Pursuant to the Education Law dated June 14, 2019;
Pursuant to the Higher Education Law dated June 18, 2012 and the Law Amending and Supplementing Certain Provisions of the Higher Education Law dated November 19, 2018;
Pursuant to Decree No. 86/2022/NĐ-CP dated October 24, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 99/2019/NĐ-CP dated December 30, 2019 of the Government detailing and guiding the implementation of certain provisions of the Law Amending and Supplementing Certain Provisions of the Higher Education Law;
7. Components of a training program include a group of courses and other learning and research activities with common characteristics in specialized fields; clearly playing a role in achieving a set of goals and requirements of the training program. These components are used to design the overall structure of the training program (such as general education, basic sciences, core subjects, internships and experiences, scientific research, and other components).
The Minister of Education and Training issues this Circular amending and supplementing certain provisions of Circular No. 03/2022/TT-BGDĐT dated January 18, 2022 issued by the Minister of Education and Training stipulating the determination of university, master's, doctoral enrollment quotas and vocational college enrollment quotas for Early Childhood Education majors.
Article 1. Amending and supplementing certain provisions of Circular No. 03/2022/TT-BGDĐT dated January 18, 2022 issued by the Minister of Education and Training stipulating the determination of university, master's, doctoral enrollment quotas and vocational college enrollment quotas for Early Childhood Education majors.
1. Amending and supplementing Clause 1 of Article 1 as follows:
"1. This Circular stipulates the determination of university, master's, doctoral enrollment quotas and vocational college enrollment quotas for Early Childhood Education majors, including those of joint training programs with foreign countries that share common quality assurance conditions in determining quotas."
2. Amend and supplement Clause 4 and add Clauses 8 and 9 to Article 3 as follows:
"4. The field of training is a collection of several groups of training majors sharing common professional or occupational characteristics according to the classification in the Secondary Education and Training Catalogue within the National Education System's Education and Training Catalogue (as specified in Appendix 3 attached hereto).
8. Enrollment quota is the number of students expected to be enrolled announced by the training institution after self-determination or after being notified by the Ministry of Education and Training pursuant to this Circular.
9. Training capacity of a major or field of training is the maximum scale of training determined based on the quality assurance conditions of the training institution as stipulated in this Circular and relevant laws."
3. Amend and supplement Clause 3, Clause 4, and Clause 7 of Article 4 as follows:
"3. University enrollment quotas are determined for each major and group of majors and must ensure that the actual training scale of the field does not exceed the training capacity. Master's, doctoral, and teacher education program enrollment quotas are determined for each major, ensuring that the actual training scale of the major does not exceed the training capacity.
4. Enrollment quotas are determined based on the training capacity of the training institution, human resource demand, employment rate of graduates within twelve months from graduation recognition date (for regular full-time undergraduate and graduate programs), accreditation results of the training institution, and the admission results of the previous recruitment year, specifically:
a) Enrollment quotas are determined in accordance with the training capacity of the training institution as prescribed from Article 7 to Article 12 of this Circular;
b) The total enrollment quotas of the training institution for each level and for each field (for university quotas) or for each major (for master's and doctoral quotas) shall not increase compared to the previous recruitment year if the training institution meets the time requirement for institutional accreditation but does not have an ongoing accreditation certificate at the time of announcing the enrollment quotas, except for institutions under the Ministry of Defense and the Ministry of Public Security;
c) The university enrollment quotas of a field shall not increase compared to the previous recruitment year if the employment rate of graduates within twelve months from graduation recognition date of the field is below 80% or the fulfillment rate of the field's enrollment quotas in the previous recruitment year is below 80%, except for majors with accredited quality programs that can be counted separately.
7. For majors belonging to the Teacher Education group, the Ministry of Education and Training determines and announces the enrollment quotas according to Articles 8 and 9 of this Circular. After calling candidates for the first enrollment period according to the general plan of the Ministry of Education and Training, based on the actual enrollment results, the training institution reviews, proposes, and reports to the Ministry of Education and Training for consideration and decision to adjust the quotas for each major by no more than 20% while ensuring the total teacher training quota remains unchanged. For vocational college and university enrollment quotas through combined work and study programs and master's and doctoral training quotas for teacher education majors, the training institution independently determines the enrollment quotas according to this Circular and relevant laws."
