Circular No. 10/2023/TT-BGTVT Issuing Economic and Technical Standards for Management and Maintenance of Inland Waterways

CIRCULAR

ISSUING ECONOMIC AND TECHNICAL STANDARDS FOR THE MANAGEMENT AND MAINTENANCE OF INLAND WATERWAYS

Pursuant to Decree No. 56/2022/NĐ-CP dated August 24, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, placing orders, or tendering for the provision of public products and services funded by state budget from regular expenditure;

Pursuant to Decree No. 45/2018/NĐ-CP dated March 13, 2018 of the Government on the management, use, and exploitation of infrastructure assets of inland waterways;

At the proposal of the Director of the Infrastructure Department and the Director of the Vietnam Inland Waterway Administration;

The Minister of Transport issues this Circular on Economic and Technical Standards for the Management and Maintenance of Inland Waterways.

Article 1. Scope of Regulation

This Circular hereby promulgates the Economic and Technical Standards for Managing and Maintaining National Inland Waterways.

Article 2. Applicability

Article 1. This Circular applies to agencies, organizations, and individuals related to the management and maintenance of national inland waterways.

Article 2. The economic and technical standards promulgated with this Circular serve as the basis for preparing and approving budgets and service prices for public services in managing and maintaining national inland waterways.

Article 3. For local inland waterways and specialized inland waterways, the economic and technical standards promulgated with this Circular may be applied.

5. For the work of managing and maintaining the infrastructure of inland waterways where maintenance is carried out based on actual quality, the economic and technical standards serve as the basis for determining the maintenance fee quota. Acceptance, payment, and settlement shall be based on the assessment of the results of management and maintenance according to actual quality.

Article 3. Implementation Provisions

Article 1. This Circular takes effect from September 1, 2023.

2. Repeal Circular No. 64/2014/TT-BGTVT dated November 10, 2014 of the Minister of Transport on Economic and Technical Standards for the Management and Maintenance of Inland Waterways and Circular No. 25/2016/TT-BGTVT dated October 3, 2016 of the Minister of Transport amending and supplementing the Economic and Technical Standards for the Management and Maintenance of Inland Waterways issued together with Circular No. 64/2014/TT-BGTVT dated November 10, 2014 of the Minister of Transport on Economic and Technical Standards for the Management and Maintenance of Inland Waterways.

3. For management and maintenance contracts of inland waterways signed before this Circular takes effect, they shall continue to be implemented until the end of the contract; if the contract is adjusted to include additional volumes, the additional volumes shall apply the Economic and Technical Standards issued together with this Circular.

4. For national management and maintenance works of inland waterways not specified in the Economic and Technical Standards issued together with this Circular, similar standards issued by competent authorities shall be applied on the principle of ensuring economic and technical efficiency, or organizing the establishment and submission to the Ministry of Transport for approval.

Article 4. Organization of Implementation

The Head of the Ministry's Office, the Inspector General, the Directors of Departments, the Director of the Vietnam Inland Waterway Administration, and the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
