundary markers of the channel protection zone;
c) Using explosives or mining minerals in violation of regulations or engaging in other acts affecting the structures;
d) Discharging harmful substances affecting the durability and lifespan of the structures.
Article 33. Scope of Channel Protection Zones
The scope of the channel protection zone is determined from the edge of the channel outward on each side. For channels already included in approved planning, it is determined according to the technical level of the planning, specifically as follows:
1. Scope of the channel protection zone when the channel does not abut the shore
a) For inland waterway channels on lakes, bays, river mouths to the sea, coastal areas, and special-grade channels: from 20 meters to 25 meters;
b) For inland waterway channels of Grade I and Grade II: from 15 meters to 20 meters;
c) For inland waterway channels of Grade III and Grade IV: from 10 meters to 15 meters;
d) For inland waterway channels of Grade V and Grade VI: 10 meters.
2. Scope of the channel protection zone when the channel abuts the shore is calculated from the natural shoreline inward by at least 5 meters; in cases where the channel passes through urban areas, towns, or townships, the scope of the channel protection zone is the red line according to the approved planning.
3. Based on the characteristics of each area, the Vietnam Inland Waterways Administration, in conjunction with the Department of Transport, shall work with the Department of Natural Resources and Environment to determine the specific natural shoreline for the protection of the infrastructure of inland waterways.
4. If the scope of the channel protection zone overlaps with the safety zone of road bridges or railway bridges, the scope of the channel protection zone is calculated from the edge of the channel to the natural shoreline and implemented according to the laws on protecting the safety zones of road bridges and railway bridges.
5. If the scope of the channel protection zone overlaps with the protection zone of maritime channels, it shall be implemented according to the laws on protecting the maritime channel protection zone.
6. If the scope of the channel protection zone overlaps with the protection range of flood prevention works, dyke protection works, and water conservancy works, it shall be implemented according to the laws on flood prevention, dyke protection, and the laws on exploitation and protection of water conservancy works.
7. If the scope of the channel protection zone overlaps with the safety protection zone of water sources, it shall be implemented according to the laws on protecting the channel protection zone.
8. When establishing a new investment project for construction or upgrading and expanding inland waterway channels, the project investor must base on the planning of the infrastructure of inland waterways to clearly define the technical grade of the inland waterway channels, and simultaneously determine the scope of the channel protection zone, and implement boundary markers after completing the project.
Article 34. Management of Navigation Channel Protection Zones
1. Establishment of management files for navigation channel protection zones
a) The management file for navigation channel protection zones must update information on structures affecting inland waterway safety, scope, time of appearance, and handling process; boundary markers of the navigation channel protection zone;
b) The Vietnam Inland Waterways Administration shall organize the establishment of national navigation channel protection zone management files, the Department of Transport and Roads shall organize the establishment of local navigation channel protection zone management files, organizations and individuals with dedicated channels shall establish management files for dedicated channel protection zones.
2. When the navigation channel protection zone changes, the Vietnam Inland Waterways Administration, the Department of Transport and Roads, organizations and individuals with dedicated channels must notify the owners of structures, organizations, and individuals conducting activities on inland waterways to implement relocation, narrowing, or removal of obstructions.
3. Organizations and individuals managing channels must set up boundary markers for navigation channel protection zones and inform the People's Committee of the commune where the boundary markers are located to cooperate in protection.
Article 35. Responsibilities for protecting inland waterway infrastructure works
1. Organizations and individuals entrusted with managing works have the responsibility to take the lead and coordinate with People's Committees at all levels to protect works belonging to inland waterway infrastructure.
2. Organizations and individuals who discover damage to works belonging to inland waterway infrastructure must promptly report to the People's Committee of the commune, the inland waterway management unit, or the nearest public security agency. Agencies and units receiving the report must require the owner of the work to promptly implement measures to ensure smooth and safe traffic.
Chapter III. MANAGEMENT OF INVESTMENT AND CONSTRUCTION OF WORKS NOT BELONGING TO INLAND WATERWAY INFRASTRUCTURE ON INLAND WATERWAYS
Article 36. General provisions on investment and construction of works not belonging to inland waterway infrastructure and related activities involving inland waterways
1. Projects for construction that do not belong to inland waterway infrastructure and activities specified in Clause 2 and Clause 3 of this Article relating to inland waterway traffic, navigation channel protection zones, or within port waters, inland waterway wharfs, anchorage areas, when establishing investment projects and organizing activities, must agree with the competent authority prescribed in Clause 1 of Article 37 of this Decree.
2. Construction works include:
a) Works serving defense and security tasks;
b) Riverbank protection structures, hydropower dams, bridges, ferry terminals;
c) Wind power, thermal power, hydropower plants;
d) Structures crossing over or under the bottom of navigation channels;
đ) Other structures affecting inland waterway traffic safety.
3. Activities include:
a) Construction work activities (including dredging of port waters, inland waterway wharfs, anchorage areas); resource exploitation, mineral extraction;
b) Aquaculture and marine farming areas (fish cages, fish pens, rafts, fish ponds, aquaculture and marine farming sites); organization of recreational, entertainment, drill, sports, festival activities; market meetings, craft villages, vocational training practice activities;
c) Other activities affecting inland waterway traffic safety.
Article 37. Competence to agree on matters related to inland waterways for works not belonging to inland waterway infrastructure and activities on inland waterways
1. Competence to agree
a) The Ministry of Transport agrees on defense and security works and activities related to inland waterway traffic on national inland waterways and dedicated inland waterways connected to national inland waterways;
b) Provincial People's Committees agree on defense and security works and activities related to inland waterway traffic on local inland waterways and dedicated inland waterways connected to local inland waterways;
c) The Vietnam Inland Waterways Administration agrees on matters related to inland waterways for works and activities on national inland waterways and dedicated inland waterways connected to national inland waterways, navigation channel protection zones, except in cases provided for in point a of this clause;
d) Departments of Transport and Roads agree on matters related to inland waterways for works and activities on local inland waterways and dedicated inland waterways connected to local inland waterways, navigation channel protection zones, except in cases provided for in point b of this clause.
đ) Port Authorities, Departments of Transport and Roads (where there is no Port Authority) agree on activities such as dredging and improving port waters, inland waterway wharfs, anchorage areas within their jurisdiction.
2. Content of agreement
a) For permanent bridges, temporary bridges: location of construction, dimensions of navigable clearance (width, height above water level);
b) For rotating bridges, lifting bridges, pontoon bridges, combined hydropower and transportation works: location of construction, dimensions of navigable clearance (width, height above water level, length, depth of berth threshold);
c) For overhead pipelines, cables, structures crossing over navigation channels: location of construction, overhead clearance of pipelines, cables, structures crossing over navigation channels;
d) For underground structures, pipelines, cables under the bottom of navigation channels: location of construction; depth from the top of underground structures, pipelines, cables;
đ) For construction work areas, resource exploitation, mineral extraction: location, scope of exploitation area, dredging depth, exploitation height;
e) Aquaculture and marine farming areas, placement of fixed fishing gear, vocational training practice activities; placement of floating restaurants, hotels; areas for markets, craft villages, recreational and entertainment areas: location, scope of activity.
Article 38. Procedures for Agreement on Content Related to Inland Waterways for Construction Projects Not Belonging to Inland Waterway Infrastructure and Activities on Inland Waterways
The project investor, organization, or individual organizing activities shall submit one set of documents directly or through other appropriate means to the competent authority specified in Clause 1, Article 37 of this Decree to agree on matters related to inland waterways. The dossier includes:
1. A request for agreement on construction of the project according to Model No. 24 attached to this Decree.
2. A cross-section drawing of the project showing its location across the river.
3. A drawing of the construction area on the national coordinate system VN2000, national elevation system. On the drawing, indicate the position of the project and natural elevations, topography, and objects of the river, canal within the construction area, adjacent projects (if any), and the following documents:
a) For permanent bridges, temporary bridges: data on the navigable clearance (location, width, height above waterline); longitudinal section drawings of the project shown across the river, canal;
b) For rotating bridges, lifting bridges, pontoon bridges, floating bridges, hydropower projects with transportation functions: data on the navigable clearance (location, width, height above waterline, length, depth at the wharf threshold); plans and technology for opening and closing; design drawings of the position and water areas planned for mooring vessels while waiting to pass through the project;
c) For pipelines, overhead lines, structures crossing air channels: drawings, data on the height above waterline, indicating the highest point of the pipeline, overhead line (lowest point of the overhead line including the safety zone of the power grid), structure crossing the channel;
d) For underground structures, pipelines under the channel bottom: drawings showing the distance, elevation of the top of the structure from the designed channel bottom elevation, scope of the channel and protection zone of the inland waterway channel;
e) For dam, hydropower, irrigation projects: plan and drawing of the port, inland waterway berth or cargo transfer area upstream and downstream of the project; loading and unloading plans;
f) For defense and security projects; wind power, thermal power projects; ferry terminals, revetments: drawings showing the layout of the port area; revetment structures, other rectification works; dimensions and structures of berths, revetments, other rectification works, and auxiliary structures; port water areas.
4. For activities specified in Clause 3, Article 36 of this Decree,the dossier includes:
a) A request for agreement according to Model No. 24 attached to this Decree;
b) Drawings showing the scope of the activity area, channel scope, and protection zone, distance to related structures in the area, and plans for traffic safety signaling on inland waterways;
c) Cross-sectional drawings and marker documents to determine the scope, dredging elevation, resource extraction (for activities involving dredging and improving port and inland waterway berth waters, dedicated channel waters for ports and inland waterway berths, anchorage areas; resource and mineral extraction).
5. Within five working days from the date of receipt of complete documents as prescribed, the competent authority specified in Clause 1 of Article 37 of this Decree shall issue an agreement document to the project investor.
Article 39. Notification of Putting Non-Inland Waterway Infrastructure Works into Operation
1. Within five working days from the date of completion acceptance of the works to be put into operation, the project investor shall send a written notification to the Inland Waterway Administration Region (for works on national inland waterways, channel protection zones, areas outside the scope of national channels, dedicated inland waterways connecting with national inland waterways) and the Department of Transport (for works on local inland waterways, channel protection zones, areas outside the scope of local channels, dedicated inland waterways connecting with local inland waterways).
2. Contents of the notification
a) Name of the work;
b) Location (mileage, place name, coordinates);
c) Main parameters of the work;
d) Time of commencement of exploitation.
3. The notification of putting non-inland waterway infrastructure works into operation shall be made according to Model No. 25 attached for implementation under this Decree.
Chapter IV. SAFETY, SECURITY, ENVIRONMENTAL PROTECTION IN INLAND WATERWAY ACTIVITIES
Section 1. ENSURING SAFETY IN INLAND WATERWAY ACTIVITIES
Article 40. Ensuring Safety in Cases of Restricted Traffic
1. Cases of restricted traffic on inland waterways include:
a) Obstacles on the channel causing hindrance to traffic;
b) Construction of works on the channel, channel protection zones, port waters, inland waterway berths, anchorage areas, and unorganized waters with transport activities that create situations affecting traffic safety;
c) Works on inland waterways limiting the channel standards already published;
d) Activities for disaster prevention and control, rescue, and relief;
đ) National defense and security activities;
e) Activities such as drills, sports, festivals, entertainment, vocational training practice, and market fairs.
2. Authority to Announce Restricted Traffic
a) The Vietnam Inland Waterway Administration announces restricted traffic for cases ensuring national defense and security on national inland waterways, dedicated inland waterways connecting with national inland waterways, and unorganized waters with transport activities adjacent to national channel protection zones;
b) The Inland Waterway Administration Region announces restricted traffic for cases stipulated in Clause 1 of this Article on national inland waterways, dedicated inland waterways connecting with national inland waterways, and unorganized waters with transport activities adjacent to national channel protection zones, except for cases stipulated in point a of this clause;
c) The Department of Transport announces restricted traffic for cases stipulated in Clause 1 of this Article on local inland waterways, dedicated inland waterways connecting with local inland waterways, and unorganized waters with transport activities within the province or centrally-administered city, except for the waters stipulated in points a and b of this clause;
d) The Port Office announces restricted traffic in port waters, inland waterway berths, and anchorage areas within its management scope.
