Pursuant to Decree No. 123/2016/ND-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 96/2017/NĐ-CP dated August 16, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Justice;
Pursuant to Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government on the organization of specialized agencies under provincial People's Committees and municipal People's Committees directly under the Central Government;

GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Circular sets out the standards for the positions of Director and Deputy Director of the Department of Justice under the People's Committee of the province, centrally governed city (hereinafter referred to collectively as the People's Committee at the provincial level).
Article 2. This Circular applies to individuals being considered for appointment, reappointment, recruitment, transfer, rotation to the position of Director and Deputy Director of the Department of Justice, and to agencies, organizations, and individuals with authority to implement or inspect, audit, supervise the implementation of appointments, reappointments, recruitments, planning, training, development, rotations, transfers, secondments, dismissals, resignations, evaluations, and the implementation of systems and policies for Directors and Deputy Directors of the Department of Justice.
Article 2. Principles of Application
Appointments, reappointments, recruitments, planning, training, development, rotations, transfers, secondments, dismissals, resignations, evaluations, and the implementation of systems and policies for Directors and Deputy Directors of the Department of Justice must ensure the corresponding job standards as prescribed by the Party and the State, and the standards set forth in this Circular.
Article 3. Legal Work Experience
The legal work experience applicable in this Circular includes:
1. Time spent in the rank of specialist or equivalent and above in positions requiring a bachelor's degree in law for civil servants and employees working at the Ministry of Justice, Department of Justice, Judicial Office; the civil enforcement system; judicial, prosecution, inspection, auditing, internal affairs, internal politics organs or in positions directly implementing legal construction and enforcement work in organs belonging to the political system.
2. Time spent in ranks such as court clerk, court examiner, judge; prosecutor, procurator; investigator in investigation organs in the Public Security Force, Vietnam People's Army, Supreme People's Procuracy; enforcement officer, civil enforcement examiner, civil enforcement clerk; inspector.
3. Time having a bachelor's degree in law and holding leadership positions in party committees, people's councils, people's committees at the district level or higher.
Article 4. General Standards for Directors and Deputy Directors of the Department of Justice
1. Political ideology standards; moral character and lifestyle; organizational discipline awareness; work style and conduct
a) Possess firm political stance, viewpoint, and ideological foundation, loyal to the country, the Party, and the people; firmly adhere to Marxism-Leninism, Ho Chi Minh Thought, the goal of independence, socialism, and the Party's reform policy; resolutely struggle to protect the Party's Program, policy, Constitution, and State laws. Have a strong sense of patriotism, prioritizing the interests of the Party, the nation, the people, and the collective over personal interests; be ready to sacrifice for the Party's cause, for the independence and freedom of the country, and for the happiness of the people; lead and implement well the Party's policies and State laws;
b) Set a good example in moral character and lifestyle, being thrifty, honest, incorruptible, impartial, diligent, and frugal; not engage in bureaucracy, corruption, waste, opportunism, self-interest, and resolutely fight against bureaucracy, corruption, waste, opportunism, pragmatism, factionalism, and interest groups; be truthful, objective, and fair in performing public duties; closely connect with the people, listen to their opinions, and meet the Professional Ethics Standards for cadres, civil servants, and employees in the Justice sector;
c) Demonstrate high responsibility and organizational discipline awareness; strictly follow the rules and regulations of the agency or unit and maintain internal unity, showing care and respect for colleagues;
d) Exhibit democratic, scientific work styles; have a spirit of learning and researching to enhance knowledge, competence, and work capacity; be dynamic, innovative, possess professional expertise, decisiveness, and willingness to take responsibility in leadership and guidance;
đ) Not abuse power and position, nor allow family members, relatives, or acquaintances to exploit power and position for personal gain.
2. Competence Standards
a) Possess the ability to study laws, analyze policies; summarize practical experiences, analyze, forecast, propose solutions for building and perfecting laws, administrative reforms, judicial reforms, and propose management methods for judicial work at the local level to serve the management activities of the Justice sector and the People's Committee at the provincial level;
b) Have independent and creative thinking; possess the ability to organize and implement the Party's policies and State laws in the specialized field and tasks assigned and required by the People's Committee at the provincial level;
c) Possess leadership and management skills; have the ability to unite and mobilize civil servants, employees, and workers in the agency or unit and coordinate with relevant levels, agencies, organizations, and individuals in implementing assigned tasks;
d) Possess the ability to disseminate, promote, persuade, and mobilize organizations and individuals to implement the Party's guidelines, policies, and State laws;
đ) Have innovative thinking, vision, and scientific working methods.
3. Knowledge Standards
a) Firmly grasp the Party's guidelines and policies, the State's laws, and the development direction and tasks of the Justice sector;
b) Be well-versed in legal normative documents concerning the Justice sector and those issued by the People's Council and People's Committee at the provincial level;
c) Have a deep understanding of state management operations and legal matters related to judicial work;
d) Be familiar with the principles of organization, working regulations, and relationships within the political system at the provincial level; have knowledge about leadership science and management;

