The Minister of Construction issues this Circular to guide the functions, tasks, and authorities of specialized agencies under Provincial People's Committees directly under the Central Government and Commune People's Committees, Ward People's Committees, and Special Administrative Economic Zones within provinces directly under the Central Government in the construction sector.
CPART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular guides the functions, tasks, and authorities of specialized agencies under Provincial People's Committees directly under the Central Government (hereinafter referred to collectively as provincial level) and Commune People's Committees, Ward People's Committees, and Special Administrative Economic Zones within provinces directly under the Central Government (hereinafter referred to collectively as commune level) in the construction sector.
Article 2. Applicability
This Circular applies to:
1. Specialized agencies under Provincial People's Committees at the provincial level in the construction sector are the Department of Construction and the Department of Planning and Architecture.
2. Specialized agencies under Commune People's Committees at the commune level in the construction sector are the Economic Office (for communes and special zones), the Economic, Infrastructure, and Urban Development Office (for wards and the special zone of Phu Quoc Island).
CPART II
DEPARTMENT OF CONSTRUCTION, DEPARTMENT OF PLANNING AND ARCHITECTURE
Article 3. Position and Functions
1. The Department of Construction performs advisory functions to assist the Provincial People's Committee in state management of construction including: urban planning and architecture; construction investment activities; urban development; technical infrastructure for urban and rural areas (including: clean water supply (excluding rural clean water supply); drainage and wastewater treatment (excluding on-site wastewater treatment; drainage for agricultural production and salt production); urban parks and greenery; urban lighting; cemeteries (excluding martyrs' cemeteries) and crematorium facilities; transportation infrastructure structure; underground space management; common use of technical infrastructure and residential areas in rural areas); housing; real estate markets; building materials; road transport, railway, inland waterway, maritime transport; traffic safety (excluding driver licensing and issuance of motor vehicle driving licenses).
In Hanoi City and Ho Chi Minh City where there is a Department of Planning and Architecture, the advisory function regarding urban planning and architecture is performed by the Department of Planning and Architecture.
2. The Department of Planning and Architecture performs advisory functions to assist the Provincial People's Committee in state management of urban and rural planning and architecture.
Article 4. Tasks and Authorities of the Department of Construction
1. Submit to the provincial People's Committee:
a) Drafting resolutions of the Provincial People's Council, decisions of the Provincial People's Committee related to the construction sector within the scope of management of the Department and other documents as assigned by the Provincial People's Committee;
b) Drafting plans for the development of the construction industry and programs, measures to implement tasks in the construction sector within the province's jurisdiction as managed by the Department;
c) Drafting decisions specifying the functions, tasks, authorities, and organizational structure of the Department; drafting decisions specifying the functions, tasks, authorities, and organizational structure of subordinate bureaus (if any);
d) Drafting decisions to implement socialization of service provision activities in the construction sector within the authority of the Provincial People's Committee;
đ) Drafting decisions, regulations, plans, projects, and other documents of the Provincial People's Committee on construction and other documents as assigned by the Provincial People's Committee;
e) Drafting decisions on the delegation and authorization of tasks in state management of construction according to regulations;
g) Deciding on investment projects in the construction sector within the authority of the Provincial People's Committee when delegated or authorized.
2. Submitting to the Chairman of the Provincial People's Committee:
a) Drafting documents within the authority to issue by the Chairman of the Provincial People's Committee as assigned;
b) Decisions on ranking public service units and enterprises managed by the Department of Construction according to laws and guidance from competent authorities.
3. Implementing legal regulatory documents, plans, programs, projects, and other documents after approval; providing information, propaganda, guidance, dissemination, education, and monitoring the implementation of laws in fields under the assigned state management.
