Decision No. 25/2021/QĐ-TTg dated July 22, 2021 of the Prime Minister on criteria for communes, wards, and towns meeting legal access standards;

Pursuant to Decree No. 96/2017/NĐ-CP dated August 16, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to Decision No. 25/2021/QĐ-TTg dated July 22, 2021 of the Prime Minister on criteria for communes, wards, and towns meeting legal access standards;

At the proposal of the Director of the Department of Legal Propaganda and Education;

The Minister of Justice issues this Circular guiding the implementation of Decision No. 25/2021/QĐ-TTg dated July 22, 2021 of the Prime Minister on criteria for communes, wards, and towns meeting legal access standards.

Article 1. Scope of Regulation and Applicability

a) This Circular guides the implementation of Clause 6 Article 3 and Clause 5 Article 5 of Decision No. 25/2021/QĐ-TTg dated July 22, 2021 of the Prime Minister on criteria for communes, wards, and towns meeting legal access standards, including: contents, scores, methods of calculating points for criteria and indicators; evaluation materials for criteria and indicators; procedures, forms serving the evaluation and recognition of communes, wards, and towns meeting legal access standards; members, tasks, and authorities of the Evaluation Council on Legal Access Standards;

b) Responsibilities of agencies, organizations, and individuals related to the evaluation and recognition of communes, wards, and towns meeting legal access standards.

This Circular applies to communes, wards, towns, and agencies, organizations, and individuals related to the evaluation and recognition of communes, wards, and towns meeting legal access standards.

Article 2. Contents, scores, methods of calculating points for criteria and indicators; evaluation materials for criteria and indicators

1. Contents, scores, methods of calculating points for criteria and indicators; evaluation materials for criteria and indicators shall be implemented according to Appendix I attached hereto (hereinafter referred to as Appendix I).

2. The total score of criteria and indicators serving as the basis for deciding to recognize communes, wards, and towns meeting legal access standards shall be determined based on the assessment score of the Evaluation Council on Legal Access Standards.

Article 3. Procedures for evaluating and recognizing communes, wards, and towns meeting legal access standards

1. People's Committee of communes, wards, and towns (hereinafter collectively referred to as commune level) shall organize the implementation of self-scoring of criteria and indicators and the evaluation of results meeting legal access standards according to the following procedure:

a) Commune-level specialized civil servants shall monitor self-scoring of criteria and indicators, compile results; seek opinions and compile results of assessing effective legal information dissemination and education models at the grassroots level; prepare evaluation materials; propose solutions to address shortcomings in implementing criteria and indicators (if any);

b) Draft the Report on the Evaluation Results Meeting Legal Access Standards, Summary Sheet of Scores of Criteria and Indicators; information and data of the Evaluation Report and the Summary Sheet of Scores shall be calculated from January 1 to December 31 of the evaluation year, for Indicator 4 of Criterion 5, the recognized standard "Safe in Security and Order" according to the regulations of the Minister of Public Security shall be used;

c) Publicly display the draft Report on the Evaluation Results Meeting Legal Access Standards, Summary Sheet of Scores of Criteria and Indicators at the office of the commune-level People's Committee for at least five (5) days; post on the electronic portal for at least five (5) days or announce on the commune-level radio station (if available) at least three (3) times within five (5) days;

d) Compile, absorb, and explain fully and objectively the opinions of the people, suggestions, and reflections of agencies, organizations, and individuals (if any) regarding the Report on the Evaluation Results Meeting Legal Access Standards, Summary Sheet of Scores of Criteria and Indicators, and other related issues concerning scoring and evaluation of communes, wards, and towns meeting legal access standards;

đ) Organize a meeting to review, evaluate, and unify the results of meeting legal access standards of communes, wards, and towns. The meeting shall be chaired by a representative of the commune-level People's Committee leadership. Participants include specialized civil servants assigned to monitor criteria and indicators; representatives of the commune-level police; representatives of the leadership of the Vietnam Fatherland Front and political-social organizations at the commune level; Village Chiefs (collectively referred to as village chiefs); Heads of residential groups (collectively referred to as residential group heads);

e) Based on the meeting results, if communes, wards, and towns meet all conditions for recognition as meeting legal access standards as stipulated in Article 4 of Decision No. 25/2021/QĐ-TTg, the commune-level People's Committee shall submit the application file for recognition as meeting legal access standards as stipulated in Clause 4 Article 5 of Decision No. 25/2021/QĐ-TTg (in paper or electronic form) to the District Legal Department before January 10 of the following year.

