Issuing the Student Affairs Regulation

for the regular undergraduate training program

On the basis of Higher Education Lawdated June 18, 2012;

Pursuant to Decree No.Decision No. 32/2008/NĐ-CPdated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

The Minister of Education and Training issues this Circular on the Student Affairs Regulation for the regular undergraduate training program.

Article 1. Attached to this Circular is the Student Affairs Regulation for the regular undergraduate training program.

Article 2. This Circular takes effect from May 23, 2016 and replaces the student-related regulations in Decision No. 42/2007/QĐ-BGDĐT dated August 13, 2007 of the Minister of Education and Training promulgating the Student and College Student Regulations for regular programs at universities, colleges, and vocational schools.

Article 3. The Head of the Office, the Director of the Department of Student Affairs. Heads of units under the Ministry of Education and Training, Rectors of universities are responsible for implementing this Circular./.

REGULATIONS

STUDENT AFFAIRS FOR THE REGULAR UNDERGRADUATE TRAINING PROGRAM
(Annexed to Circular No. 10/2016/TT-BGDĐT dated April 5June 2024;energy 4 2016 of the Minister of Education and Training)

 

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This regulation stipulates student affairs for the regular undergraduate training program, including: Duties and rights of students; rewards and disciplinary actions for students; contents of student affairs; organizational system and management of student affairs and its implementation.

2. This regulation applies to national universities, regional universities, academies, and universities (including member schools and departments of national universities and regional universities) within the national education system that implement regular undergraduate training programs (hereinafter referred to as higher education institutions) and related agencies, organizations, and individuals.

Article 2. Students

1. Students as defined in this regulation are those studying the regular undergraduate training program at higher education institutions.

2. Students are the center of educational and training activities in higher education institutions, and their duties and rights are guaranteed during the learning and training process at these institutions.

Article 3. Student Affairs

1. Student affairs is one of the key tasks of higher education institutions, encompassing all educational activities, propaganda; management; support and services for students to ensure the goals of higher education.

2. Student affairs must be carried out in accordance with the Party's guidelines, the State's policies and laws, and the regulations of the Ministry of Education and Training.

3. Student affairs must ensure democracy, objectivity, fairness, transparency, and clarity in matters related to students.

Chapter II

DUTIES AND RIGHTS OF STUDENTS

Article 4. Duties of Students

1. Adhere to the Party's guidelines, the State's policies and laws, the university charter, and the rules and internal regulations of higher education institutions.

2. Study and train according to the education and training program and plan of higher education institutions; actively and proactively self-study, research, innovate, and cultivate moral character and lifestyle.

3. Respect teachers, managers, staff, and employees of higher education institutions; unite and help each other during the learning and training process; implement good cultural living habits in school.

4. Protect and maintain property; act to protect, build, and promote the traditions of higher education institutions.

5. Fully comply with the regulations on initial health check-ups and periodic health examinations during the study period as stipulated by higher education institutions.

6. Pay tuition fees and health insurance premiums fully and on time.

7. Participate in public welfare labor, voluntary activities, and social activities for the community in accordance with their capabilities and health as required by higher education institutions.

8. Comply with the obligation to work for a limited term upon mobilization by the State when receiving scholarships or training costs provided by the State or funded from abroad under agreements signed with the State; if not complying, they must reimburse the scholarship and training costs as prescribed by the Government.

9. Participate in preventing and combating negative practices and cheating in studies, exams, and other student activities; promptly report to departments, functional offices, heads of higher education institutions, or competent authorities when discovering negative practices, cheating in studies or exams, or violations of laws, internal regulations, and rules by students, officials, and teachers in higher education institutions.

10. Participate in ensuring security, order, traffic safety, crime prevention, and social evils in schools, families, and communities.

11. Perform other duties related to the provisions of law and higher education institutions.

Article 5. Rights of Students

1. Be admitted to study in the registered major or profession if meeting the admission criteria as prescribed by the Ministry of Education and Training and higher education institutions.

2. Be respected and treated equally; be provided with full information about their studies and training as stipulated by higher education institutions; be informed of internal regulations and rules regarding training and discipline, and state policies related to students.