4. Regarding urban and rural planning:
a) Guiding, inspecting, and organizing the implementation of regulations on the preparation, review, and approval of urban and rural planning and urban design as prescribed; guiding and inspecting the implementation of national technical standards and norms for urban and rural planning;
b) Organizing the preparation, review, and submission to the Provincial People's Committee for approval or advising the Provincial People's Committee to submit to competent authorities for review and approval of urban and rural planning as prescribed by law;
c) Guiding the organization of the preparation, review, and approval of urban and rural planning within the area as prescribed;
d) Guiding, managing, and organizing the implementation of approved urban and rural planning within the delegated authority, including: organizing the announcement and disclosure of urban and rural planning; managing files of boundary markers, construction boundaries, construction elevations; introducing construction sites and infrastructure route directions; providing information on planning;
đ) Building and managing databases on urban and rural planning.
5. Regarding architecture:
a) Implement and coordinate with ministries, ministerial-level agencies to organize the implementation, monitor, inspect, and supervise the quality of architecture in construction investment projects;
b) Organize the establishment of architectural management regulations according to the分级授权的省级人民政府;指导乡级人民政府在权限范围内制定、审查城市规划管理规定,并在省级人民政府批准后发布;检查经批准发布的规划管理规定的执行情况;定期或不定期地组织审查和评估规划管理规定的实施过程,以考虑调整或建议调整规划管理规定;
c) Establish and adjust the list of architectural works of value according to the分级授权的省级人民政府;
d) Issue, adjust, extend, reissue, and revoke certificates for practicing architects; recognize and convert certificates for practicing architects for foreign individuals who already have valid certificates issued by authorized agencies or organizations in their home countries;
đ) Build databases, update, publish, and provide information about organizations and individuals engaged in architectural practice that have registered activities within the jurisdiction;
6. Regarding construction investment activities:
a) Guide and inspect the implementation of legal provisions during the process of construction investment activities, including: project planning, review, approval; construction surveying and design; issuance of construction permits; construction, acceptance, warranty, and maintenance of construction projects; specialized construction testing and inspection; safety during construction; construction contracts; management of the conditions for construction activities of organizations and individuals, and issuance of permits for foreign contractors;
b) Review feasibility studies for construction investment projects, post-design implementation designs of construction investment projects, and inspect the completion acceptance work of construction projects within the jurisdiction as stipulated;
c) Advise and assist the provincial People's Committee in managing construction order within the jurisdiction according to planning, construction design, and construction permits as stipulated;
d) Implement tender management in construction activities according to laws on construction and bidding within the jurisdiction;
đ) Advise and assist the provincial People's Committee in state management over the activities of construction project management boards established by the provincial People's Committee;
e) Advise and assist the provincial People's Committee in organizing the implementation of state management tasks regarding construction project quality, safety during construction, and maintenance of construction projects; carry out judicial appraisals in the field of construction within the jurisdiction according to the law;
g) Guide and inspect the implementation of legal provisions on construction investment cost management within the jurisdiction; organize the compilation and submission to the provincial People's Committee for publication and issuance or publication according to authorization: construction material prices, equipment prices, construction labor unit prices, machinery and equipment construction prices, machinery and equipment rental prices, construction price indices, comprehensive construction prices, investment capital rates within the scope of management (if necessary);
h) Advise and assist the provincial People's Committee in issuing economic-technical norms for special construction works of the locality according to regulations and guidelines from the Ministry of Construction;
i) Advise and assist the provincial People's Committee in establishing and issuing maintenance and repair norms not included in the normative list issued by the Ministry of Construction and specialized construction management departments according to regulations;
k) Implement the notification of information on norms, construction prices, and construction price indices monthly, quarterly, or annually, in accordance with regulations on construction investment cost management to ensure timely updates with market construction price fluctuations;
l) Issue, adjust, and revoke construction operation permits for foreign contractors operating and constructing within the jurisdiction according to regulations;