For communes, wards, and towns that do not meet the conditions for recognition as meeting legal access standards, the commune-level People's Committee shall submit the Report on the Evaluation Results Meeting Legal Access Standards, Summary Sheet of Scores of Criteria and Indicators (in paper or electronic form) before January 10 of the following year for the District Legal Department to compile and list communes, wards, and towns that have not met legal access standards for submission to the Chairman of the District People's Committee.

2. The district-level People's Committee shall organize the evaluation, examination, and decision-making on recognizing communes, wards, and towns meeting legal access standards according to the following procedure:

a) The District Legal Department shall receive, review, and inspect the application files for recognition as meeting legal access standards of communes, wards, and towns; request the commune-level People's Committee to supplement and complete relevant files and materials (if necessary). The commune-level People's Committee shall be responsible for supplementing and completing files and materials within the latest three (3) working days from the date of receipt of the request.

b) Organize a meeting of the Legal Access Standard Evaluation Council or seek written opinions from members of the Council to advise and review the application for recognition as meeting the legal access standard of communes, wards, and towns;

c) Based on the results of the advisory and review by the Legal Access Standard Evaluation Council, the Department of Justice shall complete the file and submit it to the Chairman of the People's Committee at the district level (in paper form or electronic form) for consideration and decision to recognize communes, wards, and towns as meeting the legal access standard;

The submitted file includes: The application for recognition as meeting the legal access standard of communes, wards, and towns; the Legal Access Standard Evaluation Council's review report attached with the minutes of the meeting or the summary of the evaluation opinions of the Council members (if no meeting is organized); the summary of scores of each criterion and indicator of communes, wards, and towns reviewed by the Legal Access Standard Evaluation Council; the draft Decision recognizing communes, wards, and towns as meeting the legal access standard attached with the list of communes, wards, and towns recognized as meeting the legal access standard and the list of communes, wards, and towns not meeting the legal access standard;

d) The Chairman of the People's Committee at the district level shall consider and decide to recognize communes, wards, and towns as meeting the legal access standard and announce the results of communes, wards, and towns recognized as meeting the legal access standard before February 10 of the following year after the assessment year. The announcement of the results shall be implemented on the Portal (or Website) of the People's Committee at the district level within a period not exceeding two working days from the date of signing the decision recognizing communes, wards, and towns as meeting the legal access standard;

Article 4. Forms serving the evaluation and recognition of communes, wards, and towns as meeting the legal access standard;

1. Forms serving the evaluation and application for recognition of communes, wards, and towns as meeting the legal access standard, carried out by the People's Committee at the commune level:

a) Report on the evaluation results and application for recognition of communes, wards, and towns as meeting the legal access standard (Form 01 Appendix II);

b) Summary of scores of each criterion and indicator (Form 02 Appendix II);

c) Summary of the people's opinions, suggestions, and reflections on the evaluation results of meeting the legal access standard (Form 03 Appendix II);

d) Opinion solicitation form, summary of the evaluation results on the form, model, and effectiveness of legal information dissemination and education at the grassroots level (Form 04 Appendix II);

2. Forms serving the evaluation and recognition of communes, wards, and towns as meeting the legal access standard, carried out by the People's Committee at the district level:

a) Minutes of the meeting of the Legal Access Standard Evaluation Council (Form 05 Appendix II);

b) Opinion solicitation form, summary of the evaluation opinions of the Legal Access Standard Evaluation Council members (Form 06 Appendix II);

c) Summary of scores of each criterion and indicator reviewed by the Legal Access Standard Evaluation Council (Form 07 Appendix II);

d) Decision recognizing communes, wards, and towns as meeting the legal access standard; list of communes, wards, and towns recognized as meeting the legal access standard; list of communes, wards, and towns not meeting the legal access standard (Form 08 Appendix II);

3. Forms serving the reporting, monitoring, and management of communes, wards, and towns recognized as meeting the legal access standard, carried out by the People's Committee at the district level, People's Committee at the provincial level, and centrally governed cities (hereinafter referred to collectively as the provincial level):

a) Summary of information and data on the implementation of criteria and indicators in the locality (Form 09 Appendix II);

b) Report on the results of the evaluation and recognition of communes, wards, and towns as meeting the legal access standard (Form 10 Appendix II).