3. Procedures for Announcing Restricted Inland Waterway Traffic
a) Before commencing construction of works or organizing activities on inland waterways, the project investor or the organization or individual conducting the construction or organizing the activity shall submit a written request for announcing restricted inland waterway traffic (clearly stating the location and time of restricted construction) and the approved traffic safety assurance plan to the competent authority specified in Clause 2 of this Article;
b) Within five working days from the date of receiving complete files as prescribed, the competent authority specified in Clause 2 of this Article shall issue a written announcement of restricted inland waterway traffic to the project investor or the organization or individual;
c) In case of sudden obstacles; activities for disaster prevention and control, rescue, and relief on inland waterways that limit the published channel standards, the competent authority specified in Clause 2 of this Article shall determine traffic safety assurance measures based on actual requirements and announce restricted inland waterway traffic.
4. The Minister of Transport shall provide detailed regulations on traffic control and restriction measures to ensure traffic safety, prevent drifting, and restrict inland waterway traffic.
Article 41. Traffic Safety Assurance Plan for Inland Waterway Transport
1. Projects constructing works or areas of operation related to inland waterway transport (on channels, channel protection zones, port waters, inland waterway wharves, anchorage areas, and unorganized waters with transportation activities) as specified in Clause 2 and Clause 3 of Article 36 of this Decree must have traffic safety assurance plans and measures throughout the construction period of the work and during the organization of operations. 2. Responsibility for establishing and implementing the plan
The project investor or construction contractor, organizations, or individuals organizing activities related to inland waterway transport shall be responsible for establishing and implementing the traffic safety assurance plan that has been approved by the competent authority.
3. Authority to approve the traffic safety assurance plan
a) The Vietnam Inland Waterways Administration shall approve the traffic safety assurance plan for works and activities ensuring national defense and security on national inland waterways and specialized inland waterways connected to national inland waterways;
b) Regional Inland Waterways Management Agencies shall approve the traffic safety assurance plan for works and activities on national inland waterways; specialized inland waterways connected to national inland waterways, and unorganized waters with transportation activities adjacent to national channel protection zones, except in cases stipulated in point a and point d of this clause;
c) Departments of Transportation shall approve the traffic safety assurance plan for works and activities on local inland waterways; specialized inland waterways connected to local inland waterways, and unorganized waters with transportation activities within the province or centrally governed city, except in cases stipulated in point d of this clause. Based on actual circumstances, the Department of Transportation shall submit to the provincial People's Committee for authorization and delegation to the district People's Committee to approve the traffic safety assurance plan;
d) Port Supervision Units shall approve the traffic safety assurance plan for repair, renovation, upgrading, and other activities within port waters, inland waterway wharves, and anchorage areas under their management.
4. Contents of the traffic safety assurance plan
a) General information about the work, investment construction projects, and organized activities;
b) Construction and activity implementation timeframes;
c) Construction and activity implementation plans;
d) Measures to ensure traffic safety;
đ) Organization and coordination plan for implementing traffic safety assurance.
5. Documents for requesting approval of the traffic safety assurance plan
a) Request for approval of the traffic safety assurance plan according to Model No. 26 attached to this Decree;
b) Construction implementation plan, construction time, and progress;
c) Traffic safety assurance plan;
d) Copy of the overall layout drawing of the work, construction area, and organized activity area.
6. Approval procedure
a) Before commencing construction or organizing activities as specified in Clause 1 of this Article, the project investor or organization or individual shall submit one set of documents directly or through appropriate means to the competent authority specified in Clause 3 of this Article to request approval;
b) Within five working days from the date of receipt of complete documents as prescribed, the competent authority specified in Clause 3 of this Article shall issue a document approving the traffic safety assurance plan to the project investor or organization or individual.
7. In case of accidents or incidents on inland waterways due to force majeure causing traffic disruption, the Vietnam Inland Waterways Administration or the Department of Transportation or organizations or individuals with dedicated channels must promptly organize the establishment and implementation of a traffic assurance plan at the accident or incident site.
8. Ensuring traffic safety for dredging activities in inland waterway channels, port waters, inland waterway wharves, and anchorage areas shall be carried out in accordance with the Government's regulations on dredging inland waterway waters.

Mục 2. SECURITY AT INLAND WATERWAY PORTS RECEIVING FOREIGN WATERBORNE VESSELS AND DOMESTIC WATERWAY TRAFFIC
Article 42. Security at inland waterway ports receiving foreign waterborne vessels
1. Security at inland waterway ports receiving foreign waterborne vessels means the implementation of measures to ensure security and safety for persons, vessels, and facilities at the port through organizing security assessments, developing security plans approved by competent authorities, and issuing appropriate security certificates for inland waterway ports receiving foreign waterborne vessels.
2. Security measures apply to foreign waterborne vessels and international route ships with a gross tonnage of 500 GT or more.
3. Security levels for inland waterway ports receiving foreign waterborne vessels are divided into three levels.
a) Security Level 1 is a level where appropriate security protection measures must be maintained continuously;
b) Security Level 2 is a level where additional security protection measures must be maintained during periods of high risk of a security incident;
c) Security Level 3 is a level where specific security protection measures must be maintained during limited periods when a security incident may occur or is imminent, even though the specific target may not be identified.
4. Security measures for inland waterway ports receiving foreign waterborne vessels must be appropriate to each security level.
a) Security Level 1 ensures the continuous implementation of all security tasks in the security plan; monitoring all activities occurring within the port area; controlling restricted areas within the port; inspecting and supervising cargo handling areas; inspecting and supervising the activity of receiving supplies for vessels; ensuring timely exchange of security information;
b) Security Level 2 implements additional protective measures specified in the security plan for each activity mentioned in point a of this clause;
c) Security Level 3 implements enhanced special protective measures specified in the security plan for each activity mentioned in point a of this clause.
5. Security assessment for inland waterway ports receiving foreign waterborne vessels shall be organized and implemented initially and annually by the port operator according to Model No. 27 attached as an appendix to this Decree, with the participation of representatives from specialized state management agencies at the port.
6. Security plan for inland waterway ports receiving foreign waterborne vessels
a) The security plan for inland waterway ports receiving foreign waterborne vessels (hereinafter referred to as the security plan) shall be established by the port operator according to Model No. 28 attached as an appendix to this Decree and submitted to the competent authority for approval to ensure the application of port protection measures, for persons, vessels, goods, cargo transportation units, vessel supplies within the port range, avoiding risks of a security incident;
b) The security plan must be developed and maintained based on the security assessment of inland waterway ports. The security plan must provide appropriate measures for each security level stipulated in Clause 3 of this Article.
7. Port security commitment for inland waterway ports receiving foreign waterborne vessels is carried out based on the assessment of potential risks that may arise from communication activities between waterborne vessels and ports or between waterborne vessels themselves concerning persons, property, and the environment according to Model No. 29 attached as an appendix to this Decree.
8. The security commitment must be established by the master or security officer of foreign waterborne vessels, ships, or port security personnel or organizations responsible for shore-based security on behalf of the port owner and must be committed by the port owner or vessel owner to implement appropriate security measures corresponding to the security level of the port or foreign waterborne vessels, ships. The owner of foreign waterborne vessels, ships, or the port owner may request a security commitment in any of the following cases:
a) Foreign waterborne vessels, ships have a higher security level than the port, anchorage area, or other foreign waterborne vessels they are communicating with;
b) There is an agreement on security commitments between countries for certain international routes or for specific vessels on those routes;
c) There has been a security threat or security incident related to foreign waterborne vessels, ships, or the port;
d) Foreign waterborne vessels, ships are in the port but do not require the port to have and enforce an approved security plan for inland waterway ports;
đ) Foreign waterborne vessels, ships are conducting communication activities with other foreign waterborne vessels, ships, but do not require having and enforcing an approved security plan for foreign waterborne vessels, ships;
e) The content of the security commitment must be committed by port security personnel or the master or security officer of foreign waterborne vessels, ships to implement appropriate security measures corresponding to the security level of the port and foreign waterborne vessels, ships.
9. Staff, civil servants, officials of specialized management agencies, employees of port enterprises engaged in security work at inland waterway ports must complete training courses on port security at training institutions specializing in security according to the approved port security training program by the Ministry of Transport and obtain a certificate of completion of the training course.
Article 43. Procedures for Approving Security Assessments, Security Plans, and Issuing Security Compliance Certificates for Inland Waterway Ports Receiving Foreign Vessels
1. The port management shall prepare the dossier in accordance with Clauses 2, 3, and 4 of this Article and submit three copies directly or through other appropriate means to the Port Office.
2. The dossier for requesting approval of the security assessment includes:
a) A request for approval of the security assessment in Form No. 30 attached to this Decree;
b) The security assessment prepared in accordance with Clause 5 of Article 42 of this Decree; c) Participants in the security assessment meeting include: the county police agency, the Border Guard Post at the port, the provincial traffic police department, the Customs Branch, the Port Office, the county preventive health center, the county plant quarantine agency, and the animal quarantine agency at the border.;
3. The dossier for requesting approval of the security plan and issuance of the security compliance certificate for inland waterway ports receiving foreign vessels includes:
a) A request for approval of the security plan and issuance of the security compliance certificate for inland waterway ports receiving foreign vessels in Form No. 31 attached to this Decree;
b) The security assessment that has been approved by the competent authority;
c) The security plan.
4. The dossier for annual confirmation of the security compliance certificate includes:
a) A request for annual confirmation of the security compliance certificate for inland waterway ports receiving foreign vessels in Form No. 32 attached to this Decree;
b) The security assessment must have comments from the agencies specified in point c of Clause 2 of this Article;
c) Minutes of training sessions, drills, or exercises according to the approved security plan;
d) The original security compliance certificate (to be confirmed on the back page of the certificate).
5. Within five working days from the date of receipt of all required documents, the Port Office shall review the dossier and report the results of the review along with two copies of the dossier to the Vietnam Inland Waterways Administration. Within five working days from the date of receipt of all required documents and the report from the Port Office, the Vietnam Inland Waterways Administration shall approve the security assessment, security plan, and issue the security compliance certificate for inland waterway ports receiving foreign vessels, and annually confirm the security compliance certificate for inland waterway ports receiving foreign vessels.
The security assessment approval certificate, the security plan approval certificate, and the security compliance certificate for inland waterway ports receiving foreign vessels shall be in Forms No. 33, No. 34, and No. 35 attached to this Decree.
6. The security compliance certificate for inland waterway ports receiving foreign vessels is valid for five years and must be annually confirmed by the Vietnam Inland Waterways Administration.
Article 44. Inspection and Supervision of Security at Inland Waterway Ports Receiving Foreign Vessels
1. The Vietnam Inland Waterways Administration and the Port Office, within their assigned functions, tasks, and authorities, organize inspections, supervision, and handling of violations related to security work at inland waterway ports. The list of items to be inspected for security work at inland waterway ports is in Form No. 36 attached to this Decree.
2. The port management is responsible for organizing inspections of the implementation of security work to serve the purpose of conducting security assessments and developing security plans.
3. Foreign vessels and ships entering or leaving inland waterway ports receiving foreign vessels must comply with maritime laws and regulations on security and safety as applicable to vessels entering or leaving Vietnamese seaports, except where otherwise provided by law.
4. The port management of inland waterway ports receiving foreign vessels must ensure conditions for safety and security in accordance with the provisions.
4. Managers operating inland waterway ports receiving foreign watercraft must ensure safety and security conditions as prescribed.
Article 45. Inland Waterway Pilots
1. Mandatory Pilotage System
Foreign inland waterway vessels operating on inland waterways or entering, leaving inland waterway ports must be accompanied by a pilot, except for inland waterway vessels of the Kingdom of Cambodia operating in accordance with the Agreement between the Government of the Socialist Republic of Vietnam and the Royal Government of Cambodia on inland waterway transport. In case of necessity, the master of the vessel may request pilotage services.
2. Inland Waterway Pilotage Activities
Section 3. ENVIRONMENTAL PROTECTION IN INLAND WATERWAY ACTIVITIES
Article 46. Environmental Protection in Investment Construction, Maintenance, Renovation, and Upgrading of Inland Waterway Infrastructure
1. The project owner of construction, maintenance, renovation, and upgrading projects of inland waterway infrastructure shall have the responsibility to:
a) Organize the preparation of environmental impact assessment reports or environmental protection plans to submit to the competent authority for approval or confirmation in accordance with the laws on environmental protection;
b) Determine and allocate funds for environmental protection work within the total investment amount of the project; incorporate waste treatment measures and measures to minimize adverse impacts on the environment into the basic design, technical design, and tender documents, and contracts with construction contractors of the project, as approved or confirmed by the competent authority;
c) Organize management, supervision, and report to the competent state authorities on environmental protection work during the construction of the project in accordance with the laws on construction and environmental protection.