m) Organize examinations, issue, reissue, adjust, supplement, convert, and revoke certificates for practicing construction workers and organizational capacity certificates according to regulations; guide and inspect the issuance, reissuance, adjustment, supplementation, conversion, revocation, and management of various types of construction practice certificates (capacity certificates) within the jurisdiction;
n) Publish, update, and provide information about the capabilities of organizations and individuals participating in construction activities with headquarters within the jurisdiction (including foreign contractors operating construction) according to regulations; integrate these information on the website managed by the Ministry of Construction;
o) Monitor, inspect, supervise, and comprehensively evaluate construction investment activities under the management authority of the Department;
7. Regarding urban development:
a) Advise and assist the provincial People's Committee in organizing the establishment of urban development programs or reviewing urban development programs according to authority; determine urban development areas and implementation plans; determine urban development indicators in the provincial socio-economic development plan; implement planning, plans, and programs after they are approved by competent authorities;
b) Develop mechanisms, policies, and solutions to attract and mobilize resources for the construction and development of integrated cities, new urban areas, urban development management policies and solutions, encourage the development of public services in the field of urban development; implement after being approved and issued by the provincial People's Committee;
c) Implement programs and projects for urban development investment that have been approved by competent authorities according to the division of labor of the provincial People's Committee, including: urban upgrading programs, urban development programs, proposals for developing Vietnamese cities to respond to climate change, national action plans on green growth, smart city construction and development projects, urban environmental improvement projects, enhancing urban management capacity, urban development investment projects, and other related programs and projects.
d) Organize annual evaluations and classifications of cities, propose improvements to classification criteria for recognized cities; guide and inspect city recognition proposals submitted to the provincial People's Committee for approval by competent authorities; organize reviews of proposals for city recognition and submit them to the provincial People's Committee for decisions on city recognition as prescribed.
đ) Guide and inspect activities related to urban investment and construction, urban development, land exploitation and utilization for urban construction according to approved planning and plans; implement urban development investment management according to laws on urban development investment management, construction investment laws, and relevant laws as assigned by the provincial People's Committee; guide urban construction order management.
e) Promote urban development investment activities; mobilize and coordinate domestic and foreign resources for urban system construction and development within the province as assigned by the provincial People's Committee; exploit and utilize resources and advise the provincial People's Committee on organizing handover management in urban areas or implementing when delegated or authorized by the provincial People's Committee.
g) Monitor, compile, evaluate, and report on urban development situations in the province; organize the establishment and management of urban development information databases.
8. Regarding technical infrastructure, including: clean water supply (excluding rural clean water); drainage and wastewater treatment (excluding on-site wastewater treatment; drainage for agricultural production and salt production); urban parks and greenery; urban lighting; cemeteries (excluding martyrs' cemeteries) and crematoriums: urban transportation infrastructure structures; underground urban construction management; shared use management of urban technical infrastructure works:
a) Develop plans, programs, targets, and policies for technical infrastructure development in the area, submit to competent authorities for approval; guide and inspect implementation after approval.
b) Organize the preparation and review at the appropriate level and according to legal regulations on planning within the scope of technical infrastructure in the area, submit to the provincial People's Committee for approval.
c) Organize investment promotion activities, mobilize and exploit resources for technical infrastructure development in the area.
d) Guide the establishment and management of costs for technical infrastructure services under state management; organize the preparation to submit to the provincial People's Committee for publication or issuance of economic and technical standards for technical infrastructure services in the area consistent with technical procedures and specific conditions of the locality; advise and propose to the provincial People's Committee guidelines for applying or adapting methods to determine economic and technical standards; unit prices, service fees for technical infrastructure using local government budget funds; inspect and supervise implementation.
đ) Establish and manage databases on technical infrastructure.
e) Guide and inspect compliance with legal provisions on technical infrastructure in the area.