Article 5. Legal Access Standard Evaluation Council

1. The Legal Access Standard Evaluation Council (hereinafter referred to as the Council) shall advise and assist the Chairman of the People's Committee at the district level in considering and deciding on recognizing communes, wards, towns as meeting the legal access standard, and perform the following tasks and powers:

a) Reviewing and evaluating the files, scoring results of criteria, indicators, and conditions for recognizing communes, wards, towns as meeting the legal access standard;

b) Advising on initiatives and solutions to enhance effectiveness, address limitations, resolve existing issues, and remove difficulties and obstacles in implementing the criteria and indicators;

c) Performing other tasks assigned by the Chairman of the People's Committee at the district level.

2. Composition of the Council:

a) Chairperson of the Council: The Chairman or Vice-Chairman of the People's Committee at the district level;

b) Vice-Chairperson of the Council: Head of the Justice Office; inviting a representative of the leadership of the Vietnam Fatherland Front Committee at the district level to serve as Vice-Chairperson of the Council;

c) Member of the Council: Representatives of the heads of specialized agencies under the People's Committee at the district level related to the criteria and indicators; representatives of the heads of the Police Force at the district level; inviting representatives of the heads of the Mass Mobilization Department and Propaganda Department at the district level to participate in the Council;

d) Secretary of the Council: Civil Servant of the Justice Office.

3. The number of members of the Council shall be decided by the Chairman of the People's Committee at the district level but not exceeding fifteen people. Members of the Council work on a concurrent basis.

4. Duties of Council members:

a) Reviewing and participating in opinions on the files, scoring results of criteria, indicators, and conditions for recognizing communes, wards, towns as meeting the legal access standard;

b) Advising on initiatives and solutions and organizing the implementation of these initiatives and solutions for the criteria and indicators;

c) Attending all meetings of the Council. In case they cannot attend a meeting due to valid reasons, they must submit their opinions in writing regarding the contents stipulated in point a and point b of this clause to the Justice Office for consolidation and reporting to the Chairperson of the Council;

d) The Chairperson of the Council directs and coordinates the overall activities and convenes and chairs Council meetings. The Vice-Chairperson of the Council has the duty to chair meetings and perform tasks delegated by the Chairperson of the Council when absent.

5. A Council meeting shall be held when at least two-thirds (2/3) of the total number of members are present. At the meeting, Council members provide advice, review, and approve the contents requiring Council opinions. The meeting results shall be recorded in minutes signed by the person chairing the Council meeting and the Secretary of the Council.

6. The Justice Office shall be responsible for advising and assisting the Chairperson of the Council and the Chairman of the People's Committee at the district level in performing the following tasks:

a) Proposing the establishment and improvement of the Legal Access Standard Evaluation Council;

b) Ensuring coordination and information exchange between Council members and the Justice Office during the performance of tasks;

c) Preparing materials and agenda for Council meetings and sending them to Council members at least three (3) working days before the meeting date;

d) Collecting and perfecting the documents in the file requesting recognition of communes, wards, towns as meeting the legal access standard; consolidating the proposals of Council members for the Chairman of the People's Committee at the district level to consider and decide;

đ) Advising the Chairman of the People's Committee at the district level to organize the implementation or report and propose solutions to competent authorities to enhance effectiveness, address limitations, resolve existing issues, and remove difficulties and obstacles in implementing the criteria and indicators;

e) Implementing the archiving of files and materials serving the advisory and review activities of the Council in accordance with laws on archives and records management.

Article 6. Responsibilities of agencies and organizations

1. The unit with the function of the Ministry of Justice shall take the lead in advising on state management of communes, wards, and towns meeting the standard for access to the rule of law, assist the Minister of Justice in directing, guiding, monitoring, urging, and inspecting the implementation of this Circular.

2. The People's Committee at the provincial level shall direct the People's Committees at the district and commune levels to organize the implementation of this Circular within their jurisdiction; compile and report the results of tasks related to assessing and recognizing communes, wards, and towns meeting the standard for access to the rule of law in their locality to the Ministry of Justice before February 20 of the year immediately following the assessment year for consolidation and reporting to the Prime Minister.

3. The People's Committee at the district level shall direct specialized departments under its jurisdiction to advise and assist in the assessment and recognition of communes, wards, and towns meeting the standard for access to the rule of law according to the provisions of this Circular; compile and report the results of tasks related to assessing and recognizing communes, wards, and towns meeting the standard for access to the rule of law in their locality to the People's Committee at the provincial level before February 15 of the year immediately following the assessment year for consolidation and reporting to the Ministry of Justice.

4. The People's Committee at the commune level shall direct and organize the implementation of this Circular in their locality; assign professional civil servants to monitor regularly, score, and evaluate each criterion and indicator linked to the responsibilities and tasks of the civil servants.