4. Amending and supplementing Article 5 as follows:
"Article 5. Provisions on lecturers in determining training capacity
1. Each lecturer of a training institution shall be assigned to one or more fields within one or more training disciplines corresponding to their expertise, with the total weight of teaching participation of each lecturer not exceeding 100% at each level of training. For universities, a lecturer may be assigned to one or more training units under the university, with the total weight of teaching participation of each lecturer not exceeding 100% at each level of training.
2. Provisions on lecturers in determining training capacity for undergraduate and college levels:
a) The total number of converted lecturers according to the training discipline (excluding the Teacher Training group) includes the number of full-time converted lecturers and part-time guest lecturers converted corresponding to that training discipline; the total number of converted lecturers according to the field within the Teacher Training group is the number of full-time converted lecturers of that training field (part-time guest lecturers are not counted for determining enrollment quotas).
b) The maximum number of converted part-time guest lecturers is calculated as 10% of the total number of converted full-time lecturers of the training institution determined according to the training discipline. For special training fields in the Arts discipline, special training fields with high demand for bachelor's degree human resources, and joint training programs with foreign countries (as specified in Appendix 2 issued together with this Circular), the maximum number of converted part-time guest lecturers is calculated as 40% of the number of converted full-time lecturers of the training institution determined according to the training discipline.
c) The conversion factor for full-time lecturers and part-time guest lecturers participating in associate degree training in Early Childhood Education and bachelor’s degree training in other disciplines with different titles and qualifications as specified in Table 1, Appendix 1 issued together with this Circular; where each lecturer can only be converted once at the highest conversion rate.
d) For special training fields with high demand for bachelor's degree human resources to meet national socio-economic development requirements, including training fields in the Computer Science and Information Technology discipline, the Tourism, Hotel, Sports, and Personal Services discipline (as specified in Appendix 2 issued together with this Circular) and training fields according to approved projects by the Prime Minister (announced by the Ministry of Education and Training during each phase and adjusted and supplemented based on the need for human resources to meet national socio-economic development requirements according to state policies and directions), guest lecturers include experts, technical staff, and managers who have graduated with a bachelor's degree in the same or related field as the training field and have at least five years of work experience in enterprises or professional associations related to the training field and serve as assistant lecturers, and are calculated according to the provisions in point c of this clause.
3. Provisions on lecturers in determining training capacity for master's and doctoral levels:
a) The total number of lecturers by training field includes full-time and part-time lecturers of the training institution with qualifications/titles meeting the requirements for lecturing in master's and doctoral programs and matching the relevant field of study.
b) The maximum number of part-time guest lecturers for determining enrollment quotas is calculated as 10% of the total number of full-time lecturers of the training institution determined according to the training field. For special training fields in the Arts discipline, the maximum number of part-time guest lecturers is calculated as 40% of the total number of full-time lecturers of the training institution determined according to the training field.
4. For lecturers in the Vietnamese Literature and Culture group, Foreign Literature and Culture group, Physical Education and Sports group, and special training fields in the Arts discipline:
a) Assistant lecturers who are Meritorious Artists, People's Artists, Meritorious Artisans, People's Artisans, Meritorious Teachers, People's Teachers, and have a bachelor's degree in the same or related field as the training field are calculated as having the qualifications of a master's degree holder.
b) Lecturers who are People's Artists, People's Artisans, People's Teachers, and have a master's degree in the same or related field as the training field are calculated as having the qualifications of a doctoral degree holder.
c) Lecturers who are People's Artists, People's Artisans, People's Teachers, and have a doctoral degree in the same or related field as the training field are calculated as having the qualifications of an Associate Professor.
d) Lecturers who are People's Artists, People's Artisans, People's Teachers, and have a doctoral degree and the title of Associate Professor in the same or related field as the training field are calculated as having the qualifications of a Professor.