2. Construction contractors must comply with the provisions of the laws on environmental protection, environmental technical standards, and fully meet the requirements for environmental protection stipulated in the contract signed with the project owner.
3. Environmental monitoring and supervision consulting contractors must follow environmental monitoring technical procedures, environmental technical standards, and bear responsibility before the project owner and the law for information and data created during the implementation of environmental monitoring and supervision work.
Article 47. Environmental Protection in Port and Wharf Operations
The person managing the operation of ports and wharfs shall have the responsibility to:
1. Develop and implement oil spill response plans in accordance with regulations for oil trading ports and wharfs.
2. Allocate personnel to manage and carry out environmental protection work at ports and wharfs.
3. Collect and treat wastewater generated during port and wharf operations to ensure compliance with environmental technical standards; conduct periodic wastewater monitoring before and after treatment as required in the approved documentation; retain monitoring data to serve inspections of the wastewater treatment system's operation.
4. Collect, classify, and store various types of solid waste and hazardous waste generated during port and wharf operations for disposal or hire organizations with waste disposal functions to receive, transport, and dispose of such waste according to regulations.
5. Provide facilities, tools, and equipment at ports and wharfs to receive general solid waste from vessels, ships, foreign inland waterway vessels, and seaplanes; post and provide lists of organizations with waste disposal functions to receive, transport, and dispose of hazardous waste generated from vessels, ships, foreign inland waterway vessels, and seaplanes.
6. Minimize dust and limit noise and vibration that adversely affect the surrounding environment and workers.
7. Arrange isolation and ensure safe distances in receiving and storing dangerous goods and flammable and explosive goods in accordance with regulations.
Article 48. Environmental Protection in the Activities of Building New, Repairing, Converting, Restoring, and Dismantling Vessels
The owner of the facility for building new, repairing, converting, restoring, and dismantling vessels shall be responsible for:
1. Developing and implementing environmental protection plans and oil spill response plans in accordance with regulations.
2. Assigning personnel to manage and carry out environmental protection work within the facility's operations.
3. Collecting and treating wastewater, solid waste, and hazardous waste generated during the facility's operations in accordance with regulations.
Article 49. Environmental Protection for Vessels, Ships, Seaplanes, and Foreign Watercraft Operating on Inland Waterways
1. Ships must comply with national technical standards regarding ship systems to prevent marine pollution.
2. Vessels must comply with national technical standards concerning the prevention of pollution caused by inland waterway vessels.
3. Management of General Waste
a) Vessels, ships, foreign watercraft operating on inland waterways and coastal routes must cover goods to prevent them from falling off, causing dust pollution;
b) Waste and pollutants from vessels, ships, foreign watercraft must be collected and stored on board until transferred to port reception facilities or handed over to organizations authorized to handle such waste according to regulations;
c) Vessels, ships, foreign watercraft must be equipped with wastewater treatment devices or storage tanks before being moved ashore for treatment;
d) Information about dumping waste must be recorded in the vessel's garbage logbook;
đ) If the vessel carries goods that may cause pollution, preventive measures corresponding to those goods must be taken;
4. Management of Hazardous Waste
Vessels, ships, foreign watercraft, seaplanes generating hazardous waste must comply with legal provisions governing hazardous waste management.
5. No discharge of oil, ballast water, cooling water, or water mixed with oil containing pollutants into the environment beyond permissible environmental standards; no use of oil dispersants in water bodies.
6. Upon discovering a risk or act of environmental pollution or an oil spill, the person in charge of the vessel, ship, foreign watercraft must immediately apply effective countermeasures and report the environmental pollution incident or potential oil spill to the nearest specialized administrative agency.
7. Vessels, ships, seaplanes, foreign watercraft operating on inland waterways, within port waters, inland port berths, anchorage areas must be subject to inspection and supervision by specialized state administrative agencies regarding environmental protection regulations.
8. Vessels, ships, seaplanes, foreign watercraft moored in port waters, inland port berths, anchorage areas must not engage in the following activities:
a) Cleaning chimneys or emitting black smoke;
b) Washing cargo holds or decks causing environmental pollution;
c) Pumping out dirty water, oil, water mixed with oil residues, and other harmful liquids;
d) Dumping garbage or other solid waste from the vessel, ship into the water or onto wharves, inland port berths;
đ) Rust removal or painting the vessel causing environmental pollution.
9. The master of vessels, ships, seaplanes, foreign watercraft when operating on inland waterways and within port waters, inland port berths must comply with the following requirements:
a) When discovering a risk or act of environmental pollution, immediately notify the Port Authority and record the time, location, and nature of the pollution incident in the vessel's logbook;
b) If the pollution incident arises from the vessel's own operation, immediately apply effective countermeasures and promptly inform the Port Authority.
10. The person in charge of vessels, ships, foreign watercraft causing environmental damage or pollution must compensate and be dealt with according to regulations.
Chapter V. PROCEDURES FOR VESSELS ENTERING AND LEAVING PORTS, INLAND PORT BERTHS, ANCHORAGE AREAS
Article 50. Procedures for foreign watercraft, ships, seaplanes entering and leaving domestic inland ports and wharfs
1. Foreign watercraft, ships, seaplanes entering and leaving domestic inland ports and wharfs must complete procedures to obtain permission to enter and leave such ports and wharfs.
2. Prior to entering and leaving domestic inland ports and wharfs, the person handling the procedures must notify the port authority about the watercraft (registration number), the time of entry and departure from the port and wharf, and the type of cargo or passenger count. Notification can be made via text message, telephone, or other means. The master or operator of the watercraft may only bring the vessel into or out of the port and wharf with the consent of the port authority. The notification period shall be as follows:
a) Two hours before for cargo-carrying vessels;
b) One hour before for passenger-carrying vessels and seaplanes.
3. The procedures for entering and leaving domestic inland ports and wharfs can be carried out directly, through electronic procedures, or other methods as prescribed.
4. Foreign watercraft, ships, seaplanes entering and leaving domestic inland ports and wharfs must pay fees and charges as prescribed.
5. The provisions on procedures for entering and leaving domestic inland ports and wharfs set forth in this Decree do not apply to vessels entering and leaving such ports and wharfs for national defense and security purposes.
Article 51. Forms, Time, and Locations for Handling Procedures for Foreign Watercraft, Ships, Seaplanes Entering and Leaving Domestic Inland Ports and Wharfs
1. Forms for handling procedures for foreign watercraft, ships, seaplanes entering and leaving domestic inland ports and wharfs
a) Submitting and presenting documents directly at the Port Authority;
b) Electronic procedures through the Ministry of Transport's online portal (for domestic inland vessels, ships, and seaplanes);
c) Electronic procedures under the National Single Window mechanism (for international vessels, ships, and foreign watercraft);
d) Electronic procedures through the ASEAN Single Window mechanism;
e) Other forms as prescribed by law.
2. Time for handling procedures: within thirty minutes from the time all required documents are received, except for ships and foreign watercraft.
3. Location for handling procedures by submitting and presenting documents directly for foreign watercraft, ships, seaplanes handling procedures at the office of the Port Authority or at the port or wharf, or possibly on board the vessel (in cases where the vessel comes from an area affected by diseases related to people, animals, or plants).
4. The process of electronic procedures under the National Single Window mechanism and electronic procedures through the ASEAN Single Window mechanism shall be carried out in accordance with relevant laws.
Article 52. Documents for Issuing Permission to Enter Domestic Inland Ports for Vessels and Seaplanes
1. The person handling the procedures shall submit the following documents:
a) Departure permit from the port and wharf, in case of electronic procedures;
b) Passenger list (for passenger-carrying vessels).
2. The person handling the procedures shall present the original of the following documents:
a) Certificate of vessel registration (or certified copy from a financial institution if the vessel is mortgaged or pledged);
b) Technical safety and environmental protection certificate of the vessel;
c) Professional qualification certificates of crew members and operators;
d) Crew logbook (if available);
e) Transportation contract or warehouse exit invoice or cargo transport document;
f) Civil liability insurance (for vessels required by law to have civil liability insurance);
g) Flight eligibility certificate for seaplanes;
h) Dangerous goods transportation permit and oversized cargo transportation plan (for vessels carrying dangerous goods or oversized cargo).
3. The inspector must return the documents specified in Clause 2 of this Article to the person handling the procedures after inspection, unless otherwise provided by law.
4. If the documents specified in Clause 2 of this Article are stored in an electronic database, the person handling the procedures does not need to present them.
Article 53. Documents for Issuing Port Departure Permit for Vessels and Seaplanes at Inland Waterway Ports
1. The person handling the procedure shall submit and present the following documents:
a) Documents to be submitted: passenger list (for passenger transport vessels);
b) Documents to be presented: transportation contract or waybill or cargo export certificate; professional capability certification and crew member certificates if there are changes from when the vessel entered the port or inland waterway wharf.
2. For newly built, converted, or repaired vessels that are launched for operation, the vessel owner or the new construction, conversion, or repair facility must present to the Harbor Supervision Authority the following documents:
a) Inspection report confirming the vessel's operational readiness issued by the Inspection Agency;
b) Safety assurance plan during the vessel's launch prepared by the new construction, conversion, or repair facility.
Article 54. Inspection and Issuance of Permits for Vessels and Seaplanes Entering and Departing Ports and Inland Waterway Wharfs
1. The person handling the procedure may choose one of the forms prescribed in Clause 1 of Article 51 of this Decree to handle the procedures for vessels and seaplanes entering and departing ports and inland waterway wharfs, and in accordance with the following provisions:
a) In cases where the procedure is carried out directly at the location of the procedure, the person handling the procedure submits and presents the documents specified in Articles 52 and 53 of this Decree to the Harbor Supervision Authority;
b) In cases where the procedure is conducted electronically, the person handling the procedure provides the required documents on the electronic software (selected by the person handling the procedure). Articles 52 and 53 of this Decree 2. Inspection of Crew Member and Vessel Documents
a) In cases where documents are received directly from the person handling the procedure, the Harbor Supervision Authority checks the compliance of the documents according to the regulations;
b) In cases where documents are received through the electronic procedure, the Harbor Supervision Authority only checks based on the database without directly inspecting the vessel's, crew member's, or operator's documents, and will conduct a direct inspection if discrepancies are found.
b) In cases where documents are received through electronic procedures, the Port Supervision Authority will only check based on the database without directly inspecting the vessel's documents, crew members, and vessel drivers; if any errors are found, they will conduct a direct inspection.
3. Kiểm tra phương tiện
a) Cảng vụ kiểm tra phương tiện trên cơ sở giấy chứng nhận an toàn kỹ thuật và bảo vệ môi trường của phương tiện;
b) Nếu phát hiện có vi phạm thì Cảng vụ thông báo, xử lý và hướng dẫn người làm thủ tục có biện pháp khắc phục, thay đổi bảo đảm đúng quy định.
4. Phương tiện, thủy phi cơ được cấp giấy phép vào, rời cảng, bến thủy nội địa khi bảo đảm các điều kiện theo quy định tại Nghị định này.
5. Phương tiện được cấp phép rời cảng, bến thủy nội địa vẫn neo tại vùng nước cảng, bến thủy nội địa quá 24 giờ thì phải đổi lại giấy phép rời cảng, bến thủy nội địa để điều chỉnh thời gian rời cảng, bến thủy nội địa.
6. Giấy phép vào, rời cảng, bến thủy nội địa có thể là bản giấy hoặc giấy phép điện tử. Giấy phép vào, rời cảng, bến thủy nội địa của phương tiện, thủy phi cơ theo Mẫu số 37, Mẫu số 38 tại phụ lục ban hành kèm theo Nghị định này.
7. Giấy phép vào, rời cảng, bến thủy nội địa do Cảng vụ đường thủy nội địa cấp và giấy phép rời cảng biển, cảng, bến thủy nội địa do Cảng vụ Hàng hải cấp được lưu trữ bằng giấy hoặc điện tử. Thời gian lưu trữ giấy phép vào, rời cảng, bến thủy nội địa bằng giấy là 02 năm, kể từ ngày phát hành. Hết thời hạn lưu trữ, Cảng vụ, Cảng vụ Hàng hải có trách nhiệm hủy giấy phép vào, rời cảng, bến thủy nội địa.
Điều 55. Thủ tục vào, rời cảng thủy nội địa đối với phương tiện vận tải thủy qua biên giới Việt Nam - Campuchia
1. Đối với phương tiện thủy nội địa của Vương quốc Campuchia vào, rời cảng thủy nội địa Việt Nam và phương tiện Việt Nam rời cảng thủy nội địa Việt Nam đi Campuchia, ngoài các thủ tục quy định tại Điều 51, Điều 52, Điều 53 và Điều 54 Nghị định này, còn phải xuất trình giấy phép vận tải thủy qua biên giới do cơ quan có thẩm quyền cấp.
