Regulations on the dossier for each type of urban planning

Based on the Urban Planning Law No. 30/2009/QH12;

Pursuant to the Government Decree No. 37/2010/NĐ-CP dated April 7, 2010 on the preparation, review, approval, and management of urban planning;

Based on the Government's Decree No. 17/2008/NĐ-CP dated February 4, 2008, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction,

The Ministry of Construction hereby stipulates the dossier for each type of urban planning as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation.

This Circular stipulates the dossier for the task and project of urban planning including: General urban planning, Zoning planning, Detailed planning, Specialized technical infrastructure planning, and individual urban design projects.

Article 2. Content and presentation format.

1. The content of the explanation and drawings of the task and project of urban planning must be appropriate to each type of planning and comply with the provisions of this Circular.

2. The system of drawing symbols for urban planning projects must comply with Decision No. 21/2005/QĐ-BXD dated July 22, 2005, of the Minister of Construction. For zoning planning, the regulations applicable to detailed planning at a scale of 1/2,000 shall apply.

Article 3. Dossier for the task of urban planning.

The dossier for the task of urban planning includes the explanation, drawings, and draft decision approving the task of urban planning.

Article 4. Dossier for the project of urban planning.

1. Comprehensive explanation and summary explanation. The summary explanation is written concisely based on the comprehensive explanation, only briefly stating the conclusions and results drawn from the research. As for the current status evaluation section, it only summarizes the issues that need to be addressed.

2. Drawings of the urban planning project.

a) The components of the drawings include current state drawings, planning drawings, perspective drawings, and illustrative drawings. The scale of the drawings is specified according to each type of planning project and the object of planning.

b) All drawings must fully reflect the main technical parameters of each specialty according to the stages of planning. Current state drawings and planning drawings must be consistent in scale, symbols, and colors.

3. Draft decision approving the urban planning project.

4. Draft Management Regulations according to the urban planning project. The management regulations according to the planning project must be implemented in accordance with Article 35 of the Urban Planning Law and the Appendix attached to this Circular.

5. CD storing the entire dossier of the urban planning project including explanations, drawings, and Management Regulations according to the urban planning project.

Chapter II

CONTENT OF THE DOSSIER FOR THE TASK OF URBAN PLANNING

Article 5. For general urban planning.

1. Explanation:

Fully describe the arguments in determining the reasons for establishing the planning, the scope and boundaries of the general planning, the nature of the city, the viewpoint and objectives of the project, the role of the city in the region and nationwide.

Describe the basic indicators expected regarding population, land, and technical infrastructure.

Describe the requirements and basic principles for current status surveys and data collection, urban development orientation, spatial organization structure, key facilities, social infrastructure, organization of the technical infrastructure framework system, strategic environmental assessment.

List the directory, quantity of documents, products of the project, progress, and implementation organization.

2. Components of drawings include:

Including location diagram, regional relationship diagram, scale 1/50,000 or 1/100,000, and boundary research map, planning research scope map, scale 1/10,000 or 1/25,000 or 1/50,000.

3. Draft decision approving the general urban planning task:

Fully reflect all contents prescribed in point a, Clause 1, Article 34 of Government Decree No. 37/2010/NĐ-CP dated April 7, 2010, on the establishment, review, approval, and management of urban planning (hereinafter referred to as Decree No. 37/2010/NĐ-CP).

Article 6. Regarding district planning.

1. Explanation:

Fully present the arguments in determining the scope of boundaries, area, and nature of the district planning area.

Present the basic indicators expected for population, land use, social infrastructure, and technical infrastructure based on the approved general urban planning.

Present the requirements and basic principles for current status surveys and data collection, spatial organization, functional zoning, architecture, technical infrastructure connection, strategic environmental assessment.

List the directory, quantity of documents, products of the project, progress, and implementation organization.

2. Components of drawings include:

Location map of the planning area extracted from the general urban planning.

Map of the research boundary, planning area scope, scale 1/2,000 or 1/5,000.

3. Draft decision approving the planning assignment.

Fully reflect all contents stipulated in Point b Clause 1 Article 34 of Decree No. 37/2010/ND-CP.

Article 7. Regarding detailed planning.

