CIRCULAR
DETAIL REGULATIONS IMPLEMENTING CERTAIN ARTICLES OF THE LAW ON COMPETITION AND REWARD IN THE AGRICULTURE AND RURAL DEVELOPMENT SECTOR
IN THE AGRICULTURE AND RURAL DEVELOPMENT SECTOR
Pursuant to the Law on Encouragement and Reward dated June 15, 2022;
Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.
The Minister of Agriculture and Rural Development issues this Circular to detail the implementation of certain articles of the Law on Competition and Reward in the Agriculture and Rural Development Sector.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular details the implementation of Clause 4, Article 24; Clause 3, Article 26; Clause 3, Article 27; Clause 3, Article 28; Clause 2, Article 71; Clause 6, Article 74; and Clause 2, Article 75 of the Law on Competition and Reward.
Article 2. Applicability
This Circular applies to collectives and individuals within agencies, organizations, and units under the direct management of the Ministry; the Agriculture and Rural Development sector; and collectives and individuals outside the sector who have made contributions to the construction and development of the Agriculture and Rural Development sector.
Article 3. Explanation of Terms
1. Agencies, organizations, and units directly under the Ministry are those agencies, organizations, and units directly managed by the Ministry of Agriculture and Rural Development.
2. Agencies, organizations, and units under the Ministry are those agencies, organizations, and units directly managed by agencies, organizations, and units directly under the Ministry.
3. Agencies, organizations, and units within the sector are those agencies, organizations, and units operating in the agriculture and rural development sector and field.
4. Collectives eligible for consideration for commendation titles and reward forms are organizations established by competent authorities in accordance with the law.
Chapter II
COMPETITION TITLES AND REWARD FORMS
Article 4. Title "Advanced Worker"
1. The criteria for the title "Advanced Worker" are implemented in accordance with Clause 1, Article 24 of the Law on Competition and Reward.
2. The Minister of Agriculture and Rural Development decides to recognize the title "Advanced Worker" for leaders of the Ministry.
3. Heads of agencies, organizations, and units with legal personality under and directly under the Ministry decide to confer the title "Advanced Worker" on individuals directly managed by their agency, organization, or unit.
Article 5. Title "Flag of Competition of the Ministry of Agriculture and Rural Development"
1. The Flag of Competition of the Ministry is awarded to collectives meeting the criteria set forth in Clauses 1 and 2, Article 26 of the Law on Competition and Reward.
2. The Minister of Agriculture and Rural Development organizes competition clusters and groups, including: clusters and groups of competition among agencies, organizations, and units under and directly under the Ministry; clusters and groups of competition among Departments of Agriculture and Rural Development of provinces and centrally-administered cities; clusters and groups of competition among Associations and Industry Associations operating in the agriculture and rural development field (as decided separately).
Article 6. The Title "Outstanding Labor Collective"
1. The criteria for the title "Outstanding Labor Collective" are implemented in accordance with Clause 1, Article 27 of the Law on Competition and Reward.
2. The Minister of Agriculture and Rural Development decides to award the title "Outstanding Labor Collective" to agencies, organizations, and units under and directly under the Ministry's management.
Article 7. The Title "Advanced Labor Collective"
1. The criteria for the title "Advanced Labor Collective" are implemented in accordance with Clause 1, Article 28 of the Law on Competition and Reward.
2. The Minister of Agriculture and Rural Development decides to award the title "Advanced Labor Collective" to agencies, organizations, and units directly under the Ministry's management.
3. Heads of agencies, organizations, and units with legal personality under and directly under the Ministry decide to award the title "Advanced Labor Collective" to collectives under their management.
Article 8. Certificate of Merit of the Minister of Agriculture and Rural Development
1. The Certificate of Merit of the Minister of Agriculture and Rural Development shall be awarded to individuals who meet one of the criteria set forth in Clause 1 and Clause 2 of Article 74 of the Law on Competition and Rewards.
2. The Certificate of Merit of the Minister of Agriculture and Rural Development shall be awarded to groups that meet one of the criteria set forth in Clause 3, Clause 4, and Clause 5 of Article 74 of the Law on Competition and Rewards.
3. In special cases, the decision shall be made by the Minister of Agriculture and Rural Development.
Article 9. Commendation Certificate of the Head of the Agency or Unit
1. The head of agencies, organizations, and units with legal personality under or subordinate to the Ministry of Agriculture and Rural Development shall decide to award commendation certificates to individuals within their management authority who meet one of the following criteria:
a) Completing tasks well or better;
b) Achieving notable results in competition movements;
c) Making outstanding and sudden contributions to the overall development of the agency, organization, or unit.
2. The head of agencies, organizations, and units with legal personality under or subordinate to the Ministry of Agriculture and Rural Development shall decide to award commendation certificates to exemplary groups that comply with the Party's guidelines, state policies, and laws, and meet one of the following criteria:
a) Successfully completing tasks; maintaining internal unity, effectively implementing grassroots democracy regulations, practicing thrift, combating waste, and having no disciplinary violations by individuals;
b) Achieving outstanding results recognized in competitive campaigns.
c) Making outstanding and sudden contributions to the overall development of the agency, organization, or unit.