3. Be facilitated in studying, scientific research, and training, including:

a) Using library systems, equipment, and facilities serving learning, scientific research, cultural, artistic, physical, and sports activities;

b) Participating in scientific research, outstanding student competitions, Olympic subject contests, scientific and technological innovation contests;

c) Receiving health care and protection in accordance with current state regulations;

d) Registering to apply for overseas study exchanges and participation in international student exchange activities; continuing studies at higher levels of training as prescribed by current regulations;

e) Participating in activities within the Communist Party of Vietnam, Ho Chi Minh Youth Union, Vietnam Student Association; participating in student self-management organizations and relevant social activities both inside and outside the school in accordance with the law; cultural, artistic, and sports activities that are healthy and consistent with the training objectives of higher education institutions;

f) Utilizing existing social service programs of higher education institutions (including career guidance, job counseling, health and psychological counseling, support for students with special circumstances, etc.);

g) Temporarily suspending studies, studying at a slower or faster pace, concurrently studying two programs, transferring schools in accordance with the training regulations of the Ministry of Education and Training; being entitled to summer, Tet, and holiday breaks as prescribed.

4. Enjoy benefits and policies, be eligible for academic scholarships and scholarships funded by domestic and foreign organizations and individuals as prescribed by current regulations; be exempted or reduced fees for using public services such as transportation, entertainment, museum, historical site, and cultural facility visits as prescribed by the State.

5. Provide suggestions, participate in managing and supervising educational activities and quality assurance conditions; directly or through their legitimate representatives propose solutions to contribute to building and developing higher education institutions; express wishes and complaints to the head of higher education institutions to resolve issues related to students' rights and legitimate interests.

6. Be considered for admission to dormitories and given priority in dormitory allocation as prescribed.

7. Eligible graduating students shall be awarded graduation certificates, transcripts, and related documents, and administrative procedures shall be processed.

Article 6. Acts that students are not allowed to perform

1. Insulting the dignity and reputation, infringing upon the body of teachers, managers, staff members, students of higher education institutions, and other persons.

2. Cheating in study, examination, and testing such as: copying answers, bringing study materials into examination rooms, requesting grades; studying, taking exams, conducting internships, or standing guard for others or asking others to study, take exams, conduct internships, or stand guard; copying, asking for, or doing term papers, projects, graduation theses on behalf of others; organizing or participating in organizing proxy exams or other forms of cheating.

3. Smoking, drinking alcohol, beer at school; being drunk when attending classes.

4. Organizing or participating in illegal gatherings, demonstrations, complaints; engaging in social evils, disrupting security, public order within higher education institutions or outside society.

5. Organizing or participating in illegal motorbike racing or cheering for illegal races.

6. Organizing or participating in gambling in any form.

7. Producing, trading, transporting, disseminating, storing, using, or enticing others to use weapons, explosives, narcotics, prohibited drugs, chemicals; distributing, participating in, or spreading reactionary, obscene materials, publications, information, and other prohibited materials as stipulated by the State; organizing, participating in, or spreading superstitious, religious activities within higher education institutions and other immoral acts.

8. Establishing or participating in political activities contrary to the law; organizing or participating in collective activities under the name of higher education institutions without permission from the head of the institution.

9. Posting, commenting, sharing articles, images with vulgar, violent, obscene content, infringing upon national security, opposing the Party and the State, distorting, slandering, insulting the reputation of organizations, the honor and dignity of individuals on the Internet.

10. Organizing or participating in other activities violating the law.

Chapter III

REWARD AND DISCIPLINE FOR STUDENTS

Article 7. Content and Forms of Reward

1. Regular and timely rewards for individuals and student class collectives who achieve outstanding results worthy of commendation and reward. Specifically:

a) Winning awards in subject Olympiads, scientific research competitions, technical innovation contests, academic, cultural, artistic, and sports events;

b) Effectively contributing to work related to the Communist Party, Youth Union, Student Association, volunteer activities, maintaining public security, class, faculty, dormitory activities, social, cultural, artistic, and sports activities;

c) Achieving results in implementing nationwide movements to protect national security, ensuring school security, preventing crime, social evils, bravely rescuing victims, combating corruption and negative phenomena;

d) Other special achievements. The content, form, and level of regular rewards are determined by the head of the higher education institution.