2. Trường hợp phương tiện thủy nội địa của Vương quốc Campuchia và phương tiện thủy Việt Nam nhập cảnh, xuất cảnh vào, rời cảng thủy nội địa Việt Nam áp dụng hình thức điện tử thì thực hiện theo quy định tại Điều 56, Điều 57 Nghị định này.
3. Phương tiện thủy nội địa của Vương quốc Campuchia và phương tiện thủy Việt Nam nhập cảnh, xuất cảnh vào, rời cảng thủy nội địa Việt Nam không áp dụng hình thức điện tử thì thực hiện theo hình thức nộp, trình giấy tờ trực tiếp tại Cảng vụ.
4. Khi phương tiện đến cửa khẩu phải xuất trình các loại giấy tờ đã làm thủ tục xuất cảnh tại cảng xuất cảnh cho các cơ quan quản lý nhà nước tại cửa khẩu kiểm tra trước khi phương tiện rời khỏi lãnh thổ Việt Nam.
5. Trường hợp phương tiện không thể xuất cảnh đi Campuchia theo kế hoạch, người làm thủ tục phải thông báo và nộp lại các loại giấy tờ đã làm thủ tục xuất cảnh tại cửa khẩu cảng xuất cảnh để hủy hồ sơ xuất cảnh.
6. Giấy phép rời cảng thủy nội địa cấp cho phương tiện Việt Nam và phương tiện thủy nội địa của Vương quốc Campuchia rời cảng thủy nội địa Việt Nam đi Campuchia theo Mẫu số 39 tại Phụ lục ban hành kèm theo Nghị định này.
Điều 56. Thủ tục điện tử đối với phương tiện thủy nội địa Việt Nam, Campuchia nhập cảnh vào cảng thủy nội địa Việt Nam
1. Chậm nhất 02 giờ, trước khi phương tiện dự kiến đến cửa khẩu, người làm thủ tục phải khai báo giấy tờ theo phương thức điện tử thông qua Cổng thông tin một cửa quốc gia, gồm:
a) Thông báo phương tiện đến cảng thủy nội địa theo Mẫu số 48 tại Phụ lục ban hành kèm theo Nghị định này;
b) Giấy phép rời cảng thủy nội địa theo Mẫu số 39 tại Phụ lục ban hành kèm theo Nghị định này;
c) Bản khai chung theo Mẫu số 40 tại Phụ lục ban hành kèm theo Nghị định này;
d) Danh sách thuyền viên theo Mẫu số 41 tại Phụ lục ban hành kèm theo Nghị định này;
đ) Danh sách hành khách theo Mẫu số 42 tại Phụ lục ban hành kèm theo Nghị định này;
e) Bản khai hàng hóa theo Mẫu số 43 tại Phụ lục ban hành kèm theo Nghị định này hoặc hợp đồng vận chuyển hoặc hóa đơn xuất kho hoặc giấy vận chuyển hàng hóa;
g) Bản khai kiểm dịch thực vật đối với hàng hóa thuộc diện kiểm dịch thực vật theo Mẫu số 44 tại Phụ lục ban hành kèm theo Nghị định này;
h) Bản khai kiểm dịch động vật đối với hàng hóa thuộc diện kiểm dịch động vật theo Mẫu số 45 tại Phụ lục ban hành kèm theo Nghị định này;
i) Bản khai vũ khí và vật liệu nổ (nếu có) theo Mẫu số 46 tại Phụ lục ban hành kèm theo Nghị định này;
k) Bản khai người trốn trên tàu (nếu có) theo Mẫu số 47 tại Phụ lục ban hành kèm theo Nghị định này.
2. Các giấy tờ phải xuất trình
a) Giấy tờ xuất trình cho Cảng vụ gồm: Giấy chứng nhận an toàn kỹ thuật và bảo vệ môi trường của phương tiện, giấy tờ liên quan đến hàng hóa vận tải trên phương tiện, giấy chứng nhận đăng ký phương tiện (hoặc bản sao có xác nhận của tổ chức tín dụng trong trường hợp phương tiện đang cầm cố, thế chấp), giấy chứng nhận khả năng chuyên môn, chứng chỉ chuyên môn của thuyền viên, người lái phương tiện, bản sao giấy chứng nhận bảo hiểm trách nhiệm dân sự (đối với phương tiện thuộc diện bắt buộc phải có bảo hiểm trách nhiệm dân sự), giấy phép vận tải thủy qua biên giới Việt Nam - Campuchia;
b) Giấy tờ xuất trình cho Cơ quan Hải quan: Giấy tờ liên quan đến hàng hóa vận tải trên phương tiện;
c) Giấy tờ xuất trình cho Bộ đội Biên phòng cửa khẩu: Hộ chiếu và giấy tờ có giá trị đi lại quốc tế của thuyền viên, hành khách (nếu có);
d) Giấy tờ xuất trình cho cơ quan kiểm dịch thực vật: Giấy chứng nhận kiểm dịch thực vật (đối với hàng hóa thuộc diện kiểm dịch thực vật);
đ) Giấy tờ xuất trình cho cơ quan kiểm dịch động vật: Giấy chứng nhận kiểm dịch động vật của nước xuất hàng (đối với hàng hóa thuộc diện kiểm dịch động vật);
e) Giấy tờ xuất trình cho cơ quan kiểm dịch y tế: Giấy chứng nhận tiêm chủng quốc tế của thuyền viên, người lái phương tiện, hành khách (trong trường hợp xuất phát hoặc đi qua vùng có dịch hoặc bị nghi ngờ mắc bệnh hoặc tác nhân gây bệnh truyền nhiễm).
3. Kiểm tra các loại giấy tờ liên quan đến phương tiện và thuyền viên
a) Cảng vụ kiểm tra các thông tin khai báo, tra cứu dữ liệu phương tiện, thuyền viên Việt Nam trên cơ sở dữ liệu điện tử của các cơ quan có thẩm quyền để giải quyết thủ tục cấp giấy phép cho phương tiện vào cảng thủy nội địa;
b) Cảng vụ chỉ yêu cầu người làm thủ tục nộp, xuất trình các giấy tờ trong trường hợp cơ sở dữ liệu không có thông tin của phương tiện, thuyền viên, người lái phương tiện hoặc không đủ dữ liệu điện tử để kiểm tra, đối chiếu hoặc không bảo đảm điều kiện của chứng từ điện tử và người làm thủ tục chỉ khai báo dữ liệu lần đầu về phương tiện, thuyền viên trên phần mềm điện tử (do người làm thủ tục lựa chọn). Cảng vụ làm thủ tục đầu tiên kiểm tra, đối chiếu dữ liệu khai báo với bản chính xuất trình để giải quyết thủ tục cho phương tiện vào cảng thủy nội địa hoặc khi có sự thay đổi. Cơ sở dữ liệu về thuyền viên, người lái phương tiện, phương tiện, cảng thủy nội địa được lưu giữ trên Cổng thông tin một cửa quốc gia để làm cơ sở dữ liệu cho những lần làm thủ tục tiếp theo;
c) Thời hạn xuất trình các giấy tờ không có trong cơ sở dữ liệu: Chậm nhất 02 giờ, kể từ khi phương tiện đã neo đậu tại cầu cảng hoặc 04 giờ phương tiện đã neo đậu tại vị trí khác trong vùng nước cảng thủy nội địa
4. Trách nhiệm làm thủ tục của cơ quan quản lý nhà nước chuyên ngành tại cảng thủy nội địa
a) Cảng vụ có trách nhiệm kiểm tra các giấy tờ quy định tại các điểm a, b, c, d, đ, e khoản 1, điểm a khoản 2 Điều này; chịu trách nhiệm chính và có thẩm quyền quyết định cuối cùng đối với giấy tờ quy định tại các điểm a, b, c khoản 1 Điều này, trong trường hợp các cơ quan quản lý nhà nước cùng tham gia xử lý và có ý kiến khác nhau;
b) Cơ quan Hải quan chịu trách nhiệm kiểm tra các giấy tờ quy định tại các điểm a, c, d, đ, e khoản 1 Điều này; chịu trách nhiệm chính và có thẩm quyền quyết định cuối cùng đối với giấy tờ quy định tại điểm b khoản 2 Điều này trong trường hợp các cơ quan quản lý nhà nước cùng tham gia xử lý và có ý kiến khác nhau;
c) Bộ đội Biên phòng cửa khẩu chịu trách nhiệm chính kiểm tra các giấy tờ quy định tại các điểm a, b, c, d, đ, i, k khoản 1, điểm c khoản 2 của Điều này và có thẩm quyền quyết định cuối cùng đối với các giấy tờ quy định tại các điểm i, k khoản 1, điểm c khoản 2 Điều này, trong trường hợp các cơ quan quản lý nhà nước cùng tham gia xử lý và có ý kiến khác nhau;
d) Cơ quan kiểm dịch thực vật có trách nhiệm kiểm tra các giấy tờ quy định tại các điểm c, g khoản 1, điểm đ khoản 2 Điều này; chịu trách nhiệm chính và có thẩm quyền quyết định cuối cùng đối với giấy tờ quy định tại điểm g khoản 1 Điều này, trong trường hợp các cơ quan quản lý nhà nước cùng tham gia xử lý và có ý kiến khác nhau;
đ) Cơ quan kiểm dịch động vật có trách nhiệm kiểm tra các giấy tờ quy định tại các điểm c, h khoản 1, điểm đ khoản 2 Điều này; chịu trách nhiệm chính và có thẩm quyền quyết định cuối cùng đối với giấy tờ tại điểm h khoản 1 Điều này, trong trường hợp các cơ quan quản lý nhà nước cùng tham gia xử lý và có ý kiến khác nhau;
e) Cơ quan kiểm dịch y tế có trách nhiệm kiểm tra giấy tờ quy định tại điểm e khoản 2 Điều này và có thẩm quyền quyết định cuối cùng đối với giấy tờ đã kiểm tra trong trường hợp các cơ quan quản lý nhà nước cùng tham gia xử lý và có ý kiến khác nhau.
5. Cấp phép điện tử
Chậm nhất 30 phút, kể từ khi người làm thủ tục hoàn thành các thủ tục khai báo điện tử và xuất trình đầy đủ các giấy tờ theo quy định, trên cơ sở ý kiến phản hồi của các cơ quan liên quan, Cảng vụ cấp giấy phép điện tử cho phương tiện vào cảng thủy nội địa thông qua Cổng thông tin một cửa quốc gia.
Điều 57. Thủ tục điện tử đối với phương tiện thủy nội địa Việt Nam, Campuchia xuất cảnh rời cảng thủy nội địa Việt Nam
1. Chậm nhất 02 giờ, trước khi phương tiện rời cảng thủy nội địa, người làm thủ tục khai báo giấy tờ sau đây theo hình thức điện tử thông qua Cổng thông tin một cửa quốc gia
a) Thông báo phương tiện rời cùng thủy nội địa theo Mẫu số 48 tại Phụ lục ban hành kèm theo Nghị định này;
b) Danh sách thuyền viên, người lái phương tiện với đầy đủ chức danh;
c) Danh sách hành khách (đối với phương tiện chở hành khách);
d) Bản khai hàng hóa, hợp đồng vận chuyển hoặc hóa đơn xuất kho hoặc giấy vận chuyển (đối với phương tiện chở hàng hóa).
2. Các chứng từ phải xuất trình
a) Giấy tờ xuất trình cho Cảng vụ: Giấy tờ liên quan đến hàng hóa vận tải trên phương tiện; giấy tờ xác nhận việc nộp phí, lệ phí quy định của pháp luật, trừ trường hợp thanh toán điện tử; giấy chứng nhận khả năng chuyên môn, chứng chỉ chuyên môn của thuyền viên, người lái phương tiện; giấy tờ liên quan tới những thay đổi so với giấy tờ khi làm thủ tục cho phương tiện vào cảng thủy nội địa;
b) Giấy tờ xuất trình cho Cơ quan Hải quan: Giấy tờ liên quan đến hàng hóa vận tải trên phương tiện;
c) Giấy từ xuất trình cho Bộ đội Biên phòng cửa khẩu: Hộ chiếu và giấy tờ có giá trị đi lại quốc tế của thuyền viên, hành khách (nếu có);
d) Giấy tờ xuất trình cho cơ quan kiểm dịch thực vật: Giấy chứng nhận kiểm dịch thực vật (đối với hàng hóa thuộc diện kiểm dịch thực vật);
đ) Giấy tờ xuất trình cho cơ quan kiểm dịch động vật: Giấy chứng nhận kiểm dịch động vật của nước xuất hàng (đối với hàng hóa thuộc diện kiểm dịch động vật);
e) Giấy tờ xuất trình cho cơ quan kiểm dịch y tế: Giấy chứng nhận tiêm chủng quốc gia của thuyền viên, người lái phương tiện, hành khách (trong trường hợp xuất phát hoặc đi qua vùng có dịch hoặc bị nghi ngờ mắc bệnh hoặc tác nhân gây bệnh truyền nhiễm).