5. The Department of Justice, Justice Office, and Justice - Household Registration Civil Servants shall be the focal point for advising and assisting the People's Committee and the Chairman of the People's Committee at the same level in directing, guiding, implementing, monitoring, urging, and inspecting the implementation of this Circular in their locality.

6. When there are recommendations, reflections, complaints, or denunciations regarding issues related to the assessment and recognition of communes, wards, and towns meeting the standard for access to the rule of law in their area, the Department of Justice, Justice Office, and Justice - Household Registration Civil Servants shall promptly report and advise the Chairman of the People's Committee at the same level to inspect, direct, and coordinate with relevant agencies and units to handle them promptly in accordance with the law.

Article 7. Transitional Provisions

The organization of the assessment and recognition of communes, wards, and towns meeting the standard for access to the rule of law in 2021 shall continue to be implemented according to the provisions of Circular No. 07/2017/TT-BTP dated July 28, 2017, issued by the Minister of Justice, which stipulates the scoring system, guidelines for calculating points for legal access indicators, the Legal Access Assessment Council, and some contents on building communes, wards, and towns meeting the standard for access to the rule of law.

Article 8. Effective Date

1. This Circular takes effect from January 1, 2022, and replaces Circular No. 07/2017/TT-BTP dated July 28, 2017, issued by the Minister of Justice, which stipulates the scoring system, guidelines for calculating points for legal access indicators, the Legal Access Assessment Council, and some contents on building communes, wards, and towns meeting the standard for access to the rule of law.

2. The Chairmen of the People's Committees, Directors of the Departments of Justice of provinces and centrally governed cities, Heads of units under the Ministry of Justice, and other relevant agencies, organizations, and individuals are responsible for implementing this Circular.

3. During the implementation process, if legal normative documents cited and applied in this Circular are amended, supplemented, or replaced by new legal normative documents, they shall be applied according to the new documents; if any issues arise or difficulties occur, the People's Committees at the provincial level, Departments of Justice, and relevant agencies and individuals should promptly reflect these issues to the Ministry of Justice for research and resolution.

I. Guidelines for scores, methods of calculating points for criteria and indicators; documents for assessing criteria and indicators

Note:

(1) The assessment documents in Appendix I serve as the basis for the People's Committee at the commune level to determine the results and scores of the criteria and indicators and are not required to be submitted together with the application dossier for recognition as meeting the standard for access to the rule of law as stipulated in Clause 4, Article 5 of Decision No. 25/2021/QĐ-TTg. In case of necessity, competent state authorities and the People's Committee at the district level may request the People's Committee at the commune level to provide specific documents to facilitate inspection, evaluation, review, and recognition of communes, wards, and towns meeting the standard for access to the rule of law.

Plans issued by the People's Committee at the commune level to implement activities under Indicator 2, Indicator 3, and Indicator 4 of Criterion 4 in Appendix I shall be carried out in accordance with the law on democracy at the commune, ward, and town level.

In cases where the People's Committee at the commune level issues one (1) general plan to implement the above contents, it will still be considered as assessment and scoring documents for Indicators 2, Indicator 3, and Indicator 4 of Criterion 4.

II. Guidelines for Indicator 2, Criterion 1; Indicator 4, Criterion 2

1. Indicator 2, Criterion 1

Administrative documents directly related to the rights and interests of organizations and individuals issued by the commune-level authority include:

Resolutions of the People's Council at the commune level, Decisions of the People's Committee at the commune level, and Decisions of the Chairman of the People's Committee at the commune level to organize the implementation of assigned tasks to ensure social order and safety, combat crime, prevent violations of the law, protect the assets of agencies and organizations, safeguard the lives, freedoms, reputations, personalities, properties, and other legitimate rights and interests of citizens in certain economic, land, natural resources-environment, health, culture, and social welfare areas; local budget estimates and final accounts; policies on investment programs and projects of communes, wards, and towns within the scope of delegated powers.

Decisions on administrative penalties, decisions applying preventive measures and ensuring the handling of administrative violations made by the Chairman of the People's Committee at the commune level and the Head of the Police Station at the commune level in accordance with the law on handling administrative violations.

2. Indicator 4, Criterion 2

The form, model of information dissemination, popularization, and legal education at the grassroots level is considered effective if it receives confirmation from at least 80% of the representatives of the Vietnam Fatherland Front Committee at the commune level, social-political organizations at the commune level, and village representatives that the model is effective and suitable for disseminating information, popularizing, and educating the law, implemented throughout the entire area, maintained regularly and continuously, and has potential for replication and expansion.