2. Comprehensive competition and rewards for individuals and student class collectives are conducted at the end of each academic year or semester. Specifically:

a) For individuals:

- Individual titles include three types: Good, Excellent, Outstanding.

- Criteria for classification:

+ Receiving the title of Good Student: classified as good or better in both academic performance and discipline;

+ Receiving the title of Excellent Student: classified as excellent or better in academic performance and good or better in discipline;

+ Receiving the title of Outstanding Student: achieving a grade point average of 3.6 (on a 4-point scale) or 9.0 (on a 10-point scale) or higher and classified as outstanding in discipline.

- Individual titles are recorded in the student management file.

- Students who have been disciplined or whose final grade in the academic year is below average will not be considered for rewards.

b) For student class collectives:

- Class titles include two types: Advanced Student Class and Outstanding Student Class.

- The head of the higher education institution specifies the criteria for the titles of Advanced Student Class and Outstanding Student Class.

Article 8. Procedure and formalities for commendation and award

1. At the beginning of each academic year, higher education institutions organize for students to register for individual and class collective excellence titles.

2. Formalities for commendation and award:

a) Based on the achievements in study and discipline of students, student classes establish lists accompanied by individual and class collective achievement records, confirmed by the class head teacher, and propose to the faculty or unit responsible for student affairs for consideration;

b) The faculty or unit responsible for student affairs convenes meetings to review and propose to the Student Commendation and Discipline Council of the higher education institution for approval;

c) Based on the proposal of the faculty or unit responsible for student affairs, the Student Commendation and Discipline Council of the higher education institution reviews and proposes to the Head of the higher education institution to recognize the titles for individuals and class collectives.

Article 9. Forms of Disciplinary Measures and Content of Violations

1. Students who commit violations may be warned, criticized, or subject to one of the following disciplinary measures depending on the nature, degree, and consequences of the violation:

a) Reprimand: applied to students committing their first violation at a light level;

b) Warning: applied to students who have been reprimanded and repeat the violation, or those committing a light violation but with a recurring nature, or those committing their first violation but with relatively serious circumstances;

c) Suspension from studies for a period: applied to students under warning who continue to violate discipline or commit serious prohibited behaviors; students violating laws and sentenced to suspended imprisonment. Depending on specific cases, the Head of the higher education institution bases on the training regulations to decide the suspension period according to levels: suspension for one semester, suspension for one academic year, or suspension for the duration of the suspended imprisonment sentence.

d) Expulsion: applied to students under suspension who continue to violate discipline or commit their first violation with particularly serious nature and degree, causing negative impacts on the higher education institution and society; violating laws and sentenced to imprisonment.

2. Disciplinary measures from warning upwards must be recorded in the student management file and notified to the student's family. In cases where students are disciplined with suspension from studies for a period or expulsion, the higher education institution must notify the local authorities and the student's family to coordinate in managing and educating the student.

3. The content of violations and the framework for disciplinary actions are implemented according to the provisions in the Appendix attached to this Regulation.

Article 10. Procedure, Formalities, and Documentation for Disciplinary Review

1. Formalities for Disciplinary Review:

a) Students who commit violations must write a self-criticism report and acknowledge the disciplinary measure. If a student does not comply with writing a self-criticism report, the Student Commendation and Discipline Council will still convene a meeting to handle the case based on collected evidence;

b) The class head teacher convenes a meeting with the class collective to analyze and propose disciplinary measures to the faculty or unit responsible for student affairs;

c) The faculty or unit responsible for student affairs considers and proposes to the Student Commendation and Discipline Council of the higher education institution;

d) The Student Commendation and Discipline Council convenes a meeting to review disciplinary measures, including members of the Council, representatives of the class collective with offending students, and the offending students themselves. If an offending student is invited but fails to attend (without a valid reason) and does not submit a self-criticism report, the Council will proceed with the meeting and impose additional disciplinary points for lack of organizational discipline awareness. The Council recommends the application of disciplinary measures and proposes that the Head of the higher education institution issue a written disciplinary decision.