1. Explanation:

Fully present the arguments in determining the necessity, scope of boundaries, area, and function of the detailed planning area.

Present the basic indicators expected to be applied regarding scale, land use, social infrastructure, and technical infrastructure based on the approved district planning.

Present the requirements and basic principles for current status surveys and data collection, spatial organization, landscape architecture, technical infrastructure connection, strategic environmental assessment, and other research requirements.

List the items of construction projects needed to be invested and built within the detailed planning area. List the number of files and products of the project; progress and implementation organization.

2. Components of drawings include:

Location map of the planning area extracted from the district planning or general urban planning.

Map of the research boundary, planning area scope, scale 1/500.

3. Draft decision approving the detailed planning assignment.

Fully reflect all contents stipulated in Point c Clause 1 Article 34 of Decree No. 37/2010/ND-CP.

Article 8. Regarding individual urban design projects.

1. Explanation:

Fully present the arguments in determining the reasons for establishing the urban design, viewpoints and objectives, research scope and boundaries of the urban design.

Present the economic-technical indicators related to approved planning projects. Analyze and propose the expected application indicators for facade determination, street planning, building height for each project; setback of projects within the research scope.

Present the requirements and basic principles for current status surveys and data collection, spatial organization (public green spaces, gardens, street trees, and water surfaces), landscape architecture (color, materials, form, architectural details of buildings and other architectural objects).

List the number of files and products of the project; progress and implementation organization.

2. Components of drawings include:

Location map of the urban design area extracted from the detailed planning or district planning or general urban planning.

Map of the research boundary, planning area scope for individual urban design.

3. Draft decision approving the individual urban design assignment.

Article 9. Regarding technical infrastructure sector planning.

1. Explanation

Present the reasons for establishing the planning, viewpoints and objectives of the project according to the technical infrastructure sector.

Present the requirements for comprehensive and overall evaluation of the current status of the technical infrastructure sector; review, analyze, and select economic-technical indicators; forecast needs; specific requirements for the location and scale of key facilities as well as solutions for technical network.

List the project files and products; progress and implementation organization.

2. Drawings:

Map of the research boundary for establishing technical infrastructure sector planning at a scale of 1/10,000 or 1/50,000.

3. Draft decision approving the technical infrastructure sector planning assignment.

Chapter III

CONTENTS OF THE URBAN PLANNING PROJECT FILE

Article 10. Regarding the general urban planning.

1. Central city.

a) Comprehensive explanation:

Fully present all arguments, scientific and practical bases to clarify the contents of the project as stipulated in Article 15 of Decree No. 37/2010/NĐ-CP of the Government. The explanation must include diagrams, small-scale drawings on A3 paper, statistical tables, calculation appendices, and illustrative images.

The comprehensive explanation of the project's dossier for the general urban planning of a central city should focus on the following contents:

- Objectives, driving forces for development, population size, land indicators, social infrastructure, technical infrastructure for the entire city, each urban area, and each functional zone.

- Development model, spatial structure of the entire city including: orientation for developing the urban system within the city; orientation for other functional zones for the entire city (industrial, tourism, ecological, conservation, etc.); orientation for developing rural residential areas; orientation for developing spatial axes and development corridors of the city.

- Orientation for spatial development of the central urban area including: direction for development and expansion of the central urban area; determination of the scope and scale of functional zones; to serve as a basis for determining population density indicators, urban land use planning indicators, and development principles for functional zones.

- Orientation for technical infrastructure development including: orientation for developing technical infrastructure for the entire city and orientation for developing technical infrastructure for the central urban area to serve as a basis for implementing specialized technical infrastructure planning projects for central cities.

b) Components of the drawings include:

- Diagram of location and regional connections, scale 1/50,000 or 1/100,000 or 1/250,000.

- Current status maps including: current land use, architectural landscape, transportation, urban power supply and lighting, water supply, ground level and stormwater drainage, sewage drainage, solid waste collection, cemeteries, environment, comprehensive assessment and selection of construction land, scale 1/25,000 or 1/50,000.

- Diagram of urban development structure (minimum two options. This diagram is only used for research reports and does not form part of the approval dossier).

- Diagram of spatial development orientation for the entire urban area, scale 1/25,000 or 1/50,000.