5. For lecturers in Vietnamese minority language training fields within the Vietnamese Literature and Culture group, lecturers must be from ethnic minorities or have knowledge of the language and culture of the ethnic minority group corresponding to the language and culture of the training field:
a) If they have a bachelor's degree in the same or related field as the training field, they are calculated as having the qualifications of a master's degree holder.
b) If they have a master's degree in the same or related field as the training field, they are calculated as having the qualifications of a doctoral degree holder.
c) If they have a doctoral degree in the same or related field as the training field, they are calculated as having the qualifications of an Associate Professor.
d) If they have a doctoral degree and the title of Associate Professor in the same or related field as the training field, they are calculated as having the qualifications of a Professor.
6. For lecturers in training fields within the Health discipline:
a) Training institutions that organize practical training in the Health field shall determine the practical instructors of public practice facilities falling under the provisions of Clause 2, Article 10 of Decree No. 111/2017/NĐ-CP dated January 5, 2017 on organizing practical training in the Health sector as full-time lecturers of the training institution if they have been appointed to leadership or management positions at or above the department level within the training institution;
b) Lecturers with a Residency Doctor degree or a Bachelor's degree in specialized fields participating in training shall be considered equivalent to lecturers with a Master’s degree for coefficient calculation purposes; lecturers with a Master's degree in specialized fields participating in training shall be considered equivalent to lecturers with a Doctorate degree for coefficient calculation purposes.”
5. Amend Clause 2 of Article 8 as follows:
"2. The Ministry of Education and Training shall determine and announce the enrollment quotas for Early Childhood Education colleges and regular full-time enrollment quotas for teacher training majors at universities based on the training capacity and previous years' enrollment situation of each training institution, demand for use, and the training assignment situation of localities and nationwide, in accordance with this Circular and relevant current laws."
6. Amend and supplement Clause 1 and Clause 2 of Article 9 as follows:
"1. The enrollment quota for part-time undergraduate programs in a training field shall not exceed 30% of the regular full-time enrollment quota based on the training capacity of that field; specifically, for the Art field and teacher training majors, the part-time enrollment quota shall not exceed 50% of the regular full-time enrollment quota based on the training capacity of that field/major. 2. The enrollment quota for part-time Early Childhood Education college programs shall not exceed 50% of the regular full-time enrollment quota based on the training capacity of that major."
7. Amend and supplement Point b of Clause 3 of Article 10 as follows:
"b) The conversion factor according to the qualification and position for lecturers involved in distance education, including visiting lecturers, shall be applied like the conversion factor for full-time lecturers to determine the training capacity as stipulated in Article 5 of this Circular;"
8. Amend and supplement Point b of Clause 4 of Article 10 as follows:
"b) The conversion factor according to the qualification and position for managers and dedicated staff supporting distance education shall be applied like the conversion factor for full-time lecturers to determine the training capacity as stipulated in Article 5 of this Circular;"
9. Amend Clause 3 of Article 13 as follows:
"3. Implement enrollment in accordance with the quotas determined and publicly announced for each major, group of majors, and training field, while ensuring that the actual scale of training does not exceed the training capacity as prescribed in this Circular."
Article 2.
Replace Appendix 4 of Circular No. 03/2022/TT-BGDĐT dated January 18, 2022, issued by the Minister of Education and Training, regarding the determination of enrollment quotas for bachelor's, master's, and doctoral programs and for Early Childhood Education college programs, with Appendix 4 attached to this Circular.
This Circular takes effect from December 25, 2025/.
The Director of the Office, the Director of the Department of Higher Education, heads of units related to the Ministry of Education and Training; Chairpersons of People's Committees of provinces and centrally-run cities; Directors of Departments of Education and Training; Directors of universities and academies; Principals of universities; Principals of colleges enrolling in Early Childhood Education shall be responsible for implementing this Circular.
Article 4. Implementation provisions
This Circular takes effect from June 13, 2023./.