9. Regarding housing:
a) Submit to the provincial People's Committee for consideration and approval of policies on building or adjusting provincial housing development programs and lead implementation after approval according to legal regulations.
b) Provide opinions on joint or leading reviews of investment project proposal files for housing construction projects approved by the provincial People's Committee according to investment and housing laws; select developers for housing development projects according to housing laws to submit to the provincial People's Committee for consideration and decision within its authority.
c) Advise the provincial People's Committee to approve the transfer of real estate projects in whole or in part according to real estate business laws. Guide implementation of laws for project developers according to real estate business laws. Inspect training and professional development activities for real estate brokers and management of real estate trading floors; implement issuance and management of real estate broker practice certificates in the area according to legal regulations.
d) Develop and submit to the provincial People's Committee for issuance of rental price ranges for public service housing; rental, lease purchase, and sale price ranges for public asset housing suitable to the actual conditions of the province; organize tasks related to receiving centrally and provincially managed housing funds to unify management and sell public housing to current tenants according to legal regulations.
đ) Participate in valuing various types of housing in the area according to price ranges, valuation principles, and methods for various types of housing by the State.
e) Guide and inspect compliance with housing construction standards, social housing construction standards; guide implementation of housing classification, model design, typical design, management and usage regulations, warranty and maintenance systems for housing and social housing in the area.
g) Implement state policies and laws on social housing development and management according to housing laws, including implementing support policies for housing for social groups.
h) Compile, evaluate the situation and results of housing and social housing development in the area annually or as required, report to the provincial People's Committee, the Ministry of Construction for compilation and reporting to the Government.
i) Organize investigations, statistics, and periodic evaluations of state-owned housing within the jurisdictional area;
k) Organize the construction, management of databases, and provision of information on state-owned housing within the jurisdictional area.
l) Take the lead in advising the provincial People's Committee to organize the implementation of state management tasks in the field of housing within the jurisdictional area in accordance with housing laws and perform other assigned tasks either independently or in coordination as stipulated by housing laws.
m) Organize the review of investment proposal approval/draft adjustment approval files simultaneously with investor approval as the main investor for projects to renovate and rebuild apartment buildings not funded by public investment capital.
10. Regarding the real estate market:
a) Develop and submit to the provincial People's Committee for issuance mechanisms, policies, legal normative documents on the development and management of real estate business, the real estate market within the provincial People's Committee's authority; measures and methods to ensure transparency in real estate business activities and the real estate market within the jurisdictional area; organize the implementation after the provincial People's Committee issues and approves them;
b) Take the lead and coordinate with relevant departments, agencies, and units to study and develop proposals for measures and solutions to regulate the real estate market and take the lead in organizing the implementation of such measures and solutions within the jurisdictional area in accordance with the law;
c) Guide the implementation of legal provisions regarding the eligibility criteria for developers of housing development projects, industrial infrastructure projects, and other real estate investment projects within the jurisdictional area; guide regulations on real estate being put into business operations;
d) Organize the review of project transfer file applications for new urban areas, housing development projects, and industrial infrastructure projects to be transferred partially or entirely for the provincial People's Committee to submit to the Prime Minister for decision-making or for the provincial People's Committee to decide on allowing project transfers within its authority; guide inspections of legal provisions in the activities of buying, renting, and leasing houses and construction works within the jurisdictional area;
đ) Inspect training and capacity-building activities related to real estate brokerage and management of real estate trading floors; implement the issuance and management of real estate brokerage practice certificates within the jurisdictional area;
e) Take the lead and coordinate with relevant departments, agencies, and units in building, managing, operating, and updating information on the housing and real estate market information system according to regulations; publish information on housing and the real estate market within the jurisdictional area quarterly and annually as required;
g) Take the lead in advising the provincial People's Committee to organize the implementation of state management tasks in the field of real estate business within the jurisdictional area in accordance with real estate business laws;
