Amending and supplementing certain provisions of Circular No. 46/2016/TT-BGTVT dated December 29, 2016 of the Minister of Transport on technical management of inland waterwaysdated December 29, 2016 of the Minister of Transportconcerning technical management of inland waterways

Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004, and the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Traffic dated June 17, 2014;

Pursuant to Decree No. 08/2021/NĐ-CP dated January 28, 2021 of the Government on management of inland waterway activities;

Pursuant to Decree No. 12/2017/NĐ-CP dated December 10, 2017 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Infrastructure Department and the Director of the Vietnam Inland Waterway Administration;The Minister of Transport issues this Circular amending and supplementing certain provisions of Circular No. 46/2016/TT-BGTVT dated December 29, 2016 of the Minister of Transport on technical management of inland waterways.

Article 1. Amending and supplementing certain provisions of Circular No. 46/2016/TT-BGTVT dated December 29, 2016 of the Minister of Transport on technical management of inland waterways (hereinafter referred to as Circular No. 46/2016/TT-BGTVT dated December 29, 2016).

1. Amend and supplement Article 1 as follows:

"Article 1. Scope of Regulation

This Circular stipulates technical management of inland waterway channels.

2. Amending and supplementing Article 2 as follows:

"Article 2. Applicability

This Circular applies to organizations and individuals related to inland waterway activities, including investment in construction of works, operation, maintenance, and protection of inland waterway channels and channel corridors.

3. Amend and supplement Article 4 as follows:

"Article 4. Technical management of inland waterway channels

1. Inland waterway channels are divided into seven technical grades, including: special grade, Grade I, Grade II, Grade III, Grade IV, Grade V, and Grade VI.

2. The technical grade of inland waterway channels is determined according to the Vietnamese Standard on classification of technical grades for inland waterways.

3. Inland waterway routes connecting with transport corridor routes and main transport routes approved by competent authorities may be assigned the same technical grade or a lower technical grade compared to those transport corridor routes and main transport routes.

4. When constructing new, reconstructing, or upgrading road bridges, railway bridges, or other works crossing channels, it must ensure the height, width of navigable clearance, and safe depth of the channel bottom according to the technical grade standards of the inland waterway channel route as determined in the published master plan. 5. The dimensions of inland waterways corresponding to each technical grade of inland waterways are specified in Appendix 1 of this Circular. 6. The national technical grade of inland waterways is specified in Appendix 2 of this Circular."

Article 2. Implementation clause

This Circular takes effect from June 15, 2021.

Article 3. Implementation Organization

The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Inland Waterways Administration, Directors of Provincial and Municipal Departments of Transport under the Central Government, and relevant agencies, organizations, and individuals are responsible for implementing this Circular.
