CIRCULAR

Issuing the List of Plant Protection Chemicals Permitted for Use and Prohibited from Use in Vietnam

BASED ON the Government's Decree No. 15/2017/NĐ-CP dated February 17, 2017, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

BASED ON the Law on Plant Protection and Quarantine No. 41/2013/QH13 dated November 25, 2013;

At the proposal of the Director of the Plant Protection Department;

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT ISSUES the list of plant protection products permitted for use and prohibited from use in Vietnam.

Article 1. Attached herewith are
1. The List of Plant Protection Products Permitted for Use in Vietnam, Appendix I attached to this Circular, includes:
a) Agricultural chemicals:
- Insecticides: 850 active ingredients with 1757 trade names.
- Fungicides: 563 active ingredients with 1191 trade names.
- Herbicides: 235 active ingredients with 659 trade names.
- Rodenticides: 8 active ingredients with 26 trade names.
- Growth regulators: 52 active ingredients with 148 trade names.
- Insect Attractants: 8 active substances with 8 trade names.
- Snail control agents: 33 active ingredients with 153 trade names.
- Adjuvants (spreaders): 5 active substances with 6 trade names.
b) Termite control agents: 15 active ingredients with 25 trade names.
c) Timber Preservation Products: 7 active substances with 8 trade names.
d) Warehouse disinfectants: 4 active ingredients with 10 trade names.
đ) Golf course chemicals:
- Fungicides: 2 active substances with 2 trade names.
- Herbicides: 1 active substance with 1 trade name.
- Growth regulators: 1 active ingredient with 1 trade name.
e) Seed treatment chemicals:
- Insecticides: 9 active ingredients with 14 trade names.
- Fungicides: 10 active ingredients with 11 trade names.
g) Post-harvest crop storage chemicals
- 01 active substance with 01 trade name.
2. The List of Plant Protection Chemicals Prohibited from Use in Vietnam, Appendix II attached herewith, includes:
a) Insecticides, timber preservation chemicals: 23 active ingredients.
b) Fungicides: 6 active substances.
c) Rodenticides: 1 active substance.
d) Herbicides: 1 active substance.
3. The Harmonized System (HS) code table for plant protection products permitted for use and prohibited from use in Vietnam shall be implemented according to Section 25 and Section 26 of Appendix I issued together with Circular No. 15/2018/TT-BNNPTNT dated October 29, 2018, of the Minister of Agriculture and Rural Development on issuing the HS code table for goods under the management authority of the Ministry of Agriculture and Rural Development and related amendments and supplements.
Article 2. Transitional provisions
Plant protection products containing the active ingredients Chlorpyrifos ethyl and Fipronil may only be produced and imported until February 12, 2020; they may only be traded and used until February 12, 2021.
Article 3. Effectiveness
1. This Circular takes effect from November 5, 2019.
2. This Circular replaces the following Circulars:
a) Circular No. 03/2018/TT-BNNPTNT dated February 9, 2018, of the Minister of Agriculture and Rural Development on issuing the list of plant protection products permitted for use and prohibited from use in Vietnam;
b) Circular No. 13/2018/TT-BNNPTNT dated October 8, 2018, of the Minister of Agriculture and Rural Development on amending and supplementing certain contents of Circular No. 03/2018/TT-BNNPTNT dated February 9, 2018, of the Minister of Agriculture and Rural Development on issuing the list of plant protection products permitted for use and prohibited from use in Vietnam.
Article 4. Responsibilities for Implementation
1. The Director of the Ministry’s Office, the Director of the Plant Protection Department, the Heads of units under the Ministry, the Directors of Provincial Departments of Agriculture and Rural Development, and organizations and individuals concerned are responsible for implementing this Circular.
2. During implementation, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to report to the Ministry of Agriculture and Rural Development (through the Plant Protection Department) for consideration and prompt resolution./.