- Diagram of technical infrastructure development orientation for the entire urban area, scale 1/25,000 or 1/50,000.

- Map of land use planning and functional zoning of the central urban area according to planning phases, scale 1/10,000 or 1/25,000.

- Maps of development orientation for the technical infrastructure system and environmental protection of the central urban area - scale 1/10,000 or 1/25,000.

- Strategic environmental assessment map - scale 1/10,000 or 1/25,000.

c) Management regulations based on the general urban planning project.

Management regulations based on the general urban planning project must fully reflect the contents stipulated in Clause 1 of Article 35 of the Urban Planning Law and must be accompanied by diagrams. The outline of management regulations based on the general urban planning project is guided by the Appendix attached to this Circular.

d) Draft Decision approving the general urban planning project.

2. City under Province, town.

a) Comprehensive explanation:

Fully present all arguments, scientific and practical bases to clarify the contents of the project as stipulated in Article 16 of Decree No. 37/2010/NĐ-CP of the Government. The explanation must include diagrams, small-scale drawings on A3 paper, statistical tables, calculation appendices, and illustrative images.

The comprehensive explanation of the project's dossier for the general urban planning of a city under Province, town should focus on the following contents:

- Objectives, driving forces for development, population size, land indicators, social infrastructure, technical infrastructure for the urban area.

- Spatial development orientation for the urban area including: urban development model and direction; determination of systems of centers (including underground space usage for underground construction), green parks, and urban open spaces; orientation for developing rural residential areas; proposal for organizing space, architecture for architectural and scenic areas, main spatial axes, squares, city gates, and urban focal points.

b) Components of the drawings include:

- Diagram of location and regional connections, scale 1/50,000 or 1/250,000.

- Current status maps including: current land use, architectural landscape, transportation, urban power supply and lighting, water supply, ground level and stormwater drainage, sewage drainage, solid waste collection, cemeteries, environment, comprehensive assessment and selection of construction land, scale 1/10,000 or 1/25,000.

- Diagram of urban development structure (minimum two options. This diagram is only used for research reports and does not form part of the approval dossier).

- Diagram of spatial development orientation for the urban area, scale 1/10,000 or 1/25,000.

- Map of land use planning and functional zoning according to planning phases, scale 1/10,000 or 1/25,000.

- Maps of development orientation for the technical infrastructure system and environmental protection, scale 1/10,000 or 1/25,000.

c) Management regulations based on the general urban planning project for the city.

Management regulations based on the general urban planning project for the city must fully reflect the contents stipulated in Clause 1 of Article 35 of the Urban Planning Law and must be accompanied by diagrams. The outline of management regulations based on the general urban planning project is guided by the Appendix attached to this Circular.

d) Draft Decision approving the general urban planning project.

3. Town, urban type V not yet recognized as a town.

a) Comprehensive explanation:

Fully present all arguments, scientific and practical bases to clarify the contents of the project as stipulated in Article 17 of Decree No. 37/2010/NĐ-CP of the Government. The explanation must include diagrams, small-scale drawings on A3 paper, statistical tables, calculation appendices, and illustrative images.

The comprehensive explanation of the project's dossier for the general urban planning of a town, urban type V not yet recognized as a town should focus on the following contents:

- Objectives, driving forces for development, population size, land indicators, social infrastructure, technical infrastructure for the urban area.

- Spatial development orientation for the urban area including: direction for urban development; determination of the scope and scale of functional zones of the urban area; determination of urban centers, green parks, and open spaces.

- Orientation for organizing space, architecture, and landscape for urban functional zones, main spatial axes.

b) Components of the drawings include:

- Diagram of location and regional connections, scale 1/10,000 or 1/25,000.

- The current status maps include: land use status, landscape architecture, traffic, urban power supply and lighting, water supply, ground level and stormwater drainage, wastewater drainage, solid waste collection, cemeteries, environment, comprehensive assessment and selection of construction land, at a scale of 1:2,000 or 1:5,000.

- Urban development structure diagrams (at least two options). These diagrams are only used for research reports and are not included in the approval dossier.

- Diagrams indicating the orientation for urban spatial development, at a scale of 1:2,000 or 1:5,000.

- Land use planning and functional zoning maps according to different planning phases, at a scale of 1:2,000 or 1:5,000.