3. The head of agencies, organizations, and units with legal personality under or subordinate to the Ministry of Agriculture and Rural Development shall decide to award commendation certificates to exemplary households that comply well with the Party's guidelines, state policies, and laws, and have made outstanding achievements in fields directly managed by the agency, organization, or unit.
Article 10. Commemorative Medal "For the Cause of Agriculture and Rural Development"
The Commemorative Medal "For the Cause of Agriculture and Rural Development" (hereinafter referred to as the Commemorative Medal) shall be decided once by the Minister of Agriculture and Rural Development to be awarded to individuals who have contributed to the cause of developing agriculture and rural areas in Vietnam, specifically as follows:
1. Individuals working in the field of Agriculture and Rural Development
a) Individuals currently working or retired with at least 15 years of service in the field for women and at least 20 years for men. For individuals transferred to work in the field of Agriculture and Rural Development, the total service period must be at least 15 years for women and at least 20 years for men, including at least 7 years for women and 10 years for men in the field of Agriculture and Rural Development;
b) Leaders of the Ministry of Agriculture and Rural Development;
c) Leaders of departments, bureaus, institutes, and equivalent units under and subordinate to the Ministry who have held leadership positions for at least 5 years for heads and at least 7 years for deputies;
d) Individuals currently working in the field of Agriculture and Rural Development who have been conferred titles such as "Heroic Laborer", "Heroic Soldier", "Professor", "People's Teacher", "People's Doctor", "National Artist", "National Model Worker", "Associate Professor", "Outstanding Teacher", "Outstanding Doctor", "Outstanding Artist";
đ) Chairmen of Management Councils, General Directors (Directors) of Cooperatives; owners of farms, private enterprises operating in the field of agriculture and rural development continuously for at least 10 years.
2. Individuals outside the field with achievements contributing to the field of Agriculture and Rural Development
a) Vietnamese individuals working for international organizations or Vietnamese individuals abroad who have made contributions to the development of the field of Agriculture and Rural Development;
b) Foreign individuals who have made contributions to the development of the field of Agriculture and Rural Development.
3. Special cases shall be considered and decided by the Minister of Agriculture and Rural Development.
4. Cases not eligible for the Commemorative Medal
a) Individuals who have already received one of the Medals or Commemorative Medals: "For the Development of Agriculture"; "For the Protection and Development of Forests"; "For the Development of the Water Resources Sector"; "For the Fishing Industry"; "For the Development of the Aquaculture Industry";
b) Individuals who were disciplined during their service with dismissal from duty;
c) Individuals who are currently undergoing disciplinary proceedings or being considered for disciplinary action, the disciplinary period will not be counted towards eligibility for the Commemorative Medal;
d) Individuals who voluntarily left the agency, organization, or unit.
Article 11. Application for Awards
1. The components of the application for awards shall be carried out in accordance with Article 84 of the Law on Competition and Commendation and other relevant regulatory legal documents.
2. Number of applications: 01 main set.
3. Place to submit the application
Agencies and units submit the award application (including paper version and electronic version); the paper version is sent directly or via post to the Ministry of Agriculture and Rural Development (through the Cadre and Civil Servant Department), No. 2, Ngoc Ha Street, Ba Dinh District, Hanoi City; the electronic version is sent to the email: [email protected].
Chapter III
IMPLEMENTATION
Article 12. Responsibilities of agencies, organizations, units, and individuals in competition and commendation work
1. Heads of agencies, organizations, units under the Ministry of Agriculture and Rural Development directly lead and direct and are responsible for the results of competition and commendation work; identify collectives and individuals with outstanding achievements to propose the Minister of Agriculture and Rural Development to commend or submit to competent authorities for commendation; promote exemplary models; evaluate achievements and decide on commendations within their authority.
2. Responsibilities of agencies, organizations, units, and individuals related
a) Strictly comply with legal provisions and regulations of agencies, organizations, and units in competition and reward work;
b) Bear responsibility under the law for declaring and reporting achievements, preparing application for commendation; have the responsibility to preserve and keep commendation items;
c) Apply information technology and modernize the declaration, reporting of achievements, and management of competition and commendation work.
3. Communication agencies of the Ministry of Agriculture and Rural Development have the responsibility to publicize the Party's policies; state policies and laws on competition and commendation; disseminate and set examples of collectives and individuals with outstanding achievements, exemplary models, good people and good deeds in competition movements; promptly reflect and combat violations of laws on competition and commendation.
Article 13. Effective Date
1. This Circular takes effect from January 1, 2024.
2. This Circular replaces Circular No. 08/2018/TT-BNNPTNT dated August 6, 2018, issued by the Minister of Agriculture and Rural Development guiding competition and commendation work in the agriculture and rural development sector.
3. In cases where the legal normative documents referred to in this Circular are amended, supplemented, or replaced, they shall be implemented according to the newly issued documents.
Article 14. Implementation Organization
1. The Head of the Cadre and Civil Servant Department, Heads of agencies, organizations, units under the Ministry of Agriculture and Rural Development; Directors of Provincial Departments of Agriculture and Rural Development; Chairmen of Associations operating in the agricultural and rural fields; relevant agencies, organizations, units, and individuals are responsible for implementing this Circular.
2. During the implementation process, if there are difficulties, agencies, organizations, units, and individuals are requested to promptly report to the Ministry of Agriculture and Rural Development (Cadre and Civil Servant Department) for consolidation, study, and appropriate amendments and supplements.
