Guidelines for implementing the adjustment of monthly allowances from July 1, 2019 for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers. From July 1, 2019

Pursuant to Decree No. 34/2017/NĐ-CP dated April 3, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to Clause 2, Article 4 of Decree No. 44/2019/NĐ-CP dated May 20, 2019 of the Government adjusting pensions, social insurance allowances, and monthly allowances;

At the proposal of the Director of the Salary Department;

The Minister of Home Affairs issues this Circular guiding the implementation of the adjustment of monthly allowances from July 1, 2019 for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.

Article 1. Scope of application

The subjects to which this Circular applies are village cadres who have retired and are receiving monthly allowances according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers (hereinafter referred to as retired village cadres).

Article 2. Adjustment of Monthly Allowance

As of July 1, 2019, the adjustment of monthly allowances for retired village cadres shall be implemented in accordance with Article 2 of Decree No. 44/2019/NĐ-CP dated May 20, 2019 of the Government adjusting pensions, social insurance allowances, and monthly allowances, increasing the monthly allowance by 7.19% over the monthly allowance received at the time of June 2019, specifically as follows:

1. Formula for adjusting the monthly allowance from July 1, 2019: Monthly allowance received from July 1, 2019

In which: The monthly allowance received at the time of June 2019 is the monthly allowance stipulated in Clause 2, Article 2 of Circular No. 08/2018/TT-BNV dated June 28, 2018 of the Minister of Home Affairs guiding the implementation of the adjustment of monthly allowances from July 1, 2018 for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers.

2. The monthly allowance received from July 1, 2019 of retired village cadres (rounded off according to the calculation formula in Clause 1 of this Article) is as follows:

a) For cadres who were originally Secretaries of the Party Committee, Chairmen of the People's Committee of villages: VND 1,974,000/month x 1.0719 = VND 2,116,000/month.

b) For cadres who were originally Deputy Secretaries, Deputy Chairmen, Standing Members of the Party Committee, Secretaries of the People's Committee, Secretaries of the People's Council, Village Militia Chiefs, Chiefs of Public Security Stations: VND 1,910,000/month x 1.0719 = VND 2,048,000/month.

c) For other positions: VND 1,768,000/month x 1.0719 = VND 1,896,000/month.

Article 3. Implementation Organization

1. Provincial People's Committees and municipal people's committees directly under the central government shall guide and implement the payment of monthly allowances from July 1, 2019 according to the guidelines set out in this Circular for the subjects within their jurisdiction.

2. The source of funds for adjusting the monthly allowance for retired village cadres shall be implemented in accordance with Clause 1, Article 3 of Decree No. 44/2019/NĐ-CP dated May 20, 2019 of the Government adjusting pensions, social insurance allowances, and monthly allowances.

Article 4. Effective date

1. This Circular takes effect from August 1, 2019.

2. The provisions of this Circular shall be implemented from July 1, 2019.

3. This Circular replaces Circular No. 08/2018/TT-BNV dated June 28, 2018 of the Minister of Home Affairs guiding the implementation of the adjustment of monthly allowances from July 1, 2018 for village cadres who have retired according to Decision No. 130-CP dated June 20, 1975 of the Council of Ministers and Decision No. 111-HĐBT dated October 13, 1981 of the Council of Ministers. During the implementation process, if there are difficulties, please report them to the Ministry of Home Affairs for research and resolution.