3. Kiểm tra các loại giấy chứng nhận của phương tiện và thuyền viên.
a) Cảng vụ kiểm tra các thông tin khai báo, tra cứu dữ liệu của phương tiện, thuyền viên trên cơ sở dữ liệu điện tử của các cơ quan có thẩm quyền để giải quyết thủ tục cấp giấy phép rời cảng thủy nội địa cho phương tiện;
b) Cảng vụ chỉ yêu cầu người làm thủ tục nộp, xuất trình các giấy tờ trong trường hợp cơ sở dữ liệu không có dữ liệu của phương tiện, thuyền viên, người lái phương tiện hoặc không đủ dữ liệu điện tử để kiểm tra, đối chiếu hoặc không bảo đảm điều kiện của chứng từ điện tử và người làm thủ tục chỉ việc khai báo dữ liệu lần đầu về phương tiện, thuyền viên trên phần mềm điện tử (do người làm thủ tục lựa chọn). Cảng vụ làm thủ tục cuối cùng kiểm tra, đối chiếu dữ liệu khai báo với bản chính xuất trình để giải quyết thủ tục cho phương tiện rời cảng thủy nội địa Việt Nam hoặc khi có sự thay đổi. Cơ sở dữ liệu về thuyền viên, người lái phương tiện, phương tiện rời cảng thủy nội địa Việt Nam được lưu giữ trên phần mềm điện tử để làm cơ sở dữ liệu cho những lần làm thủ tục tiếp theo.
4. Thời hạn nộp hoặc xuất trình các giấy tờ không có trong cơ sở dữ liệu: Chậm nhất 02 giờ, trước khi phương tiện rời cảng và cửa khẩu. Đối với phương tiện chở khách có thể thực hiện ngay tại thời điểm phương tiện chuẩn bị rời cảng và cửa khẩu.
5. Trách nhiệm làm thủ tục của cơ quan quản lý nhà nước chuyên ngành tại cảng thủy nội địa
a) Cảng vụ có trách nhiệm kiểm tra các giấy tờ quy định tại khoản 1 và điểm a khoản 2 Điều này; chịu trách nhiệm chính và có thẩm quyền quyết định cuối cùng đối với giấy tờ quy định tại điểm a khoản 1 Điều này trong trường hợp các cơ quan quản lý nhà nước cùng tham gia xử lý và có ý kiến khác nhau;
b) Cơ quan hải quan chịu trách nhiệm trong việc kiểm tra các giấy tờ quy định tại khoản 1, điểm b khoản 2 Điều này; chịu trách nhiệm chính và có thẩm quyền quyết định cuối cùng đối với giấy tờ quy định tại điểm b khoản 2 Điều này trong trường hợp các cơ quan quản lý nhà nước cùng tham gia xử lý và có ý kiến khác nhau;
c) Bộ đội Biên phòng cửa khẩu chịu trách nhiệm trong việc kiểm tra các chứng từ quy định tại các điểm a, b, c khoản 1, điểm c khoản 2 Điều này; chịu trách nhiệm chính và có thẩm quyền quyết định cuối cùng đối với giấy tờ quy định tại các điểm b, c khoản 1 Điều này trong trường hợp các cơ quan quản lý nhà nước cùng tham gia xử lý và có ý kiến khác nhau;
d) Cơ quan kiểm dịch thực vật có trách nhiệm kiểm tra các giấy tờ quy định tại điểm a khoản 1 và điểm d khoản 2 Điều này, chịu trách nhiệm chính và có thẩm quyền quyết định cuối cùng đối với giấy tờ quy định tại các điểm d khoản 2 Điều này trong trường hợp các cơ quan quản lý nhà nước cùng tham gia xử lý và có ý kiến khác nhau;
đ) Cơ quan kiểm dịch động vật có trách nhiệm kiểm tra các chứng từ quy định tại điểm a khoản 1 và điểm đ khoản 2 Điều này, chịu trách nhiệm chính và có thẩm quyền quyết định cuối cùng đối với giấy tờ quy định tại các điểm đ khoản 2 Điều này trong trường hợp các cơ quan quản lý nhà nước cùng tham gia xử lý và có ý kiến khác nhau;
e) Cơ quan kiểm dịch y tế có trách nhiệm kiểm tra giấy tờ quy định tại điểm e khoản 2 Điều này, chịu trách nhiệm chính và có thẩm quyền quyết định cuối cùng đối với giấy tờ quy định tại các điểm e khoản 2 Điều này trong trường hợp các cơ quan quản lý nhà nước cùng tham gia xử lý và có ý kiến khác nhau.
6. Cấp phép điện tử
a) Chậm nhất 30 phút, kể từ khi người làm thủ tục hoàn thành các thủ tục khai báo điện tử và xuất trình đầy đủ các giấy tờ theo quy định, trên cơ sở ý kiến phản hồi của các cơ quan liên quan, Cảng vụ cấp giấy phép cho phương tiện rời cảng thủy nội địa thông qua phần mềm điện tử;
b) Trường hợp phương tiện đã được cấp giấy phép rời cảng thủy nội địa nhưng ra đến cửa khẩu, cơ quan chức năng tại cửa khẩu không cho phương tiện xuất cảnh thì phải trả lời cho chủ phương tiện biết và nêu rõ lý do, đồng thời thông báo cho Cảng vụ cấp giấy phép rời cảng biết.
Điều 58. Thủ tục đối với tàu biển, phương tiện thủy nước ngoài vào, rời và nhập cảnh, xuất cảnh tại cảng thủy nội địa
1. Phương tiện thủy nước ngoài, tàu biển vào, rời và nhập cảnh, xuất cảnh tại cảng thủy nội địa thực hiện thủ tục theo quy định của pháp luật hàng hải đối với tàu thuyền vào, rời và nhập cảnh, xuất cảnh tại cảng biển và Nghị định này.
2. Mẫu giấy phép vào, rời cảng thủy nội địa và nhập cảnh, xuất cảnh đối với tàu biển, phương tiện thủy nước ngoài thực hiện theo quy định của pháp luật về hàng hải.
Điều 59. Phương tiện, thủy phi cơ, tàu biển vào, rời khu neo đậu
1. Phương tiện, thủy phi cơ, tàu biển vào, rời khu neo đậu để chuyển tải hàng hóa, đón trả hành khách phải thực hiện thủ tục theo quy định như vào, rời cảng, bến thủy nội địa quy định tại Nghị định này.
2. Giấy phép vào, rời khu neo đậu theo Mẫu số 37, Mẫu số 38 tại Phụ lục ban hành kèm theo Nghị định này.
3. Bộ Tài chính quy định mức thu phí, lệ phí vào, rời khu neo đậu đối với phương tiện, thủy phi cơ, tàu biển quy định tại khoản 1 Điều này.
Điều 60. Miễn, giảm thủ tục vào, rời cảng, bến thủy nội địa, khu neo đậu
1. Các phương tiện sau đây được miễn làm thủ tục vào, rời cảng, bến thủy nội địa, khu neo đậu
a) Phương tiện chữa cháy; phương tiện tìm kiếm, cứu nạn, cứu hộ; phương tiện hộ đê; phương tiện, tàu biển, thủy phi cơ, phương tiện thủy nước ngoài tránh trú bão, lũ;
b) Phương tiện của cơ quan nhà nước, đơn vị lực lượng vũ trang đang làm nhiệm vụ; phương tiện, đoàn phương tiện có Công an hộ tống hoặc dẫn đường;
c) Phương tiện chuyên dùng của đơn vị quản lý chuyên ngành đường thủy nội địa;
d) Phương tiện đón, trả hoa tiêu, tàu cá;
d) Phương tiện vận tải hành khách ngang sông tại bến khách ngang sông;
e) Phương tiện (tàu con) chuyển tải hành khách, hàng hóa từ phương tiện, tàu biển, phương tiện thủy nước ngoài (tàu mẹ) vào cảng, bến và ngược lại; trong trường hợp này, tàu mẹ phải được làm thủ tục như thủ tục vào, rời cảng, bến, khu neo đậu. Trước khi vào cảng, bến thủy nội địa, thuyền trưởng, người lái phương tiện (tàu con) quy định tại điểm này phải thông báo cho Cảng vụ biết bằng văn bản hoặc bằng hình thức thông tin phù hợp khác;
g) Phương tiện chở người, vật tư, thiết bị đến và rời khu vực nuôi, trồng thủy, hải sản, xây dựng thi công công trình trên sông, hồ, đầm, phá, vụng, vịnh và trên biển;
h) Phương tiện thô sơ không kinh doanh vận tải;
i) Phương tiện vận tải hàng hóa (trừ hàng hóa nguy hiểm) có trọng tải toàn phần dưới 10 tấn;
k) Phương tiện, tàu biển, phương tiện thủy nước ngoài, thủy phi cơ vào, rời cảng thủy nội địa để tiếp nhận nhiên liệu, lương thực, thực phẩm.
2. Phương tiện, tàu biển, thủy phi cơ được giảm thủ tục vào, rời cảng, bến thủy nội địa
a) Phương tiện vận tải hành khách đã đăng ký hoạt động trên tuyến cố định có nhiều cảng, bến thủy nội địa đón, trả hành khách, nếu không thay đổi thuyền viên, người lái phương tiện thì chỉ làm thủ tục vào, rời cảng, bến thủy nội địa đầu và cảng, bến thủy nội địa cuối;
b) Phương tiện, tàu biển, thủy phi cơ trong một chuyến vận tải hàng hóa, hành khách vào, rời nhiều cảng, bến thủy nội địa, khu neo đậu thuộc phạm vi quản lý của một Đại diện cảng vụ mà không thay đổi hành khách, thuyền viên, người lái phương tiện thì chỉ làm thủ tục vào cảng, bến thủy nội địa đầu tiên và làm thủ tục rời tại cảng, bến thủy nội địa cuối cùng. Trong trường hợp này, việc di chuyển giữa các cảng, bến thủy nội địa được Cảng vụ cấp lệnh điều động cho phương tiện, tàu biển, thủy phi cơ. Lệnh điều động theo Mẫu số 49 tại Phụ lục ban hành kèm theo Nghị định này;
c) Phương tiện vận tải hành khách, thủy phi cơ thường xuyên vào, rời một cảng, bến thủy nội địa mà không thay đổi thuyền viên, người lái phương tiện và phương tiện có giấy chứng nhận an toàn kỹ thuật và bảo vệ môi trường còn hiệu lực thì làm thủ tục phương tiện vào, rời cảng, bến thủy nội địa chuyến thứ nhất. Từ chuyến thứ hai trở lên chỉ thực hiện kiểm tra an toàn và cấp giấy phép rời cảng, bến thủy nội địa;
d) Phương tiện vận chuyển nguyên liệu, nông sản, thủy sản từ nơi sản xuất, nuôi trồng đến cảng, bến của nhà máy chế biến mà khi rời cảng, bến này không vận chuyển hàng hóa, không thay đổi thuyền viên, người lái phương tiện thì không phải làm thủ tục rời cảng, bến;
đ) Phương tiện vào, rời cảng, bến thủy nội địa trong phạm vi quản lý của một Đại diện Cảng vụ từ hai lần trở lên trong một ngày mà không thay đổi thuyền viên, người lái phương tiện thì Cảng vụ kiểm tra giấy tờ của phương tiện, thuyền viên lần đầu. Việc kiểm tra điều kiện an toàn các lần vào, rời thực hiện theo quy định tại Nghị định này;
e) Phương tiện, tàu biển, thủy phi cơ, phương tiện thủy nước ngoài vào cầu, bến cảng biển hoặc khu vực hàng hải sau đó đến cảng, bến thủy nội địa trong vùng nước cảng biển hoặc khu vực hàng hải để rời vùng nước cảng biển hoặc khu vực hàng hải, thì Cảng vụ chỉ làm thủ tục rời cảng, bến thủy nội địa;
g) Phương tiện, tàu biển, thủy phi cơ, phương tiện thủy nước ngoài vào cảng, bến thủy nội địa trong vùng nước cảng biển hoặc khu vực hàng hải sau đó đến cầu, bến cảng biển trong vùng nước cảng biển hoặc khu vực hàng hải đó, thì Cảng vụ chỉ làm thủ tục vào cảng, bến thủy nội địa;
h) Phương tiện, tàu biển, thủy phi cơ, phương tiện thủy nước ngoài vào cầu, bến cảng biển, cảng, bến thủy nội địa trong vùng nước cảng biển hoặc khu vực hàng hải sau đó di chuyển giữa các cảng, bến thủy nội địa hoặc cảng biển, trong vùng nước cảng biển hoặc khu vực hàng hải, thì Cảng vụ cấp lệnh điều động cho phương tiện. Lệnh điều động theo Mẫu số 49 tại Phụ lục ban hành kèm theo Nghị định này.