- Maps indicating the orientation for the development of technical infrastructure systems and environmental protection, at a scale of 1:2,000 or 1:5,000.

c) Management regulations based on the general urban planning project for the city.

Management regulations based on the general urban planning project for the city must fully reflect the contents stipulated in Clause 1 of Article 35 of the Urban Planning Law and must be accompanied by diagrams. The outline of management regulations based on the general urban planning project is guided by the Appendix attached to this Circular.

d) Draft Decision approving the master plan.

Article 11. For district planning.

1. Comprehensive explanation:

Provide all arguments, scientific and practical bases to clarify the contents of the project as stipulated in Article 19 of Decree No. 37/2010/NĐ-CP of the Government. The explanation must include diagrams, small-scale drawings on A3 paper, statistical tables, calculation appendices, and illustrative images.

The explanation of the district planning project dossier should focus on the following contents:

- Objectives and scope of planning to meet the needs for establishing investment construction projects.

- Determining the land use indicators for urban planning, social infrastructure, and technical infrastructure for the entire planned area.

- Determining the principles and requirements for organizing space, architecture, and landscape for each functional zone, each block, main streets, open space areas, and key areas.

- Determining the priority technical infrastructure programs and resources for implementation.

2. Components of drawings include:

- Location and boundary diagram of the land plot, at a scale of 1:10,000 or 1:25,000.

- Current status map of architectural landscape and construction land evaluation, at a scale of 1:2,000 or 1:5,000.

- Current status maps of technical infrastructure systems and environmental protection, at a scale of 1:2,000 or 1:5,000.

- Master plan map of overall land use layout, at a scale of 1:2,000 or 1:5,000.

- Diagram of spatial organization of architecture and landscape, at a scale of 1:2,000 or 1:5,000.

- Traffic planning map and red-line boundaries, construction boundaries, at a scale of 1:2,000 or 1:5,000.

- Other technical infrastructure system and environmental planning maps, at a scale of 1:2,000 or 1:5,000.

- Integrated technical pipeline and cable map, at a scale of 1:2,000 or 1:5,000.

- Strategic environmental assessment map, at a scale of 1:2,000 or 1:5,000.

3. Management regulations according to the district planning project.

Management regulations according to the district planning project must fully reflect the provisions set out in Clause 2 of Article 35 of the Urban Planning Law and must include diagrams of functional zones attached. The framework for management regulations according to the planning project is guided by the Appendix attached to this Circular.

Article 12. For detailed planning.

1. Comprehensive explanation:

Provide all arguments, scientific and practical bases to clarify the contents of the project as stipulated in Article 20 of Decree No. 37/2010/NĐ-CP of the Government. The explanation must include diagrams, small-scale drawings on A3 paper, statistical tables, calculation appendices, and illustrative images.

The explanation of the detailed urban planning project dossier should focus on the following contents:

- Determining population indicators, social infrastructure, technical infrastructure, and requirements for organizing space, architecture for the entire planned area; land use indicators and architectural requirements for each plot; arrangement of technical infrastructure networks up to the plot boundaries.

- Determining the location and scale of special areas that need to be controlled, contents to be implemented for control, and regulations to be enforced.

- Specifying or proposing specific design solutions.

- Determining areas for underground construction (underground public facilities, high-rise residential buildings with basement floors...).

2. The drawing components include:

- Location and boundary diagram of the land plot, at a scale of 1:2,000 or 1:5,000.

- Current status map of architectural landscape and construction land evaluation, at a scale of 1:500.

- Current status maps of technical infrastructure systems, at a scale of 1:500.

- Master plan map of overall land use layout, at a scale of 1:500.

- Diagram of spatial organization, architecture, and landscape.

- Red-line boundary, construction boundary, and protective corridors for technical infrastructure lines map, at a scale of 1:500.

- Detailed planning maps of technical infrastructure systems and environment, at a scale of 1:500.

- Integrated technical pipeline and cable map, at a scale of 1:500.

- Strategic environmental assessment map, at a scale of 1:500.

Additional topographic maps incorporating cadastral maps should be provided for the following types of maps: current status of architectural landscape and construction land evaluation; current status of technical infrastructure systems; master plan of overall land use layout; red-line boundary, construction boundary, and protective corridors for technical infrastructure lines; detailed planning of technical infrastructure systems and environment.