h) Organize the review of project transfer notification files for conditions to raise funds through capital contributions, joint ventures, business cooperation, joint stock companies, and partnerships to develop housing;
i) Organize the review of land use right transfer files for plots with existing technical infrastructure in real estate projects for individuals to build their own houses in accordance with real estate business laws;
11. Regarding construction materials:
a) Advise and assist the provincial People's Committee in establishing, reviewing, approving, and managing the implementation of local construction material development programs and plans; local ordinary construction material mineral exploration, exploitation, and utilization schemes within the provincial planning;
b) Manage and organize the implementation of Group II mineral resource planning (currently the planning for exploration, exploitation, processing, and utilization of construction materials and cement raw materials) that has been approved within the jurisdictional area in accordance with the law;
c) Provide comments on the review of construction projects for producing construction materials within the jurisdictional area as stipulated;
d) Guide activities related to the assessment and evaluation of: Group II mineral resource extraction and processing technology (currently construction materials and cement raw materials); construction material production technology; construction material product quality;
đ) Guide, inspect, and organize the implementation of technical standards and safety and labor hygiene regulations in activities: Group II mineral resource exploration and exploitation, processing (currently construction materials and cement raw materials); construction material production;
e) Guide legal provisions on construction material business for organizations and individuals engaged in construction material business within the jurisdictional area as assigned by the provincial People's Committee;
g) Advise and assist the provincial People's Committee in managing the quality of construction material products and goods within the jurisdictional area in accordance with the law;
h) Monitor and compile the situation of Group II mineral resource exploitation and processing (currently construction materials and cement raw materials), and the production situation of construction materials by organizations and individuals within the jurisdictional area;
i) Develop and implement programs, projects, and initiatives to encourage, support, and promote the development of construction machinery and transportation products within the province's management scope under the Department;
12. Regarding transportation infrastructure:
a) Implement the duties and powers of the investment decision-making agency, main investor, and specialized construction agency for transportation infrastructure construction projects within the management scope or delegated and authorized according to the law;
b) Manage, maintain, and ensure technical standards and specifications for operational road, railway, and inland waterway projects within the management scope or delegated and authorized according to the law;
c) Manage, operate, exploit, maintain, and protect transportation infrastructure within the jurisdictional area in accordance with the law;
d) Submit to the provincial People's Committee for decision-making or make decisions within its authority on the management of construction infrastructure within the scope of the Department's duties and powers as stipulated by the law.
đ) Chair and coordinate with relevant agencies to advise and assist the Chairman of the Provincial People's Committee in deciding on the classification and adjustment of provincial roads, urban roads, other roads, and the announcement of load limits and bridge width restrictions for roads under their management in accordance with the provisions of the law;
e) Submit to the Provincial People's Committee for agreement or agree within their authority on matters related to inland waterways for construction projects not part of inland waterway infrastructure and activities on inland waterways; issue permits for construction on operational road and inland waterway routes managed by local authorities or delegated according to the provisions of the law;
g) Organize the implementation of state management tasks and powers at bus stations, parking lots, railway stations, rest stops, and inland waterway ports on local road and inland waterway routes managed by local authorities or delegated according to the provisions of the law;
h) Submit to the Provincial People's Committee for decisions on putting shipbreaking facilities into operation, re-decisions on putting shipbreaking facilities into operation, decisions to suspend or immediately suspend operations of shipbreaking facilities, approval of shipbreaking plans, and issuance of Import Permits for used ships for shipbreaking within the scope of their management area according to the provisions of the law;
i) Submit to the Provincial People's Committee to handle procedures for renaming inland ports within the scope of their management area according to the provisions of the law;
13. Regarding transportation means and persons operating such means, specialized loading and unloading equipment, and construction machinery used in transportation (excluding transportation means serving national defense and security purposes and fishing vessels; excluding driver licensing examination and issuance tasks) and specialized technical equipment in the construction industry;
a) Organize the implementation of technical safety inspections and environmental protection for land and inland waterway transportation means in the locality or delegated according to the provisions of the law;