3. Trường hợp phương tiện vận tải hàng hóa vào cảng, bến thủy nội địa có giấy phép rời cảng, bến thủy nội địa, mà trong giấy phép ghi nơi đến là cảng, bến thủy nội địa khác, thì Cảng vụ làm thủ tục cho phương tiện vào cảng, bến thủy nội địa và yêu cầu người làm thủ tục trình bày lý do thay đổi kế hoạch vận tải của phương tiện.
4. Khi phương tiện rời cảng, bến thủy nội địa chưa xác định được cảng, bến thủy nội địa đến, thì Cảng vụ ghi nơi đến (dự kiến) do người làm thủ tục đề xuất trong giấy phép rời cảng, bến.
Chương VI. TRÁCH NHIỆM TỔ CHỨC QUẢN LÝ HOẠT ĐỘNG ĐƯỜNG THỦY NỘI ĐỊA
Điều 61. Trách nhiệm phối hợp quản lý hoạt động đường thủy nội địa
1. Các cơ quan quản lý nhà nước chuyên ngành trên đường thủy nội địa về tại cảng, bến thủy nội địa, khu neo đậu phải phối hợp thực hiện nhiệm vụ, tuân theo các quy định của pháp luật bảo đảm an toàn, an ninh và hiệu quả.
2. Các vướng mắc phát sinh liên quan đến chức năng, nhiệm vụ của các cơ quan quản lý nhà nước chuyên ngành khác đều phải được trao đổi thống nhất để giải quyết kịp thời. Trường hợp không thống nhất, phải kịp thời thông báo cho Cục Đường thủy nội địa Việt Nam, Cục Hàng hải Việt Nam, Cục Cảnh sát giao thông, Sở Giao thông vận tải biết để giải quyết theo quy định của pháp luật.
3. Trách nhiệm phối hợp hoạt động quản lý tại cảng thủy nội địa tiếp nhận phương tiện thủy nước ngoài
a) Các cơ quan quản lý nhà nước chuyên ngành tại cảng thủy nội địa tiếp nhận phương tiện thủy nước ngoài khi thực hiện nhiệm vụ phải tuân theo các quy định của pháp luật, không gây phiền hà, làm ảnh hưởng đến hoạt động bình thường của doanh nghiệp, chủ tàu, chủ hàng, phương tiện và các tổ chức, cá nhân khác trong khu vực cảng thủy nội địa;
b) Cơ quan quản lý nhà nước chuyên ngành tại cảng thủy nội địa có trách nhiệm phối hợp chặt chẽ giải quyết kịp thời, đúng pháp luật các thủ tục liên quan đến phương tiện, hàng hóa, hành khách, thuyền viên khi hoạt động tại cảng thủy nội địa theo quy định tại Nghị định này và quy định của pháp luật khác có liên quan; thông báo cho Cảng vụ biết kết quả giải quyết thủ tục liên quan đến phương tiện, hàng hóa, thuyền viên, hành khách khi hoạt động tại cảng thủy nội địa;
c) Cảng vụ có trách nhiệm chủ trì tổ chức phối hợp hoạt động giữa các cơ quan quản lý nhà nước chuyên ngành tại cảng thủy nội địa tiếp nhận phương tiện thủy nước ngoài; trao đổi với các cơ quan, doanh nghiệp thống nhất việc giải quyết những vướng mắc phát sinh trong hoạt động đường thủy nội địa tại vùng nước cảng thủy nội địa do mình phụ trách; yêu cầu các cơ quan quản lý nhà nước chuyên ngành khác tại cảng thủy nội địa thông báo kịp thời kết quả làm thủ tục; yêu cầu người khai thác cảng thủy nội địa, chủ phương tiện, thuyền trưởng và các cơ quan, tổ chức liên quan khác cung cấp số liệu, thông tin về hoạt động đường thủy nội địa tại cảng thủy nội địa.
4. Cơ quan có thẩm quyền thỏa thuận xây dựng, thiết lập công trình, công bố hoạt động công trình thuộc kết cấu hạ tầng đường thủy nội địa; chấp thuận phương án bảo đảm giao thông; thỏa thuận xây dựng, thiết lập công trình không thuộc kết cấu hạ tầng đường thủy nội địa; cấp giấy phép, cho ý kiến về những vấn đề liên quan đến đường thủy nội địa, quốc phòng, an ninh phải thực hiện đúng trình tự theo quy định tại Nghị định này. Trường hợp không đồng ý phải có văn bản trả lời, nêu rõ lý do.
Điều 62. Trách nhiệm quản lý hoạt động đường thủy nội địa của Bộ Giao thông vận tải
1. Thực hiện quản lý nhà nước về hoạt động giao thông đường thủy nội địa trong phạm vi cả nước; chủ trì, phối hợp với các bộ, ngành và Ủy ban nhân dân cấp tỉnh tổ chức thực hiện Nghị định này.
2. Công bố danh mục cảng thủy nội địa 03 năm/lần, trên cơ sở rà soát, tổng hợp, báo cáo của Cục Đường thủy nội địa Việt Nam.
3. Chỉ đạo Cục Đường thủy nội địa Việt Nam tổ chức thực hiện:
a) Kiểm tra, hướng dẫn việc thực hiện quy hoạch, quản lý, bảo trì kết cấu hạ tầng đường thủy nội địa trên đường thủy nội địa quốc gia, đường thủy nội địa chuyên dùng nối với đường thủy nội địa quốc gia;
b) Lập mẫu báo cáo, hướng dẫn thực hiện báo cáo về quản lý hoạt động khai thác, bảo trì kết cấu hạ tầng đường thủy nội địa; hoạt động cảng, bến thủy nội địa, khu neo đậu;
c) Xây dựng cơ sở dữ liệu để quản lý luồng, cảng, bến thủy nội địa, khu neo đậu; phương tiện ra, vào cảng, bến thủy nội địa, khu neo đậu trong phạm vi cả nước;
d) Công bố danh mục bến thủy nội địa, khu neo đậu hằng năm, trên cơ sở báo cáo tổng hợp của Sở Giao thông vận tải;
đ) Tổ chức thanh tra, kiểm tra việc chấp hành quy định về hoạt động đường thủy nội địa thuộc phạm vi thẩm quyền theo quy định của pháp luật.
4. Công bố tuyến hoạt động của phương tiện thủy nội địa mang cấp VR-SB; quy định về quản lý phương tiện, thuyền viên làm việc trên phương tiện thủy nội địa mang cấp VR-SB và các hoạt động khác theo quy định của pháp luật có liên quan nhằm bảo đảm an toàn, an ninh trong hoạt động đường thủy nội địa.
5. Thực hiện nhiệm vụ, quyền hạn khác theo quy định tại Nghị định này.
Điều 63. Trách nhiệm trong quản lý hoạt động giao thông đường thủy nội địa của các bộ liên quan
1. Bộ Công an có trách nhiệm:
a) Chủ trì phối hợp với Bộ Giao thông vận tải, các bộ, ngành liên quan và Ủy ban nhân dân cấp tỉnh thực hiện các biện pháp bảo đảm trật tự, an toàn giao thông đường thủy nội địa;
b) Tổ chức lực lượng Cảnh sát giao thông tuần tra, kiểm soát, xử lý hành vi vi phạm pháp luật trên đường thủy nội địa đối với người, phương tiện tham gia giao thông đường thủy nội địa theo quy định của pháp luật; điều tra, thống kê, cung cấp dữ liệu về tai nạn giao thông đường thủy nội địa;
c) Chỉ đạo lực lượng Công an các địa phương tăng cường phối hợp bảo vệ kết cấu hạ tầng đường thủy nội địa.
2. Bộ Tài nguyên và Môi trường có trách nhiệm:
a) Chủ trì phối hợp với Ủy ban nhân dân cấp tỉnh, Bộ Giao thông vận tải quản lý hoạt động khai thác cát, sỏi, khoáng sản khác trên sông, kênh, rạch, hồ, đầm, phá có liên quan đến luồng và hành lang bảo vệ luồng, bảo đảm an toàn giao thông, bảo vệ môi trường trên đường thủy nội địa, cảng, bến thủy nội địa;
b) Chỉ đạo Thanh tra chuyên ngành phối hợp với các cơ quan liên quan thanh tra hoạt động khai thác khoáng sản, bảo vệ môi trường trên đường thủy nội địa theo quy định.
3. Bộ Nông nghiệp và Phát triển nông thôn có trách nhiệm:
a) Chỉ đạo, hướng dẫn tổ chức, cá nhân nuôi trồng, đánh bắt thủy, hải sản và tàu cá hoạt động trên đường thủy nội địa thực hiện các biện pháp bảo đảm an toàn giao thông;
b) Chỉ đạo các địa phương tạo điều kiện để chủ cảng, bến thủy nội địa lập kho lưu hàng hóa, tập kết hàng hóa trên diện tích đất của cảng, bến thủy nội địa; kết hợp việc thoát lũ phù hợp với điều kiện thực tế không để cảng, bến thủy nội địa phải ngừng hoạt động khai thác trong thời gian không có lũ;
c) Phối hợp với Ủy ban nhân cấp tỉnh rà soát, giải tỏa các bến bãi tập kết hàng hóa vi phạm hành lang bảo vệ đê, công trình thủy lợi khác.
4. Các bộ, ngành có liên quan có trách nhiệm chỉ đạo, hướng dẫn các cơ quan quản lý nhà nước chuyên ngành trực thuộc thực hiện phối hợp hoạt động quản lý nhà nước trên đường thủy nội địa, cảng, bến thủy nội địa, khu neo đậu.
Điều 64. Trách nhiệm quản lý hoạt động đường thủy nội địa của Ủy ban nhân dân cấp tỉnh
1. Chỉ đạo, hướng dẫn Ủy ban nhân dân cấp huyện, cấp xã tổ chức quản lý, khai thác bến khách ngang sông; thực hiện các biện pháp bảo vệ kết cấu hạ tầng đường thủy nội địa, chống lấn, chiếm hành lang bảo vệ luồng; bảo đảm trật tự an toàn giao thông đường thủy nội địa và chịu trách nhiệm về trật tự, an toàn giao thông đường thủy nội địa tại địa phương.
2. Tổ chức quản lý đối với sông, kênh, hồ, đầm, phá trên địa bàn chưa được đầu tư xây dựng, công bố mở luồng mà có hoạt động vận tải nhằm bảo đảm trật tự, an toàn giao thông.
3. Ưu tiên bố trí đất xây dựng cảng, bến thủy nội địa bảo đảm ổn định. Chỉ đạo các cơ quan tham mưu tạo điều kiện để các tổ chức, cá nhân có nhu cầu xây dựng, kinh doanh cảng, bến thủy nội địa được giao đất, cho thuê đất, lập hồ sơ đề nghị công bố hoạt động theo quy định.
4. Tổ chức giải tỏa các bến tập kết, xếp dỡ hàng hóa không đủ điều kiện để công bố hoạt động và các công trình, nhà hàng nổi, khách sạn nổi hoạt động trái quy định.
5. Tổ chức tuyên truyền, phổ biến, giáo dục pháp luật về giao thông đường thủy nội địa; áp dụng các biện pháp bảo đảm trật tự, an toàn giao thông đường thủy nội địa tại địa phương.
6. Chỉ đạo, tổ chức quản lý nhà nước chuyên ngành về giao thông vận tải đường thủy nội địa tại cảng, bến thủy nội địa, khu neo đậu trên đường thủy nội địa địa phương, đường thủy nội địa chuyên dùng nối với đường thủy nội địa địa phương.