SPECIFIC PROVISIONS
Section 1
STANDARDS FOR THE TITLE OF DIRECTOR OF THE DEPARTMENT OF JUSTICE
Article 5. Position, Title
The Director of the Department of Justice is the head of the Department of Justice, leading the work of the Department; responsible before the People's Committee, the Chairman of the People's Committee at the provincial level, and simultaneously responsible before the Minister of Justice and before the law for performing the functions, tasks, powers of the Department of Justice as prescribed by law and assigned by the People's Committee, the Chairman of the People's Committee at the provincial level.
Article 6. Standards on Qualifications and Experience
1. Standards on Qualifications
a) Hold a bachelor's degree in law or higher;
b) Currently holding the rank of Senior Specialist or equivalent;
c) Having a certificate for training in the Senior Specialist rank or having a degree in Advanced Political Theory and Administration or equivalent as prescribed;
d) Having a degree in Advanced Political Theory or Advanced Political Theory and Administration or a Bachelor's Degree in Politics or having a certificate confirming equivalent advanced political theory qualifications issued by the competent authority;
đ) Having a leadership training certificate at the departmental or provincial level;
e) Having a foreign language certificate with a level equivalent to level 3 or higher of the Vietnamese Foreign Language Competency Framework as currently prescribed by the Ministry of Education and Training;
g) Having a computer skills certificate meeting the basic standard for using information technology as prescribed to serve leadership and management work.
2. Standards on Work Experience
Having at least five years of legal work experience and at least three years in a leadership position at the departmental section level or equivalent. In cases where the time mentioned above is not continuous, it can be accumulated.
3. Being planned for the title of Director of the Department or equivalent or higher.
4. Other standards approved by the competent authority and the Chairman of the People's Committee at the provincial level in accordance with the provisions of this Circular.
5. Other standards according to general regulations of the Party and State.
Section 2
STANDARDS FOR THE TITLE OF DEPUTY DIRECTOR OF THE DEPARTMENT OF JUSTICE
Article 7. Position, Title
Deputy Director of the Department of Justice is a managerial position assisting the Director of the Department in overseeing and directing the implementation of certain tasks and areas of work assigned by the Director of the Department of Justice; representing the Director of the Department in managing the work of the Department when authorized; responsible before the Director of the Department and before the law for the tasks assigned.
Article 8. Standards on Qualifications and Experience
1. Standards on Qualifications
a) Hold a bachelor's degree in law or higher;
b) Currently holding the rank of Specialist or equivalent;
c) Having a certificate for training in the Senior Specialist rank or having a degree in Advanced Political Theory and Administration or equivalent as prescribed;
d) Having a degree in Advanced Political Theory or Advanced Political Theory and Administration or a Bachelor's Degree in Politics or having a certificate confirming equivalent advanced political theory qualifications issued by the competent authority;
đ) Having a leadership training certificate at the departmental or provincial level;

Chapter III
IMPLEMENTING PROVISIONS
Article 9. Effective Date
This Circular takes effect from February 12, 2020, and replaces Decision No. 07/2006/QĐ-BTP dated August 1, 2006, of the Minister of Justice prescribing the standards for the Director of the Department of Justice.
Article 10. Transitional Provisions
1. From the date this Circular takes effect, the appointment of Directors and Deputy Directors of the Department of Justice must comply fully with the standards prescribed in this Circular.
2. For those who were appointed as Directors and Deputy Directors of the Department of Justice before the date this Circular takes effect, the Provincial People's Committee shall be responsible for arranging conditions, sending Directors and Deputy Directors of the Department of Justice to participate in courses and examinations to upgrade civil servant ranks to complete the required standards as prescribed in this Circular and related documents.
Article 11. Responsibility for Implementation
1. The Chairman of the Provincial People's Committee shall be responsible for submitting to the Ministry of Justice the decision on appointment and a summary of the curriculum vitae of the person appointed to the positions of Director and Deputy Director of the Department within seven working days from the date of the appointment decision for verification, monitoring, and coordinating the implementation of tasks related to training, upgrading, and enhancing the management capacity in justice affairs and planning leadership positions for units under the Ministry and the leadership of the Ministry of Justice as prescribed.
2. The Department of Justice shall base its work on the standards prescribed in this Circular to implement evaluation, proposal, planning, training, and upgrading of cadres and managers of the unit as prescribed.
3. The Cadre and Civil Service Department shall take the lead, in coordination with other units under the Ministry, to assist the Minister in guiding and supervising the implementation of this Circular./.