2. Documentation for Student Disciplinary Review:

a) Self-criticism report (if available);

b) Minutes of the class collective meeting reviewing the student who committed the violation;

c) Minutes of the faculty or unit responsible for student affairs;

d) Related documents.

Article 11. Termination of effect of disciplinary decision

1. For students disciplined with reprimand: three months from the date of the disciplinary decision, if the student does not repeat the offense or does not commit violations to the extent that disciplinary action is required, the disciplinary decision shall be terminated automatically and the student shall enjoy the rights of a student from the date the disciplinary decision ceases to have effect.

2. For students disciplined with warning: six months from the date of the disciplinary decision, if the student does not repeat the offense or does not commit violations to the extent that disciplinary action is required, the disciplinary decision shall be terminated automatically and the student shall enjoy the rights of a student from the date the disciplinary decision ceases to have effect.

3. In cases of suspension from study for a limited period: upon expiration of the suspension period, the student must present a certificate from the local authority (ward, commune, town) where they reside regarding their good performance of civic duties at the locality; a certificate from the competent authority regarding completion of suspended sentence to be considered and accepted back to study by the higher education institution if eligible.

4. The competent authority deciding on disciplinary action must clearly specify the time during which the student is subject to disciplinary measures, from the date of issuance of the disciplinary decision until the end of the disciplinary period as prescribed.

Article 12. Structure and tasks of the Student Awards and Disciplinary Council

1. Structure of the Student Awards and Disciplinary Council:

a) Chairperson of the Council: the head or deputy head of the higher education institution.

b) Standing members of the Council: the head of the political work department.

c) Members: representatives from relevant departments, faculties, the Ho Chi Minh Communist Youth Union, and the Vietnam Students' Association of the higher education institution.

The Council may invite representatives from student classes, class advisors, and academic counselors. These components can participate in expressing opinions and proposing award levels or disciplinary actions but do not have voting rights.

2. The head of the higher education institution issues a decision to establish the Council and specifies its functions, tasks, organization, and activities.

Article 13. Right to appeal regarding awards and disciplinary actions

Individuals and groups of students who consider the forms of awards and disciplinary actions inappropriate have the right to appeal to relevant departments or the head of the higher education institution; if the higher education institution has reviewed but still finds it unsatisfactory, they may appeal to the competent authority according to the law on appeals and complaints.

Chapter IV

CONTENT OF STUDENT WORK

Article 14. Organization of educational and propaganda activities

1. Political ideology education

a) Educate and propagate to enable students to grasp and implement correctly the Party's policies and guidelines, form political resilience, love the socialist Vietnam, be vigilant and know how to criticize distorted arguments and actions against the Party and State:

b) Coordinate with the Ho Chi Minh Communist Youth Union, the Student Association, and other related political-social organizations in student training activities. Create an environment for students to strive and be considered for admission into the Party.

2. Moral and lifestyle education

a) Educate and propagate to students about the fine traditional values and moral standards of the Vietnamese nation, common social moral standards, and professional ethics; know how to criticize behaviors inconsistent with these standards.

b) Guide and educate towards a healthy, civilized, progressive lifestyle consistent with the national cultural identity; educate individual students' sense of responsibility towards the collective and community.

3. Legal education and propaganda

a) Educate and propagate to enhance awareness and adherence to the law, habits of living and working according to the law.

b) The content of legal education for students focuses on regulations and rules concerning study and training; laws on crime prevention, social evils; ensuring traffic safety and other relevant laws.

4. Skill education: Life skills, vocational skills, employment,...

5. Physical education

a) Educate and guide students on techniques, methods of exercise and organize students to participate in physical exercises and sports activities in accordance with the Ministry of Education and Training's regulations.

b) Popularize and enhance students' understanding about nutritious eating, food safety, regular living habits, avoiding excessive alcohol and stimulants; knowledge and skills in health care, disease prevention, accident prevention,... Organize and implement the activities of the Health Station in the higher education institution according to the Ministry of Education and Training's regulations.

