ANNULMENT OF APPLICATION OF IMPLEMENTATION PROVISIONS OF PARTIAL/TOTAL OF SOME TECHNICAL REGULATIONS IN CIRCULAR NO. 04/2023/TT-BTTTT OF THE MINISTER OF INFORMATION AND COMMUNICATIONS ON THE LIST OF PRODUCTS AND GOODS WITH POTENTIAL TO CAUSE SAFETY HAZARDS UNDER THE MANAGEMENT RESPONSIBILITY OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS
On the basis of The Law on Product and Commodity Quality dated November 21, 2007;
On the basis of Law on Telecommunications dated November 23, 2009;
On the basis of Law on Radio Frequency dated November 23, 2009, Law Amending and Supplementing Certain Provisions of the Law on Radio Frequency dated November 9, 2022;
On the basis of Article 1. Amending and supplementing Level 1 Codes of agencies and organizations prescribed in Decision No. 20/2020/QĐ-TTg dated July 22, 2020 of the Prime Minister on electronic identification codes for agencies and organizations to facilitate data connection and sharing with ministries, sectors, and localities

Decree No. Decree No. 48/2022/NĐ-CP dated July 26, 2022 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Pursuant to the proposal of the Director of the Science and Technology Department,
The Minister of Information and Communications issues this Circular to annul the application of implementation provisions of partial/total of some technical regulations in Circular No. 04/2023/TT-BTTTT dated May 31, 2023 of the Minister of Information and Communications on the List of Products and Goods with Potential to Cause Safety Hazards under the Management Responsibility of the Ministry of Information and Communications.
Article 1. Cease the implementation
1. Annul the application of implementation provisions of partial/total of some technical regulations at points 1.1.1, 1.1.2, 1.1.3, 1.1.4, 1.1.5, 1.1.6, 1.1.8, 1.1.9, 1.1.10, 1.1.11, 1.1.12, 1.1.14, 2.1, 2.2, 2.3, 2.4 in Appendix I issued together with Circular No. 04/2023/TT-BTTTT dated May 31, 2023 of the Minister of Information and Communications on the List of Products and Goods with Potential to Cause Safety Hazards under the Management Responsibility of the Ministry of Information and Communications, with detailed content in Appendix I of this Circular.
2. Annul the application of implementation provisions of partial/total of some technical regulations at points 3.1.1, 3.2.1, 3.2.2, 3.3.1, 3.3.2, 3.3.3, 3.3.4, 3.3.5, 3.3.6, 3.3.8, 3.3.9, 3.3.10, 3.3.11, 3.3.12, 3.3.13, 3.3.14, 3.3.15, 4.1, 4.2, 4.3, 4.4 in Appendix II issued together with Circular No. 04/2023/TT-BTTTT dated May 31, 2023 of the Minister of Information and Communications on the List of Products and Goods with Potential to Cause Safety Hazards under the Management Responsibility of the Ministry of Information and Communications, with detailed content in Appendix II of this Circular.
3. The period for annulment of the application of points 1.1.1, 1.1.2, 1.1.10, 2.1, 2.2, 2.3, 2.4 in Appendix I of this Circular shall be from the date this Circular takes effect until December 31, 2023.
4. The period for annulment of the application of points 1.1.3, 1.1.4, 1.1.5, 1.1.6, 1.1.8, 1.1.9, 1.1.11, 1.1.12, 1.1.14 in Appendix I and points 3.1.1, 3.2.1, 3.2.2, 3.3.1, 3.3.2, 3.3.3, 3.3.4, 3.3.5, 3.3.6, 3.3.8, 3.3.9, 3.3.10, 3.3.11, 3.3.12, 3.3.13, 3.3.14, 3.3.15, 4.1, 4.2, 4.3, 4.4 in Appendix II of this Circular shall be from the date this Circular takes effect until June 30, 2024.
Article 2. Effective Date
1. The Director of the Finance and Planning Department is responsible for guiding and supervising the implementation of this Circular.
Article 3. Transitional Provisions
1. Organizations and individuals related to conformity assessment, declaration of conformity, and quality inspection of products and goods specified in Article 1 of this Circular for import, production, and business from July 15, 2023 to before the date this Circular takes effect shall apply this Circular.
2. During the period of annulment:
Organizations and individuals related to products and goods specified in Article 1 of this Circular are not required to perform conformity assessment procedures and declaration of conformity for the contents of technical regulations that have been annulled.
3. After the period of annulment:
a) Organizations and individuals related to conformity assessment, declaration of conformity, and quality inspection of products and goods specified in Article 1 of this Circular shall comply with the provisions of Circular No. 04/2023/TT-BTTTT.
b) For products and goods specified in Article 1 of this Circular, if they have obtained conformity assessment certificates according to Circular No. 04/2023/TT-BTTTT during the period of annulment, such certificates will remain valid until their expiration date.
c) For products and goods specified in Article 1 of this Circular, if they have undergone conformity assessment, declaration of conformity, and quality inspection during the period of annulment, and continue to be produced or imported, they must undergo supplementary conformity assessment and declaration of conformity for the contents of technical regulations that have been annulled, or must be re-assessed and re-declared with full technical regulations. In case of supplementary conformity assessment, the validity period of the conformity assessment certificate will be equal to the remaining validity period of the previously issued certificate.
Article 4. The Director of the Office, Heads of Science and Technology Departments, Heads of agencies and units under the Ministry of Information and Communications, and relevant organizations and individuals are responsible for implementing this Circular./.