3. Management regulations according to the detailed planning project.

Management regulations according to the detailed planning project must fully reflect the provisions set out in Clause 3 of Article 35 of the Urban Planning Law and attached diagrams. The framework for management regulations according to the planning project is guided by the Appendix attached to this Circular.

Article 13. Regarding urban technical infrastructure sector planning.

1. Urban transportation sector planning project.

a) Comprehensive explanation:

Analyze, synthesize, and evaluate the current status of urban transportation system construction and development; planning solutions for the urban transportation system must ensure the contents stipulated in Article 22 of Decree No. 37/2010/NĐ-CP. The explanatory notes must include diagrams, A3-sized scaled drawings, statistical tables, calculation appendices, and illustrative images.

b) Components of the drawings include:

- Diagram showing location and regional connectivity indicating: research boundaries, planning scope, main transportation network connections, scale 1/50,000 or 1/250,000.

- Current situation map of the transportation system showing external transportation networks, urban transportation networks; locations and scales of railway stations, airports, river ports, sea ports, inter-provincial bus terminals, large parking lots, scale 1/10,000 or 1/25,000.

- Diagram of planned urban transportation system, scale 1/10,000 or 1/25,000:

+ External transportation system including: scale, route direction of national highways, railways, waterways, airways; locations and scales of airports, railway stations, ports, inland ports, inter-provincial bus terminals.

+ Urban transportation system including: urban road network (to major city streets); urban rail transit; waterways; locations, types, scales of important intersections, parking areas, central passenger transport stations, large bridges crossing rivers, overpasses, highway tunnels; main public passenger transport routes.

2. Urban land level and surface drainage planning project.

a) Comprehensive explanation:

Analyze, synthesize, and evaluate topography, engineering geological conditions, hydrology, areas with environmental hazards, propose planning solutions for land levels and surface drainage ensuring the contents stipulated in Article 23 of Decree No. 37/2010/NĐ-CP. The explanatory notes must include diagrams, A3-sized scaled drawings, analytical tables, and calculations.

b) Components of the drawings include:

- Diagram showing location and regional connectivity indicating: research boundaries, planning scope, main river systems and irrigation systems of the region, scale 1/50,000 or 1/250,000.

- Current situation map evaluating overall construction land, surface drainage system; locations and scales of key facilities, scale 1/10,000 or 1/25,000.

- Diagram of planned urban land levels and surface drainage, scale 1/10,000 or 1/25,000:

+ Drainage catchment areas, drainage systems; locations and scales of key facilities.

+ Land levels at various urban areas and major city streets.

3. Urban power supply planning project.

a) Comprehensive explanation:

Analyze, synthesize, and evaluate the current status of power supply; propose planning solutions for power supply ensuring the contents stipulated in Article 24 of Decree No. 37/2010/NĐ-CP. The explanatory notes must include diagrams, A3-sized scaled drawings, analytical tables, and calculations.

b) Components of the drawings include:

- Diagram showing location and regional connectivity indicating: research boundaries, planning scope, power transmission system, scale 1/50,000 or 1/250,000.

- Current situation map of the power supply system showing power sources, transmission and distribution lines; locations and scales of transformer substations, scale 1/10,000 or 1/25,000.

- Map of planned power supply showing power sources, transmission and distribution lines; locations and scales of transformer substations, scale 1/10,000 or 1/25,000.

- Illustrative drawings (if any).

4. Urban lighting planning project.

a) Comprehensive explanation:

Analyze, synthesize, and evaluate the current status of urban lighting; planning solutions for lighting must comply with the provisions of Article 25 of Decree No. 37/2010/NĐ-CP, while also clearly defining themes and ideas for lighting in functional urban zones, public spaces, transportation structures, exterior building lighting, advertising lighting, and festival areas. The explanatory notes must include A3-sized scaled drawings, analytical tables, calculations, and illustrative images.

b) Components of the drawings include:

- Diagram showing location and regional connectivity indicating: research boundaries and planning scope, scale 1/50,000 or 1/250,000.

- Current situation map of the urban lighting system showing the general power supply system of the city, lighting grid along major axes to district level, scale 1/10,000 or 1/25,000.