b) Review technical designs in the repair and modification of transportation means, specialized loading and unloading equipment, and construction machinery used in land and inland waterway transportation in the locality or delegated according to the provisions of the law;
c) Organize the implementation and be responsible for training, examination, issuance, renewal, and revocation of certificates and licenses within their management scope or delegated according to the provisions of the law;
d) Submit to the Provincial People's Committee for issuance, reissuance, and revocation of Certificates of Business Conditions for Training Seafarers and Inland Waterway Vessel Operators from Class 3 upwards within the scope of their management area according to the provisions of the law;
14. Regarding transportation:
a) Chair or coordinate with relevant agencies to implement policies for developing public passenger transportation services according to the regulations of the Provincial People's Committee;
b) Organize the implementation of management of transportation activities and supporting services for land and inland waterway transportation, railways within the province according to the provisions of the law;
c) Guide and inspect the establishment and publication of bus stations, taxi parking points, pick-up and drop-off points for passengers on the local area according to approved planning;
15. Regarding traffic safety:
a) Chair or coordinate with relevant agencies to implement emergency response measures for accidents and natural disasters, search and rescue operations on land, rail, inland waterways, maritime, and aviation, and handling traffic accidents occurring in the local area according to the provisions of the law and the division of labor of the Provincial People's Committee;
b) Implement preventive measures to reduce traffic accidents and congestion; prevent and handle acts that cause traffic safety violations in the local area according to their authority and the provisions of the law;
c) Review traffic safety within their management scope or delegated according to the provisions of the law;
d) Chair or coordinate with relevant agencies to organize traffic on the road and inland waterway systems within their management scope according to the provisions of the law;
đ) Chair or coordinate with relevant agencies to handle sudden traffic accident hotspots and potential accident spots, ensuring traffic on the road and inland waterway systems within their management scope or delegated according to the provisions of the law;
e) Issue permits for the circulation of motorized vehicles on roads within their management scope or delegated according to the provisions of the law;
g) Submit to the Provincial People's Committee to organize the issuance of Import Permits for maritime signal devices according to the conditions for providing maritime safety services within the scope of their management area according to the provisions of the law;
h) Submit to the Provincial People's Committee for approval of diving vessel operation areas; approve plans for putting diving vessels into operation and terminating their operations according to the provisions of the law;
16. Manage enterprises, collective economic organizations, private economic organizations, associations, and non-governmental organizations within the scope of the Department's management according to the provisions of the law;
17. Implement international cooperation in the fields managed by the Department according to the provisions of the law;
18. Organize research, application of scientific and technological progress, innovation, and digital transformation; build information and storage systems to serve state management and professional tasks;
19. Provide professional guidance to specialized agencies under the People's Committee of the commune in the fields managed by the Department;
20. Carry out the work of entering and updating information in the national database on construction activities according to the provisions; perform regular and urgent reporting on the implementation of assigned tasks to the Provincial People's Committee, the Ministry of Construction, and other competent authorities according to the provisions;
21. Define the functions, tasks, and powers of the Department's Office and specialized departments in accordance with the Department's functions, tasks, and powers as guided by this Circular and according to the provisions of the Provincial People's Committee.
22. Manage the organizational structure, civil servant establishment, civil service grade and grading, job positions, staff structure according to occupational titles and number of workers in public service units; implement salary systems and incentive policies, training, rewards, and disciplinary measures for civil servants, public officials, and employees under its management as prescribed by law.
23. Manage and be responsible for financial resources and assets allocated according to legal regulations.
24. Organize the implementation and be responsible for appraisal, registration, issuance of permits, certificates, and licenses within the scope of management responsibility of the Department as prescribed by law.
25. Manage the activities of public service units both inside and outside the public sector within the scope of management of the Department.
26. Inspect the implementation of laws and regulations related to construction by organizations and individuals; receive citizens, handle complaints and denunciations, prevent corruption, waste, and negative practices as prescribed by law.
27. Perform other tasks assigned, delegated, or authorized by the provincial People's Committee, Chairman of the provincial People's Committee, and as prescribed by law.