7. Chỉ đạo Sở Giao thông vận tải tổ chức thực hiện:
a) Kiểm tra, hướng dẫn việc thực hiện quy hoạch, quản lý, bảo trì kết cấu hạ tầng đường thủy nội địa thuộc phạm vi trách nhiệm được giao;
b) Lập danh bạ luồng địa phương, luồng chuyên dùng nối với luồng địa phương, cảng, bến thủy nội địa, khu neo đậu thuộc phạm vi quản lý, bến khách ngang sông trên địa bàn địa phương, báo cáo Ủy ban nhân dân cấp tỉnh và Cục Đường thủy nội địa Việt Nam; tổ chức thực hiện quản lý nhà nước tại cảng, bến thủy nội địa, khu neo đậu thuộc phạm vi trách nhiệm;
c) Tổ chức lực lượng Thanh tra giao thông thanh tra, kiểm tra việc chấp hành quy định về hoạt động đường thủy nội địa thuộc phạm vi thẩm quyền theo quy định của pháp luật.
8. Thực hiện nhiệm vụ, quyền hạn khác theo quy định tại Nghị định này.
Điều 65. Quản lý nhà nước chuyên ngành tại cảng, bến thủy nội địa, khu neo đậu
1. Hoạt động quản lý nhà nước chuyên ngành tại cảng, bến thủy nội địa, khu neo đậu theo quy định tại Điều 71, Điều 72 Luật Giao thông đường thủy nội địa và Nghị định này.
2.[12] Cảng vụ thuộc Cục Đường thủy nội địa Việt Nam thực hiện chức năng quản lý nhà nước chuyên ngành tại cảng, bến thủy nội địa (trừ bến khách ngang sông), khu neo đậu đã được công bố, cấp phép hoạt động trên đường thủy nội địa quốc gia, đường thủy nội địa chuyên dùng nối với đường thủy nội địa quốc gia; cảng, bến thủy nội địa, khu neo đậu có vùng đất, vùng nước vừa trên đường thủy nội địa quốc gia và đường thủy nội địa địa phương; cảng, bến thủy nội địa, khu neo đậu trong vùng nước cảng biển được Bộ Giao thông vận tải giao.
3.[13] Cảng vụ thuộc Sở Giao thông vận tải hoặc cơ quan, đơn vị được Ủy ban nhân dân cấp tỉnh giao thực hiện tại địa phương chưa có tổ chức Cảng vụ đường thủy nội địa trực thuộc Sở Giao thông vận tải thực hiện chức năng quản lý nhà nước chuyên ngành tại cảng, bến thủy nội địa (trừ bến khách ngang sông), khu neo đậu đã được công bố, cấp phép hoạt động trên đường thủy nội địa địa phương, đường thủy nội địa chuyên dùng nối với đường thủy nội địa địa phương; cảng, bến thủy nội địa, khu neo đậu trong vùng nước cảng biển thuộc địa giới hành chính của địa phương được Bộ Giao thông vận tải giao; cảng, bến thủy nội địa, khu neo đậu theo quy định tại khoản 2 Điều này được Bộ trưởng Bộ Giao thông vận tải phân cấp theo quy định.
Điều 66. Trách nhiệm của chủ cảng, bến, người quản lý khai thác cảng, bến thủy nội địa, khu neo đậu
Chủ cảng, bến thủy nội địa, khu neo đậu, người quản lý khai thác cảng, bến, khu neo đậu có trách nhiệm thực hiện những quy định sau đây:
1. Duy trì hoạt động an toàn, an ninh của cảng, bến thủy nội địa, khu neo đậu, các thiết bị neo đậu phương tiện và báo hiệu đường thủy nội địa tại cảng, bến thủy nội địa; tổ chức thực hiện các nhiệm vụ trong kế hoạch an ninh cảng thủy nội địa tiếp nhận phương tiện thủy nước ngoài.
2. Xây dựng nội quy hoạt động của cảng, bến thủy nội địa, khu neo đậu; niêm yết giá bốc xếp hàng hóa và các dịch vụ khác. Nội quy hoạt động, bảng niêm yết giá bốc xếp hàng hóa phải bố trí ở nơi thuận lợi dễ thấy, nội dung rõ ràng, dễ đọc.
3. Lắp đèn chiếu sáng khi hoạt động ban đêm; xây dựng nơi chờ cho hành khách đối với cảng, bến đón trả hành khách; đối với cảng, bến hành khách bố trí giao thông kết nối hỗ trợ người khuyết tật, người cao tuổi.
4. Thiết bị xếp dỡ bảo đảm tiêu chuẩn an toàn kỹ thuật và phù hợp với kết cấu, sức chịu lực của công trình. Bố trí người điều khiển thiết bị xếp dỡ phải có giấy chứng nhận, chứng chỉ điều khiển theo quy định của pháp luật.
5. Không tiếp nhận phương tiện không có giấy chứng nhận đăng ký, giấy chứng nhận an toàn kỹ thuật và bảo vệ môi trường hoặc giấy chứng nhận an toàn kỹ thuật và bảo vệ môi trường đã hết hạn sử dụng.
6. Không xếp hàng hóa vượt quá kích thước hoặc quá vạch dấu mớn nước an toàn của phương tiện hoặc xếp ô tô quá số lượng, vượt quá trọng tải xuống phương tiện; không xếp hành khách quá số lượng theo quy định xuống phương tiện; không xếp hàng hóa lên ô tô quá tải trọng cho phép.
7. Chấp hành đầy đủ các quy định của pháp luật về xếp dỡ hàng hóa độc hại, nguy hiểm.
8. Không cho phương tiện, tàu biển, thủy phi cơ, phương tiện thủy nước ngoài vào, rời cảng, bến thủy nội địa, khu neo đậu khi chưa có giấy phép vào, rời cảng, bến, khu neo đậu do Cảng vụ cấp.
9. Duy trì chuẩn tắc luồng chuyên dùng vào cảng, bến thủy nội địa, vùng nước cảng, bến thủy nội địa, khu neo đậu.
10. Chịu trách nhiệm bảo đảm an toàn, an ninh công trình cảng, bến thủy nội địa, khu neo đậu và hành khách, phương tiện neo đậu tại cảng, bến thủy nội địa, khu neo đậu.
11. Bố trí nhân lực quản lý, khai thác cảng, bến thủy nội địa, khu neo đậu bảo đảm trật tự, an toàn, an ninh và môi trường.
12. Trường hợp cảng, bến thủy nội địa, khu neo đậu được cho thuê, ủy quyền khai thác thì người thuê, người được ủy quyền quản lý khai thác phải tuân theo quy định của pháp luật về quản lý, khai thác kết cấu hạ tầng đường thủy nội địa quy định tại Nghị định này và quy định khác có liên quan của pháp luật.
13. Chủ động cứu người, hàng hóa, phương tiện khi xảy ra tai nạn; báo cáo và phối hợp với cơ quan chức năng có thẩm quyền giải quyết, khắc phục hậu quả tai nạn và ô nhiễm môi trường; tuân thủ sự điều động của Cảng vụ hoặc cơ quan liên quan trong việc cứu người, hàng hóa, phương tiện bị nạn trong vùng nước cảng, bến thủy nội địa và phòng chống thiên tai.
14. Tiếp nhận, bảo quản danh sách hành khách do người làm thủ tục giao.
15. Cập nhật thường xuyên dữ liệu cảng, bến thủy nội địa, khu neo đậu đang khai thác, số liệu phương tiện, hàng hóa, hành khách qua cảng, bến thủy nội địa, khu neo đậu trên cơ sở dữ liệu của Cục Đường thủy nội địa Việt Nam.
Điều 67. Trách nhiệm của thuyền trưởng, người lái phương tiện của phương tiện, tàu biển, phương tiện thủy nước ngoài, thủy phi cơ hoạt động trong vùng nước cảng, bến thủy nội địa và khu neo đậu
Thuyền trưởng, người lái phương tiện, tàu biển, thủy phi cơ, phương tiện thủy nước ngoài hoạt động trong vừng nước cảng, bến thủy nội địa và khu neo đậu có trách nhiệm thực hiện những quy định sau:
1. Neo đậu phương tiện tại nơi do Cảng vụ bố trí.
2. Tuân thủ nội quy cảng, bến thủy nội địa, khu neo đậu và các quy định về phòng chống thiên tai, phòng chống cháy, nổ, sự cố môi trường; chấp hành lệnh điều động của Cảng vụ trong các trường hợp khẩn cấp.
3. Phân công người trực ca để duy trì hoạt động của động cơ, thiết bị an toàn; thiết bị thông tin liên lạc; động cơ chính của phương tiện luôn ở trạng thái sẵn sàng hoạt động để xử lý kịp thời sự cố mất an toàn.
4. Trường hợp phát hiện trên phương tiện có người, động vật mắc bệnh truyền nhiễm hoặc thực vật có khả năng gây bệnh phải báo ngay cho Cảng vụ hoặc chính quyền địa phương nơi có cảng, bến thủy nội địa, khu neo đậu, cơ quan chức năng có liên quan và đưa phương tiện neo đậu tại khu vực riêng để có biện pháp xử lý.
5. Trong quá trình xếp, dỡ hàng hóa hoặc đón trả hành khách phải kiểm tra, chuẩn bị các điều kiện cần thiết bảo đảm an toàn lao động, nếu phát hiện dấu hiệu không an toàn, phải dừng ngay việc xếp, dỡ hàng hóa để có biện pháp khắc phục. Không xếp hàng hóa vượt quá kích thước của phương tiện, quá vạch dấu mớn nước an toàn, không nhận hành khách quá số lượng theo quy định.
6. Chỉ được cho phương tiện rời cảng, bến thủy nội địa, khu neo đậu khi phương tiện bảo đảm ổn định, điều kiện thời tiết, khí hậu thuận lợi. Thuyền trưởng, người lái phương tiện phải chịu trách nhiệm về sự an toàn, an ninh của hành khách, phương tiện, tàu biển, thủy phi cơ, phương tiện thủy nước ngoài khi rời cảng, bến thủy nội địa, khu neo đậu; sau khi rời cảng, bến thủy nội địa nếu có thay đổi về thuyền viên, thuyền trưởng phải thông báo cho Cảng vụ nơi cấp giấy phép rời cảng, bến thủy nội địa.
7. Không cản trở hoặc gây khó khăn cho người thi hành công vụ, thuyền viên của phương tiện khác đi qua phương tiện mình.
8. Khi phương tiện bị trôi dạt hoặc bị thay đổi nơi neo đậu do các nguyên nhân khách quan, phải tiến hành ngay các biện pháp bảo đảm an toàn và báo cho Cảng vụ biết.
9. Thuyền trưởng, thuyền viên, người lái phương tiện đang hoạt động tại cảng, bến thủy nội địa, khu neo đậu có nghĩa vụ bắt buộc cứu người và phương tiện thủy bị tai nạn xảy ra trong vùng nước cảng, bến thủy nội địa, khu neo đậu.
10. Khi phát hiện tai nạn hoặc nguy cơ xảy ra tai nạn, thuyền trưởng, thuyền viên hoặc người lái phương tiện bị nạn phải lập tức phát tín hiệu cấp cứu theo quy định và tiến hành ngay các biện pháp cứu người, tài sản, đồng thời thông báo cho Cảng vụ hoặc Công an, Ủy ban nhân dân cấp xã nơi có cảng, bến thủy nội địa để có biện pháp xử lý kịp thời.
11. Chấp hành sự huy động của Cảng vụ, Công an, chính quyền địa phương đưa phương tiện, thiết bị, dụng cụ tham gia tìm kiếm, cứu nạn.
12. Trường hợp phương tiện bị chìm đắm, sau khi cứu người, tài sản, thuyền trưởng hoặc người lái phương tiện bị đắm phải đặt báo hiệu theo quy định, tổ chức cảnh báo và báo cáo ngay cho chủ phương tiện để tiến hành trục vớt. Việc xử lý phương tiện, tài sản chìm đắm tại vùng nước cảng, bến thủy nội địa áp dụng theo quy định của Chính phủ về xử lý tài sản chìm đắm trên đường thủy nội địa.
13. Thuyền trưởng phương tiện thủy nước ngoài phải treo quốc kỳ nước Cộng hòa xã hội chủ nghĩa Việt Nam ở đỉnh cột cao nhất; trường hợp cần treo cờ lễ, cờ tang, kéo còi trong các dịp nghỉ lễ của nước mình, phải thông báo trước cho Cảng vụ.