- Map of planned urban lighting showing themes and ideas for urban lighting according to functional urban zones, public spaces, major axes to district level, and urban focal points, scale 1/10,000 or 1/25,000.

- Illustrative drawings (if any).

5. Urban water supply planning project.

a) Comprehensive explanation:

Analyze, synthesize, and evaluate the current status of the water supply system; water reserves and sources; propose planning solutions for water supply ensuring the contents stipulated in Article 26 of Decree No. 37/2010/NĐ-CP. The explanatory notes must include diagrams, A3-sized scaled drawings, analytical tables, and calculations.

b) Components of the drawings include:

- Diagram showing location and regional connectivity indicating: research boundaries and planning scope, scale 1/50,000 or 1/250,000.

- Current situation map of the water supply system construction and development showing: locations and scales of water supply facilities, primary and secondary water transmission and distribution lines, scale 1/10,000 or 1/25,000.

- Map of planned water supply showing water supply zones; locations of primary and secondary water transmission and distribution lines; locations and scales of water supply facilities, scale 1/10,000 or 1/25,000.

6. Urban wastewater drainage planning project.

a) Comprehensive explanation:

Analyze, synthesize, and evaluate the current status of: drainage systems, environmental changes, drainage capacity. Propose planning solutions ensuring the contents stipulated in Article 27 of Decree No. 37/2010/NĐ-CP. The explanatory notes must include diagrams, A3-sized scaled drawings, analytical tables, and calculations.

b) Components of the drawings include:

- Diagram showing location and regional connectivity indicating: research boundaries and planning scope, scale 1/50,000 or 1/250,000.

- Current situation map of the wastewater drainage system construction and development showing: locations and scales of drainage facilities, primary and secondary drainage lines, scale 1/10,000 or 1/25,000.

- Diagram of planned wastewater drainage showing: drainage zones; locations of primary and secondary drainage lines; locations and scales of drainage facilities, scale 1/10,000 or 1/25,000.

7. Solid waste treatment planning project.

a) Comprehensive explanation:

Analysis, synthesis, and evaluation of the current status of solid waste management; planning and management solutions for solid waste must ensure that the contents are prescribed in Article 28 of Decree No. 37/2010/NĐ-CP. The explanatory note must include diagrams, A3-scale drawings, tables, and analytical calculations.

b) Components of the drawings include:

- Diagram showing location and regional connectivity indicating: research boundaries and planning scope, scale 1/50,000 or 1/250,000.

- Current status map of solid waste management showing the location and scale of transfer stations and solid waste treatment facilities, at a scale of 1/10,000 or 1/25,000.

- Planning map for solid waste management showing the location and scale of solid waste treatment facilities and transfer stations, at a scale of 1/10,000 or 1/25,000.

8. Urban design project for cemeteries.

a) Comprehensive explanation:

Analysis, synthesis, and evaluation of the current status of cemetery distribution; specific planning solutions for cemeteries in an urban design project must comply with the provisions set out in Article 29 of Decree No. 37/2010/NĐ-CP. The explanatory note must include diagrams, A3-scale drawings, tables, and analytical calculations.

b) Components of the drawings include:

- Diagram showing location and regional connectivity indicating: research boundaries and planning scope, scale 1/50,000 or 1/250,000.

- Current status map showing the location, scale, and type of cemeteries, at a scale of 1/10,000 or 1/25,000.

- Planning map for cemeteries showing the location, scale, type, and level of cemeteries, at a scale of 1/10,000 or 1/25,000.

9. Urban design project for telecommunications.

a) Comprehensive explanation:

Analysis, synthesis, and evaluation of the current status of the telecommunications system, proposing planning solutions for telecommunications systems that comply with the provisions set out in Article 30 of Decree No. 37/2010/NĐ-CP. The explanatory note must include diagrams, A3-scale drawings, tables, and analytical calculations.

b) Components of the drawings include:

- Diagram showing location and regional connectivity indicating: research boundaries and planning scope, scale 1/50,000 or 1/250,000.

- Current status map of the telecommunications system showing the location and scale of transmission stations, wired information transmission systems, at a scale of 1/10,000 or 1/25,000.

