Circular No. 107/2018/TT-BTC on the management, payment, and settlement of investment capital for construction projects using public investment funds of Vietnamese representative agencies abroad and other Vietnamese agencies abroad

CIRCULAR

ABOLISHING CIRCULARS OF THE MINISTER OF FINANCE

Pursuant to the Law on Legislative Regulatory Documents dated June 22, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents dated June 18, 2020;

Pursuant to the State Budget Law dated June 25, 2015;

Pursuant to the Law on Public Investment dated June 13, 2019;

Pursuant to the Public-Private Partnership Investment Law dated June 18, 2020;

Pursuant to Resolution No. 31/2016/QH14 dated November 22, 2016 of the National Assembly on suspending the investment project for the Ninh Thuan nuclear power plant;

Pursuant to Decree No. 28/2021/NĐ-CP dated March 26, 2021 of the Government detailing the financial mechanism for public-private partnership investment projects;

Pursuant to Decree No. 35/2021/NĐ-CP dated March 29, 2021 of the Government detailing and guiding the implementation of the Law on Public-Private Partnership Investment;

Pursuant to Decree No. 99/2021/NĐ-CP dated November 11, 2021 of the Government on management, payment, and settlement of projects using state capital;

Pursuant to Decree No. 08/2022/NĐ-CP dated January 10, 2022 of the Government detailing certain provisions of the Law on Environmental Protection;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing some articles of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some provisions and measures to implement the Law on Issuing Legal Normative Documents;

Pursuant to Decree No. 14/2023/NĐ-CP dated April 20, 2023 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Finance;

At the proposal of the Director of the Investment Department;

The Minister of Finance issues this Circular to abolish certain Circulars of the Minister of Finance.

Repeal all of the following Circulars:

Abolish the following seven Circulars entirely:

1. Circular No. 88/2018/TT-BTC dated September 28, 2018 of the Minister of Finance detailing certain contents regarding financial management for public-private partnership investment projects and costs for selecting investors;

2. Circular No. 08/2016/TT-BTC dated January 18, 2016 of the Minister of Finance detailing the management and payment of capital investment using state budget funds;

3. Circular No. 108/2016/TT-BTC dated June 30, 2016 of the Minister of Finance amending and supplementing certain articles of Circular No. 08/2016/TT-BTC dated January 18, 2016 of the Minister of Finance detailing the management and payment of capital investment using state budget funds;

4. Circular No. 52/2018/TT-BTC dated May 24, 2018 of the Minister of Finance amending and supplementing certain articles of Circular No. 08/2016/TT-BTC dated January 18, 2016 of the Minister of Finance detailing the management and payment of capital investment using state budget funds; Circular No. 108/2016/TT-BTC dated June 30, 2016 of the Minister of Finance amending and supplementing certain articles of Circular No. 08/2016/TT-BTC dated January 18, 2016 of the Minister of Finance;

5. Circular No. 107/2018/TT-BTC dated November 15, 2018 of the Minister of Finance detailing the management, payment, and settlement of capital investment for construction projects using official development assistance funds of Vietnam's representative offices abroad and other Vietnamese agencies abroad;

6. Circular No. 12/2017/TT-BTC dated February 10, 2017 of the Minister of Finance guiding the procedures and formalities for supporting capital investment in equipment for projects implementing environmental protection inventions;

7. Circular No. 180/2014/TT-BTC dated November 27, 2014 of the Minister of Finance detailing the management, payment, and settlement of advance capital of the Vietnam Electricity Corporation for the resettlement project of the Ninh Thuan nuclear power plant;

Article 2. Implementation clause

This Circular shall take effect from February 25, 2024

2. The Director of the Investment Department, heads of units under the Ministry of Finance, and relevant agencies, organizations, and individuals shall be responsible for implementing this Circular. /