The Department of Construction of Hanoi City and Ho Chi Minh City shall perform the tasks and powers stipulated in this Article, except for the tasks stipulated in Clause 4 and Clause 5 of this Article.
Article 5. Tasks and Powers of the Department of Planning and Architecture
The Department of Planning and Architecture of Hanoi City and Ho Chi Minh City shall perform the tasks and powers stipulated from Clause 1 to Clause 5 and from Clause 16 to Clause 27 of this Article.
CPART III
ECONOMIC DIVISION; ECONOMIC INFRASTRUCTURE AND URBAN DEVELOPMENT DIVISION
Article 6. Position and Functions
1. The Economic Division; Economic Infrastructure and Urban Development Division (hereinafter referred to collectively as the Division) shall perform the function of advising and assisting the municipal People's Committee in exercising state management over construction, including urban and rural planning, architecture; construction investment activities; urban development; urban technical infrastructure (including urban water supply, drainage; construction material production facilities; urban lighting, greenery; cemetery management, excluding martyrs' cemeteries; underground urban construction management; common use management of urban technical infrastructure); housing; construction materials; transportation.
For other fields under the Division, they shall follow the guidance of the relevant ministry managing the respective industry or field.
2. The Division shall be subject to the direction and management of the municipal People's Committee regarding organization, job positions, civil servant establishment, civil service grade structure, and personnel work, while also being subject to the direction, inspection, and professional guidance of the Department of Construction and the Department of Planning and Architecture in the construction field.
Article 7. Tasks and Powers
1. Submit to the People's Committee at the commune level:
a) Draft resolutions of the municipal People's Council (if applicable) and decisions of the municipal People's Committee related to the construction field under the Division's management and other documents as assigned by the municipal People's Committee;
b) Draft plans for developing the construction field; programs and measures to organize the implementation of construction-related tasks on the municipal level within the Division's management scope;
c) Draft decisions on medium-term and annual planning and development; programs and measures to organize the implementation of administrative reform tasks in the construction field; draft documents defining the functions, tasks, powers, and organizational structure of the Division;
d) Draft decisions specifying the functions, tasks, powers, and organizational structure of the Division;
đ) Draft programs and solutions to mobilize and coordinate inter-departmental efforts in ensuring traffic order and safety on the municipal level;
e) Construction investment projects for infrastructure development on the municipal level as prescribed by law and as assigned and delegated by the municipal People's Committee;
g) Draft decisions on classifying rural roads according to legal provisions;
2. Submit to the Chairman of the municipal People's Committee draft documents within his authority to issue as assigned.
3. Implement legal documents, plans, and programs after approval; provide information, propaganda, dissemination, and education on laws related to the construction field within the assigned management scope; monitor law enforcement.
4. Advise the municipal People's Committee on organizing the implementation of tasks in the following areas: urban and rural planning; architecture; construction investment activities; urban development; technical infrastructure; housing; office buildings; construction materials on the municipal level as prescribed by law and as assigned and delegated by the provincial People's Committee.
5. Assist the municipal People's Committee in establishing architectural management regulations, implementing regulations according to urban planning and design schemes as assigned and delegated by the provincial and municipal People's Committees.
6. Help the municipal People's Committee implement and be responsible for appraising, registering, and issuing various types of permits and approvals regarding construction sites within the Division's responsibilities and authorities as prescribed by law and as assigned by the municipal People's Committee.
7. Inspect organizations and individuals in the implementation of laws in the assigned fields; receive citizens, handle complaints and denunciations; prevent corruption, waste, and negative practices as prescribed by law and as assigned by the municipal People's Committee.
8. Advise the municipal People's Committee during the process of drafting, appraising, and implementing urban development programs; in drafting and approving urban development plans as prescribed; participate in drafting proposals for recognizing urban categories on the municipal level as prescribed.