- Planning map for the telecommunications system showing transmission routes, regional transmission stations, key infrastructure projects, at a scale of 1/10,000 or 1/25,000.

Article 14. For individual urban design projects.

1. Comprehensive explanation:

Provide comprehensive arguments and scientific and practical bases to clearly determine the building height for each structure; setback distances of structures along each street and intersection; determine the color, material, form, and architectural details of structures and other architectural objects; organize public green spaces, gardens, street trees, and water surfaces.

The content of the explanatory note for the individual urban design project's dossier should focus on the following aspects:

- Current factors affecting urban design including community information, characteristics of the area, resource conditions, etc.

- Determine existing land funds and those planned for development.

- Determine areas requiring research on location and scale, points, lines, and distinctive connections that need urban design guidance to control development.

2. The drawing components include:

- Diagrams showing the location and relationship between the design area and the city and surrounding areas.

- Diagrams evaluating the historical development of the area.

- Diagrams analyzing the current architectural landscape of the area.

- Diagrams analyzing zoning functions and spatial organization concepts.

- Urban design guidance drawings.

3. Management regulations according to individual urban design projects.

Management regulations according to the project must fully reflect the contents prescribed in Clause 4, Article 35 of the Urban Planning Law.

Chapter IV

IMPLEMENTATION

Article 15. Implementation Provisions.

This Circular shall take effect from September 20, 2010, and replace the provisions on files for tasks and urban planning projects in Circular No. 07/2008/TT-BXD dated April 7, 2008, issued by the Ministry of Construction, and Decision No. 03/2008/QĐ-BXD dated March 31, 2008, issued by the Minister of Construction.

Article 16. Transition implementation for tasks and urban planning projects initiated before May 25, 2010. (the date Decree No. 37/2010/NĐ-CP dated April 7, 2010 takes effect).

1. For overall urban planning:

a) For approved general urban planning tasks, continue to develop the planning project according to the Construction Law and Government Decree No. 08/2005/NĐ-CP on urban planning. The review and approval of the project shall be carried out according to the Urban Planning Law and Decree No. 37/2010/NĐ-CP dated April 7, 2010.

b) For general urban planning tasks that have not been approved, the development, review, and approval of the planning task and project shall be conducted according to the Urban Planning Law and Decree No. 37/2010/NĐ-CP dated April 7, 2010.

c) For adjustment planning projects of district and county general urban planning that have already had their planning tasks approved, continue to develop, review, and approve the project according to Government Decree No. 08/2005/NĐ-CP on urban planning and Circular No. 07/2008/TT-BXD dated April 7, 2008, issued by the Ministry of Construction, guiding the development, review, approval, and management of urban planning.

Adjusted general urban planning projects of districts and counties that have been approved will serve as the basis for developing detailed planning projects and detailed planning projects within the districts and counties.

2. For detailed planning:

a) For approved detailed urban planning projects at a scale of 1/2000, continue to develop detailed urban planning projects at a scale of 1/2000 without changing the name of the project. However, the content of the project must be combined with the content of the zoning plan as stipulated by the Urban Planning Law and Decree No. 37/2010/NĐ-CP dated April 7, 2010.

The review and approval of the project shall be carried out according to the Urban Planning Law and Decree No. 37/2010/NĐ-CP dated April 7, 2010.

b) For detailed planning projects at a scale of 1/2000 that have not yet had their planning tasks approved, implement zoning planning according to the Urban Planning Law and Decree No. 37/2010/NĐ-CP dated April 7, 2010.

c) For detailed planning projects at a scale of 1/500 that have already had their planning tasks approved, continue to develop, review, and approve the detailed planning project according to the Urban Planning Law and Decree No. 37/2010/NĐ-CP dated April 7, 2010.

Article 17. Responsibilities for Implementation.

1. Organizations and individuals involved in urban planning work are responsible for implementing this Circular.

2. The Architecture and Urban Planning Department of the Ministry of Construction, Construction Departments of provinces and cities, and the Planning and Architecture Departments of Hanoi and Ho Chi Minh City are responsible for guiding and supervising the implementation of the provisions of this Circular.

3. In the course of implementation, if there are difficulties, organizations and individuals are requested to send their opinions to the Ministry of Construction for study and resolution./.