6. Aesthetic education

a) Educate knowledge and skills so that students can appreciate beauty in nature, society, and art.

b) Form the ability to judge and evaluate aesthetics; form correct aesthetic tastes and ideals; form artistic creativity, desire, and ability to convey beauty into daily life, work, and behavior. Have attitudes to criticize ugliness, un-aesthetic elements in the soul, behavior, appearance, attire,...

Article 15. Student Management Work

1. Administrative Work

a) Organizing the acceptance of successful candidates, arranging and placing students in classes; appointing temporary class executive boards (class presidents, vice-presidents), issuing student cards and library cards; managing and organizing the issuance of diplomas and certificates for students;

b) Statistics, data compilation, and management and storage of files related to students; handling administrative matters related to students.

2. Reward and Disciplinary Work

a) Monitoring and evaluating academic awareness; organizing the assessment of students' training results; categorizing and ranking students at the end of each semester, school year, and program according to the regulations of the Ministry of Education and Training;

b) Initiating and organizing competitive movements among students; organizing evaluations, elections, and rewards for outstanding collectives and individuals in studies and training; organizing scientific research, subject Olympiads, creative talent competitions, and other activities encouraging learning;

c) Guiding, inspecting, and supervising the implementation of regulations and rules concerning studies and training for students;

d) Advising, monitoring, and compiling disciplinary actions against students who violate regulations as stipulated.

3. Resident and Non-resident Student Work

Implementing the contents and measures of resident and non-resident student work as prescribed by the Ministry of Education and Training.

4. Ensuring School Security and Order

a) Issuing internal regulations and guidelines, planning, organizing inspections, and supervising the implementation of guiding documents and legal normative documents of the Party and State regarding ensuring security, social order, crime prevention, and social evils among students. Cooperating with local police to implement measures to ensure school security;

b) Creating a healthy educational environment, ensuring safety for students' learning and training activities. Monitoring and understanding students' ideological trends and behaviors to provide guidance and education; cooperating to prevent incitement and recruitment of students to participate in anti-State activities, social evils, illegal religious preaching, and other unlawful acts; cooperating in handling school security incidents and those involving students both within and outside higher education institutions.

5. Implementation of Policies for Students

Promoting, guiding, monitoring, compiling, and resolving policies of the State related to students as prescribed.

Article 16. Support and Services for Students

1. Academic Counseling

Providing counseling and support for students to develop appropriate study plans and methods consistent with their goals and capabilities; providing information on training programs and guiding students to access resources (academic, financial, technical, etc.) to enhance their learning abilities and effectiveness.

2. Career Guidance and Employment Counseling

Implementing the contents and measures of career guidance and employment counseling as prescribed by the Ministry of Education and Training.

3. Psychological Counseling and Health Care

a) Providing counseling and support for students facing psychological and social issues; coordinating to organize counseling and health care services to provide necessary assistance and intervention when students encounter problems affecting their physical and mental health;

b) Organizing initial and periodic health check-ups for students; providing counseling and organizing students to comply with the Health Insurance Law; providing first aid, preliminary medical treatment for students.

4. Financial Support

Coordinating with benevolent organizations and individuals to establish and manage scholarship funds; organizing the awarding of scholarships to outstanding students and those from financially disadvantaged families.

5. Special Support

6. Organization and Management of Student Services

Chapter V

Organizing services for students such as internet, telephone, dining halls, cafeterias, parking, playgrounds, sports fields, cultural facilities, etc.

Article 17. Student Affairs Organization System and Management

The student affairs organization system and management of the school includes: the head of the higher education institution, units responsible for student affairs, faculties, class advisors, academic counselors, and student classes.

Based on the University Charter, the head of the higher education institution shall establish a suitable student affairs organization system and management to ensure the effective implementation of student affairs activities.

Article 18. Head of Higher Education Institution

1. Direct and organize the management of student affairs activities. Allocate resources to ensure the effective implementation of student affairs activities.

2. Develop plans and implement policies, guidelines of the Party, laws and regulations of the State, provisions of the Ministry of Education and Training, sectors, and localities related to student affairs; create conditions for students to fully exercise their rights and fulfill their duties.

3. Direct the organization of "Citizen-Student Life Week" at the beginning of each semester and academic year according to the guidance of the Ministry of Education and Training; annually, organize dialogues with students to provide necessary information, understand their thoughts and aspirations, and promptly address their legitimate concerns and needs.