9. Advise the municipal People's Committee on organizing the registration of inland waterway transport vehicles, railway vehicles, and water-based recreational equipment.
10. Organize the drafting, appraisal, submission to the municipal People's Committee for approval, or organize the drafting for submission to competent authorities for appraisal and approval of urban and rural planning on the municipal level as prescribed by law.
11. Advise and assist the People's Committee at the commune level in organizing the implementation of mechanisms and policies regarding housing and public offices; manage the housing fund and the right to manage and use public offices within the jurisdiction delegated by the provincial People's Committee; organize the implementation of surveys, statistics, and periodic assessments on housing and public offices within the area.
12. Guide and inspect the construction of projects according to architectural management regulations and urban planning and design management regulations approved by competent authorities; organize the publication and disclosure of urban and rural plans; provide information on urban and rural planning; manage boundary markers, construction boundaries, and construction levels within the area according to the jurisdiction delegated.
13. Organize the management, maintenance, and operation to ensure technical standards and norms for the network of road traffic infrastructure, urban rail transit, inland waterways under exploitation that are managed by the commune level.
14. Manage transportation activities within the area in accordance with the provisions of the law and guidance from competent state agencies.
15. Implement preventive measures, block, and handle acts of infringing upon traffic infrastructure and encroaching on traffic safety zones; coordinate with relevant agencies in the clearance of encroachments on traffic safety zones within the area according to the guidance of specialized management agencies, the Department of Construction, and directives from the commune-level People's Committee.
16. Coordinate with relevant agencies to implement search and rescue operations for road, rail, inland waterway, maritime, and air incidents occurring within the area.
17. Assist the commune-level People's Committee in managing state administration over collective economic organizations, private economic organizations, associations, and non-governmental organizations operating within the area under the jurisdiction of the department as prescribed by law.
18. Organize the application of scientific and technological progress; build information systems, innovation, digital transformation, and storage services for state administrative management and professional tasks of the department.
19. Implement the entry and updating, adjustment of information in the national database on construction activities according to regulations; report periodically and urgently on the situation of assigned tasks according to the regulations of the commune-level People's Committee and the sector management department.
20. Manage organizational structure, civil servant quota, civil service grade and grading, job positions, implement salary systems, incentive policies, rewards, disciplinary actions, training, and professional development for civil servants, public officials, and employees within the scope of management according to the law and the division of labor by the commune-level People's Committee.
21. Manage and be responsible for the financial and property affairs of the specialized agency according to the law.
22. Conduct feasibility study reports for investment construction projects and post-design implementation design reviews of investment construction projects; inspect the acceptance work of construction projects within the area according to the jurisdiction delegated by the provincial People's Committee.
23. Perform other tasks and powers according to the jurisdiction, delegation, and authority division of competent agencies as prescribed by law.
CPART IV
IMPLEMENTATION
Article 8. Effective Date
Article 32. Responsibilities of Agencies
2. This Circular abolishes the following Circulars:
a) Circular No. 15/2021/TT-BGTVT dated July 30, 2021, issued by the Minister of Transport guiding the functions, tasks, and powers of specialized agencies on transport under the People's Committees of provinces and centrally-administered cities, and districts, towns, urban districts, and towns under provinces and centrally-administered cities;
b) Circular No. 03/2022/TT-BXD dated September 27, 2022, issued by the Minister of Construction guiding the functions, tasks, and powers of specialized agencies on construction under the People's Committees of provinces and centrally-administered cities, and districts, towns, urban districts, and towns under provinces and centrally-administered cities.
Article 9. Responsibility for implementation
1. The provincial People's Committee and the Chairman of the provincial People's Committee; the commune-level People's Committee and the Chairman of the commune-level People's Committee shall be responsible for directing and organizing the implementation of this Circular.
2. During the implementation process, if there are difficulties or need for supplementation or amendment, the provincial People's Committee shall promptly reflect to the Ministry of Construction for consideration and resolution within its authority./.
