Guidelines on positions for civil servants in specialized labor, war invalids, and social affairs jobs within agencies and organizations under the labor, war invalids, and social affairs sector

Based on Decree No. 62/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decree No. 62/2020/NĐ-CP dated June 1, 2020, of the Government, on positions and staffing of civil servants;

The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.

The Minister of Labor, Invalids, and Social Affairs issues this Circular to provide guidelines on positions for civil servants in specialized labor, war invalids, and social affairs jobs within agencies and organizations under the labor, war invalids, and social affairs sector.

Article 1. Scope of Regulation

This Circular provides guidelines on the list of job positions, job descriptions, and competency frameworks for civil servants in specialized labor, war invalids, and social affairs jobs within agencies and organizations under the labor, war invalids, and social affairs sector.

Article 2. Applicability

1. Administrative agencies under Ministries and agencies at the level of Ministries performing advisory functions to assist Ministers and heads of agencies at the level of Ministries in managing state administration over the labor, war invalids, and social affairs sector.

2. Specialized agencies under provincial People's Committees performing advisory functions to assist provincial People's Committees in managing state administration over the labor, war invalids, and social affairs sector.

3. Specialized agencies under district People's Committees performing advisory functions to assist district People's Committees in managing state administration over the labor, war invalids, and social affairs sector.

4. Relevant agencies, organizations, units, and individuals.

Article 3. Principles and bases for determining positions for civil servants in specialized labor, war invalids, and social affairs jobs

1. Principles for determining positions for civil servants in specialized labor, war invalids, and social affairs jobs shall be implemented in accordance with Article 3 of Decree No. 62/2020/NĐ-CP dated June 1, 2020 of the Government on job positions and civil servant staffing levels.

2. Bases for determining positions for civil servants in specialized labor, war invalids, and social affairs jobs shall be implemented in accordance with Clause 1, Article 4 of Decree No. 62/2020/NĐ-CP dated June 1, 2020 of the Government on job positions and civil servant staffing levels.

Article 4. List of job positions, job descriptions, and competency frameworks for civil servants in specialized labor, war invalids, and social affairs jobs

1. The list of job positions for civil servants in specialized labor, war invalids, and social affairs jobs is specified in Appendix I attached hereto.

2. Job descriptions and competency frameworks for civil servants in specialized labor, war invalids, and social affairs jobs are specified in Appendix II attached hereto.

3. The level framework for determining requirements for competencies for job positions for civil servants in specialized labor, war invalids, and social affairs jobs is specified in Appendix III attached hereto.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. Based on this Circular, agencies and organizations mentioned in Article 2 shall develop their job position plans and submit them to the agency or organization responsible for reviewing such plans for review and submission to the competent authority for approval in accordance with the law.

2. In cases where the regulatory documents referred to in this Circular are changed, supplemented, or replaced, they shall be implemented according to the newly issued documents.

Article 6. Transitional Provisions

In cases where civil servants currently hold higher ranks than those required for the job positions defined in this Circular, they shall retain their current ranks until new regulations on salary systems are issued.

Article 7. Effectiveness and Responsibility for Implementation

1. This Circular takes effect from December 5, 2023.