4. Ensure conditions for effectively promoting the role of the Ho Chi Minh Communist Youth Union and the Vietnam Student Association in student affairs; focus on political ideology education, moral education, and lifestyle guidance for students.

5. Decide on the participation of students representing the higher education institution when mobilized by localities, levels, sectors, or other organizations.

Article 19. Units and Individuals Responsible for Student Affairs

1. Based on the University Charter, the head of the higher education institution decides to establish and define the functions and responsibilities of Faculties and units responsible for student affairs activities of the school, and assigns the Political Work Department (or Student Affairs Department) as the main advisory unit assisting the head of the higher education institution in student affairs.

2. Class Advisors

Based on specific conditions, the head of the higher education institution or the Dean assigns lecturers or staff members of the school to serve as class advisors to support management and guide the learning and discipline activities of the student class.

3. Academic Counselors

Based on specific conditions, the head of the higher education institution or the Dean assigns lecturers to concurrently serve as academic counselors to advise and guide students in complying with training regulations and policies. The higher education institution may assign a lecturer to concurrently serve as both an academic counselor and a class advisor.

Article 20. Student Classes

1. A student class consists of students from the same major and academic year. The student class remains stable throughout the academic year, serving as a venue for the higher education institution to organize and manage the implementation of study tasks, discipline, group activities, social activities, competitions, awards, and disciplinary actions.

2. The class executive board comprises:

a) The class president and vice-presidents elected by the class students, recognized by the head of the higher education institution (or the Dean, or the unit responsible for student affairs based on the delegation of the head of the higher education institution). The term of the class executive board is one academic year.

b) Responsibilities of the class executive board:

- Organize the implementation of study tasks, discipline, life activities, and social activities according to the school's, faculty's, department's, or office's plan;

- Urge students in the class to strictly comply with internal rules and regulations regarding study and discipline. Establish self-management practices within the class;

- Organize and encourage assistance for students facing difficulties in study and discipline. Represent the class to contact the class advisor and subject lecturers; request the faculties, units responsible for student affairs, and the school's administration to resolve issues related to the rights and duties of students in the class;

- Closely and regularly coordinate with the Ho Chi Minh Communist Youth Union and the Vietnam Student Association in class activities;

- Report comprehensively and accurately on the study and discipline situation of the class by semester and academic year, and any urgent matters to the faculty or the unit responsible for student affairs;

c) Benefits of the class executive board:

They are entitled to priority in earning discipline points and other benefits as stipulated by the school.

Article 21. Course Class

1. Course Class: includes students who register to study the same course unit. The Course Class is organized during the time of studying a course unit, serving as a place for the school to monitor and manage students' academic performance and discipline during class hours.

2. The Course Class Executive Board consists of a class president and vice-presidents designated by the higher education institution. The term of the Course Class Executive Board corresponds to the duration of the course unit. The Course Class Executive Board is responsible for reporting students' compliance with internal regulations and rules to the faculty and student affairs units. The Course Class Executive Board is given priority in adding points for training and other benefits according to the regulations of the higher education institution.

Chapter VI

TIMPLEMENTATION

Article 22. Responsibilities of Higher Education Institutions

1. Based on the contents of this Regulation, establish specific regulations and provisions regarding student affairs work that are suitable for the functions, tasks, and practical organizational and educational training activities of the school.

2. Proactively coordinate closely with youth organizations, student families, and related agencies in the area to effectively implement student affairs work.

3. Organize the summary and evaluation of student affairs work, report to the Ministry of Education and Training at the end of the academic year; submit urgent reports to the Ministry of Education and Training and directly managing agencies about complex and serious incidents involving students.

Article 23. Inspection, Supervision, Commendation, and Disciplinary Actions

1. The Ministry of Education and Training, provincial departments of education and training, and higher education institutions within their jurisdiction organize inspections and supervision of the implementation of student affairs work.

2. Higher education institutions, units, and individuals with outstanding achievements in student affairs work shall be considered for commendation according to regulations.

3. Individuals violating regulations concerning student affairs work will be subject to handling according to the degree of violation as stipulated.