Chương VII. ĐIỀU KHOẢN THI HÀNH[14]
Điều 68. Hiệu lực thi hành
1. Nghị định này có hiệu lực thi hành từ ngày 15 tháng 3 năm 2021.
2. Bãi bỏ Điều 3, Điều 4, Điều 5, Điều 10 Nghị định số 24/2015/NĐ-CP ngày 27 tháng 02 năm 2015 của Chính phủ quy định chi tiết và biện pháp thi hành một số điều của Luật Giao thông đường thủy nội địa và Luật sửa đổi, bổ sung một số điều của Luật Giao thông đường thủy nội địa.
3. Bãi bỏ quy định liên quan đến thủ tục điện tử đối với phương tiện thủy nội địa của Vương quốc Campuchia nhập cảnh, xuất cảnh tại cảng thủy nội địa Việt Nam và phương tiện thủy nội địa Việt Nam xuất cảnh tại cảng thủy nội địa đi Campuchia tại Quyết định số 34/2016/QĐ-TTg ngày 23 tháng 8 năm 2016 của Thủ tướng Chính phủ quy định về thủ tục điện tử đối với tàu thuyền vào, rời cảng biển, cảng thủy nội địa, cảng dầu khí ngoài khơi thông qua Cơ chế một cửa quốc gia.
Điều 69. Điều khoản chuyển tiếp
1. Đối với luồng quốc gia đã được công bố đưa vào hoạt động trước ngày Nghị định này có hiệu lực thi hành, Cục Đường thủy nội địa Việt Nam tiếp tục tổ chức quản lý, bảo trì; đồng thời rà soát, phân loại, điều chuyển tài sản để đáp ứng các quy định tại khoản 2 Điều 7 Nghị định này.
2. Trường hợp các dự án đầu tư xây dựng công trình thuộc kết cấu hạ tầng đường thủy nội địa đã được chấp thuận chủ trương xây dựng trước ngày Nghị định này có hiệu lực thi hành và còn thời hạn thì tiếp tục được thực hiện theo nội dung của văn bản đã chấp thuận; trường hợp, thời hạn của văn bản chấp thuận đã hết mà chưa triển khai thực hiện dự án, nếu tiếp tục đầu tư xây dựng thì thực hiện theo quy định tại Nghị định này.
3. Cảng, bến thủy nội địa đã công bố, cấp phép hoạt động trước ngày Nghị định này có hiệu lực thi hành, được khai thác theo thời hạn ghi trong quyết định, giấy phép. Khi hết thời hạn, nếu tiếp tục khai thác thì thực hiện công bố lại hoạt động theo quy định tại Nghị định này.
4. Đối với cảng, bến thủy nội địa trong vùng nước cảng biển do các Cảng vụ thực hiện chức năng quản lý chuyên ngành tại cảng, bến thủy nội địa trước ngày Nghị định này có hiệu lực thi hành thì tiếp tục thực hiện chức năng quản lý đến hết ngày 31 tháng 12 năm 2023, từ ngày 01 tháng 01 năm 2024, hoạt động quản lý cảng, bến thủy nội địa trong vùng nước cảng biển thực hiện theo quy định tại Nghị định này.
5. Đối với cảng, bến thủy nội địa trong vùng nước cảng biển đã được chấp thuận chủ trương xây dựng trước ngày Nghị định này có hiệu lực thi hành thì tiếp tục thực hiện theo văn bản chấp thuận; cơ quan chấp thuận chủ trương xây dựng cảng, bến thủy nội địa công bố hoạt động của cảng, bến thủy nội địa.
6. Thời hạn lưu trữ của giấy phép vào, rời cảng, bến thủy nội địa, giấy phép rời cảng biển đã được cấp trước ngày Nghị định này có hiệu lực thi hành được tính theo quy định tại khoản 7 Điều 54 Nghị định này.
Điều 70. Trách nhiệm thi hành
Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Nghị định này./.

[1] Nghị định số 54/2022/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định số 78/2016/NĐ-CP ngày 01 tháng 7 năm 2016 của Chính phủ quy định điều kiện kinh doanh dịch vụ đào tạo thuyền viên, người lái phương tiện thủy nội địa và Nghị định số 08/2021/NĐ-CP ngày 28 tháng 01 năm 2021 của Chính phủ quy định về quản lý hoạt động đường thủy nội địa có căn cứ ban hành như sau:
“Căn cứ Luật Tổ chức Chính phủ ngày 19 tháng 6 năm 2015; Luật sửa đổi, bổ sung một số điều của Luật Tổ chức Chính phủ và Luật Tổ chức chính quyền địa phương ngày 22 tháng 11 năm 2019;
Căn cứ Luật Giao thông đường thủy nội địa ngày 15 tháng 6 năm 2004; Luật sửa đổi, bổ sung một số điều của Luật Giao thông đường thủy nội địa ngày 17 tháng 6 năm 2014;
Theo đề nghị của Bộ trưởng Bộ Giao thông vận tải;
Chính phủ ban hành Nghị định sửa đổi, bổ sung một số điều của Nghị định số 78/2016/NĐ-CP ngày 01 tháng 7 năm 2016 của Chính phủ quy định điều kiện kinh doanh dịch vụ đào tạo thuyền viên, người lái phương tiện thủy nội địa và Nghị định số 08/2021/NĐ-CP ngày 28 tháng 01 năm 2021 của Chính phủ quy định về quản lý hoạt động đường thủy nội địa.”
Nghị định số 06/2024/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định số 08/2021/NĐ-CP ngày 28 tháng 01 năm 2021 của Chính phủ quy định về quản lý hoạt động đường thủy nội địa có căn cứ ban hành như sau:
“Căn cứ Luật Tổ chức Chính phủ ngày 19 tháng 6 năm 2015; Luật sửa đổi, bổ sung một số điều của Luật Tổ chức Chính phủ và Luật Tổ chức chính quyền địa phương ngày 22 tháng 11 năm 2019;
Căn cứ Luật Giao thông đường thủy nội địa ngày 15 tháng 6 năm 2004; Luật sửa đổi, bổ sung một số điều của Luật Giao thông đường thủy nội địa ngày 17 tháng 6 năm 2014;
Theo đề nghị của Bộ trưởng Bộ Giao thông vận tải;
Chính phủ ban hành Nghị định sửa đổi, bổ sung một số điều của Nghị định số 08/2021/NĐ-CP ngày 28 tháng 01 năm 2021 của Chính phủ quy định về quản lý hoạt động đường thủy nội địa.”
[2] Điểm này được sửa đổi, bổ sung theo quy định tại điểm a khoản 1 Điều 1 của Nghị định số 06/2024/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định số 08/2021/NĐ-CP ngày 28 tháng 01 năm 2021 của Chính phủ quy định về quản lý hoạt động đường thủy nội địa, có hiệu lực kể từ ngày 10 tháng 3 năm 2024.
[3] Điểm này được bổ sung theo quy định tại điểm b khoản 1 Điều 1 của Nghị định số 06/2024/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định số 08/2021/NĐ-CP ngày 28 tháng 01 năm 2021 của Chính phủ quy định về quản lý hoạt động đường thủy nội địa, có hiệu lực kể từ ngày 10 tháng 3 năm 2024.

[10] Điểm này được bãi bỏ theo quy định tại khoản 4 Điều 1 của Nghị định số 06/2024/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định số 08/2021/NĐ-CP ngày 28 tháng 01 năm 2021 của Chính phủ quy định về quản lý hoạt động đường thủy nội địa, có hiệu lực kể từ ngày 10 tháng 3 năm 2024.

[12] Khoản này được sửa đổi, bổ sung theo quy định tại khoản 1 Điều 2 của Nghị định số 54/2022/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định số 78/2016/NĐ-CP ngày 01 tháng 7 năm 2016 của Chính phủ quy định điều kiện kinh doanh dịch vụ đào tạo thuyền viên, người lái phương tiện thủy nội địa và Nghị định số 08/2021/NĐ-CP ngày 28 tháng 01 năm 2021 của Chính phủ quy định về quản lý hoạt động đường thủy nội địa, có hiệu lực kể từ ngày 01 tháng 11 năm 2022.
[13] Khoản này được sửa đổi, bổ sung theo quy định tại khoản 2 Điều 2 của Nghị định số 54/2022/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định số 78/2016/NĐ-CP ngày 01 tháng 7 năm 2016 của Chính phủ quy định điều kiện kinh doanh dịch vụ đào tạo thuyền viên, người lái phương tiện thủy nội địa và Nghị định số 08/2021/NĐ-CP ngày 28 tháng 01 năm 2021 của Chính phủ quy định về quản lý hoạt động đường thủy nội địa, có hiệu lực kể từ ngày 01 tháng 11 năm 2022.
[14] Điều 3 của Nghị định số 54/2022/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định số 78/2016/NĐ-CP ngày 01 tháng 7 năm 2016 của Chính phủ quy định điều kiện kinh doanh dịch vụ đào tạo thuyền viên, người lái phương tiện thủy nội địa và Nghị định số 08/2021/NĐ-CP
ngày 28 tháng 01 năm 2021 của Chính phủ quy định về quản lý hoạt động đường thủy nội địa, có hiệu lực kể từ ngày 01 tháng 11 năm 2022 quy định như sau:
“Điều 3. Hiệu lực thi hành và tổ chức thực hiện
1. Nghị định này có hiệu lực thi hành từ ngày 01 tháng 11 năm 2022.
2. Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm hướng dẫn và thi hành Nghị định này.”
Điều 2 và Điều 3 của Nghị định số 06/2024/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định số 08/2021/NĐ-CP ngày 28 tháng 01 năm 2021 của Chính phủ quy định về quản lý hoạt động đường thủy nội địa, có hiệu lực kể từ ngày 10 tháng 3 năm 2024 quy định như sau:
“Điều 2. Quy định chuyển tiếp
1. Các văn bản thỏa thuận thông số kỹ thuật xây dựng bến thủy nội địa, bến khách ngang sông, bến thủy nội địa phục vụ thi công công trình chính và các Quyết định công bố, công bố lại, gia hạn hoạt động bến thủy nội địa, bến khách ngang sông, bến thủy nội địa phục vụ thi công công trình chính đã được cơ quan có thẩm quyền ban hành trước ngày Nghị định này có hiệu lực thi hành thì tiếp tục được thực hiện đến khi hết thời hạn quy định của văn bản. Hết thời hạn quy định của văn bản, các tổ chức, cá nhân thực hiện theo quy định tại Nghị định này.
2. Các hồ sơ đề nghị thỏa thuận thông số kỹ thuật xây dựng bến thủy nội địa, bến khách ngang sông, bến thủy nội địa phục vụ thi công công trình chính và các hồ sơ đề nghị công bố, công bố lại, gia hạn hoạt động bến thủy nội địa, bến khách ngang sông, bến thủy nội địa phục vụ thi công công trình chính, công bố đóng bến thủy nội địa đã được cơ quan có thẩm quyền tiếp nhận hồ sơ trước ngày Nghị định này có hiệu lực thi hành thì cơ quan có thẩm quyền đã tiếp nhận hồ sơ tiếp tục thực hiện giải quyết theo quy định của văn bản quy phạm pháp luật có hiệu lực tại thời điểm tiếp nhận hồ sơ.
3. Trong thời hạn 90 ngày làm việc, kể từ ngày Nghị định này có hiệu lực, Sở Giao thông vận tải thực hiện bàn giao hồ sơ đề nghị công bố, công bố lại hoạt động bến thủy nội địa đã được giải quyết về Ủy ban nhân dân cấp huyện nơi có thẩm quyền công bố, công bố lại, gia hạn hoạt động bến thủy nội địa theo quy định tại khoản 2 và khoản 5 Điều 1 Nghị định này. Trong thời gian chưa bàn giao, tiếp nhận hồ sơ, nếu có trường hợp đề nghị công bố lại hoạt động bến thủy nội địa thì Sở Giao thông phối hợp cung cấp trước hồ sơ bến đó cho Ủy ban nhân dân cấp huyện để công bố hoạt động lại bến thủy nội địa.
4. Đối với hình thức thực hiện thủ tục hành chính trực tuyến qua Cổng dịch vụ công thực hiện từ ngày 01 tháng 01 năm 2025.
Điều 3. Điều khoản thi hành
1. Nghị định này có hiệu lực thi hành từ ngày 10 tháng 03 năm 2024.
2. Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm hướng dẫn và thi hành Nghị định này.”
