CIRCULAR

Guidelines for the staffing levels of personnel in public service units under the labor, war invalids, and social affairs sectors

Pursuant to Decree No.62/2022/ND-CP of September 12, 2022, by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - Invalids and Social Affairs;

Pursuant to Decree No.106/2020/ND-CP of September 10, 2020, by the Government stipulating positions and staffing levels in public service units;

Pursuant to Decree No.120/2020/ND-CP of October 7, 2020, by the Government stipulating the establishment, restructuring, and dissolution of public service units;

The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.

The Minister of Labor - Invalids and Social Affairs issues this Circular to guide the staffing levels of personnel in public service units under the labor, war invalids, and social affairs sectors.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular guides the staffing levels of personnel in public service units under the labor, war invalids, and social affairs sectors.

Article 2. Applicability

Article 1. This Circular applies to public service units under the labor, war invalids, and social affairs sectors established by competent authorities in accordance with the law and other related agencies, organizations, and individuals.

2. This Circular does not apply to:

a) Public service units under the Ministry of Public Security and the Ministry of National Defense;

b) Public service units under the management of special administrative-economic units.

Article 3. Principles and bases for determining the number of personnel in public service units

Clause 1. The principle for determining the number of personnel in public service units under the labor, war invalids, and social affairs sectors is based on the principles set forth in Point d, Clause 1, Article 5 and Point d, Clause 1, Clause 2, and Clause 3, Article 6 of Decree No. 120/2020/ND-CP dated October 7, 2020, of the Government stipulating the establishment, restructuring, and dissolution of public service units.

Clause 2. The basis for determining the number of personnel in public service units under the labor, war invalids, and social affairs sectors shall be implemented in accordance with the provisions of Clause 5, Article 3 and Clause 2, Article 4 of Decree No. 106/2020/ND-CP dated September 10, 2020, of the Government regarding positions and staffing levels in public service units.

Clause 3. Based on the complexity of the work and the number of personnel needed to be arranged according to each position in public service units under the labor, war invalids, and social affairs sectors, which have been approved by the competent authority.

Clause 4. Ensuring consistency and synchronization with specialized laws and regulations in the labor, war invalids, and social affairs sectors.

Chapter II
STAFFING LEVELS OF PERSONNEL IN

PUBLIC SERVICE UNITS UNDER THE SECTORS OF

LABOR, WAR INVALIDS, AND SOCIAL AFFAIRS

Article 4. Staffing levels of personnel in public service units providing services in the vocational education sector

Public service units in the vocational education sector base their staffing levels on actual operational conditions, scale of training, and criteria for the ratio of students and trainees to teachers and lecturers, with a maximum ratio of 25 to determine the appropriate staffing level of teachers and lecturers.

Article 5. Staffing levels of personnel in public service units providing services in occupational safety and health

Public service units providing services in occupational safety and health base their staffing levels on actual unit conditions, functions, tasks, organizational structures, and reduction plans (if any) to determine the minimum number of personnel for each position and the minimum number of personnel in the unit, ensuring compliance with the following requirements:

Ensuring that the minimum number of personnel in the unit is 15 people (excluding public service units providing basic and essential public services established in accordance with specialized laws).

Article 6. Staffing levels for public service units providing social assistance services and child protection; social services in public social welfare facilities

1. Public service units providing social assistance services and child protection; social services in public social welfare facilities shall base staffing levels for specialized vocational positions within the unit on the characteristics of the target group, scale, and number of individuals as follows:

Child Care Staff

1 childcare staff member is responsible for 1 infant under 18 months old, up to 6 normal children aged 18 months to under 6 years, or up to 10 normal children aged 6 to under 16 years; cares for up to 4 disabled or mentally ill children or those with HIV/AIDS aged 18 months to under 6 years; cares for up to 5 disabled or mentally ill children or those with HIV/AIDS aged 6 to under 16 years

b)

Disabled Care Staff

1 care staff member is responsible for up to 10 self-sufficient disabled persons or up to 4 non-self-sufficient disabled persons

c)

Elderly Care Staff

1 care staff member is responsible for up to 10 self-sufficient elderly persons or up to 4 non-self-sufficient elderly persons

d)

Mental Health Care Staff

1 care staff member is responsible for up to 2 severely mentally ill individuals, up to 4 moderately mentally ill individuals, or up to 10 mentally ill individuals who have recovered and stabilized

Homeless Care Staff

1 care staff member is responsible for up to 12 homeless individuals (this standard applies during periods when homeless individuals are received at the facility for assessment and return to their place of origin)

Psychological Staff

Each facility must have at least 1 psychological staff member

6.

Medical Staff

1 medical staff member is responsible for the health care of up to 50 individuals

7.

Nutrition Staff

1 nutrition staff member serves up to 20 individuals

8.

Rehabilitation Staff

1 rehabilitation staff member guides up to 5 individuals in functional recovery

9.

Cultural and Vocational Education Teacher

1 teacher is responsible for teaching cultural and vocational education to up to 9 individuals

10.

Professional Positions Shared and Support Services shall not exceed 20% of the total number of staff members assigned by the competent authority

2. For units with functions and tasks requiring specialized positions in healthcare and other professional requirements, the unit shall determine the appropriate staffing level based on guidelines from the Ministry of Health and the relevant sectoral management ministry.

Article 7. Staffing Levels for Public Service Units Providing Employment Services

Public service units providing employment services shall base staffing levels on the nature, characteristics of the target group, and the scale of labor force in the managed area as follows:

1. Public service units providing services for care of persons with merit shall determine the staffing standards based on the characteristics of the target group being cared for and rehabilitated, the scale and number of the target group being cared for and rehabilitated, as follows:

Article 10. Annual Adjustment of the Number of Employees

The annual adjustment of the number of employees in public service units shall be carried out in accordance with Clause 1 of Article 11 of Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on job positions and staffing levels in public service units.

Chapter III
IMPLEMENTATION

Article 11. Effectiveness and Responsibility for Implementation

1. This Circular takes effect from October 15, 2024.

2. The Minister, Heads of Ministries equivalent to Ministries, Heads of agencies under the Government, heads of organizations established by the Government or the Prime Minister that are not public service units, Chairpersons of People's Committees of provinces and centrally-administered cities, relevant agencies, organizations, and individuals are responsible for implementing this Circular.

3. In the course of implementation, if there are any difficulties, agencies, organizations, and individuals are requested to report to the Ministry of Labor - Invalids and Social Affairs for guidance and resolution.
