RESOLUTION

Regarding amending and supplementing Resolution No. 16/2000/NQ-CP dated October 18, 2000 of the Government on streamlining the establishment of administrative agencies and public service units

Implementing Conclusion No. 15-KL/TW dated July 26, 2002 of the 6th Plenary Session of the 9th Central Committee of the Party on continuing to implement Resolution No. 3 of the 7th Central Committee, Resolution No. 3 and Resolution No. 7 of the 8th Central Committee on organizational work and cadres; based on Resolution No. 07 dated May 30, 2003 of the regular meeting of the Government in May 2003, the Government has agreed to amend and supplement some measures and policies and continue to streamline the establishment of administrative agencies and public service units as stipulated in Resolution No. 16/2000/NQ-CP dated October 18, 2000 of the Government on streamlining the establishment of administrative agencies and public service units according to the following specific contents:

I. SOME MEASURES AND POLICIES FOR STREAMLINING THE ESTABLISHMENT

1. Continue to implement the policy of streamlining the establishment of administrative agencies and public service units according to Resolution No. 16/2000/NQ-CP dated October 18, 2000 of the Government on streamlining the establishment of administrative agencies and public service units until the end of 2005.

2. Supplement the target group for streamlining the establishment according to Resolution No. 16/2000/NQ-CP dated October 18, 2000 of the Government for cadres, civil servants, and employees working directly in public service units under the education, training, health, scientific research, culture information, sports, and other public service sectors.

In 2003, implement the streamlining of the establishment for teachers in mountainous provinces and the Central Highlands. From 2004, apply this to the groups mentioned in this point.

3. Provide severance pay for those who stop working due to streamlining the establishment according to Resolution No. 16/2000/NQ-CP dated October 18, 2000 of the Government in accordance with the provisions at Clause 2, Article 6 of Decree No. 03/2003/NĐ-CP dated January 15, 2003 of the Government on adjusting salaries, social allowances, and reforming the salary management mechanism.

4. Ministries, sectors, People's Committees of provinces and centrally governed cities continue to implement the streamlining of the establishment:

a) Establish and promulgate appropriate management mechanisms for public service units based on the principle of granting autonomy rights linked to responsibilities and duties in performing functions, tasks, plans, finance, personnel, and service quality of each unit;

b) Vigorously implement socialization of public activities in cities, urban areas, concentrated industrial zones, and places with developed socio-economic conditions according to Resolution No. 90/CP dated August 21, 1997 of the Government on the direction and policy of socializing educational, health, cultural activities and Decree No. 73/1999/NĐ-CP dated August 19, 1999 of the Government on policies encouraging socialization in the fields of education, health, culture, and sports.

5. The number of cadres, civil servants, and employees subject to reduction if reduced due to organizational restructuring and eliminating overlapping functions and tasks will correspondingly decrease; allow recruitment of qualified individuals to replace those reduced due to poor health or inadequate professional skills to improve quality and ensure the quantity of the cadre, civil servant, and employee team meets requirements and assigned tasks.

II. IMPLEMENTATION

1. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial and centrally governed city People's Committees shall organize the assessment of the implementation results of Resolution No. 16/2000/NQ-CP dated October 18, 2000 of the Government and report to the same-level Party Committee the results and plan for continuing to implement the streamlining of the establishment according to the provisions of this Resolution.

2. The Minister of Finance shall be responsible for arranging the state budget plan and take the lead in coordinating with the Ministry of Home Affairs to guide procedures for issuing, disbursing, paying, and settling accounts for implementing this Resolution.

3. The Minister of Home Affairs shall be responsible for taking the lead and coordinating with the Ministry of Finance to guide the implementation of this Resolution; coordinate with the Government Office to monitor, urge, and inspect the implementation of the Resolution; report regularly to the Prime Minister annually.

4. Apply the policy of streamlining the establishment stipulated in Resolution No. 16/2000/NQ-CP and this Resolution to positions of members of the Board of Directors, General Director, Deputy General Director, Director, Deputy Director, Chief Accountant, and members of the Supervisory Board within the scope that must be reorganized due to the restructuring of state-owned enterprises.

The source of funds to resolve policies for the aforementioned positions in state-owned enterprises shall be implemented according to the provisions of Decree No. 41/2002/NĐ-CP dated April 11, 2002 of the Government on policies for surplus labor due to the restructuring of state-owned enterprises.

This Resolution takes effect 15 days after its publication in the Official Gazette.
